            orphan drugs under the Medicare Drug Price Negotiation Program.</official-title>

            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Big Blockbuster Bailouts Act</short-title></quote>.</text>
        </section>

            <enum>2.</enum>
            <header>Treatment of orphan drugs under the Medicare Drug Price Negotiation
                Program</header>
            <subsection id="idf23069af240f4b0ab106c09554bdeea4">
                <enum>(a)</enum>
                <header>In general</header>
 <text display-inline="yes-display-inline">Section 1192(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320f-1">42 U.S.C. 1320f–1(e)</external-xref>) is amended—</text>
                <paragraph id="id91a893f4ef96455c95b2781324a73293">
                    <enum>(1)</enum>
 <text>in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>through (4)</quote> and inserting <quote>and (3)</quote>;</text>
                </paragraph>

                    <enum>(2)</enum>
 <text>in paragraph (3)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id92e0c3dd52f04d44a2e94934f369ec61"> <enum>(A)</enum> <text display-inline="yes-display-inline">by striking subparagraph (A);</text>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="id58db07914446457cb3c3cfee7abdc989">
                        <enum>(B)</enum>
 <text>by redesignating subparagraphs (B) and (C) as subparagraphs (A) and (B), respectively; and</text>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="id6cd0efe742e448df90e002cc30ba4507">
                        <enum>(C)</enum>
 <text>in subparagraph (A)(iii), as redesignated by subparagraph (B) of this paragraph, by striking <quote>with respect to</quote> and inserting <quote>subject to paragraph (4), with respect to</quote>; and</text>
                    </subparagraph>

 <text>by striking paragraph (4) and inserting the following new paragraph:</text>

                            <enum>(4)</enum>
                            <header>Treatment of orphan drugs</header>
 <text>In the case of a drug that is designated as a drug for one or more rare diseases or conditions and for which the only approved indication (or indications) is for one or more such rare diseases or conditions (as such term is defined in section 526(a)(2) of the Federal Food, Drug, and Cosmetic Act), paragraph (3)(A) shall be applied by substituting <quote>$400,000,000</quote> for <quote>$200,000,000</quote> in clause (i) of such paragraph.</text>

            </subsection>
            <subsection id="ida60c24dbbe74425383f943ade05f39f2" commented="no" display-inline="no-display-inline">
                <enum>(b)</enum>
                <header>Application</header>
 <text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply with respect to initial price applicability years (as defined in section 1191(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320f">42 U.S.C. 1320f(b)</external-xref>)) beginning on or after January 1, 2028.</text>
