            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wildfire Emissions Prevention Act of 2025</short-title></quote>.</text>

            <enum>2.</enum>
            <header>Air quality monitoring data influenced by exceptional events and prescribed
                fires</header>
            <subsection commented="no" display-inline="no-display-inline" id="idce3a3991cb5448d0ab75d5d2334f4b9b">
                <enum>(a)</enum>
                <header display-inline="yes-display-inline">In general</header>
 <text display-inline="yes-display-inline">Section 319(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7619">42 U.S.C. 7619(b)</external-xref>) is amended—</text>
                <paragraph commented="no" display-inline="no-display-inline" id="idd1b96ec8c884405083b63991b354b913">
                    <enum>(1)</enum>
 <text>in the subsection heading, by inserting <quote><header-in-text style="OLC" level="subsection">and prescribed fires</header-in-text></quote> after <quote><header-in-text style="OLC" level="subsection">events</header-in-text></quote>;</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id228ffb583ff740bfa00a282e82c8e0a9">
                    <enum>(2)</enum>
 <text>in paragraph (1)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ide0f6ae18c5434289b1a144403ab1add6"> <enum>(A)</enum> <text>in subparagraph (A)—</text>
                        <clause commented="no" display-inline="no-display-inline" id="id18c2f986b4614883a9bc39168f6df53c">
                            <enum>(i)</enum>
 <text>in clause (ii), by inserting <quote>, unless the purpose is to prevent more severe emissions</quote> before the semicolon at the end;</text>
                        </clause>

                            <enum>(ii)</enum>
 <text display-inline="yes-display-inline">by striking clauses (iii) and (iv) and inserting the following:</text>

                                    <enum>(iii)</enum>
 <text>is a natural event, or an event caused by human activity that is unlikely to recur unless the event intended to mirror the occurrence or reoccurrence of a natural event, or a prescribed fire; and</text>
                                </clause>
                                <clause commented="no" display-inline="no-display-inline" id="id8396bd6c59424b2681f7d377b082593e">
                                    <enum>(iv)</enum>
 <text display-inline="yes-display-inline">is determined to be an exceptional event by the impacted State, unless the Administrator, through the process established in the regulations revised under paragraph (2), subsequently determines that the event is not an exceptional event.</text>
                                </clause>

                            </quoted-block>
                        </clause>

                            <enum>(iii)</enum>
 <text>by redesignating clauses (i) through (iv) as subclauses (I) through (IV), respectively, and indenting appropriately;</text>
                        </clause>
                    </subparagraph>
                    <subparagraph id="id4355982c583a413694bee2c41db7a7ec">
                        <enum>(B)</enum>
 <text>in subparagraph (B)—</text> <clause id="idafb91f1a7fa24e829891e94613558c92"> <enum>(i)</enum> <text>in the matter preceding clause (i), by striking <quote>In this subsection, the</quote> and inserting <quote>The</quote>; and</text>
                        </clause>

                        <enum>(D)</enum>
 <text>by striking the paragraph designation and heading and all that follows through <quote>this section:</quote> in the matter preceding clause (i) (as so redesignated) and inserting the following:</text>

                                <enum>(B)</enum>
                                <header>Prescribed fire</header>
 <text>The term <term>prescribed fire</term> means a fire originating from a planned ignition in accordance with applicable laws, policies, and regulations to meet specific objectives.</text>
                            </subparagraph>

                        </quoted-block>
                    </subparagraph>
                </paragraph>

                    <enum>(3)</enum>
 <text>in paragraph (2)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id15892fecc05c4ff5945b67cd769a2e0d"> <enum>(A)</enum> <text>by striking subparagraph (A) and inserting the following:</text>

                                <header>Proposed revisions</header>
 <text>Not later than 270 days after the date of enactment of the <short-title>Wildfire Emissions Prevention Act of 2025</short-title>, the Administrator, after consultation with Federal land managers, State air pollution control agencies, State foresters, and State fish and wildlife agencies, shall publish in the Federal Register revisions to existing regulations promulgated under this section to govern the review of State determinations and handling of air quality monitoring data influenced by exceptional events or prescribed fires.</text>
                            </subparagraph>
                            <after-quoted-block>; and</after-quoted-block>
                        </quoted-block>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="id0c29e7d94eb04d688699dccae72f1b5f">
                        <enum>(B)</enum>
 <text>in subparagraph (B)—</text> <clause commented="no" display-inline="no-display-inline" id="id7db4277522ee44f7a1da1d9c24246288"> <enum>(i)</enum> <text>in the subparagraph heading, by striking <quote><header-in-text style="OLC" level="subparagraph">regulations</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subparagraph">revisions</header-in-text></quote>;</text>
                        </clause>
                        <clause commented="no" display-inline="no-display-inline" id="ida4f25fff46da4f44a827f109bb04a0ad">
                            <enum>(ii)</enum>
 <text>by striking <quote>proposed regulations</quote> each place it appears and inserting <quote>proposed revisions</quote>;</text>
                        </clause>

                            <enum>(iii)</enum>
 <text display-inline="yes-display-inline">by striking <quote>1 year</quote> and inserting <quote>180 days</quote>; and</text>
                        </clause>
                        <clause commented="no" display-inline="no-display-inline" id="id613b192194ea41e09e090ea7816f8426">
                            <enum>(iv)</enum>
 <text>by striking <quote>promulgate final regulations</quote> and all that follows through the period at the end and inserting <quote>finalize the revisions under subparagraph (A) to regulations promulgated under this section to govern the review of State determinations and handling of air quality monitoring data influenced by exceptional events or prescribed fires that are consistent with paragraph (3).</quote>;</text>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id842c3f28ab4840b3a89cac9f43b5deaa">
                    <enum>(4)</enum>
 <text>in paragraph (3)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id65e6c4a60af847a484c491c3980e18e0"> <enum>(A)</enum> <text>in subparagraph (A)(iii), by striking <quote>manner, an appropriate</quote> and inserting <quote>manner in an appropriate</quote>; and</text>

 <text>in clause (ii)—</text> <subclause commented="no" display-inline="no-display-inline" id="id2ddb080cc7764c42bd0f4d510a89f26b"> <enum>(I)</enum> <text>by inserting <quote>or be reasonably expected to exist</quote> after <quote>must exist</quote>; and</text>
                            </subclause>
                            <subclause commented="no" display-inline="no-display-inline" id="idb9dac80119854bf888cf79f8483c807c">
                                <enum>(II)</enum>
 <text>by striking <quote>exceptional event</quote> each place it appears and inserting <quote>exceptional event or a prescribed fire</quote>; and</text>
                            </subclause>
                        </clause>

                            <enum>(iii)</enum>
 <text>in clause (iv)—</text> <subclause commented="no" display-inline="no-display-inline" id="idce64455266e64765aa4bd6bf37c58799"> <enum>(I)</enum> <text>by striking <quote>Governor of a State to petition the Administrator</quote> and inserting <quote>Administrator to review State determinations</quote>;</text>
                            </subclause>
                            <subclause commented="no" display-inline="no-display-inline" id="id59dd2e4bd4b549c3b105a144ab175be9">
                                <enum>(II)</enum>
 <text>by inserting <quote>or prescribed fires</quote> after <quote>exceptional events</quote>;</text>
                            </subclause>
                            <subclause commented="no" display-inline="no-display-inline" id="id4ceec73436b144c9b6e9489363fac19a">
                                <enum>(III)</enum>
 <text>by striking <quote>with respect to exceedances</quote> and inserting the following: “with respect to—</text>

                                        <enum>(I)</enum>
 <text>exceedances</text> </subclause> <after-quoted-block>;</after-quoted-block> </quoted-block> </subclause> <subclause commented="no" display-inline="no-display-inline" id="id9879acdab4134a149b89557af4097c47"> <enum>(IV)</enum> <text>in subclause (I) (as so designated), by striking the period at the end and inserting <quote>; or</quote>; and</text>
                            </subclause>
                            <subclause commented="no" display-inline="no-display-inline" id="id12842e0079444dd1a76bf8f573aac917">
                                <enum>(V)</enum>
 <text>by adding at the end the following:</text> <quoted-block id="idCCB7D8FB41DC4D06834C1C4B41B91C5B" style="OLC" act-name=""> <subclause id="id56C95A453F5A45F09AFB68CC889B9948"> <enum>(II)</enum> <text>the designation, redesignation, classification, or reclassification of an area, the demonstration by a State of attainment of a national ambient air quality standard, or other determinations by the Administrator for determining compliance with this Act.</text>
                                    </subclause>
                                    <after-quoted-block>; and</after-quoted-block>
                                </quoted-block>
                            </subclause>
                        </clause>
                    </subparagraph>
                </paragraph>

                    <enum>(5)</enum>
 <text>by striking paragraph (4) and inserting the following:</text> <quoted-block id="id8377527F3CE7489584CE5C3188531365" style="OLC" act-name=""> <paragraph id="id0B802F4D5B9B4BB39251775EC592C4C3"> <enum>(4)</enum> <header>Regional, national, or international exceptional events</header> <text>At the request of multiple State or local government agencies or Tribal authorities, the Administrator shall conduct analyses or otherwise collaborate with such agencies or authorities to lead the development of regional, national, or international exceptional event demonstrations when exceptional events impact multijurisdictional areas.</text>
                        </paragraph>

                </paragraph>
            </subsection>
            <subsection commented="no" display-inline="no-display-inline" id="id0cc00305db8444bfb0ba47d79097dc33">
                <enum>(b)</enum>
                <header>Savings provision</header>
 <text>Nothing in this Act or an amendment made by this Act makes stationary source (as defined in section 51.491 of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act)) emissions that were not an exceptional event (as defined in section 319(b)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7619">42 U.S.C. 7619(b)(1)</external-xref>)) on the day before the date of enactment of this Act an exceptional event under that section after that date of enactment.</text>
            </subsection>
