which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>A bill to amend title 49, United States Code, to clarify the authority of the Administrator of the Federal Motor Carrier Safety Administration relating to the shipping of household goods, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Household Goods Shipping Consumer Protection Act</short-title></quote>.</text></section><section id="H3FF648653827492E80F94DCA9E129220"><enum>2.</enum><header>Administrative Assessment of Civil Penalties for Violations of Commercial Regulations</header><subsection id="H0ADE4E0AD39B4CD0B93D5D23A94948CC"><enum>(a)</enum><header>Enforcement by Secretary</header><text display-inline="yes-display-inline">Section 14914 of title 49, United States Code, is amended—</text><paragraph id="HE74C6C72499E4C7B9FF564B2C265D53A"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (b), (c), and (d) as subsections (c), (d), and (e), respectively;</text></paragraph><paragraph id="H3CB6DD50C18E4A23B6F039CAD85AE1E2"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="USC" id="H7F56028F276B4760A6F8A75A1222A7D2" display-inline="no-display-inline"><subsection id="H48973608B6E94A50BEBE5B491738F339"><enum>(b)</enum><header>Enforcement by Secretary</header><text display-inline="yes-display-inline">If, after notice and an opportunity for a hearing, the Secretary finds that a person violated a provision of part B of subtitle IV of this title, or a regulation or order issued pursuant to such part, the Secretary shall assess a civil penalty by written notice.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H472CABDE4B2D4C3BB9308AD7521A2713"><enum>(3)</enum><text>in subsection (c), as redesignated by paragraph (1), by inserting <quote>or the Secretary</quote> after <quote>Board</quote>; and</text></paragraph><paragraph id="H0030768E521740FE802AA69706C04287"><enum>(4)</enum><text>in subsection (d), as redesignated by paragraph (1), by inserting <quote>or the Secretary</quote> after <quote>Board</quote>.</text></paragraph></subsection><subsection id="H8DCB4E30A9044EE4BB7A3E70A54163EE"><enum>(b)</enum><header>Application</header><text>Section 501(b) of title 49, United States Code, is amended—</text><paragraph id="H1653CE66317D4CAE99AC106DCC47166E"><enum>(1)</enum><text>by inserting <quote>5,</quote> after <quote>20303 and chapters</quote>; and</text></paragraph><paragraph id="H8CEC8FF19F974C86B0F5061F633EC712"><enum>(2)</enum><text>by inserting <quote>311, 313,</quote> after <quote>chapters),</quote>. </text></paragraph></subsection></section><section id="H01D0B04D9E0C41FC931A77AD88517FBA"><enum>3.</enum><header>State Use of Grant Funds for Commercial Enforcement and Consumer Protection</header><text display-inline="no-display-inline">Section 31102 of title 49, United States Code, is amended—</text><paragraph id="H684D4B00549D4EC994FEA29EA382960E"><enum>(1)</enum><text>in subsection (h)—</text><subparagraph id="H45444F0B69884FEC880B8AAEE39789AA"><enum>(A)</enum><text>in paragraph (1)(B), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HF5F008715EF34C17B8DBE112A582E907"><enum>(B)</enum><text>in paragraph (2)(B), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H0601B636ED4544668B01D8FE9A10CAD6" commented="no"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="HDA951D391F1B438A9BC8008B7242BA7B" display-inline="no-display-inline"><paragraph id="H92C8B0C017BA4B1F8DA506BB278ADBD9" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">for the enforcement of Federal household goods statutes and regulations for the interstate transportation of household goods by household goods motor carriers and brokers, and for the intrastate transportation of household goods by household goods motor carriers if the State has adopted laws or regulations that are compatible with Federal household goods regulations.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H8972A502D7EA4774BAABD311154B8750"><enum>(2)</enum><text>in subsection (l)(2)—</text><subparagraph id="H01C6EA77B4624F82AD17F6C9ED5FABE7" display-inline="no-display-inline"><enum>(A)</enum><text>in subparagraph (I), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H1ECC18B77186446E8409E262F3487987"><enum>(B)</enum><text>by redesignating subparagraph (J) as subparagraph (K); and</text></subparagraph><subparagraph id="HB762171768274CECA02F9E51B8ADEE0B"><enum>(C)</enum><text>by inserting after subparagraph (I) the following:</text><quoted-block style="USC" id="HE570FDFBF9E2429C9827D1426AE55EF5" display-inline="no-display-inline"><subparagraph id="HAA0C790AE45E41B3803CFDF98DCF0B3B"><enum>(J)</enum><text display-inline="yes-display-inline">enforce Federal household goods statutes and regulations for the interstate transportation of household goods by household goods motor carriers and brokers, and for the intrastate transportation of household goods by household goods motor carriers if the State has adopted laws or regulations that are compatible with Federal household goods regulations; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H64D67FF377314DEDA261483B58D4138D"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HE2F06C11AB264A30A17AE7BE456AA98B"><subsection id="HD723BC5267ED4CCF952A64DBCF73D1DB" commented="no"><enum>(m)</enum><header>State discretion</header><text display-inline="yes-display-inline">The activities described in subsections (h)(3) and (l)(2)(J) are—</text><paragraph id="HB372C1130C9D470A8B3B851DAAE86345" commented="no"><enum>(1)</enum><text>optional at the discretion of a State; and</text></paragraph><paragraph id="H0AB59E50EF7E45449F5D9FE2E94A64FF" commented="no"><enum>(2)</enum><text>not a condition on funds received under this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HBBF8BAF0352D440191C4FD074F864836"><enum>4.</enum><header>State Retention of Penalties and Fines</header><text display-inline="no-display-inline">Section 14711 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H11E1CAFB4B2242B1B3530A62054765D0" display-inline="no-display-inline"><subsection id="H3536BD9B8EB1479B9F23F09A69DA75E2"><enum>(g)</enum><header>Penalties</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any fine or penalty imposed on a carrier or broker in a proceeding under this section shall be paid to, and retained by, the State that imposed such fine or penalty. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H26A08E2132604907BAA35483616B24FF"><enum>5.</enum><header>Registration Requirements</header><subsection id="HC2C0A2B105C94F01A1AF5C7D06F2A4C8"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 13102 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H4C295404D7E241EA83BA78C2604335BE" display-inline="no-display-inline"><paragraph id="H1F0D0D3F28334BAFB9FE4D8BC75AF97E"><enum>(28)</enum><header>Principal place of business</header><text display-inline="yes-display-inline">The term <quote>principal place of business</quote> means a single physical business location of a specified entity where—</text><subparagraph id="HA81D9267F37F401B953D8D80F3DF25F4"><enum>(A)</enum><text>management officials of such specified entity report to work; </text></subparagraph><subparagraph id="H21F3E19C7A3040A1859EAB15F7EE87D5"><enum>(B)</enum><text>such specified entity conducts a significant portion of its business relating to the transportation of persons or property; and</text></subparagraph><subparagraph id="HF2917BAF68FF43A4BA498D31769AC835"><enum>(C)</enum><text>such specified entity maintains records required by part B of subtitle IV or part B of subtitle VI.</text></subparagraph></paragraph><paragraph id="HE33D4C4D19DD4CC6B3D09788C221393E"><enum>(29)</enum><header>Specified entity</header><text>The term <quote>specified entity</quote> means— </text><subparagraph id="H1FDFA549DDA44334A92591FEA15C781F"><enum>(A)</enum><text>an employer, as such term is defined in section 31132;</text></subparagraph><subparagraph id="H3985374488D5468EA7E5FF4DAF6B0959"><enum>(B)</enum><text>a person;</text></subparagraph><subparagraph id="HF99CAB6E59A8489894853B7C6C537ECF"><enum>(C)</enum><text>a motor carrier, including a foreign motor carrier or foreign motor private carrier;</text></subparagraph><subparagraph id="HBAE0D7D018D64834BF795E6C9FD71A8D"><enum>(D)</enum><text>a broker; or</text></subparagraph><subparagraph id="H429CA5E6B30E49C58B939C2ADB33917C"><enum>(E)</enum><text>a freight forwarder.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6AAF2DC4A8A64AF68F3B48BFD87A75B2"><enum>(b)</enum><header>Motor Carrier Generally</header><text>Section 13902(a)(1) of title 49, United States Code, is amended—</text><paragraph id="H9DA4949888234857B6977AFC66601B95"><enum>(1)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H3AA6A6B1BA364C3A84DDA1346AC5FDB3"><enum>(2)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H906010BB04DA4DB78FC3BF997B61DD55"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H74648F61E13E40EE8C1641FF9346CDAD" display-inline="no-display-inline"><subparagraph id="HBAA16C21C71C4C00878AC55379D4A208"><enum>(E)</enum><text display-inline="yes-display-inline">has designated a principal place of business.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HED6559D151BF4D27914C4CA04868EF30"><enum>(c)</enum><header>Registration of freight forwarders</header><text display-inline="yes-display-inline">Section 13903(a) of title 49, United States Code, is amended—</text><paragraph id="H3FEC4C09D11A431FAE7E8CC6DF67CB57"><enum>(1)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H6499187469E541888C5CAB2221D43EDF"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="H224B5BE6C3944C64A372499DD76DFE9C"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="HB7C312FA4C4540308EBD9557FBAF9153" display-inline="no-display-inline"><paragraph id="HFB9F2AC0404F42489261A6EEF5EBC60D"><enum>(3)</enum><text display-inline="yes-display-inline">has designated a principal place of business; and</text></paragraph><paragraph id="H9CD44B6950734BB8BAC43C1776CC34DD"><enum>(4)</enum><text display-inline="yes-display-inline">has disclosed any relationship involving common ownership, common management, common control, or common familial relationship between such person and any other motor carrier, freight forwarder, broker, or any other applicant for motor carrier, freight forwarder, or broker registration, if the relationship occurred in the 3-year period preceding the date of the filing of the application for registration.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB0F721D09C9247B29F4195CCC0F429CD"><enum>(d)</enum><header>Registration of brokers</header><text>Section 13904(a) of title 49, United States Code, is amended—</text><paragraph id="HD80CC4CCF9E44638841CF34E94D82CDD"><enum>(1)</enum><text>in subsection (1) by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="HCC8542F2AFBE4C1B84DF4E7639CCC711"><enum>(2)</enum><text>in subsection (2) by striking the period and inserting a semicolon; and</text></paragraph><paragraph id="H80B941AB373A47839EA7B5F455401C57"><enum>(3)</enum><text>by inserting at the end the following:</text><quoted-block id="HE7A3240D94BC41689A78B59A68E8B875" style="OLC"><paragraph id="H46CBDC4D0C2146E9A364EB21894818EA"><enum>(3)</enum><text display-inline="yes-display-inline">has designated a principal place of business; and</text></paragraph><paragraph id="HDC7E1B1955274504B34C5B8AF100512F"><enum>(4)</enum><text>has disclosed any relationship involving common ownership, common management, common control, or common familial relationship between such person and any other motor carrier, freight forwarder, or broker, or any other applicant for motor carrier, freight forwarder, or broker registration, if the relationship occurred in the 3-year period preceding the date of the filing of the application for registration.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA094A464726D41B788EFD07C861441F4"><enum>(e)</enum><header>Complaints and actions on Secretary initiatives</header><text>Section 13905(d)(2) of title 49, United States Code, is amended—</text><paragraph id="H0222F60F58034439983C1D17F2BEE2EE"><enum>(1)</enum><text>in subparagraph (C)(iii), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="H31A93894AE9944C6B796E023F79AAC40"><enum>(2)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HA2EADA3C1F984CD48B0457B78AC97E19"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H93C411B87D6F4EDFB49F36D81A0A272D" display-inline="no-display-inline"><subparagraph id="H2C22C48087C948439C0D68912066C037"><enum>(E)</enum><text display-inline="yes-display-inline">withhold, suspend, amend, or revoke any part of a registration of a motor carrier, foreign motor carrier, foreign motor private carrier, broker, or freight forwarder if the Secretary finds that the motor carrier, foreign motor carrier, foreign motor private carrier, broker, or freight forwarder failed to designate a valid principal place of business.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H38A7B825F89640DB8AB4E9A2E6290FFE"><enum>(f)</enum><header>Requirement for registration and USDOT number</header><text>Section 31134 of title 49, United States Code, is amended—</text><paragraph id="H967405CA4CD9410383C6DF325A508E4E"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H5D67EA5A60BE467BABBDAB2B37C5711A"><enum>(A)</enum><text>in paragraph (2), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="HAC737368D8CF4853BE1228DD5EC55A49"><enum>(B)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="HB1A9F4553F35458F86BC7716222248F7"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H7A9EBAAED77C4830955B552AD288FCB7" display-inline="no-display-inline"><paragraph id="H07A22C6E7640471A98B1E64B1FB9F8F1"><enum>(4)</enum><text display-inline="yes-display-inline">the employer or person seeking registration has designated a principal place of business, as defined in section 13102.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE16B9FB79DE742E2B176777D9D64E64D"><enum>(2)</enum><text>in subsection (c)(2), by striking <quote>subsection (b)(1)</quote> and inserting <quote>subsection (b)</quote>.</text></paragraph></subsection></section></legis-body></bill>
