            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prohibiting Abortion &amp; Transgender Procedures on the Exchanges Act</short-title></quote>.</text>
        </section>

            <enum>2.</enum>
            <header>Exclusion of gender-transition procedures for minors and abortion from coverage
                under health plans offered through the American Health Benefits Exchanges</header>
            <subsection commented="no" display-inline="no-display-inline" id="id1c091582adc24a48a0cf142ed7ee8a34">
                <enum>(a)</enum>
                <header>In general</header>
 <text display-inline="yes-display-inline">Section 1303 of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18023">42 U.S.C. 18023</external-xref>) is amended—</text>
                <paragraph commented="no" display-inline="no-display-inline" id="id078d59f78a9b4712b0e7038782ba8762">
                    <enum>(1)</enum>
 <text display-inline="yes-display-inline">in subsection (a)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id27bc1299831b4b0db48259ffcafa9562"> <enum>(A)</enum> <text display-inline="yes-display-inline">by striking paragraph (2); and</text>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="id5580727fd0c641769444c453413a93e9">
                        <enum>(B)</enum>
 <text>by striking the subsection designation and heading and all that follows through <quote>A State</quote> in paragraph (1) and inserting the following:</text>

 <text>by redesignating subsections (a) through (d) as subsections (b) through (e), respectively; and</text>

 <text>by inserting before subsection (b) (as so redesignated) the following:</text>

                            <header>Prohibition on coverage of gender-Transition procedures for
                                minors and abortion</header>
                            <paragraph commented="no" display-inline="no-display-inline"

                                <enum>(1)</enum>
                                <header>In general</header>
 <text display-inline="yes-display-inline">An Exchange may not make available any health plan, including any health plan offering excepted benefits (as defined in section 2791(c) of the Public Health Service Act), that provides coverage for— </text>
                                <subparagraph commented="no" display-inline="no-display-inline"
                                    id="id996b76a8a2fc414f8298eb0ec3f9f1f2">
                                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">abortion, except in the case where a woman suffers from a physical disorder, physical injury, or physical illness that would, as certified by a physician, place the woman in danger of death unless an abortion is performed, including a life-endangering physical condition caused by or arising from the pregnancy itself, or unless the pregnancy is the result of an act of rape or incest; or</text>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline"

                                    <enum>(B)</enum>
 <text>gender-transition procedures for minors.</text> </subparagraph> </paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id9e4abafa8d834bc9b220f7566653bb1b"> <enum>(2)</enum> <header>Definitions</header> <text>In this subsection:</text>
                                <subparagraph id="idF0DF039A259C467487AE7D8714017EC6">
                                    <enum>(A)</enum>
                                    <header>Gender-transition procedure</header>
                                    <clause id="idA73ACF6151DA4B96A19D94D5E0417C56">
                                        <enum>(i)</enum>
                                        <header>In general</header>
 <text>Except as provided in clause (ii), the term <term>gender-transition procedure</term> means—</text>
                                        <subclause id="id0ECCDA9A73F94C4DB2EE4D8626DC5F89">
                                            <enum>(I)</enum>
 <text>the prescription or administration of gonadotropin-releasing hormone agonists or any other puberty-blocking drugs for the purpose of changing the body of an individual so that it conforms to the subjective sense of identity of the individual, in the case such identity is at odds with the individual's biological sex of male or female;</text>
                                        </subclause>
                                        <subclause id="id42E3DF7A7E584031B93D17F4EEEC152E">
                                            <enum>(II)</enum>
 <text>the prescription or administration of testosterone (when prescribed to a female) or estrogen (when prescribed to a male) for the purpose of changing the body of an individual so that it conforms to the subjective sense of identity of the individual, in the case such identity is at odds with the individual’s biological sex of male or female; or</text>
                                        </subclause>
                                        <subclause id="id110E88FACF69454FB038F5EEB22FB8C2">
                                            <enum>(III)</enum>
 <text>a surgery to change the body of an individual so that it conforms to the subjective sense of identity of the individual, in the case such identity is at odds with the individual’s biological sex of male or female.</text>
                                        </subclause>
                                    </clause>
                                    <clause id="id688C33ED08B146EE9D1795B4D8A64B45">
                                        <enum>(ii)</enum>
                                        <header>Exception</header>
 <text>The term <term>gender-transition procedure</term> does not include—</text>
                                        <subclause id="id5B8FC7BFA0104D50AD381BA47D87A259">
                                            <enum>(I)</enum>
 <text>an intervention described in clause (i) that is performed on—</text>
                                            <item id="idCD0A622EEE8D458AABE8DABEC95DE322">
                                                <enum>(aa)</enum>
 <text>an individual with biological sex characteristics that are inherently ambiguous, such as those born with 46 XX chromosomes with virilization, 46 XY chromosomes with undervirilization, or having both ovarian and testicular tissue; or</text>
                                            </item>
                                            <item id="idC04B304995E6426DA1A4A617EA9A310F">
                                                <enum>(bb)</enum>
 <text>an individual with respect to whom a physician has determined through genetic or biochemical testing that the individual does not have normal sex chromosome structure, sex steroid hormone production, or sex steroid hormone action, for a biological male or biological female;</text>
                                            </item>
                                        </subclause>
                                        <subclause id="idF57E39CF82704746A6583C7CF70CFAB4">
                                            <enum>(II)</enum>
 <text>the treatment of any infection, injury, disease, or disorder that has been caused or exacerbated by the performance of an intervention described in clause (i) without regard to whether the intervention was performed in accordance with State or Federal law; or</text>
                                        </subclause>
                                        <subclause id="id66C1C4FC4B9E47AC9D67D3171C9D65CC"
                                            commented="no" display-inline="no-display-inline">
                                            <enum>(III)</enum>
 <text>any procedure undertaken because the individual suffers from a physical disorder, physical injury, or physical illness that would, as certified by a physician, place the individual in imminent danger of death or impairment of major bodily function unless the procedure is performed. </text>
                                        </subclause>
                                    </clause>
                                </subparagraph>
                                <subparagraph id="id134d4e0acd484f1ab70c8bc3099cc078" commented="no"
                                    display-inline="no-display-inline">
                                    <enum>(B)</enum>
                                    <header>Minor</header>
 <text>The term <term>minor</term> means an individual who has not yet reached 18 years of age.</text>
                                </subparagraph>
                            </paragraph>
                        </subsection>

                <enum>(b)</enum>
                <header>Conforming amendment</header>
 <text>Section 1334(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/18054">42 U.S.C. 18054(a)</external-xref>) is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="id6c8db095abe3480493406f37e5614cbd"> <enum>(1)</enum> <text display-inline="yes-display-inline">by striking paragraph (6); and</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="idcfb72b065c8b44afb6abef92b9c0d54e">
                    <enum>(2)</enum>
 <text>by redesignating paragraph (7) as paragraph (6).</text> </paragraph> </subsection> <subsection id="id6d56f14fdc18417883616465c1f121d5"> <enum>(c)</enum> <header>Effective date</header> <text>The amendments made by this section shall apply with respect to plan years beginning on or after January 1, 2026.</text>
