display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">The term <term>Administration</term> means the National Oceanic and Atmospheric Administration.</text></paragraph><paragraph id="id042fce9e-0d21-476b-b75c-b5005f7b5389" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriate committees of Congress</header><text display-inline="yes-display-inline">The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="idd774e1e8-457b-4b55-be09-cf8cbe0234a3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Commerce, Science, and Transportation of the Senate; and</text></subparagraph><subparagraph id="id7fdbf210-7b22-4dea-b004-c5256aa5c197" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Science, Space, and Technology of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id5e5f0150-60c4-48be-820a-57307bc24a8f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Earth system model</header><text display-inline="yes-display-inline">The term <term>Earth system model</term> means a mathematical model containing all relevant components of the Earth, namely the atmosphere, oceans, land, cryosphere, and biosphere. </text></paragraph><paragraph id="id16f6615a-e02c-4e4a-ac8a-738cbe2cff64" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Fire environment</header><text display-inline="yes-display-inline">The term <term>fire environment</term> means—</text><subparagraph id="idf18109cd-1e24-4b4a-b2bb-d60b86fe9bce" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the environmental conditions, such as soil moisture, vegetation, topography, snowpack, atmospheric temperature, moisture, and wind, that influence—</text><clause id="idd8ac7dcf-8cca-4189-aa45-821803e22332" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">fuel and fire behavior; and </text></clause><clause id="idafdee8a0-c48b-4f03-9d22-e5269f1a242f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the emission, chemical evolution, and transport of wildfire smoke; and </text></clause></subparagraph><subparagraph id="ide03b3939-6741-4eea-bfe9-fb8773195839" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the associated environmental impacts occurring during and after fire events.</text></subparagraph></paragraph><paragraph id="id95ce446fa7a74806aec648a7e95d4aba" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Fire weather</header><text display-inline="yes-display-inline">The term <term>fire weather</term> means the weather conditions that influence the start, spread, character, or behavior of wildfires and relevant meteorological and chemical phenomena, including air quality, wildfire smoke, and meteorological parameters such as relative humidity, air temperature, wind speed and direction, and atmospheric composition and chemistry, including emissions and mixing heights.</text></paragraph><paragraph id="id3f1329e1-fcee-4d75-9a4a-b77ac0f79981" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Impact-based decision support services</header><text display-inline="yes-display-inline">The term <term>impact-based decision support services</term> means scientific advice and interpretative services the Administration provides to help core partners, such as emergency personnel and public safety officials, make decisions when the information impacts the lives and livelihoods of the people of the United States. </text></paragraph><paragraph id="ide2638de0-158c-486c-9187-32c08d971997" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Indian tribe</header><text display-inline="yes-display-inline">The term <term>Indian tribe</term> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></paragraph><paragraph id="id55ef63f8-855f-46db-9f81-3d4bfe8b3da9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">Native Hawaiian organization</header><text display-inline="yes-display-inline">The term <term>Native Hawaiian organization</term> has the meaning given that term in section 6207 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7517">20 U.S.C. 7517</external-xref>), including the Department of Hawaiian Home Lands and the Office of Hawaiian Affairs. </text></paragraph><paragraph id="id600462e3-b68c-44a2-b7b6-69a763869952" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header display-inline="yes-display-inline">Seasonal</header><text display-inline="yes-display-inline">The term <term>seasonal</term> has the meaning given that term in section 2 of the Weather Research and Forecasting Innovation Act of 2017 (<external-xref legal-doc="usc" parsable-cite="usc/15/8501">15 U.S.C. 8501</external-xref>).</text></paragraph><paragraph id="id58be1374-4a95-44ef-8382-8212652805d0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(10)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means a State, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, the United State Virgin Islands, the Federated States of Micronesia, the Republic of the Marshall Islands, or the Republic of Palau.</text></paragraph><paragraph id="idea9a5482-16b3-4e09-b24a-5f9178b3b6bd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(11)</enum><header display-inline="yes-display-inline">Tribal organization</header><text display-inline="yes-display-inline">The term <term>Tribal organization</term> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>). </text></paragraph><paragraph id="id3419d984-12f4-4586-a2c1-c15f47ef1515" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(12)</enum><header display-inline="yes-display-inline">Under Secretary</header><text display-inline="yes-display-inline">The term <term>Under Secretary</term> means the Under Secretary of Commerce for Oceans and Atmosphere.</text></paragraph></section><section id="id4d53a44c-7dc6-4298-8394-776b53a18efd" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Establishment of fire weather services program</header><subsection id="id1753c642-5e47-4748-ba95-b871f7208013" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Under Secretary shall establish and maintain a coordinated fire weather services program among the offices of the Administration in existence as of the date of the enactment of this Act.</text></subsection><subsection id="id434d9e00-955f-4627-aefb-c228b0b66a1c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Program functions</header><text display-inline="yes-display-inline">The functions of the program established under subsection (a), consistent with the priorities described in section 101 of the Weather Research and Forecasting Innovation Act of 2017 (<external-xref legal-doc="usc" parsable-cite="usc/15/8511">15 U.S.C. 8511</external-xref>), shall be—</text><paragraph id="ida06574c3-e5ec-4684-9cb6-2302f009e14c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">to support readiness, responsiveness, understanding, and resilience of the United States to wildfires, fire weather, wildfire smoke, post-fire flooding and debris flows, and associated hazards and impacts in built and natural environments; </text></paragraph><paragraph id="idecf70f9f-cae0-4e7c-9d8a-ad3f211adad4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">to collaboratively develop and disseminate accurate, precise, effective, and timely risk communications, forecasts, watches, and warnings relating to wildfires, fire weather, wildfire smoke, post-fire flooding and debris flows, and other associated conditions, hazards, and impacts, as applicable, with Federal land management agencies;</text></paragraph><paragraph id="idc3fc4588-4f59-4095-8437-370147896916" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">to partner with and support the public, Federal and State government entities, Indian tribes, Native Hawaiian organizations, and academic and local partners through the development of capabilities, impact-based decision support services, and overall service delivery and utility related to fire weather;</text></paragraph><paragraph id="id208de441-3c9d-4119-8742-dc74a8c579fd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">to conduct and support research and development of new and innovative models, technologies, techniques, products, systems, processes, and procedures to predict and improve understanding of wildfires, fire weather, related air quality, post-fire flooding and debris flows, and the fire environment;</text></paragraph><paragraph id="id14bddadf90464770b3f4d556ac8f7604" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">to develop processes to transition research into operational use and inform additional areas of research to deliver fire weather products, services, and decision support tools to operational users and platforms;</text></paragraph><paragraph id="id46a8c131f9a64518b7ae4a1cfcab89cc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">to develop communications networks and strategies to ensure parity of fire forecasts, warning services, and information about current fire location, for remote, isolated, and rural communities, including communities where the public acts as the first responder to wildfire; and </text></paragraph><paragraph id="id7a171e70-ca13-4e3b-9498-2e806c005983" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">to develop, in coordination with Federal land management agencies, impact-based decision support services that operationalize and integrate the functions described in paragraphs (1) through (6) in order to provide comprehensive impact-based decision support services that encompass the fire environment.</text></paragraph></subsection><subsection id="id921d203f-30c6-4ffb-9b17-e4d2dc5b0361" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Program priorities</header><text display-inline="yes-display-inline">In developing and implementing the program established under subsection (a), the Under Secretary shall prioritize—</text><paragraph id="id34dad437-537c-4d10-8896-0c3335dd1efe" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">development of a fire weather-enabled Earth system model and data assimilation systems that—</text><subparagraph id="id0b55b1ab-82db-41ff-987d-31ef96ed6079" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">are capable of prediction and forecasting across relevant spatial and temporal scales; </text></subparagraph><subparagraph id="id8b0a5560-5c46-4e81-a1bb-09d36ab6a183" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">include variables associated with fire weather and the fire environment;</text></subparagraph><subparagraph id="idf3fe4367-c138-4844-af0b-a0f8289aaf5e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">improve understanding of the connections between fire weather and modes of climate variability; </text></subparagraph><subparagraph id="id38d203e2-6098-42e2-9d60-c8b4196a8a9c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">incorporate emerging techniques such as artificial intelligence, machine learning, and cloud computing; and</text></subparagraph><subparagraph id="id9f37703e-b636-4175-a5c1-efae869d9862" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">use a rapidly deployable network of rain gauges for post-fire hazard monitoring;</text></subparagraph></paragraph><paragraph id="ida9ccfd92-37c4-4207-881b-959d67e6894f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">advancement of existing and new observational capabilities, including satellite-, airborne-, air-, and ground-based systems and technologies, and social networking and other public information-gathering applications that— </text><subparagraph id="id68af5fd5-5614-4bb4-a5c3-4f7bc6c2dfc7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">identify—</text><clause id="id3993edab-8f85-46b8-9ff6-17159e441e90" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">high-risk pre-ignition conditions;</text></clause><clause id="id234f4c8f-4f11-4150-8305-03d06ca98253" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">conditions that influence fire behavior and spread including those conditions that suppress active fire events; and</text></clause><clause id="id4d8843dae66f42f6b9777d54258bae2a" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">fire weather threat levels;</text></clause></subparagraph><subparagraph id="idb52bf8eb-6c4f-4e7d-9186-fc68975b2eb4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">support real-time notification and monitoring of ignitions;</text></subparagraph><subparagraph id="id0c53da2e-bfcb-4808-89e6-959c1f0fa615" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">support observations and data collection of fire weather and fire environment variables, including vegetation state and profiles of wildfire smoke, winds, temperature, and humidity, for development of the model and systems under paragraph (1); and</text></subparagraph><subparagraph id="id89854f7d-7ef1-40b0-93f3-1799ee36b64b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">support forecasts and research that mitigate the impacts of wildfires on human life, health, and the economy; </text></subparagraph></paragraph><paragraph id="idf8fc031b-52b8-45e7-8a9f-7402c91a0497" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">development and implementation of advanced and user-oriented impact-based decision tools, science, and technologies that—</text><subparagraph id="id8564b99d-dd11-4496-8afd-bf848969a718" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">ensure real-time and retrospective data, products, and services are findable, accessible, interoperable, usable, inform further research, and are analysis- and decision-ready;</text></subparagraph><subparagraph id="id2a9212fb-97fd-45b6-b81b-19686af23659" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">provide targeted information throughout the fire lifecycle including pre-ignition, detection, forecasting, post-fire, and monitoring phases; and</text></subparagraph><subparagraph id="id273def47-e3ee-48ee-a924-2cbeddfd7606" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">support early assessment of post-fire hazards, such as air quality, debris flows, mudslides, and flooding; and</text></subparagraph></paragraph><paragraph id="id3c7a8dfce848484e8508cc2b528bb1a3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">ensuring the parity of access to and support from the tools, science, and technologies developed under this subsection for remote, isolated, and rural communities. </text></paragraph></subsection><subsection id="id6b019c91-6933-4156-89f9-6d4c871c9190" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Program activities</header><text display-inline="yes-display-inline">In developing and implementing the program established under subsection (a), the Under Secretary may—</text><paragraph id="idedb00b50-c1c3-419e-bb61-b9eda0594bed" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">conduct relevant physical and social science research activities in support of the functions described in subsection (b) and the priorities described in subsection (c);</text></paragraph><paragraph id="ida5258fd4-799f-42c0-a7df-b36a6eedb6d1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">conduct relevant activities, in coordination with Federal land management agencies and Federal science agencies, to assess fuel characteristics, including moisture, loading, and other parameters used to determine fire risk levels and outlooks;</text></paragraph><paragraph id="id3b80328f-d0a3-4a3e-8146-419514111940" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">support and conduct research that assesses impacts to marine, riverine, watershed, and other relevant ecosystems, which may include forest and rangeland ecosystems, resulting from activities associated with mitigation of and response to wildfires;</text></paragraph><paragraph id="id127ef24b-9764-4a0d-873c-7b0fff814fca" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">support and conduct attribution science research relating to wildfires, fire weather, fire risk, wildfire smoke, and associated conditions, risks, and impacts;</text></paragraph><paragraph id="id9218b81c-f8fe-49fe-825a-a715991b2cd6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">develop wildfire smoke and air quality forecasts, forecast guidance, and prescribed burn weather forecasts, and conduct research on the impact of such forecasts on response behavior that minimizes health-related impacts from wildfire smoke exposure;</text></paragraph><paragraph id="ida96e98a3-5514-40b6-b2ff-f90378aa93da" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">use, in coordination with Federal land management agencies, wildland fuels information and fire resource intelligence to inform fire environment impact-based decision support services and products for safety;</text></paragraph><paragraph id="ide23fd7e8-9dff-4c04-b264-d2ad55e9dfe7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">work with Federal agencies to provide data, tools, and services to support the implementation of mitigation measures by such agencies;</text></paragraph><paragraph id="idc4b019c6-9cc1-43a2-ab83-83b320b995c3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text display-inline="yes-display-inline">provide training and support to ensure effective media utilization of impact-based decision support services and products to the public regarding actions needing to be taken;</text></paragraph><paragraph id="id83beb47e-b678-48d1-aba5-debae41ca8b9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(9)</enum><text display-inline="yes-display-inline">provide comprehensive training to ensure staff of the program established under subsection (a) is properly equipped to deliver the impact-based decision support services and products described in paragraphs (1) through (6); and </text></paragraph><paragraph id="id2beb8c51-b27d-4f23-8623-8c3e6f4f9a74" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(10)</enum><text display-inline="yes-display-inline">acquire, through contracted purchase, private sector-produced observational data to fill identified gaps, as needed.</text></paragraph></subsection><subsection id="id1447c080acf240468a37370373020321" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Parity for remote, isolated, and rural communities</header><text display-inline="yes-display-inline">In developing and implementing the program established under subsection (a), the Under Secretary shall ensure parity of coverage and programmatic activity for remote, isolated, and rural communities, including communities where the public acts as the first responder to wildfire. </text></subsection><subsection id="id955739a3-8ee4-4225-9c94-46583c12c513" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Collaboration</header><text display-inline="yes-display-inline">The Under Secretary shall, as the Under Secretary considers appropriate, collaborate with partners in the weather and climate enterprises, academic institutions, States, Indian tribes, Tribal organizations, Native Hawaiian organizations, local partners, and Federal agencies in the development and implementation of the program established under subsection (a). </text></subsection><subsection id="id9f5215bc-14a9-4a8f-b242-44683f0299fa" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">Agreements</header><text display-inline="yes-display-inline">In carrying out the activities under this Act and the amendments made by this Act, the Under Secretary may provide support to non-Federal entities by making funds and resources available through—</text><paragraph id="id744dea1e-c8a8-4f26-872f-89ee35022605" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">competitive grants;</text></paragraph><paragraph id="id6ee76e9f-8cdf-442c-84e6-ed8bc422aa7d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">contracts under the mobility program under subchapter VI of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code (commonly referred to as the <quote>Intergovernmental Personnel Act Mobility Program</quote>);</text></paragraph><paragraph id="id6c527ce8-d8cf-4716-ab26-091c8c7252a7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">cooperative agreements; and</text></paragraph><paragraph id="ide7dc6be4-e888-45e1-8b30-1d71ddc44a36" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">co-location agreements as described in section 502 of the National Oceanic and Atmospheric Administration Commissioned Officer Corps Amendments Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/33/851">33 U.S.C. 851</external-xref> note prec.). </text></paragraph></subsection><subsection id="id89cf700d-0d72-4388-a47a-f7bb1e3b1e40" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(h)</enum><header display-inline="yes-display-inline">Program administration plan</header><paragraph id="id5569876e-5e5e-4b34-86d6-7c7ff2025cb0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Under Secretary shall submit to the appropriate committees of Congress a plan that details how the program established under subsection (a) will be administered and governed within the Administration.</text></paragraph><paragraph id="id6c29ecba-06b3-4c0f-9588-c64a390d3438" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The plan required by paragraph (1) should include a description of—</text><subparagraph id="id0d7c172b-c387-4d14-8e72-241427a342fc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">how the functions described in subsection (b), the priorities described in subsection (c), and the activities described in subsection (d) will be distributed among the line offices of the Administration; and</text></subparagraph><subparagraph id="idba923e22-c4e3-4c37-b4b8-6abf081c40d0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the mechanisms in place to ensure seamless coordination among those offices.</text></subparagraph></paragraph></subsection></section><section id="ida7c66e65-33d2-44a1-9aba-d561c9a491d9" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Fire weather testbed</header><subsection id="ide7c09be6-a7b2-46c5-ba4b-2ba9247c6915" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment of fire weather testbed</header><text display-inline="yes-display-inline">The Under Secretary shall establish a fire weather testbed that enables engagement across the Federal Government, State and local governments, academia, private and federally funded research laboratories, the private sector, and end-users in order to evaluate the accuracy and usability of technology, models, fire weather products and services, and other research to accelerate the implementation, transition to operations, and use of new capabilities by the Administration, Federal and land management agencies, and other relevant stakeholders.</text></subsection><subsection id="ide0c58cb7-3f2a-4a78-9410-f01c19795101" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Uncrewed systems</header><paragraph id="id982a6498-0850-457c-b0cd-5e412fa776f0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Under Secretary shall—</text><subparagraph id="idc5b0e0d4-d888-4b37-a835-c2cf2a6bfe6f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">establish and carry out a research and development program to support the application of uncrewed systems technologies to improve data collection in support of modeling, observations, predictions, forecasts, and impact-based decision support services, and for other purposes of the Administration;</text></subparagraph><subparagraph id="id7fd08dd8-f5dd-45f1-8f97-eb524e37828e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">transition uncrewed systems technologies from research to operations as the Under Secretary considers appropriate; and</text></subparagraph><subparagraph id="id8b5caeb8-1c2a-4905-a456-51163245605d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">coordinate with other Federal agencies that may be developing uncrewed systems and related technologies to meet the challenges of wildland fire management.</text></subparagraph></paragraph><paragraph id="id89fc57c2-adf3-4bda-a91a-fdfd1b79eb7f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Pilots required</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Under Secretary shall conduct pilots of uncrewed systems for fire weather and fire environment observations, including—</text><subparagraph id="id437761db-6376-4814-9dfe-49097690506e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">testing of uncrewed systems in approximations of real-world scenarios;</text></subparagraph><subparagraph id="ide3e87c66-fd08-44da-935e-e116e7107ec5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">assessment of the utility of meteorological data collected from fire response and assessment aircraft;</text></subparagraph><subparagraph id="id0dc99722-0b4d-4ade-93a6-42f85a807a1e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">input of the collected data into appropriate models to predict fire behavior, including coupled atmosphere and fire models; and</text></subparagraph><subparagraph id="id5e403742-4128-4f93-a82b-bfdaa084bfe8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">collection of best management practices for deployment of uncrewed systems and other remote data technology, including for communication and coordination between the stakeholders described in subsection (a).</text></subparagraph></paragraph><paragraph id="idced182c4-9065-4214-8534-83e5d713d249" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Savings clause</header><subparagraph id="id4697370c-c707-4596-9af5-1598713d9bfe" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In carrying out activities under this subsection, the Under Secretary shall ensure that any testing or deployment of uncrewed systems follow procedures, restrictions, and protocols established by the heads of the Federal agencies with statutory or regulatory jurisdiction over any airspace in which wildfire response activities are conducted during an active wildfire event.</text></subparagraph><subparagraph id="ida8ae89ff-44b6-46c2-9b82-6b564d1d896d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Consultation and coordination</header><text display-inline="yes-display-inline">The Under Secretary shall consult and coordinate with relevant Federal land management agencies, Federal science agencies, and the Federal Aviation Administration to develop processes for the appropriate deployment of the systems described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="id89b8046e-bf1c-44bd-a914-a879e09289a6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Additional pilot projects</header><text display-inline="yes-display-inline">The Under Secretary shall establish additional pilot projects relating to the fire weather testbed that may include the following elements:</text><paragraph id="idd0d84822-8509-4e80-880d-d1810c8ca601" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Advanced products to detect fire from satellites.</text></paragraph><paragraph id="id64544293-c21c-44b7-9255-4d38178f8ed0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">Procurement and use of commercial data.</text></paragraph><paragraph id="id7d83240c-9c3e-46bc-894b-9ca64bece08b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">Investigation and evaluation of information needs of users and decision makers. </text></paragraph></subsection><subsection id="idcb4c358b-bd92-4873-80b8-3368cbbaadd2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Section 108(a)(5) of the National Oceanic and Atmospheric Administration Authorization Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/15/8520">15 U.S.C. 8520(a)(5)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idb6836170-17ba-4e15-825e-913289a15a5e" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (C), by adding <quote>and</quote> at the end; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idea3411ca-8643-48aa-8e18-d401ddfeffb9" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (D)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id60bfd573-e814-4e20-b859-b4da01caf1ab" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>and</quote>; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1350d8c5-a6fb-42ce-9e51-d3f8c6eb177a" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (iii), by adding <quote>and</quote> at the end; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7719f538-58f5-4f65-b029-a1b1821c53c6" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idefee437b-615b-4d56-aefb-f35ffc58812b" changed="not-changed"><clause id="idd597ae2b-9d70-45b6-862e-aa9be6973e23" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">a description of the research that has been transitioned into operations, including research at the fire weather testbed established under section 4(a) of the <short-title>Fire Ready Nation Act of 2025</short-title>;</text></clause><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="idfeb0d60c-651f-487b-ad5f-f8389b4d4a0b" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Data management and technology modernization</header><subsection commented="no" display-inline="no-display-inline" id="id1bac4546-3692-4f8c-a43b-431d235918b3" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Data availability and management</header><text display-inline="yes-display-inline">Section 301 of the Weather Research and Forecasting Innovation Act of 2017 (<external-xref legal-doc="usc" parsable-cite="usc/15/8531">15 U.S.C. 8531</external-xref>) is amended—</text><paragraph id="ideb093bc3-5578-4b5a-8893-8fb9af31ba6d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (f) and (g) as subsections (g) and (h), respectively; and</text></paragraph><paragraph id="id4c349ff1-2587-45cf-b4e2-e7218d512324" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (e) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id26983a6a-4299-4d65-8532-020902e6afac" changed="not-changed"><subsection id="id8067f367-5319-4bb0-8e07-2e9123f3294c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Data availability and management</header><paragraph id="id730187ca-9039-4ade-9ef2-0bd466452bdd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Under Secretary shall—</text><subparagraph id="id3b2bd246-97bd-4d4b-801d-73ca8e716aa0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">make data and metadata generated or collected by the National Oceanic and Atmospheric Administration that the Under Secretary has the legal right to redistribute fully and openly available, in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, and the Foundations for Evidence-Based Policymaking Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/435">Public Law 115–435</external-xref>; 132 Stat. 5529) and the amendments made by that Act, and preserve and curate such data and metadata, in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/31">chapter 31</external-xref> of title 44, United States Code (commonly known as the <quote>Federal Records Act of 1950</quote>), in order to maximize use of such data and metadata; and</text></subparagraph><subparagraph id="id37f7edab-8d21-4fb6-afa3-8cc93bb32cde" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">manage and steward the access, archival, and retrieval activities for the data and metadata described in subparagraph (A) by—</text><clause id="ide1cd3740-0ddd-4608-975e-f216aba70c21" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">using—</text><subclause id="idc54f5c41-c673-4771-a216-e1f36705d02e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">enterprise-wide infrastructure, emerging technologies, commercial partnerships, and the skilled workforce needed to provide appropriate data management from collection to broad access; and</text></subclause><subclause id="id39cd6128-c772-4fb0-bc76-f0451dd2a79c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">associated information services; and</text></subclause></clause><clause id="id5330c1cd-43aa-46fc-b94a-a623ebcdf63a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">pursuing the maximum interoperability of data and information by—</text><subclause id="idf52e5536-e9c4-4498-9345-95ee538c62ef" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">leveraging data, information, knowledge, and tools from across the Federal Government to support equitable access, cross-sectoral collaboration and innovation, and local planning and decision-making; and</text></subclause><subclause id="idd00d7f20-4cb7-426f-b7ac-41297267c7da" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">developing standards and practices for the adoption and citation of digital object identifiers for datasets, models, and analytical tools.</text></subclause></clause></subparagraph></paragraph><paragraph id="id0a8e23c2-bca5-4923-9e44-d70558407c8a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Collaboration</header><text display-inline="yes-display-inline">In carrying out this subsection, the Under Secretary shall collaborate with such Federal partners and stakeholders as the Under Secretary considers relevant—</text><subparagraph id="idd6806677-2cd0-4c7e-a1e4-1f2acc342b39" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to develop standards to pursue maximum interoperability of data, information, knowledge, and tools across the Federal Government, convert historical records into common digital formats, and improve access and usability of data by partners and stakeholders;</text></subparagraph><subparagraph id="id69ebc35b-2b60-4ea4-a797-af4cef72d8ae" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to identify and solicit relevant data from Federal and international partners and other relevant stakeholders, as the Under Secretary considers appropriate; and</text></subparagraph><subparagraph id="id1a0d05e6-6dba-437c-8a78-acd4f676a10c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">to develop standards and practices for the adoption and citation of digital object identifiers for datasets, models, and analytical tools.</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idd1875c15-87f7-4c2b-8f5c-5420d4ceef8b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Wildfire technology modernization</header><text display-inline="yes-display-inline">Section 1114 of the John D. Dingell, Jr. Conservation, Management, and Recreation Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1748b-1">43 U.S.C. 1748b–1</external-xref>) is amended—</text><paragraph id="id11bf4ec5-44b1-49de-baa6-7c6bea51571a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(3), by inserting <quote>the National Oceanic and Atmospheric Administration,</quote> after <quote>Federal Aviation Administration,</quote>;</text></paragraph><paragraph id="id2d4d8468-8919-4dcd-aa02-e1379e5b0d76" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (e)(2)—</text><subparagraph id="id646e20e2-6428-42c9-b636-0d1c3f03d6ff" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (B) as subparagraph (C); and</text></subparagraph><subparagraph id="id9fb52813-b186-49c7-9c32-42da69e891ac" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id45c5efc6-a96e-46eb-9844-a62729554ea8" changed="not-changed"><subparagraph id="id3a896e2a-16e7-40ec-9f58-4b6ae70846c9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Consultation</header><clause id="idb8460af7-cae0-41b9-863d-701aae8a8673" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In carrying out subparagraph (A), the Secretaries shall consult with the Under Secretary of Commerce for Oceans and Atmosphere regarding any development of impact-based decision support services that relate to wildfire-related activities of the National Oceanic and Atmospheric Administration.</text></clause><clause id="id44ad47a7-15c7-48ad-b845-b32b52e35b30" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><header display-inline="yes-display-inline">Definition of impact-based decision support services</header><text display-inline="yes-display-inline">In this subparagraph, the term <term>impact-based decision support services</term> means scientific advice and interpretative services the National Oceanic and Atmospheric Administration provides to help core partners, such as emergency personnel and public safety officials, make decisions when the information impacts the lives and livelihoods of the people (f)—</text><subparagraph id="idcf730a08-942b-4034-8479-22864e883c46" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and moving such subparagraphs, as so redesignated, 2 ems to the prediction, forecasting, and modeling.</text></paragraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id1ea0d44a-dfc1-4781-9aa6-be12065f25d3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Digital presence</header><paragraph id="idb0af68d1-430c-4c01-94f1-fc935cf73945" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Under Secretary shall develop and maintain a comprehensive, centralized, and publicly accessible digital presence designed to promote findability, accessibility, interoperability, usability, and utility of the services, tools, data, and information produced by the program established under section 3(a).</text></paragraph><paragraph id="idc6477003-e394-4f09-9301-6c6c9f50bb0f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Digital platform and tools</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Under Secretary shall seek to ensure the digital platform and tools of the Administration integrate geospatial data, decision support tools, training, and best practices to provide real-time fire weather forecasts and address fire-related issues and needs.</text></paragraph></subsection><subsection id="id35facc7b-a379-40e6-a183-6070d4d74c40" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">High-Performance computing</header><paragraph id="idfb276b62-15ba-4d23-ae65-b29b1ec78050" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Under Secretary shall seek to acquire sufficient high-performance computing resources and capacity for research, operations, and data storage in support of the program established under section 3(a).</text></paragraph><paragraph id="ide841bf8d-7708-4a83-9b48-aac38f6388bc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">In acquiring high-performance computing capacity under paragraph (1), the Under Secretary shall consider requirements needed for—</text><subparagraph id="id9e959c64-647e-4dbb-8cad-3dc1c8ca0244" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">conducting research, development, and testbed experiments;</text></subparagraph><subparagraph id="idcd2985b0-aeb3-4b21-9d8e-49c49ac5d33d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the transition of research and testbed developments into operations;</text></subparagraph><subparagraph id="id0dd7def7-514f-4c0a-95ca-94f58b786bd8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">sustaining capabilities in operations;</text></subparagraph><subparagraph id="idd7554c91-1042-4eaa-b58b-e58d33566bc1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">capabilities existing in other Federal agencies and the commercial sector; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7a568237-9188-4311-a27d-39f3fd36425f" changed="not-changed"><enum>(E)</enum><text display-inline="yes-display-inline">skilled workforce development. </text></subparagraph></paragraph></subsection></section><section id="id1d619732-c60e-4093-810f-7dadea54d774" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Surveys and assessments</header><subsection id="id49cfb511-ed32-48d5-9e7c-2de4a6020141" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Post-Fire weather surveys and assessments </header><paragraph commented="no" display-inline="no-display-inline" id="idc8b540d0-ad29-4ef8-b622-b0bff89de193" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Annual post-fire-weather-season survey and assessment</header><subparagraph id="id485ddeb1-49c2-4f64-95dd-aae1bb03e17b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">During the second winter following the date of the enactment of this Act, and each year thereafter, the Under Secretary shall conduct a post-fire-weather-season survey and assessment.</text></subparagraph><subparagraph id="id39ecbb3c-3f44-4bfa-b813-9d5213485471" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">After conducting a post-fire-weather-season survey and assessment under subparagraph (A), the Under Secretary shall—</text><clause id="id89465aee-8a22-4565-9a05-83e47c00e4e7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">investigate any gaps in weather data collected during the assessment;</text></clause><clause id="idcff7c5f2-b34d-4bde-959c-ddbbc0418d17" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">identify and implement strategies and procedures to improve program services and information dissemination;</text></clause><clause id="idc32b3c44-50e6-4c65-b2f4-37b8147b5831" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">update systems, processes, strategies, and procedures to enhance the efficiency and reliability of weather data obtained from the assessment;</text></clause><clause id="id53966c10-f7fb-4cd7-9262-c6f1a1f023ac" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">evaluate the accuracy and efficacy of physical fire weather forecasting information for each incident included in the survey and assessment; and</text></clause><clause id="ida5363d71-090a-49da-bc76-135be5d80705" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">assess and refine performance measures, as needed.</text></clause></subparagraph></paragraph><paragraph id="id728463a4-87ac-467c-b170-491804bf0ff6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Surveys and assessments following individual wildfire events</header><text display-inline="yes-display-inline">The Under Secretary may conduct surveys and assessments following individual wildfire events as the Under Secretary determines necessary.</text></paragraph><paragraph id="id7b39d04c-c536-40fd-8e16-b4619f0a0c4a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Goal</header><text display-inline="yes-display-inline">In carrying out activities under this subsection, the Under Secretary shall seek to increase the number of post-wildfire community impact studies, including by surveying individual and collective responses and incorporating other applicable topics of social science research.</text></paragraph><paragraph id="ide6663554b011468b96ef764117aef368" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Annual briefing</header><text display-inline="yes-display-inline">Not less frequently than once each year, the Under Secretary shall join other relevant agencies to provide a briefing to the appropriate committees of Congress that provides—</text><subparagraph id="idf8c899f6-b965-4336-a986-b06dc1cace88" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">an overview of the fire season;</text></subparagraph><subparagraph id="idd09645868af540e8962c2e3a57cb7044" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">an outlook for the fire season; and</text></subparagraph><subparagraph id="id78bcf8abdbef448d8cd47eef44b9f855" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">fire weather forecasts.</text></subparagraph></paragraph><paragraph id="id65016749-cf69-4f2a-afbe-ae4c38497f94" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Coordination</header><text display-inline="yes-display-inline">In conducting any survey or assessment under this subsection, the Under Secretary shall coordinate with Federal, State, and local partners, Indian tribes, Native Hawaiian organizations, private entities, and such institutions of higher education as the Under Secretary considers relevant in order to—</text><subparagraph id="id0f1fa4e4-255c-438c-9acf-62fd5b343f7a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">improve operations and collaboration; and</text></subparagraph><subparagraph id="ided0b5feb-377c-49cb-9f6f-83851d452921" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">optimize data collection, sharing, integration, assimilation, and dissemination.</text></subparagraph></paragraph><paragraph id="ided90c159-820e-410f-a2ae-998671a0e010" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Data availability</header><text display-inline="yes-display-inline">The Under Secretary shall make the data and findings obtained from each assessment conducted under this subsection available to the public in an accessible digital format as soon as practicable after conducting the assessment.</text></paragraph><paragraph id="id9d459fd7-426e-4e9e-a76d-3a9d8042077a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Service improvements</header><text display-inline="yes-display-inline">The Under Secretary shall make best efforts to incorporate the results and recommendations of each assessment conducted under this subsection into the research and development plan and operations of the Administration.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idddeba7f0-8a08-4d9b-971b-6324bffc2641" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Joint Assessment and plan for automated surface observing system</header><paragraph id="id2c98dedb-86c2-4c1b-92fb-1609ecae0858" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Under Secretary, in collaboration with the Administrator of the Federal Aviation Administration and the Secretary of Defense, shall—</text><subparagraph id="id74145ff9-1ecc-46ba-a7a8-3e669623175f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">conduct an assessment of resources, personnel, procedures, and activities necessary to maximize the functionality and utility of the automated surface observing system of the United States that identifies—</text><clause id="id75c69dcd-a2a9-49b9-a693-7d114cdbe8d8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">key system upgrades needed to improve observation quality and utility for weather forecasting, aviation safety, and other users;</text></clause><clause id="ida856690d-6b58-4feb-b4f8-39ac0ff4968b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">improvements needed in observations within the planetary boundary layer, including mixing height;</text></clause><clause id="id1f4abab1-1cfe-4290-8836-419287054f43" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">improvements needed in public accessibility of observational data;</text></clause><clause id="idf3683bb0-7813-4e6d-972e-9a9748da30e0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">improvements needed to reduce latency in reporting of observational data;</text></clause><clause id="id8ecb6218-f987-42d1-b2ee-385578d1ac60" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">relevant data to be collected for the production of forecasts or forecast guidance relating to atmospheric composition, including particulate and air quality data related to wildfires, and aviation safety;</text></clause><clause id="id65000617-81c3-4807-8aa0-368888d26140" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><text display-inline="yes-display-inline">areas of concern regarding operational continuity and reliability of the system, which may include needs for on-night staff, particularly in remote and rural areas and areas where system failure would have the greatest negative impact to the community;</text></clause><clause id="id59cce28b-33cd-434b-89b1-a65fee00174a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(vii)</enum><text display-inline="yes-display-inline">stewardship, data handling, data distribution, and product generation needs arising from upgrading and changing the automated surface observation systems;</text></clause><clause id="idfe09971a-5f34-4fdd-b0e2-b94ed04a3e1d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(viii)</enum><text display-inline="yes-display-inline">possible solutions for areas of concern identified under clause (vi), including with respect to the potential use of backup systems, power and communication system reliability, staffing needs and personnel location, and the acquisition of critical component backups and proper storage location to ensure rapid system repair necessary to ensure system operational continuity; and</text></clause><clause id="id2778e7b3-dd44-4497-8aab-7adc7b525007" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ix)</enum><text display-inline="yes-display-inline">research, development, and transition to operations needed to develop advanced data collection, quality control, and distribution so that the data are provided to models, users, and decision support systems in a timely manner; and</text></clause></subparagraph><subparagraph id="idcd4f7fd6-68f1-47aa-a19e-d6fdd566c269" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">develop and implement a plan that addresses the findings of the assessment conducted under subparagraph (A), including by seeking and allocating resources necessary to ensure that system upgrades are standardized across the Administration, the Federal Aviation Administration, and the Department of Defense to the extent practicable.</text></subparagraph></paragraph><paragraph id="idb35e1ecc-8295-46fb-8061-3b712863f1a6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Standardization</header><text display-inline="yes-display-inline">Any system standardization implemented under paragraph (1)(B) shall not impede activities to upgrade or improve individual units of the system.</text></paragraph><paragraph id="id63a608eed25b4321bc27aa77dd34384b" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Remote automatic weather station coordination</header><text display-inline="yes-display-inline">The Under Secretary, in collaboration with relevant Federal agencies and the National Interagency Coordination Center, shall assess and develop cooperative agreements to improve coordination, interoperability standards, operations, and placement of remote automatic weather stations for the purpose of improving utility and coverage of remote automatic weather stations, automated surface observation systems, wildfire smoke monitoring platforms, and other similar stations and systems for weather and climate operations.</text></paragraph><paragraph id="id0c2e4585-f085-43e3-8daa-0d50624ce3fa" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Report to Congress</header><subparagraph id="idf5d08464-b11d-417e-8449-cfd999e2e279" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this Act, the Under Secretary, in collaboration with the Administrator of the Federal Aviation Administration and the Secretary of Defense, shall submit to the appropriate committees of Congress a report that—</text><clause id="id0c10730d-ae73-423f-9df4-84b8933efe8e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">details the findings of the assessment required by subparagraph (A) of paragraph (1); and</text></clause><clause id="idae853dd7-b60f-4291-9229-5be66e66c5a9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the plan required by subparagraph (B) of such paragraph.</text></clause></subparagraph><subparagraph id="iddad65dda-20c7-4802-851f-b662eb3797ba" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The report required by subparagraph (A) shall include a detailed assessment of appropriations required—</text><clause id="id83111231-9049-48cc-9905-dd1c92cb01e6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">to address the findings of the assessment required by subparagraph (A) of paragraph (1); and</text></clause><clause id="id4ee18d8d-420e-433e-bae6-21d56662817b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">to implement the plan required by subparagraph (B) of such paragraph. </text></clause></subparagraph></paragraph></subsection></section><section id="id40325fbc-7aae-46fa-b742-c8d8ad237409" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Incident Meteorologist Service</header><subsection id="id4d6002b2-9c1b-43e8-8730-18b2b32f4cc9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Under Secretary shall establish and maintain an Incident Meteorologist Service within the National Weather Service (in this section referred to as the <quote>Service</quote>).</text></subsection><subsection id="id6d0f22fe-8b68-4874-a8c9-75d2553ab3e1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Inclusion of existing incident meteorologists</header><text display-inline="yes-display-inline">The Service shall include—</text><paragraph id="idd686e18e-693e-4f35-bcc7-586bfa1d56e5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the incident meteorologists of the Administration as of the date of the enactment of this Act; and</text></paragraph><paragraph id="idb4e27842-8ca0-42c8-a69f-8c98320873c2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">such incident meteorologists of the Administration as may be appointed after such date.</text></paragraph></subsection><subsection id="idf75400ba-2996-4b76-a10e-66862de10fb3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Functions</header><text display-inline="yes-display-inline">The Service shall provide—</text><paragraph id="ida98025ec-1e61-4b98-8e53-e9290ea0c3ed" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">on-site impact-based decision support services to Federal, State, and local government emergency response agencies, Indian tribes, and Native Hawaiian organizations preceding, during, and following significant weather-related events, such as wildland fires, that threaten human life, property, or the economy; and</text></paragraph><paragraph id="ida2027e9a-a106-4c1d-af78-43bf6e6785bc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">support to Federal, State, and local government decision makers, partners, and stakeholders, Indian tribes, Tribal organizations, and Native Hawaiian organizations for seasonal planning and pre-fire mitigation activities. </text></paragraph></subsection><subsection id="id821715e1-eca9-4b45-be33-e1f61a9016d9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Deployment</header><text display-inline="yes-display-inline">The Service shall be deployed—</text><paragraph id="id6821530a-28c1-4179-805e-94a6cf4e1aa7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">as determined by the Under Secretary; or</text></paragraph><paragraph id="id9a359cf1-62ec-48cf-8a2c-1ca106dbd6ff" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">at the request of the head of another Federal agency and with the approval of the Under Secretary.</text></paragraph></subsection><subsection id="id089df9a8-0f9c-4fb3-8252-69aa7dd559fa" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Staffing and resources</header><text display-inline="yes-display-inline">In establishing and maintaining the Service, the Under Secretary shall identify, acquire, and maintain adequate levels of staffing and resources to meet user needs.</text></subsection><subsection id="id10dcee2f-4e94-456a-a335-0619a364e445" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Support for incident meteorologists</header><text display-inline="yes-display-inline">The Under Secretary shall provide resources, access to real-time fire weather forecasts, training, administrative and logistical support, and access to professional counseling or other forms of support as the Under Secretary considers appropriate for the betterment of the emotional and mental health and well-being of incident meteorologists and other employees of the Administration so long as the need for such resources, training, access, or support is due to the response of such employees to high-impact and extreme fire weather events.</text></subsection></section><section id="id1f6542e6-c553-4d0f-a1c4-a815dd84a553" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Emergency response activities</header><subsection id="idcc5371e8-d65e-4c43-9ab8-5f90a236a8b8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id65f67674-f8e7-4043-a86f-2a4321033c85" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Basic pay</header><text display-inline="yes-display-inline">The term <term>basic pay</term> includes any applicable locality-based comparability payment under section 5304 of title 5, United States Code, any applicable special rate supplement under section 5305 of such title, or any equivalent payment under a similar provision of law.</text></paragraph><paragraph id="id373e01a5-5641-4295-8fe7-35c0386bd84a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Covered employee</header><text display-inline="yes-display-inline">The term <term>covered employee</term> means an employee of the Department of Commerce, the Department of Agriculture, or the Department of the Interior. </text></paragraph><paragraph id="id7705aae6-8270-41b4-a3fa-2bcc0ac7693b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Covered services</header><text display-inline="yes-display-inline">The term <term>covered services</term> means services that are performed by a covered employee while serving—</text><subparagraph id="id18905f9d-bfe9-4a00-afae-bd8cde4174e1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">as a wildland firefighter or a fire management response official, including a regional fire director, a deputy regional fire director, and a fire management officer;</text></subparagraph><subparagraph id="id44f00aa1-fdef-453a-9b15-81907aff09e8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">as an incident meteorologist accompanying a wildland firefighter crew; or</text></subparagraph><subparagraph id="id5e4c5fcb-6d59-4710-9e64-330a6093381e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">on an incident management team, at the National Interagency Fire Center, at a Geographic Area Coordinating Center, or at an operations center.</text></subparagraph></paragraph><paragraph id="idcc37e40e-ec23-42d1-97e9-03f55d171288" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Premium pay</header><text display-inline="yes-display-inline">The term <term>premium pay</term> means premium pay paid under a provision of law described in the matter preceding paragraph (1) of section 5547(a) of title 5, United States Code.</text></paragraph><paragraph id="idecc86e48-7a09-4911-a04a-6381cc4e00da" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Relevant congressional committees</header><text display-inline="yes-display-inline">The term <term>relevant congressional committees</term> means—</text><subparagraph id="id73f535cb-14c1-437b-ba5b-9fb844e4b1e9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Commerce, Science, and Transportation of the Senate;</text></subparagraph><subparagraph id="id510e45a0-f815-4c55-af4c-913f5ddc6cf4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and Governmental Affairs of the Senate; </text></subparagraph><subparagraph id="idc89e4ad5-9b75-462c-9763-5a31f2795baa" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the Committee on Agriculture, Nutrition, and Forestry of the Appropriations of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id4fe0c049-e16d-4a25-a8d0-b11e390e851a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Secretary concerned</header><text display-inline="yes-display-inline">The term <term>Secretary concerned</term> means—</text><subparagraph id="id6fc5e03d-f838-4a29-b0f5-d8a362a86712" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of Commerce, with respect to an employee of the Department of Commerce;</text></subparagraph><subparagraph id="id1041e57a-27fd-498b-ae03-fb561c18ebeb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of Agriculture, with respect to an employee of the Interior.</text></subparagraph></paragraph></subsection><subsection id="id6a34ff98-3f26-4c05-8561-ea67348f63c4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Waiver</header><paragraph id="idac1c1ef3-9027-4eab-8b2c-4936cb5897e2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any premium pay received by a covered employee for covered services shall be disregarded in calculating the aggregate of the basic pay and premium pay for the covered employee for purposes of applying the limitation on premium pay under section 5547(a) of title 5, United States Code.</text></paragraph><paragraph id="id73b590dc-54e2-485b-a365-cab8f4cee1e2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Calculation of aggregate pay</header><text display-inline="yes-display-inline">Any pay that is disregarded under paragraph (1) shall be disregarded in calculating the aggregate pay of the applicable covered employee for purposes of applying the limitation under section 5307 of title 5, United States Code, during calendar year 2025.</text></paragraph><paragraph id="id24cd67b1-c0a7-4dbd-9d18-f89485a0da42" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">A covered employee may not be paid premium pay under this subsection if, or to the extent that, the aggregate of the basic pay and premium pay (including premium pay for covered services) of the covered employee for a calendar year would exceed the rate of basic pay payable for a position at level II of the Executive Schedule under section 5313 of title 5, United States Code, as in effect at the end of that calendar year.</text></paragraph><paragraph id="ide0ab8699-52cf-4b54-9d29-891f9237fc2d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Treatment of additional premium pay</header><text display-inline="yes-display-inline">If the application of this subsection results in the payment of additional premium pay to a covered employee of a type that is normally creditable as basic pay for retirement or any other purpose, that additional premium pay shall not be—</text><subparagraph id="id583707bf-c96a-4b04-bc53-19edabbcea74" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">considered to be basic pay of the covered employee for any purpose; or</text></subparagraph><subparagraph id="id032256d0-9373-40da-be6c-fe96c7f1e45e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">used in computing a lump-sum payment to the covered employee for accumulated and accrued annual leave under section 5551 or 5552 of title 5, United States Code.</text></subparagraph></paragraph><paragraph id="id5ddf6b70-2be3-4546-9e77-3e4bfb79fd57" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Effective period</header><text display-inline="yes-display-inline">This subsection shall be in effect during calendar year 2025 and apply to premium pay payable during that year.</text></paragraph></subsection><subsection id="idad77fde7-cf10-4ab3-99bf-3af88320ec9a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Amendment</header><text display-inline="yes-display-inline">Section 5542(a)(5) of title 5, United States Code, is amended by inserting <quote>, the Department of Commerce,</quote> after <quote>Interior</quote>. </text></subsection><subsection id="id19ef6382-38c4-4dd4-bdeb-8f92db7c8827" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Plan To address needs</header><paragraph id="id730bda3d-040d-482e-9a1a-04968591f989" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Development and implementation</header><text display-inline="yes-display-inline">Not later than March 30, 2026, the Secretaries referred to in subsection (a)(6), in consultation with the Director of the Office of Management and Budget and the Director of the Office of Personnel Management, shall jointly develop and implement a plan that addresses the needs of the Department of Commerce, the Department of Agriculture, and the Department of the Interior, as applicable, to hire, appoint, promote, or train additional covered employees who carry out covered services such that sufficient covered employees are available throughout each fiscal year, beginning in fiscal year 2026, without the need for waivers of premium pay limitations.</text></paragraph><paragraph id="idec1fe1a3-3a50-41d9-9be4-0a77ee264a21" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Submittal</header><text display-inline="yes-display-inline">Not later than 30 days before the date on which the Secretaries implement the plan developed under paragraph (1), the Secretaries shall submit the plan to the relevant congressional committees.</text></paragraph><paragraph id="ida5f72a84-f2bb-497b-88ee-5b16867e36fe" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">The plan developed under paragraph (1) shall not be contingent on any Secretary receiving amounts appropriated for fiscal years beginning in fiscal year 2026 in amounts greater than amounts appropriated for fiscal year 2024.</text></paragraph></subsection><subsection id="id99416f44-0370-4cea-be8e-3590c3581bd7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Policies and procedures for health, safety, and well-Being</header><text display-inline="yes-display-inline">The Secretary concerned shall maintain policies and procedures to promote the health, safety, and well-being of covered employees.</text></subsection></section><section id="idfe870090-0d7b-4f03-9772-f8baa26e9821" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Submissions to Congress regarding the fire weather services program, incident meteorologist workforce needs, and National Weather Service workforce support</header><subsection id="id1178893d-c84f-42e7-a4b8-86325c025d10" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Under Secretary shall submit to the appropriate committees of Congress—</text><paragraph id="ide379ff43-53e9-47b3-8e7b-0872825aa9e0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the plan described in subsection (b);</text></paragraph><paragraph id="idadc8ddcb-1aca-41ab-8382-6371bad746a1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the assessment described in subsection (c); and</text></paragraph><paragraph id="id85443f31-206d-4f87-88c2-606518cec6bc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">the assessment described in subsection (d).</text></paragraph></subsection><subsection id="idb1a3e62d-260a-403f-b752-a6da303f7aaf" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Fire weather services program plan</header><paragraph id="id5d93e93d-c604-45a3-be90-27f62d679056" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The plan submitted under subsection (a)(1) shall detail—</text><subparagraph id="id0fad4ccd-b2e4-430c-89a8-cf7e36bac97c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the observational data, modeling requirements, ongoing computational needs, research, development, and technology transfer activities, data management, skilled-personnel requirements, engagement with relevant Federal emergency and land management agencies and partners, and corresponding research, development, and operational resources and timelines necessary to achieve the functions described in subsection (b) of section 3 and the priorities described in subsection (c) of such section; and</text></subparagraph><subparagraph id="id60f24f8d-c11b-4b30-a042-8e7e68e567da" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">plans and needs for all other activities and requirements under this Act and the amendments made by this Act.</text></subparagraph></paragraph><paragraph id="ide54d4785-e3ac-4801-954f-d63ab138216b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Submittal of annual budget for plan</header><text display-inline="yes-display-inline">Following completion of the plan submitted under subsection (a)(1), the Under Secretary shall, not less frequently than once each year concurrent with the submission of the budget by the President to Congress under section 1105 of title 31, United States Code, submit to Congress a proposed budget corresponding with the elements detailed in the plan.</text></paragraph></subsection><subsection id="id26b351e4-783f-429c-93ba-93a1c0139c35" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Incident meteorologist workforce needs assessment</header><paragraph id="id64c02eeb-4059-4eee-bcbd-87936210d6cc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Under Secretary shall conduct a workforce needs assessment on the current and future demand for additional incident meteorologists for wildfires and other high-impact fire weather events.</text></paragraph><paragraph id="idbfcc5620-5edb-4423-b48a-8fd72d0d8200" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The assessment required by paragraph (1) shall include the following:</text><subparagraph id="id477ba6d8-51e7-4a2b-a3ed-3f32ff8bc0bd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">A description of staffing levels as of the date on which the assessment is submitted under subsection (a)(2) and projected future staffing levels.</text></subparagraph><subparagraph id="id7e047290-eecc-4b0a-9877-5f0d91d5dbe7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">An assessment of the state of the research, development, and operational infrastructure of the National Weather Service as of the date on which the assessment is submitted and future needs of such infrastructure in order to meet current and future demands, including with respect to information technology support and logistical and administrative operations.</text></subparagraph></paragraph><paragraph id="id41e4d1ba-e369-45de-beb3-58d58a4e479a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">In conducting the assessment required by paragraph (1), the Under Secretary shall consider user needs and feedback from relevant stakeholders. </text></paragraph></subsection><subsection id="idfa535d04-f13c-47ff-8014-90bd507532a5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Support services assessment</header><paragraph id="id36b1eb6e-5287-4fe2-8187-5f922595abe8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Under Secretary shall conduct a workforce support services assessment with respect to employees of the National Weather Service engaged in emergency response.</text></paragraph><paragraph id="id19ea4ac9-9119-4d43-bebc-9f053e5b13bf" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The assessment required by paragraph (1) shall include the following:</text><subparagraph id="ideabcd816-a77b-4658-8d39-06f17f58697b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">An assessment of need for further support of employees of the National Weather Service engaged in emergency response through services provided by the Public Health Service.</text></subparagraph><subparagraph id="id3fedbf29-7931-47ad-a3e8-d3151cfaaec9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">A detailed assessment of appropriations required to secure the level of support services needed as identified in the assessment described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="idc051b1f2-c4a4-4451-8634-e9b514cc4bb8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Additional support services</header><text display-inline="yes-display-inline">Following the completion of the assessment required by paragraph (1), the Under Secretary shall seek to acquire additional support services to meet the needs identified in the assessment.</text></paragraph></subsection></section><section id="id843930b4-4e11-49c9-9993-8d75c8be5eaf" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Fire Science and Technology Working Group; strategic plan</header><subsection id="id1423f357-164f-40cd-bbb8-226eb0ebafc8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Fire science and technology working group</header><paragraph id="id8e582517-4e70-4d53-8c05-af79e3ce3db5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Executive Director of the Interagency Committee for Advancing Weather Services established under section 402 of the Weather Research and Forecasting Innovation Act of 2017 (<external-xref legal-doc="usc" parsable-cite="usc/15/8542">15 U.S.C. 8542</external-xref>) (in this section referred to as the <quote>Interagency Committee</quote>) shall establish a working group, to be known as the <quote>Fire Science and Technology Working Group</quote> (in this section referred to as the <quote>Working Group</quote>).</text></paragraph><paragraph id="idc6f39b9c-3004-48a0-97b1-c6c97ab54374" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Chair</header><text display-inline="yes-display-inline">The Working Group shall be chaired by the Under Secretary, or designee.</text></paragraph><paragraph id="iddcc38766-ad52-4e12-a492-41d156f05614" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">General duties</header><subparagraph id="id35b06033-9e24-4f7d-966e-44ce39cb47a2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Working Group shall seek to build efficiencies among the agencies listed under section 12(c)(1) and coordinate the planning and management of science, research, technology, and operations related to science and support services for wildland fire prediction, detection, forecasting, modeling, resilience, response, management, and assessments.</text></subparagraph><subparagraph id="idd42c388d-ea2a-42cb-a23b-2b116c2287c8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Input</header><text display-inline="yes-display-inline">The Working Group shall solicit input from non-Federal stakeholders.</text></subparagraph></paragraph></subsection><subsection id="id7b34cc4e-75ab-473b-ad55-d67462d891cf" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Strategic plan</header><paragraph id="idacf43646-cb58-4ade-ab48-d7f5c2025c31" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Interagency Committee shall prepare and submit to Congress a strategic plan for interagency coordination, research, and development that will improve the assessment of fire environments and the understanding and prediction of wildland fires, associated wildfire smoke, and the impacts of such fires and smoke, including—</text><subparagraph id="idb21dbc2a-c72b-4c3c-b461-20789dc98243" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">on communities, buildings, and other infrastructure;</text></subparagraph><subparagraph watersheds;</text></subparagraph><subparagraph id="id9b36a40b-782e-4568-b210-7f4069b9323d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">social and economic impacts;</text></subparagraph><subparagraph id="idea1b2c2b-26d3-459a-a3ca-e8c1f42f7b4e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">by developing and encouraging the adoption of science-based and cost-effective measures—</text><clause id="ida55f3b4a-8adc-4015-9452-a4b1c2497762" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">to enhance community resilience to wildland fires;</text></clause><clause id="id6e8eb3c4-68ce-4d00-b5d6-d5b690b7f3d3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">to address and mitigate the impacts of wildland fires and associated wildfire smoke; and</text></clause><clause id="idbc9bf8d4-ff0d-4fb8-8c2b-978891bd801d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">to restore natural fire regimes in fire-dependent ecosystems;</text></clause></subparagraph><subparagraph id="idda6a69d9-2cd0-4767-98a2-60e39a2408ba" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">by improving the understanding and mitigation of the effects of weather and long-term drought on wildland fire risk, frequency, and severity;</text></subparagraph><subparagraph id="idc3941089-2c36-47a9-8be0-e2ba00ec597e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">through integrations of social and behavioral sciences in public safety fire communication;</text></subparagraph><subparagraph id="id8f249b06-e816-4a3e-878f-50de536f2753" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">by improving the forecasting and understanding of prescribed fires and the impacts of such fires, and how those impacts may differ from impacts of wildland fires that originate from an unplanned ignition; and</text></subparagraph><subparagraph id="id961880e4-4dac-422e-bf9f-976053bf38f7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">consideration and adoption of any recommendations included in the report required by section 12(c).</text></subparagraph></paragraph><paragraph id="id089c7448-de66-42f7-a916-7e376b36b081" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Plan elements</header><text display-inline="yes-display-inline">The strategic plan required by paragraph (1) shall include the following:</text><subparagraph id="id03e193c7-1e7e-4fb1-81c5-467e07e9299a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">A description of the priorities and needs of vulnerable populations.</text></subparagraph><subparagraph id="id7c8212a5-b13c-4851-8060-7d3873a780ae" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">A description of high-performance computing, visualization, and dissemination needs.</text></subparagraph><subparagraph id="ida2cc618d-7a97-4cb9-921d-6a453319edef" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">A timeline and guidance for implementation of—</text><clause id="ide48bc938-16a3-424f-b266-6c78ba2bcf5c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">an interagency data sharing system for data relevant to performing fire assessments and modeling fire risk and fire behavior;</text></clause><clause id="ide716bc1d-3861-4142-8dbd-a94012752507" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a system for ensuring that the fire prediction models of relevant agencies can be interconnected; and</text></clause><clause id="id8f45e1f1-55bc-4e9f-802e-e51c5313c8be" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, any recommendations included in the report required by section 12(c).</text></clause></subparagraph><subparagraph id="id7720cb1c-8677-4d63-aeb2-f1994bab1cf1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">A plan for incorporating and coordinating research and operational observations, including from infrared technologies, microwave, radars, satellites, mobile weather stations, and uncrewed aerial systems.</text></subparagraph><subparagraph id="id38a004c6-097a-4218-8df1-5bc0b057bcf8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">A flexible framework to communicate clear and simple fire event information to the public.</text></subparagraph><subparagraph id="idd0ee5192-0d33-416d-8981-e9d5e90c6111" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">Integration of social, behavioral, risk, and communication research to improve the fire operational environment and societal information reception and response. </text></subparagraph></paragraph></subsection><subsection id="id9345c00fe9ec4cfab5fe609fd4bba71a" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">The Working Group shall terminate not later than 1 year after the date of the enactment of this Act. </text></subsection></section><section commented="no" display-inline="no-display-inline" id="id402876a1-e07a-4026-b6f7-317c02c50764" changed="not-changed" section-type="subsequent-section"><enum>11.</enum><header display-inline="yes-display-inline">Fire weather rating system</header><subsection id="ida733957deac44a70a10e7b1cf8bda4de" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Under Secretary shall, in collaboration with the Chief of the United States Forest Service, the Director of the United States Geological Survey, the Director of the National Park Service, the Administrator of the Federal Emergency Management Agency, the Director of the United States Fish and Wildlife Service, the Director of the Bureau of Indian Affairs, the Director of the Bureau of Land Management, and such stakeholders as the Under Secretary considers appropriate—</text><paragraph id="id36910408-3132-4bed-82e3-d443953d091d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">evaluate the system used as of the date of the enactment of this Act to rate the risk of wildfire; and</text></paragraph><paragraph id="id52ca1c95-265a-476c-bb8f-ffe409118483" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">determine whether updates to that system are required to ensure that the ratings accurately reflect the severity of fire risk.</text></paragraph></subsection><subsection id="id22ccb12e-5dbe-4c17-9cbf-a1134ca99586" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Update required</header><text display-inline="yes-display-inline">If the Under Secretary determines under subsection (a) that updates to the system described in paragraph (1) of such subsection are necessary, the Under Secretary shall update that system.</text></subsection></section><section id="id5d7aa246-6f5c-4584-becd-1ac34dedc5df" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>12.</enum><header display-inline="yes-display-inline">Government Accountability Office reports</header><subsection id="id3c746fd2-2c32-4cfe-8a9a-d905e7990503" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Report on fire weather services program</header><paragraph commented="no" display-inline="no-display-inline" id="id88a85770-e055-475d-be89-a4f12e678a2c" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the program established under section 3(a).</text></paragraph><paragraph id="idea653adc-06f1-48ae-af86-7cdcdd3605dd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The report required by paragraph (1) shall—</text><subparagraph id="ideee41623-a470-4e35-be3d-313c7ff2e713" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">evaluate the performance of the program by establishing initial baseline capabilities and tracking progress made toward fully operationalizing the functions described in section 3(b); and</text></subparagraph><subparagraph id="idd248c9ec-a5d9-4056-a63b-e4f7729590c9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">include such other recommendations as the Comptroller General determines are appropriate to improve the program.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4a18a636-a03a-46db-b050-ac7810668f05" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Report on interagency bodies for wildfire forecasting, prevention, planning, and management</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Comptroller General of the United States shall submit to Congress a report that—</text><paragraph id="id63e42929-ab9b-4e89-a32e-ed4b8f36ff0a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">identifies all Federal interagency bodies established for the purpose of wildfire forecasting, prevention, planning, and management (such as wildfire councils, commissions, and workgroups), including—</text><subparagraph id="id216ca50b-3943-49d2-aaed-221d77bf46ad" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Wildland Fire Leadership Council;</text></subparagraph><subparagraph id="idda5cc77c-22cb-403e-b066-74eaa7b30718" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the White House Wildfire Resilience Interagency Group;</text></subparagraph><subparagraph id="id2e3a8a08-9582-47a1-89c5-1079f006080c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the Wildland Fire Management Policy Committee;</text></subparagraph><subparagraph id="idf9b8475e-6b28-482a-91c2-d51a3d9394fe" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the Wildland Fire Mitigation and Management Commission;</text></subparagraph><subparagraph id="id5b1d60de-895d-414b-9c80-1fcb372f8149" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">the Joint Science Fire Program;</text></subparagraph><subparagraph id="id65a16bc8-18c2-4895-b74a-054464af6db0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">the National Interagency Coordination Center;</text></subparagraph><subparagraph id="idc47abf07-1f30-4c50-be8d-9d0d16dd0905" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">the National Predictive Services Oversight Group;</text></subparagraph><subparagraph id="id58c871de-dbd1-42d8-a339-9a3022ae1cb7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">the Interagency Council for Advancing Meteorological Services;</text></subparagraph><subparagraph id="idbc5b2105-1d47-4fff-ab30-0042ba618ceb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the National Wildfire Coordinating Group;</text></subparagraph><subparagraph id="id984d7885-5e2b-49ee-8443-b079d9159101" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(J)</enum><text display-inline="yes-display-inline">the National Multi-Agency Coordinating Group; and</text></subparagraph><subparagraph id="idb0a632fc-82c0-4367-a105-a0012072f0b6" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(K)</enum><text display-inline="yes-display-inline">the Mitigation Framework Leadership Group;</text></subparagraph></paragraph><paragraph id="id98f1c800-99c0-48b4-a397-2b7ab690d951" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">evaluates the roles, functionality, and utility of such interagency bodies;</text></paragraph><paragraph id="iddde4e75e-50a0-4598-9023-f14ba129fd08" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">evaluates the progress, performance, and implementation of such interagency bodies;</text></paragraph><paragraph id="id62091f51-cf7e-4dc4-89d8-014cb83b158b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">assesses efficacy and identifies potential overlap and duplication of such interagency bodies in carrying out interagency collaboration with respect to wildfire prevention, planning, and management; and</text></paragraph><paragraph id="id58f5c4b6-0ed7-479a-956d-b313ba23d653" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">includes such other recommendations as the Comptroller General determines are appropriate to streamline and improve wildfire forecasting, prevention, planning, and management, including recommendations regarding the interagency bodies for which the addition of the Administration is necessary to improve wildfire forecasting, prevention, planning, and management.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc6bc567e-782e-4202-a946-937e1f563135" changed="not-changed"><enum>(c)</enum><header display-inline="yes-display-inline">Report on interagency coordination</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Comptroller General of the United States shall submit to Congress a report that identifies—</text><paragraph id="idff966d77-2785-4a68-8ada-e8c24447cd2b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the authorities, roles, and science and support services relating to wildland fire prediction, detection, forecasting, modeling, resilience, response, management, and assessment provided by—</text><subparagraph id="id4031e66d-cce8-4a9c-bf82-f673a07c6018" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the Department of Commerce, including the Administration and the National Institute of Standards and Technology;</text></subparagraph><subparagraph id="id024dd2af-73bb-456d-a665-fbeae5932ac5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the National Aeronautics and Space Administration;</text></subparagraph><subparagraph id="idf97c3181-f75f-4458-924e-fb95ae4d58d1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the Department of the Interior;</text></subparagraph><subparagraph id="id926079cd-e231-406f-84b0-faaea787873e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the Department of Agriculture;</text></subparagraph><subparagraph id="ide24b2d49-e613-4a22-a84f-5eaecbf3c016" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">the National Science Foundation;</text></subparagraph><subparagraph id="ide382eade-1844-4c60-8d51-22feda66bfe9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">the Department of Energy;</text></subparagraph><subparagraph id="ide28ed2c2-bd6e-42fc-b164-baaa4dcf0497" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">the Federal Emergency Management Agency;</text></subparagraph><subparagraph id="id746986eb-1f87-4e4a-96c1-9238857ede9c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">the Department of Transportation;</text></subparagraph><subparagraph id="id8bc3e9a4-5c01-4c55-a548-37dd9a090e1a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the Environmental Protection Agency; and</text></subparagraph><subparagraph id="idd8a154ba-979a-4608-b579-095430cb4377" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(J)</enum><text display-inline="yes-display-inline">the Department of Defense; and</text></subparagraph></paragraph><paragraph id="iddbce7ad0-5f46-4f72-8940-fd59cc8b4e6b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">recommended areas in and mechanisms by which the agencies listed under paragraph (1) could support and improve—</text><subparagraph id="id2d6f028e-e0b1-45e8-9164-311ed6bbb166" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">coordination between Federal agencies, State and local governments, Indian tribes, Tribal organizations, Native Hawaiian organizations, and other relevant stakeholders, including through examination of possible public-private partnerships; </text></subparagraph><subparagraph id="id00a288c6-dd64-4ba9-a4b8-29b38197a26f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">research and development, including interdisciplinary research, related to fire environments, wildland fires, associated wildfire smoke, and the impacts of such environments, fires, and smoke, in furtherance of a coordinated interagency effort to address wildland fire risk reduction;</text></subparagraph><subparagraph id="id3acdaed8-cb70-4cf0-b3d9-dcfff7006ed9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">data management and stewardship, the development and coordination of data systems and computational tools, and the creation of a centralized, integrated data collaboration environment for agency data, including historical data, relating to weather, fire environments, wildland fires, associated wildfire smoke, and the impacts of such environments, fires, and smoke, and the assessment of wildland fire risk mitigation measures;</text></subparagraph><subparagraph id="id461b90b5-c412-41c6-85d4-5ab56dd30e5a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">interoperability, usability, and accessibility of the scientific data, data systems, and computational and information tools of the agencies listed under paragraph (1);</text></subparagraph><subparagraph id="id21304345-cabf-447b-a75e-564e1b634797" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">coordinated public safety communications relating to fire weather events, fire hazards, and wildland fire and smoke risk reduction strategies; and</text></subparagraph><subparagraph id="idd0cfc5fe-3789-4b65-b281-020c49b7f49d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">secure and accurate real-time data, alerts, and advisories to wildland firefighters and other decision support tools for wildland fire incident command posts.</text></subparagraph></paragraph></subsection><subsection id="id66ed3be2-751c-459a-a2d4-6e80fc2d258f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Report on automated surface observing system</header><text display-inline="yes-display-inline">Not later than 4 years after the date of the enactment of this Act, the Comptroller General of the United States shall submit to Congress a report that—</text><paragraph id="id5da362bc-1e89-4784-9b24-1ff77f99160b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">evaluates the functionality, utility, reliability, and operational status of the automated surface observing system across the Administration, the Federal Aviation Administration, and the Department of Defense;</text></paragraph><paragraph id="id6a1e41ca-5bb6-4a3a-826a-90039df5330d" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">evaluates the progress, performance, and implementation of the plan required by section 6(b)(1)(B);</text></paragraph><paragraph id="id057755cc-cd7f-48ac-813d-0950a005833e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">assesses the efficacy of cross-agency collaboration and stakeholder engagement in carrying out the plan and provides recommendations to improve such activities;</text></paragraph><paragraph id="id3d2805dd-ec04-4289-9ea2-af639dbd565a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">evaluates the operational continuity and reliability of the system, particularly in remote and rural areas and areas where system failure would have the greatest negative impact to the community, and provides recommendations to improve such continuity and reliability;</text></paragraph><paragraph id="idf8339683-157f-4311-aaaf-8e5ef12f8d07" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">assesses Federal coordination regarding the remote automatic weather station network, air resource advisors, and other Federal observing assets used for weather and climate modeling and response activities, and provides recommendations for improvements; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95206f24-1d93-4545-804b-3b47be600565" changed="not-changed"><enum>(6)</enum><text display-inline="yes-display-inline">includes such other recommendations as the Comptroller General determines are appropriate to improve the system. </text></paragraph></subsection></section><section id="id34a8f518-20ca-41f2-8a62-a6eca325572d" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>13.</enum><header display-inline="yes-display-inline">Cooperation and coordination</header><subsection id="idaa1f5da2-3e68-4fee-aa12-70e2b99fb233" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Cooperation</header><text display-inline="yes-display-inline">Each Federal agency shall cooperate and coordinate with the Under Secretary, as appropriate, in carrying out this Act and the amendments made by this Act.</text></subsection><subsection id="id83ff26b6-34b2-4391-8997-d6770fbc9647" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Coordination</header><paragraph id="id71d59e67-e365-495a-b261-ad1a7c63e4f2" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In meeting the requirements under this Act and the amendments made by this Act, the Under Secretary shall coordinate, and as appropriate, establish agreements with Federal and external partners to fully use and leverage existing assets, systems, networks, technologies, and sources of data.</text></paragraph><paragraph id="id9773f8e3-ee0c-40e1-90f4-c5d3ae6282ca" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">Coordination carried out under paragraph (1) shall include coordination with—</text><subparagraph id="idff79c615-99e8-42b9-9edf-e46a36efe1ba" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the agencies represented at the National Interagency Fire Center;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd64ec0f4-070c-4aa2-af5f-6ef28ebd8371" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">the Predictive Services Program of the National Interagency Coordination Center;</text></subparagraph><subparagraph id="idad2efdda-b8fe-44a9-946d-e59b9a4f2c8a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the National Wildfire Coordinating Group; and</text></subparagraph><subparagraph id="id4c5a5679-8d68-40b2-9597-17635ae2cdac" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">relevant interagency bodies identified in the report required by section 12(b).</text></subparagraph></paragraph><paragraph id="id59cdc937-73ff-4846-aca6-d66c7d34bdb7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In carrying out this subsection, the Under Secretary shall consult with Federal partners including—</text><subparagraph id="id4e14c025-5f35-46d9-bd5c-78409a5a269e" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">the National Aeronautics and Space Administration;</text></subparagraph><subparagraph id="id60407265-3122-402b-bfc7-48c5a244365b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the Department of the Interior;</text></subparagraph><subparagraph id="id2cab4a19-5faa-4e59-a8c2-1d271b10be32" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the Federal Emergency Management Agency;</text></subparagraph><subparagraph id="id69dc4f49-943d-4cbd-ae81-91c709fc3968" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">the National Science Foundation;</text></subparagraph><subparagraph id="idbdd39e7c-ad82-4968-a92b-cef8569536a4" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">the United States Geological Survey;</text></subparagraph><subparagraph id="id34f97f4b-f8dc-4338-adf4-8e1ee5ff02cb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">the Department of Agriculture;</text></subparagraph><subparagraph id="id1331c5b4-749e-405c-8770-19f1de8649ef" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">the Environmental Protection Agency;</text></subparagraph><subparagraph id="idb3811ab9-60c0-4b23-893a-b3953dd7d9d8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">the Department of Energy;</text></subparagraph><subparagraph id="id9a815982-3548-47f8-a30f-adf89baa971b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">the Department of Defense;</text></subparagraph><subparagraph id="idbeeca80d-2dec-4986-80a3-a2d2d7df4d57" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(J)</enum><text display-inline="yes-display-inline">the National Institute of Standards and Technology; and</text></subparagraph><subparagraph id="iddddf55d3-38c3-44dd-8b6c-e5e051357931" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(K)</enum><text display-inline="yes-display-inline">such other departments and agencies as the Under Secretary considers relevant.</text></subparagraph></paragraph></subsection><subsection id="idef27b3c2-5d75-4dcd-9bca-a734373747fd" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Process for annual coordination with non-Federal entities</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Under Secretary shall develop and submit to the appropriate committees of Congress a process for annual coordination with State and local governments, Indian tribes, Tribal organizations, and Native Hawaiian organizations to assist the development of improved fire weather products and services.</text></subsection><subsection id="id25864570-fe00-4f75-9647-c19b64af9c94" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">International coordination</header><paragraph commented="no" display-inline="no-display-inline" id="id108808c8-850d-40f2-95e8-dfe97b7d3f99" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Under Secretary may develop collaborative relationships and agreements with foreign partners and counterparts to address transboundary issues pertaining to wildfires, fire weather, wildfire smoke, air quality, and associated conditions and hazards or other relevant meteorological phenomena, as appropriate, to facilitate full and open exchange of data and information.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9f881e40-296b-4b07-9fbe-88f93b39c7db" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In carrying out activities under this subsection, the Under Secretary shall consult with the Department of State and such other Federal partners as the Under Secretary considers relevant. </text></paragraph></subsection></section><section id="idbd327c50-358c-4480-bf46-deb7168f45a8" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>14.</enum><header display-inline="yes-display-inline">General provisions</header><subsection id="ide2af4e43-f720-499f-beb7-2863f4e62045" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Avoidance of duplication</header><paragraph commented="no" display-inline="no-display-inline" id="id7372b007-c957-45cb-8acb-72964cb7773b" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Under Secretary shall ensure, to the greatest extent practicable, that activities carried out under this Act and the amendments made by this Act are not duplicative of activities supported by other parts of the Administration or other relevant Federal agencies.</text></paragraph><paragraph id="id23e6e106-3a05-443d-8f0c-c336af290f9c" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Coordination</header><text display-inline="yes-display-inline">In carrying out activities under this Act and the amendments made by this Act, the Under Secretary shall coordinate with the Administration and heads of other Federal research agencies—</text><subparagraph id="id3c2ab78e-a284-41b7-9fd7-ad9945ab9b79" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">to ensure those activities enhance and complement, but do not constitute unnecessary duplication of, efforts; and</text></subparagraph><subparagraph id="id110e76a8-dda9-4976-b82a-e7d8dea26aa7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">to ensure the responsible stewardship of funds.</text></subparagraph></paragraph></subsection><subsection commented="no" id="id83564df1-52d6-45bb-b59d-bae0e3a55cc6" changed="not-changed" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act may be construed—</text><paragraph commented="no" id="id236ec51f-c66c-439e-a056-c10846bd7c0b" changed="not-changed" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">to satisfy any requirement for government-to-government consultation with Indian tribes; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf7cbd381-e77c-4e5c-8dd8-cf76fea97239" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">to affect or modify any treaty or other right of any Indian tribe. </text></paragraph></subsection></section><section id="id5ae0cc34-3efb-4cb5-9d20-73703bb45e8c" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>15.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><subsection commented="no" display-inline="no-display-inline" id="idb95d53ef-666a-4c44-8923-70c5df48d415" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Administration to carry out this Act and the amendments made by this Act—</text><paragraph id="id1a027558-e987-40c6-9999-bdb38bd9ec49" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">$15,000,000 for fiscal year 2026;</text></paragraph><paragraph id="idfcaded71-550a-4e0c-94e1-401b42aa406f" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">$20,000,000 for fiscal year 2027;</text></paragraph><paragraph id="id965d4d14-b069-4cb9-ba1b-4266ad6d3bab" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">$27,000,000 for fiscal year 2028;</text></paragraph><paragraph id="id23cd5cc7-4b79-4807-b55f-841d1603f9c0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">$36,000,000 for fiscal year 2029; and</text></paragraph><paragraph id="idd854ef99-98ac-4406-89ae-cad6875eef23" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">$50,000,000 for fiscal year 2030.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id81264bea-8be6-4625-ae63-1383cbab1ebd" changed="not-changed"><enum>(b)</enum><header display-inline="yes-display-inline">Prohibition</header><text display-inline="yes-display-inline">None of the amounts authorized to be appropriated by subsection (a) may be used to unnecessarily duplicate activities funded under title VIII of division D of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law
