<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 3109</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20251105">November 5, 2025</action-date><action-desc><sponsor name-id="S396">Mrs. Blackburn</sponsor> (for herself and <cosponsor name-id="S385">Ms. Cortez Masto</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend titles 46 and 49, United States Code, to require that individuals who commit human trafficking violations be permanently disqualified from obtaining certain licenses issued by the Department of Homeland Security and the Department of Transportation, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Trafficker Restrictions for Aviation, Federal Freight, and Interstate Carriers Act of 2025</short-title></quote> of the <quote><short-title>TRAFFIC Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idb1d60378a167414080fee6615a724535"><enum>2.</enum><header>Permanent disqualification for human trafficking violations</header><subsection id="id339db6bf22444b368d54536709bf8e26"><enum>(a)</enum><header>Merchant seamen licenses, certificates, and documents</header><paragraph commented="no" display-inline="no-display-inline" id="idaabe80d2382e410a80be810f94cc034c"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/75">Chapter 75</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id4be0a21708094b0b9b9075cc2e31fb23"><section commented="no" display-inline="no-display-inline" id="id0491e131dbaf4299960db2c85ba7737b"><enum>7512.</enum><header>Human trafficking as grounds for denial</header><text display-inline="no-display-inline">A license, certificate, or merchant mariner’s document authorized to be issued under this part shall be denied to an individual who has been convicted of—</text><paragraph commented="no" display-inline="no-display-inline" id="id837427ffd98742f09e3349494ad2599a"><enum>(1)</enum><text display-inline="yes-display-inline">an offense prohibited under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/77">chapter 77</external-xref> of title 18; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfa00f30c11054c4d910806ea793678ee"><enum>(2)</enum><text display-inline="yes-display-inline">a substantially similar offense prohibited under—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd47a0fe711a64a028ad9c6ea7447f1a8"><enum>(A)</enum><text display-inline="yes-display-inline">any other Federal law; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id06efaaac07404ac6891528f07658669c"><enum>(B)</enum><text display-inline="yes-display-inline">a State, local, or Tribal law.</text></subparagraph></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id364ffb89522b4662b6d3dd1365874157"><enum>(2)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/75">chapter 75</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddcea4b71651b4d6f97c527d61d7c7d8e"><toc><toc-entry level="section" bold="off">7512. Human trafficking as grounds for denial.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idfb69448c06d24d3abdc3a62e52dc1028"><enum>(b)</enum><header>Licensing or certification of locomotive operators</header><text display-inline="yes-display-inline">Section 20135 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idc092e955cbba49099d78bf999c5f3ac2"><subsection commented="no" display-inline="no-display-inline" id="idb61e413963564e76815efd8e914a59d5"><enum>(f)</enum><header>Human trafficking violations</header><text>The Secretary may not issue a license or certification described under this section to an individual who has been convicted of—</text><paragraph commented="no" display-inline="no-display-inline" id="id0996707a700643de9f514443e1f1c411"><enum>(1)</enum><text display-inline="yes-display-inline">an offense prohibited under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/77">chapter 77</external-xref> of title 18; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6cbf117b3cf444acb9526002fc718758"><enum>(2)</enum><text display-inline="yes-display-inline">a substantially similar offense prohibited under—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd70f0d3882e241c4874ed5391bc66345"><enum>(A)</enum><text display-inline="yes-display-inline">any other Federal law; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3abbd3d972b34c51af49a0be380163dd"><enum>(B)</enum><text display-inline="yes-display-inline">a State, local, or Tribal law.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id039782491231410daf3be1e60a39dfec"><enum>(c)</enum><header>Certification of train conductors</header><text display-inline="yes-display-inline">Section 20163 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbd87840108cf4144b5af203e52e0b3e9"><subsection commented="no" display-inline="no-display-inline" id="id9663c3549e404b0cbf93e201586ef652"><enum>(c)</enum><header>Human trafficking violations</header><text>In developing the regulations required by subsection (a), the Secretary may not permit a certification described under this section to be issued to an individual who has been convicted of—</text><paragraph commented="no" display-inline="no-display-inline" id="id8b233c380ff647939e354228fec3f014"><enum>(1)</enum><text display-inline="yes-display-inline">an offense prohibited under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/77">chapter 77</external-xref> of title 18; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf92253beda59475d9fa99fc6b16586df"><enum>(2)</enum><text display-inline="yes-display-inline">a substantially similar offense prohibited under—</text><subparagraph commented="no" display-inline="no-display-inline" id="id80b23649bae34e67b2da3b62f2189944"><enum>(A)</enum><text display-inline="yes-display-inline">any other Federal law; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3575dba64edb4654b32e53e24ff39329"><enum>(B)</enum><text display-inline="yes-display-inline">a State, local, or Tribal law.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id272942f791ba4b938f73a79488964ea4"><enum>(d)</enum><header>Commercial driver’s licenses</header><text>Section 31310(d)(2) of title 49, United States Code, is amended by striking <quote>who uses a commercial motor vehicle in committing a felony involving an act or practice described in paragraph (9) of section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102(9)</external-xref>)</quote> and inserting the following: “who has been convicted of—</text><quoted-block id="id884b458664874bbdb305bc8ac9afbae5" display-inline="no-display-inline" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="id2c23c349ceac4559b9e131da9d044cae"><enum>(1)</enum><text display-inline="yes-display-inline">an offense prohibited under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/77">chapter 77</external-xref> of title 18; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc35e2defa276433d8ff8708a5af7c7e8"><enum>(2)</enum><text display-inline="yes-display-inline">a substantially similar offense prohibited under—</text><subparagraph commented="no" display-inline="no-display-inline" id="id201fdaf4e8c245babef9d0c4771f4472"><enum>(A)</enum><text display-inline="yes-display-inline">any other Federal law; or</text></subparagraph><subparagraph id="id9625c9ffb87b4cbe8fdfe5b72af25540" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">a State, local, or Tribal law.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id4cae431d3da2400cad8be01f41e18053" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Pilot certificate permanent disqualification</header><text>Section 44703 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id05035ffd7d3d4261aa040f8f5137a1cd"><subsection commented="no" display-inline="no-display-inline" id="id21bf2619ca0841d28195c4e872a7cf68"><enum>(m)</enum><header>Human trafficking violations</header><text display-inline="yes-display-inline">The Administrator of the Federal Aviation Administration may not issue an airman certificate to any individual who has been convicted of—</text><paragraph id="id7545bd4fe96e425ca292d4911ec0a707"><enum>(1)</enum><text>an offense prohibited under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/77">chapter 77</external-xref> of title 18; or</text></paragraph><paragraph id="id4a83ec0b777c43a4b193d35eb19c0d2a"><enum>(2)</enum><text>a substantially similar offense prohibited under—</text><subparagraph id="id463b80aa942240dba7c19b8f7ef4117b"><enum>(A)</enum><text>any other Federal law; or</text></subparagraph><subparagraph id="id505850028f1341b388c51b10dfc56635" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>a State, local, or Tribal law.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id9505261e0ff34b41aa35f7e3f5a57130"><enum>(f)</enum><header>Other licenses, certificates, and authorizations</header><paragraph commented="no" display-inline="no-display-inline" id="idada6083f86684923877e09f389266933"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary of Transportation or the Secretary of Homeland Security, as applicable, shall disqualify from receiving or holding a document or authorization described in paragraph (2) any individual who has been convicted of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb9fca81a77d44a86a7e730194d793bc9"><enum>(A)</enum><text display-inline="yes-display-inline">an offense prohibited under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/77">chapter 77</external-xref> of title 18, United States Code; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9f752c9c080a4096b14d12fa8b9717a4"><enum>(B)</enum><text display-inline="yes-display-inline">a substantially similar offense prohibited under—</text><clause commented="no" display-inline="no-display-inline" id="id2155c6d47b07471889983832e87bb569"><enum>(i)</enum><text display-inline="yes-display-inline">any other Federal law; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id8d80829d8bda4a1ebf7e941be3ddf3b6"><enum>(ii)</enum><text display-inline="yes-display-inline">a State, local, or Tribal law.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida97684ceaae243c8b001a9ed260b71ad"><enum>(2)</enum><header>Documents and authorizations described</header><text>A document or authorization referred to in paragraph (1) is a license, certificate, or other document or authorization—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9781edaea8504fca8111dcffba086525"><enum>(A)</enum><text display-inline="yes-display-inline">that is issued by the Department of Transportation or the Department of Homeland Security;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id76855eb6858e46508e64af979042965f"><enum>(B)</enum><text display-inline="yes-display-inline">that authorizes or otherwise relates to the operation of any vehicle, aircraft, vessel, or other form of transportation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1a26c271ed8444a5a842c39668431a08"><enum>(C)</enum><text display-inline="yes-display-inline">the issuance or holding of which is not addressed by—</text><clause commented="no" display-inline="no-display-inline" id="idf946ed8df7204d989f5503c80861b5ca"><enum>(i)</enum><text display-inline="yes-display-inline">section 7512 of title 46, United States Code; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idf05dcb9b03da4b10b0da9d654ae8f725"><enum>(ii)</enum><text>section 20135(f), 20163(c), 31310(d)(2), or 44703(m) of title 49, United States Code.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
