                introduced the following bill; which was read twice and referred to the
                    <committee-name committee-id="SSJU00">Committee on the
                    Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To restore limited, free telephone service for detainees to facilitate
            consultations with legal counsel and to maintain ties with their families, and for other
 purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Access for Detainees Act</short-title></quote>.</text></section><section id="idf083a761d856427994ef1e83e1655a0b"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id72680b9217f04ae58591686b3a515231"><enum>(1)</enum><text>individuals in civil immigration detention require access to counsel to address their legal needs and their ability to maintain ties with family and loved ones;</text></paragraph><paragraph id="idca8a89d528404d298fd4e830ad39c02a"><enum>(2)</enum><text>while existing communication options in detention are helpful, they do not adequately address the needs of detainees, including detainees who are indigent or seeking legal representation;</text></paragraph><paragraph id="id33a8ff6789cf49dd8070399d81460947"><enum>(3)</enum><text>in April 2020, the Trump administration instituted a program in which detained individuals were provided up to 520 free minutes of telephone service per month to maintain contact with families and legal representatives during the COVID–19 public health emergency, but that program was halted during 2024 due to a lack of funding;</text></paragraph><paragraph id="idf862078570254c7182e80d18bade0c1d"><enum>(4)</enum><text>since U.S. Immigration and Customs Enforcement received additional funding under section 100052 of <external-xref legal-doc="public-law" parsable-cite="pl/119/21">Public Law 119–21</external-xref> (commonly referred to as the <quote>One Big Beautiful Bill Act</quote>), a portion of such funding should be reserved for restoring the free telephone service program for detainees to more conveniently maintain contact with families and legal representatives.</text></paragraph></section><section id="idc6e16de40fe74a86ae1d50e7d01652bb"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idece63089ab944e4994e8b7c39df03a03"><enum>(1)</enum><header>Communication</header><text display-inline="yes-display-inline">The term <term>communication</term> means the exchange of information through a phone call, email, video, or any other form of electronic communication.</text></paragraph><paragraph id="ide11148b74556461a83c2d1ae3fa0a15f" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Custody</header><text>The term <term>custody</term> means, with respect to an alien, that the alien is not free to leave, regardless of whether the detaining agency is a Federal, State, or local official or any contractors or subcontractors of any Federal agency, including the United States military, and includes legal or physical custody.</text></paragraph></section><section id="ide765f6caca8d48b4a8f407dc0d67a67a"><enum>4.</enum><header>Restoration of free telephone service program for detainees and other
 communication requirements</header><subsection commented="no" display-inline="no-display-inline" id="idd570d57f4e8942b99d10acffa8837461"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to the protocols established pursuant to subsection (b) and the restrictions established pursuant to subsection (c), any alien who is in the custody of the Department of Homeland Security shall be provided, at the expense of the Federal Government—</text><paragraph id="id1a48e0f01f4d4e379c640d4488ac11c2"><enum>(1)</enum><text>during the first 5 hours of such custody and during the 5-hour period beginning at the time such alien arrives at a new location, at least 1 communication of not less than 10 minutes with an immediate family member to notify such family member where the alien is being detained;</text></paragraph><paragraph id="id7f9e8d9027464a94af96bc90eae4375d"><enum>(2)</enum><text>if the alien is unable to initiate a communication with any immediate family during any 5-hour period referred to in paragraph (1), continued attempts to establish communication with such family member until the alien is successful;</text></paragraph><paragraph id="id4ed9d4bdd30f43b89c22fc6fbf03383a"><enum>(3)</enum><text>at least 200 free minutes each month for outgoing communication to any person referred to in paragraphs (1) and (2);</text></paragraph><paragraph id="id2378926da3834efdb92746c9639a32eb"><enum>(4)</enum><text>during the first 5 hours of such custody and during the 5-hour period beginning at the time such alien arrives at a new location, an opportunity to establish private communication with the alien's legal counsel or potential legal counsel or an official at the appropriate consulate;</text></paragraph><paragraph id="idc32465d3ca4e4b8c86a6c8d9ebe83f88"><enum>(5)</enum><text>an opportunity to establish private communication with any official investigating detention conditions, including an official from the Office of the Immigration Detention Ombudsman, the Office of the Inspector General of the Department of Homeland Security, or the Office for Civil Rights and Civil Liberties; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6273464b03024ecd9052cc041c5eb422"><enum>(6)</enum><text display-inline="yes-display-inline">unlimited free minutes for communication with—</text><subparagraph commented="no" display-inline="no-display-inline" id="id32866fe2f434413699643bfbef63f095"><enum>(A)</enum><text display-inline="yes-display-inline">any person referred to in paragraphs (4) and (5);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5abc0ec58a964b34b37694b289188175"><enum>(B)</enum><text display-inline="yes-display-inline">the Executive Office for Immigration Review;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8b9dc71ba3d54e168560583521d5d42d"><enum>(C)</enum><text>the Board of Immigration Appeals;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id50b8aa921f7d42ca802790b398835d15"><enum>(D)</enum><text display-inline="yes-display-inline">the local immigration court;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id703fd4457e5241dcb804bada3ff3d725"><enum>(E)</enum><text display-inline="yes-display-inline">any Federal or State court where the detained individual is or may become involved in a legal proceeding;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0d96e2157d3d4418a77753f1b325a16a"><enum>(F)</enum><text display-inline="yes-display-inline">the United Nations High Commissioner for Refugees;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1714bdb9c0534aecbbc178a2b87938fc"><enum>(G)</enum><text display-inline="yes-display-inline">any Federal, State, or local government office for the purpose of obtaining documents relevant to the alien's immigration case; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf2f0d69a525b4821b685f5cc018e9a2b"><enum>(H)</enum><text display-inline="yes-display-inline">the U.S. Immigration and Customs Enforcement Office of Professional Responsibility Joint Intake Center.</text></subparagraph></paragraph></subsection><subsection id="id5f30806468e941b78c04a91a6df595db"><enum>(b)</enum><header>Protocols</header><text>The Secretary of Homeland Security shall establish protocols to ensure detained individuals are not prevented (either through dissuasion or retaliation) from—</text><paragraph commented="no" display-inline="no-display-inline" id="id9ad2eb29e62f4cf0b3322dd112210b73"><enum>(1)</enum><text display-inline="yes-display-inline">accessing the means of communication described in subsection (a); or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida96d8f55a10e4fe6a776b042b782ffa0"><enum>(2)</enum><text display-inline="yes-display-inline">making additional calls to other individuals at their own expense.</text></paragraph></subsection><subsection id="id22edc752a2334d5c8817f51803b372b5"><enum>(c)</enum><header>Time, place, and manner restrictions</header><paragraph commented="no" display-inline="no-display-inline" id="idf824bd4e96b244cc894fb0ad8cf405b3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraphs (2) and (3), each detention facility is authorized to establish consistent policies regulating the time, place, and manner of outgoing communication authorized under subsection (a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51254ff4ebcd49429a0ada308c1eada2"><enum>(2)</enum><header>Limitations</header><text display-inline="yes-display-inline">Detention facilities may not—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd0c8cf7adae3476ea0444871cd45f3a5"><enum>(A)</enum><text display-inline="yes-display-inline">restrict the number of minutes detainees communicate with their legal representatives;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idea0edeed8dff419994fa603f1ea16c03"><enum>(B)</enum><text display-inline="yes-display-inline">limit the duration of such communications by rule or automatic cut-off; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1e656a6932dd4c289439e7a0c42fbbdd"><enum>(C)</enum><text display-inline="yes-display-inline">include incoming calls towards the total free minutes of communication required under subsection (a)(3).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id67f2b1c4ecc9440db5bc5aa7d3b20a28"><enum>(3)</enum><header>Application</header><text display-inline="yes-display-inline">The policies established pursuant to paragraph (1) shall be—</text><subparagraph commented="no" display-inline="no-display-inline" id="id84e651dc9cab4a92b7798e40bcf63f72"><enum>(A)</enum><text display-inline="yes-display-inline">consistently applied;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide187fd008d614b9ea8354affe706b687"><enum>(B)</enum><text display-inline="yes-display-inline">given to each alien at the time of his or her arrival at a detention facility; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id44be4c3c4c40467da88aac23d3ff1bb7"><enum>(C)</enum><text display-inline="yes-display-inline">available at each detention facility for examination by the public.</text></subparagraph></paragraph></subsection><subsection id="id6c299f5411b246e7a9f26879d54480ae"><enum>(d)</enum><header>Confidentiality</header><paragraph commented="no" display-inline="no-display-inline" id="id2f6631ac4178421a99d8f39d09419030"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), any communication made pursuant to paragraph (4), (5), or (6) of subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id308a0df0f086426ebad9785aeb657942"><enum>(A)</enum><text display-inline="yes-display-inline">may not be monitored or recorded; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8547f5dd8df549cebe77db6aff73cd0a"><enum>(B)</enum><text>shall take place in a space with auditory privacy.</text></subparagraph></paragraph><paragraph id="id37894e466504413fbb32f51df819c4bc"><enum>(2)</enum><header>Exception</header><text>The limitation under paragraph (1) shall not apply to a circumstance in which a government official has a lawful warrant issued by a court of competent jurisdiction to authorize the monitoring or recording of communication described in such paragraph.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idd76995afabe349ac896262f57f231ea1"><enum>5.</enum><header>Savings provision</header><text display-inline="no-display-inline">Nothing in this Act may be construed to limit or interfere with any settlement agreement in effect on the date of the enactment of this Act.</text></section></legis-body></bill>
