<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 3192</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20251118">November 18, 2025</action-date><action-desc><sponsor name-id="S253">Mr. Durbin</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require Transmission Organizations to allow aggregators of retail customers to submit to organized wholesale electric markets bids that aggregate demand flexibility of customers of certain utilities, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Responsive Energy Demand Unlocks Clean Energy Act</short-title></quote> or the <quote><short-title>REDUCE Act</short-title></quote>.</text></section><section id="idF18C42A8FB1F4BFBA0327D4B33B4D763"><enum>2.</enum><header>Aggregator bidding into organized power markets</header><subsection commented="no" display-inline="no-display-inline" id="id16c119f50b9d42aaa1aeb27709b30756"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any prohibition established by State law or a State commission (as defined in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>)) with respect to who may bid into an organized wholesale electric market, each Transmission Organization shall, consistent with any applicable market rules that do not establish such a prohibition, allow aggregators of retail customers to submit bids that aggregate demand flexibility of customers of utilities that distributed more than 4,000,000 megawatt-hours in the previous fiscal year.</text></subsection><subsection id="idf68c6618f98c4c0cb3c07498c7a5596a"><enum>(b)</enum><header>Rulemaking</header><text>Not later than 1 year after the date of enactment of this Act, the Federal Energy Regulatory Commission shall issue a rule to carry out the requirements of subsection (a).</text></subsection></section></legis-body></bill>
