which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To expand eligibility for and provide judicial review for the Elderly Home Detention Pilot Program, and to make other technical corrections.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="not-changed"><section section-type="section-one" id="id07dc9614-47ec-4310-a223-97b076761dfb" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safer Detention Act of 2025</short-title></quote>.</text></section><section id="id94f5e5fa663c47e4a33e17a963171590"><enum>2.</enum><header>Home detention for certain elderly nonviolent offenders</header><text display-inline="no-display-inline">Section 231 of the Second Chance Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/34/60541">34 U.S.C. 60541</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id5fa5cdfc70f648eaba1f42eb355617ad"><enum>(1)</enum><text>in subsection (g)—</text><subparagraph id="id0318B4023B69486A8459F6456A8B483F"><enum>(A)</enum><text>in paragraph (1), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8C147D17C543445BAF52A9897D5FB273"><subparagraph id="id2F9671E44A604D699EB38D8DB89CD0DF"><enum>(D)</enum><header>Judicial review</header><clause id="idD1A769E159D145568033BBD53E94AA5E"><enum>(i)</enum><header>In general</header><text>Upon motion of a defendant, on or after the date described in clause (ii), a court may reduce an imposed term of imprisonment of the defendant and substitute a term of supervised release with the condition of home detention for the unserved portion of the original term of imprisonment, after considering the factors set forth in section 3553(a) of title 18, United States Code, if the court finds the defendant is an eligible elderly offender or eligible terminally ill offender.</text></clause><clause id="idE97EE0F302BC41E88967F5E34E5AA96B"><enum>(ii)</enum><header>Date described</header><text>The date described in this clause is the earlier of—</text><subclause id="id6D5657EF907E4F03A5E2512DEF958939"><enum>(I)</enum><text>the date on which the defendant fully exhausts all administrative rights to appeal a failure of the Bureau of Prisons to place the defendant on home detention; or </text></subclause><subclause id="id0C373F73C457401E944EAD1D37F90BCA"><enum>(II)</enum><text>the expiration of the 30-day period beginning on the date on which the defendant submits to the warden of the facility in which the defendant is imprisoned a request for placement of the defendant on home detention, regardless of the status of the request.</text></subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id4656c10649f94c61824c986ea7d5e093"><enum>(B)</enum><text>in paragraph (3), by striking <quote>through 2023</quote> and inserting <quote>through 2029</quote>; and</text></subparagraph><subparagraph id="id186D37859CAD4F58840FA7415F9811DB"><enum>(C)</enum><text>in paragraph (5)—</text><clause id="id8426D7764A6F496182BC1FA074C55814"><enum>(i)</enum><text>in subparagraph (A)(ii)—</text><subclause id="id8946883824B145F684B8FAD0E510D8D6"><enum>(I)</enum><text>by inserting <quote>, including offenses under the laws of the District of Columbia,</quote> after <quote>offense or offenses</quote>; and</text></subclause><subclause id="id0C3FF50B749646E6BAFB1AD7F42AA26E"><enum>(II)</enum><text>by striking <quote><fraction>2/3</fraction> of the term of imprisonment to which the offender was sentenced</quote> and inserting <quote><fraction>1/2</fraction> of the term of imprisonment reduced by any credit toward the service of the offender’s sentence awarded under section 3624(b) of title 18, United States Code</quote>; and</text></subclause></clause><clause id="id85684E78B6F844F5B6877CC344795CC3"><enum>(ii)</enum><text>in subparagraph (D)(i), by inserting <quote>, including offenses under the laws of the District of Columbia,</quote> after <quote>offense or offenses</quote>; and</text></clause></subparagraph></paragraph><paragraph id="idfb3a8f3cddb446f18d06783ba7438c71"><enum>(2)</enum><text>in subsection (h), by striking <quote>through 2023</quote> and inserting <quote>through 2029</quote>.</text></paragraph></section><section id="idBCA97CCB49044400AA951ADB849C9F09"><enum>3.</enum><header>Compassionate release technical correction</header><text display-inline="no-display-inline">Section 3582 of title 18, United States Code, is amended—</text><paragraph id="id50280723cb0449be864a405856cd9976"><enum>(1)</enum><text>in subsection (c)(1)—</text><subparagraph id="idF550781770F54758A4EA65E571E02894"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by inserting after <quote>case</quote> the following: <quote>, including, notwithstanding any other provision of law, any case involving an offense committed before November 1, 1987</quote>; and</text></subparagraph><subparagraph id="id2B0C4638C1224FE6BA1E511B29CF3FFF"><enum>(B)</enum><text>in subparagraph (A)—</text><clause id="id472d869817b8442f9525ae7fe85afaf3"><enum>(i)</enum><text>by inserting <quote>on or after the date described in subsection (d),</quote> after <quote>upon motion of the defendant</quote>; and</text></clause><clause id="id96BDA3B1EF0740E5AB8DC6DFF62C1F4E"><enum>(ii)</enum><text>by striking <quote>after the defendant has fully exhausted all administrative rights to appeal a failure of the Bureau of Prisons to bring a motion on the defendant’s behalf or the lapse of 30 days from the receipt of such a request by the warden of the defendant’s facility, whichever is earlier,</quote>;</text></clause></subparagraph></paragraph><paragraph id="id3A9A862F930D470FA00F3180B8AC9D7B"><enum>(2)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f), respectively; and</text></paragraph><paragraph id="id041309C1B97D4D60BB1672CFC0E05FBC"><enum>(3)</enum><text>by inserting after subsection (c) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAAEA749021B7426EA3041A89241EE8B0"><subsection id="id1D7754CC3BDB4EB885E27FB277DAFC5D"><enum>(d)</enum><header>Date described</header><text>For purposes of subsection (c)(1)(A), the date described in this subsection is the earlier of—</text><paragraph id="id3E9CE95B58984162A1E28EB168DFDE02"><enum>(1)</enum><text>the date on which the defendant fully exhausts all administrative rights to appeal a failure of the Bureau of Prisons to bring a motion on the defendant’s behalf; or</text></paragraph><paragraph id="idC64A77784DFE412DAB088EA6A93C5684"><enum>(2)</enum><text>the expiration of the 30-day period beginning on the date on which the defendant submits a request for a reduction in sentence to the warden of the facility in which the defendant is imprisoned, regardless of the status of the request.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
