which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide that silencers be treated the same as firearms accessories. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Silencers Help Us Save Hearing Act</short-title></quote> or the <quote><short-title>SHUSH Act</short-title></quote>.</text></section><section id="H02457575D174451EB1EB1B5BF0BF5089"><enum>2.</enum><header>Equal treatment of silencers and firearms</header><subsection id="H6C9D31024374423FB51D41250105F0B3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/5845">Section 5845(a)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>(7) any silencer</quote> and all that follows through <quote>; and (8)</quote> and inserting <quote>and (7)</quote>.</text></subsection><subsection id="HCA7DD0714A53400A9D52A6B2F1E7F5A6"><enum>(b)</enum><header>Effective date</header><paragraph id="HCDFAA621962C43FD8E9BE61829851915"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the amendments made by this section shall take effect on the date of enactment of this Act.</text></paragraph><paragraph id="H992C2B1055DE4082BCC963095FCDFCEB"><enum>(2)</enum><header>Transfers</header><text>In the case of the tax imposed by <external-xref legal-doc="usc" parsable-cite="usc/26/5811">section 5811</external-xref> of the Internal Revenue Code of 1986, the amendments made by this section shall apply with respect to transfers after the date which is 2 years prior to the date of enactment of this Act.</text></paragraph></subsection></section><section id="H8495064C688A4678B810180BA33E540D"><enum>3.</enum><header>Treatment of certain silencers</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/5841">Section 5841</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF36F585C6FD44AECA23D7A4EA8930FAA"><subsection commented="no" display-inline="no-display-inline" id="HC932ED66F0704D3CA8CB61E41D88A65A"><enum>(f)</enum><header>Firearm silencers</header><text display-inline="yes-display-inline">A person acquiring or possessing a firearm silencer in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, shall be treated as meeting any registration and licensing requirements of the National Firearms Act (as in effect on the day before the date of the enactment of this subsection) with respect to such silencer.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idbad548493ba74639bd488271727efd1e"><enum>4.</enum><header>Preemption of certain State laws in relation to firearm silencers</header><text display-inline="no-display-inline">Section 927 of title 18, United States Code, is amended by adding at the end the following: <quote>Notwithstanding the preceding sentence, a law of a State or a political subdivision of a State that, as a condition of lawfully making, transferring, using, possessing, or transporting a firearm silencer in interstate or foreign commerce, imposes a tax on any such conduct, or a marking, recordkeeping, or registration requirement with respect to the firearm silencer, shall have no force or effect.</quote>.</text></section><section id="idb956cd277a984b2e8b98b69dcb6b8beb"><enum>5.</enum><header>Silencers and mufflers not to be federally regulated</header><subsection id="id8b25f8855ca843f68a43717dc0e7ea52"><enum>(a)</enum><header>Definitions</header><text>Section 921(a) of title 18, United States Code, is amended—</text><paragraph id="id1758538150e14d81b1190455453515d1"><enum>(1)</enum><text>in paragraph (3), by striking <quote>(C) any firearm muffler or firearm silencer; or (D)</quote> and inserting <quote>or (C)</quote>; and</text></paragraph><paragraph id="idBA7DDE413E714D5C9F6BE5D863B45870"><enum>(2)</enum><text>by striking paragraph (25).</text></paragraph></subsection><subsection id="id4A5F0BA651BB4A6BBA3F620398665872"><enum>(b)</enum><header>Penalties</header><text>Section 924 of title 18, United States Code, is amended—</text><paragraph id="idf764b9365bbb45dcbe5098c030fb1d93"><enum>(1)</enum><text>in subsection (c)(1)—</text><subparagraph id="id30be70d07fd64c0b8b118361b97760ac"><enum>(A)</enum><text>in subparagraph (B)(ii), by striking ‘‘, or is equipped with a firearm silencer or firearm muffler’’; and</text></subparagraph><subparagraph id="id39ee01c02bf2449b938cd5735641b6a3"><enum>(B)</enum><text>in subparagraph (C)(ii), by striking ‘‘or is equipped with a firearm silencer or firearm muffler,’’; and</text></subparagraph></paragraph><paragraph id="id91fdb8ef3e27483aa4fbe28fb497ec8d"><enum>(2)</enum><text>in subsection (o), by striking <quote>or is equipped with a firearm silencer or muffler,</quote>.</text></paragraph></subsection><subsection id="id57e448896b1342a2b018543dd2d5d4d8"><enum>(c)</enum><header>Carrying of concealed firearms by qualified law enforcement officers</header><text>Section 926B(e)(3) of title 18, United States Code, is amended—</text><paragraph id="idADDFF09C6CB94AAFBB19BE0C1CF4442D"><enum>(1)</enum><text>in subparagraph (A), by adding <quote>and</quote> at the end;</text></paragraph><paragraph id="ide9d086316a7b4531abed7081ffb39abe"><enum>(2)</enum><text>by striking subparagraph (B); and</text></paragraph><paragraph id="id3ebcdc5778a6444fb214969f3493cc15"><enum>(3)</enum><text>by redesignating subparagraph (C) as subparagraph (B).</text></paragraph></subsection><subsection id="id33d059640c0e4afab51b30d5f05c4ff1"><enum>(d)</enum><header>Carrying of concealed firearms by qualified retired law enforcement officers</header><text>Section 926C(e)(1)(C) of title 18, United States Code, is amended—</text><paragraph id="id09F3136FB299413F8EF7DC8B06E2181A"><enum>(1)</enum><text>in clause (i), by adding <quote>and</quote> at the end;</text></paragraph><paragraph id="id49D506F4C1B54AE9A2891BC7F166E373"><enum>(2)</enum><text>by striking clause (ii); and</text></paragraph><paragraph id="id1DE2DA51388E4954B22F1CFCDA8ADC0A"><enum>(3)</enum><text>by redesignating clause (iii) as clause (ii).</text></paragraph></subsection></section><section id="id67e3ed10e7d94fdaa87217d25220eecb"><enum>6.</enum><header>Excepting silencers from regulation by the Consumer Product Safety Commission</header><text display-inline="no-display-inline">Section 3(5) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2052">15 U.S.C. 2052(a)(5)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id76ad5290fe634479ae14572b13412f21"><enum>(1)</enum><text>in subparagraph (H), by striking <quote>or</quote> at the end;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7358a0945e2b4ab6bdfb6b5564276b56"><enum>(2)</enum><text>in subparagraph (I), by striking <quote>Act).</quote> and inserting <quote>; or</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92d08d345f174d48beb468c9ea46b235"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF37626DD64334CBBAC333C339A7D3FC3"><subparagraph commented="no" display-inline="no-display-inline" id="id188b18a6b9a3425facfe665febd80ff0"><enum>(J)</enum><text>any firearm muffler or firearm silencer (as such term is defined in <external-xref legal-doc="usc" parsable-cite="usc/26/5841">section 5841(f)</external-xref> of the Internal Revenue Code of 1986).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
