and</text></paragraph><paragraph id="idee69e0554c5748969ae5a2db339e010c" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>the term <term>appropriate committees of Congress</term> means the Committee on Small Business and Entrepreneurship and the Committee on Appropriations of the Senate and the Committee on Small Business and the Committee on Appropriations of the House of Representatives. </text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id8a5b56d7980f4333a0a214615382ce4b" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><enum>4.</enum><header>Monthly disaster loan reports</header><text display-inline="no-display-inline">Section 12091(a) of the Small Business Disaster Response and Loan Improvements Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/15/636k">15 U.S.C. 636k(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id1d5de97cd01a4ba7a0dab2bb316eec00"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>during the applicable period for a major disaster</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb5ad4ef03e1449f9846811fd9f38cb37"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6ccd6773d4654a93b0316a09fd7c8ad3"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking <quote>how long the available funding for such loans will last</quote> and inserting <quote>the date at which available funding for such loans will reach 10 percent of the most recent appropriation and the date at which the funds will be depleted</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc5b463690b7f49e2a10da7e011bf1488"><enum>(B)</enum><text>in subparagraph (H), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id23b6f745f1cb46aea2931f932353924a"><enum>(C)</enum><text>in subparagraph (I), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id87dcef0ef53f4246b5fce1be0de6e5ac"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5B4816A575D14F4D820AAB19D997B4CA" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><subparagraph commented="no" display-inline="no-display-inline" id="idb5fb4bf9b5c5483a8fa0bc4af883536b"><enum>(J)</enum><text>a summary detailing any changes to estimates or assumptions on obligations and expenditures, including data supporting these changes.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0481f7d754414212a326ef7ee53c2d77"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2D6DEB6495684D8A945779A493F9CD26" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><paragraph commented="no" display-inline="no-display-inline" id="id29afb9fefb354ad4ba11acffad8ac953"><enum>(3)</enum><header>Prohibition on official travel</header><text>If the Administrator does not submit a report required to be submitted under paragraph (1) by the required date, no funds may be obligated for official travel by the Administrator until the Administrator submits the report.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id859a8f74c21a4cde809455d1e1bc6d6d" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><enum>5.</enum><header>Budget request relating to disaster loans</header><text display-inline="no-display-inline">Section 1105 of title 31, United States Code, is amended— </text><paragraph commented="no" display-inline="no-display-inline" id="iddd46c0769c9c42f3b0c8b0f519fbaaa2"><enum>(1)</enum><text>in subsection (a), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6247386379BA44B3A4FCA7BC61C0369F" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><paragraph id="iddafbd61943ed40cfa3d2dd4846deee8f"><enum>(39)</enum><text>separate statements of— </text><subparagraph commented="no" display-inline="no-display-inline" id="id486342b050c045c2bdb8a60d3c265539"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of appropriations requested for the fiscal year for which the budget is submitted for the cost of SBA disaster loans, the 10-year average of the cost of SBA disaster loans, and an explanation for any difference between the amount requested and the 10-year average cost; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddf17b02082fa40b9928f76b52e1fb1e7"><enum>(B)</enum><text display-inline="yes-display-inline">the amount of appropriations requested for the fiscal year for which the budget is submitted for the cost of COVID-EIDL loans, the 10-year average of the cost of COVID-EIDL loans, and an explanation for any difference between the amount requested and the 10-year average cost. </text></subparagraph></paragraph><paragraph id="id5087FD418BAF4612A4DEE15C6D17BF8F"><enum>(40)</enum><text>separate statements of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4758c97047c0468a894e90b5ba5948a7"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of appropriations requested for the fiscal year for which the budget is submitted for administrative costs relating to SBA disaster loans, the 10-year average of such administrative costs, and an explanation for any difference between the amount requested and the 10-year average costs; and</text></subparagraph><subparagraph id="idebf6846e7f504c629f95eadfb68d0ac7"><enum>(B)</enum><text>the amount of appropriations requested for the fiscal year for which the budget is submitted for administrative costs relating to COVID-EIDL loans, the 10-year average of such administrative costs, and an explanation for any difference between the amount requested and the 10-year average costs.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="ida8863748bc2a4372b42a01ad598137e8"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="id8F9D5F369621433DA5193FC319E3E2F1" display-inline="no-display-inline" style="OLC" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><subsection commented="no" display-inline="no-display-inline" id="ida04a2cf7ced7499fb06c123a7bd4dce6"><enum>(j)</enum><text>In paragraphs (39) and (40) of subsection (a)—</text><paragraph commented="no" display-inline="no-display-inline" id="id4d727263e0a54186b4d667acdbba545c"><enum>(1)</enum><text>the term <term>COVID-EIDL loan</term> means a direct loan under section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) that was authorized under section 1110 of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009">15 U.S.C. 9009</external-xref>); and</text></paragraph><paragraph id="id0e806312146d464aa13b2075010156b2" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>SBA disaster loan</term> means a direct loan authorized by section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>), other than a loan that was authorized under section 1110 of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009">15 U.S.C. 9009</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="ida35ba18cda674469b6da9ad37a638ecc" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><enum>6.</enum><header>Limitations on loan forgiveness</header><text display-inline="no-display-inline">Section 7 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636</external-xref>) is amended by adding at the end the following:</text><quoted-block id="id21F084CA6E3A4E209E3AF8679A170C57" display-inline="no-display-inline" style="OLC" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><subsection commented="no" display-inline="no-display-inline" id="id57136c50445f453583e664973419c636"><enum>(o)</enum><header>Limitations on loan forgiveness</header><paragraph commented="no" display-inline="no-display-inline" id="idb2f07d988ece4630a807147f2c89f9b0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator may not—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9fad15501dbe4c1bbeb3f7b632d0427b"><enum>(A)</enum><text display-inline="yes-display-inline">forgive any loan under this section unless Congress has authorized such forgiveness; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8ea24b3c8cfe4e1fa76cff0ace1243b3"><enum>(B)</enum><text display-inline="yes-display-inline">compromise on, suspend, or end collections on a debt owed to the Administration pursuant to paragraph (2) or (3) of section 3711(a) of title 31, United States Code.</text></subparagraph></paragraph><paragraph id="id556073dd7b214c768dae20c975cb0a17" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Referral of debt</header><text>If the Administrator seeks to discharge a debt and the discharge of such debt is limited under paragraph (1), the Administrator shall refer such debt to the Department of the Treasury for collection action, including a final determination regarding whether to suspend, end, or continue collection of the debt.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idCCC5C90DA3D145878243AD43EBE85897" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><enum>7.</enum><header>Limits on disaster loans</header><subsection commented="no" display-inline="no-display-inline" id="id278429c2bf5547379a230e7553ff87b1"><enum>(a)</enum><header display-inline="yes-display-inline">Low funding</header><text display-inline="yes-display-inline">Section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id26215ab32ffa4d688325b3f136a37d5e"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating the second paragraph designated as paragraph (16), relating to statute of limitations, as added by the COVID–19 EIDL Fraud Statute of Limitations Act of 2022 (<external-xref legal-doc="public-law" parsable-cite="pl/117/165">Public Law 117–165</external-xref>; 136 Stat. 1363), as paragraph (18); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3e9ed4e296184246b2c41e7edf070eac"><enum>(2)</enum><text>by inserting after paragraph (16), relating to disaster declarations in rural areas, as added by the Disaster Assistance for Rural Communities Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/249">Public Law 117–249</external-xref>; 136 Stat. 2350), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB3D56EA5471947C2847A6014A749196A" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><paragraph commented="no" display-inline="no-display-inline" id="idbe2bf78d8f514cd0a8a650f8a8387b0f"><enum>(17)</enum><header>Requirements when funding is low</header><subparagraph commented="no" display-inline="no-display-inline" id="id9711FD8E7391488CB9642847D8400C01"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 24 hours after the unobligated balance of amounts available for the cost of direct loans authorized by this subsection is less than 10 percent of the most recent appropriation for such costs, the Administrator shall notify the <committee-name committee-id="SSAP00">Committee on Appropriations</committee-name> and the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship of the Senate</committee-name> and the <committee-name committee-id="">Committee on Appropriations</committee-name> and the <committee-name committee-id="">Committee on Small Business of the House of Representatives</committee-name>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idef8f2c520c0243f798f2461975be1ec1"><enum>(B)</enum><header>Limitation on obligating funds</header><text display-inline="yes-display-inline">During the period beginning on the first business day occurring on or after the date by which the Administrator is required to notify Congress under subparagraph (A) and ending on the date on which additional amounts are appropriated for such costs, the Administrator may not obligate funds for a direct loan authorized under this subsection in an amount that is more than the amount of such a loan for which collateral is required.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id3305fcabc18f45c2968396b31291304d" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Repeal of authority To increase amount of loans for which collateral is not required</header><text>Section 7(d)(6) of the Small Business Act is amended by striking <quote>(or such higher amount as the Administrator determines appropriate in the event of a major disaster)</quote>.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="idc121935b125a4f98b038289fc308b36b" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><enum>8.</enum><header>Prohibition regarding SBA rules relating to disaster loans</header><subsection commented="no" display-inline="no-display-inline" id="id595bebf304e1479f9e94c0d0a8a47665"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id49cf690fc670423da909d6babf0fa020"><enum>(1)</enum><header>Cost</header><text>The term <term>cost</term> has the meaning given the term in section 502 of the Federal Credit Reform Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/661a">2 U.S.C. 661a</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8bbea696b1714369882cec37e38b8354"><enum>(2)</enum><header display-inline="yes-display-inline">Rule</header><text>The term <term>rule</term> has the meaning given the term in section 551 of title 5, United States Code.</text></paragraph></subsection><subsection id="id5a935a9af9184e51a472f3c23782bacd" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Prohibition</header><text>Notwithstanding any other provision of law or regulation, beginning on the date of enactment of this Act, the Administrator of the Small Business Administration may not issue any rule that will result in any increased cost to the program carried out under section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>). </text></subsection></section><section id="idb435bd620c0743d9ba8d01e418fd9c14" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><enum>9.</enum><header>GAO report on disaster loan changes</header><subsection commented="no" display-inline="no-display-inline" id="id332d0727847b479f8ec13e5a748c7ad4"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this section, the term <term>covered final rule</term> means—</text><paragraph commented="no" display-inline="no-display-inline" id="idede8df4b1ab24bb68043ddd0f34ea2ee"><enum>(1)</enum><text display-inline="yes-display-inline">the final rule entitled <quote>Disaster Assistance Loan Program Changes to Maximum Loan Amounts and Miscellaneous Updates</quote> (88 Fed. Reg. 59826 (July 24, 2024); RIN 3245–AI08).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb62a9c9f61e142e7a7ad54ac7bd055ba"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Small Business and Entrepreneurship and the Committee on Appropriations of the Senate and the Committee on Small Business and the Committee on Appropriations of the House of Representatives a report on—</text><paragraph commented="no" display-inline="no-display-inline" id="id46b8141fa5ee447f877ec6501c1a1c75"><enum>(1)</enum><text display-inline="yes-display-inline">the cost (as defined in section 502 of the Federal Credit Reform Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/661a">2 U.S.C. 661a</external-xref>)) of the increase in the home loan lending limits for, the extension of the deferment period for, the expansion of mitigation options for, the modifications to the criteria for determining whether applicants can obtain credit elsewhere with respect to, the changes to collateral requirements for, and other changes to the terms and conditions of loans under section 7(b)(1) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(1)</external-xref>) made by the covered final rules; and </text></paragraph><paragraph id="idd318dcff86844684a65a87ed89b11284" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the effect on the subsidy for such loans of the changes contained in the covered final rules. </text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id04fc1716018c4c8f9e860f9cb040d98d" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><enum>10.</enum><header>SBA Inspector General review</header><subsection commented="no" display-inline="no-display-inline" id="iddeff6733e6e146bd9e45517b082f963d"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph commented="no" display-inline="no-display-inline" id="id07f9691d27f64e31b590df27c6ecff91"><enum>(1)</enum><text>the term <term>covered amounts</term> means amounts made available for the cost of direct loans authorized by section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id30505d48cd0a44bbbdc0bf6987dffd50"><enum>(2)</enum><text>the term <term>Inspector General</term> means the Inspector General of the Administration.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide3b0a340ae204935825c81c1ebb0c308"><enum>(b)</enum><header>Review</header><paragraph commented="no" display-inline="no-display-inline" id="idb26a6f6d5ee943488302b1e9dda65e0c"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Inspector General shall conduct a review of the circumstances surrounding the funding shortfall with respect to covered amounts, as described in—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide0b20c5e3b6946eea0cb2cbf90b1fc85"><enum>(A)</enum><text display-inline="yes-display-inline">the letter from President Joseph R. Biden, Jr. entitled <quote>Letter to Congress on Disaster Needs</quote>, dated October 4, 2024; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9b16e8a8e6d54e518e6c983218cda2b9"><enum>(B)</enum><text>the letter from the Administrator submitted to the Chair and Ranking Members of the Committees on Appropriations of the Senate and the House of Representatives, dated October 10, 2024.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide3298633e8224431aaa19f51e5218048"><enum>(2)</enum><header>Contents</header><text>The review required under paragraph (1) shall include the following with respect to the funding shortfall described in that paragraph:</text><subparagraph commented="no" display-inline="no-display-inline" id="id6cea05c5911741e1bc049ea0ea769f33"><enum>(A)</enum><text>The identification of any reporting or notification requirements in statute that the Administration failed to provide to Congress with respect to the funding shortfall.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id804c273ecd364a73b9158e2715b154de"><enum>(B)</enum><text>The reason for any obligation or expenditure of covered amounts for a purpose that significantly diverged from the purpose for which the covered amounts were made available.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida74184c87761402195468199c9bc7ba7"><enum>(C)</enum><text>An analysis of the accuracy of projections and estimates relevant to the divergences described in subparagraph (B).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3f524f4cfcba4a35a97f370808493135"><enum>(D)</enum><text>The identification and description of any internal controls in place to manage covered amounts.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida0ae7b96cbd64c8eb4c81525a10911e1"><enum>(E)</enum><text>An analysis of the impact that any reorganization of the Administration, including the transfer of administrative authority for the program carried out under section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) to the Office of Capital Access of the Administration, may have had with respect to the funding shortfall.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4418fd03131045fb9917e2affce5066c"><enum>(F)</enum><text>The identification of actions that the Administration can take to— </text><clause commented="no" display-inline="no-display-inline" id="id1793c674781948f7a74298b7865a16a0"><enum>(i)</enum><text display-inline="yes-display-inline">improve the accuracy of information submitted by the President under section 1105(a) of title 31, United States Code, with respect to the Administration; </text></clause><clause commented="no" display-inline="no-display-inline" id="ide8d54ade652348f5a909619c33e3b7c1"><enum>(ii)</enum><text>prevent any future funding shortfall with respect to any account of the Administration; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida89ed5d581ea4287bed3f9c46ec6684f"><enum>(iii)</enum><text>improve the report submitted to the appropriate committees of Congress under section 12091(a) of the Small Business Disaster Response and Loan Improvements Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/15/636k">15 U.S.C. 636k(a)</external-xref>). </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id992c62d3da224389902f70d9e703145f"><enum>(G)</enum><text>Any other matter determined relevant by the Inspector General.</text></subparagraph></paragraph></subsection><subsection id="idec2a1681b33f41a08066de91c658d520" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Inspector General shall submit to the appropriate committees of Congress a report that contains the findings of the review carried out under subsection (b). </text></subsection></section><section id="idde69fbcd34c84eada15918a35a2280b3" changed="deleted" reported-display-style="strikethrough" committee-id="SSSB00"><enum>11.</enum><header>Budget and forecasting report regarding the cost of direct disaster loans</header><subsection commented="no" display-inline="no-display-inline" id="ide3e848c6b640454bb2d925ed14278564"><enum>(a)</enum><header display-inline="yes-display-inline">Budget formulation and forecasting</header><text>Not later than 30 days after the date of enactment of this Act, the Administrator shall submit to the appropriate committees of Congress a report detailing corrections the Administration will make to improve forecasting, data quality, and budget assumptions relating to budget submissions relating to amounts made available for the cost of direct loans authorized by section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>). </text></subsection><subsection id="idd883a8e50e024fc69511af7b0929a0cd"><enum>(b)</enum><header>Updates</header><text>Not later than 90 days after the date of enactment of this Act, and every 90 days thereafter until the date that is 90 days after the date on which all the corrections described in subsection (a) have been implemented, the Administrator shall submit to the appropriate committees of Congress a report— </text><paragraph commented="no" display-inline="no-display-inline" id="id58822b3f11064802a7a3b21236d7b439"><enum>(1)</enum><text display-inline="yes-display-inline">detailing the actions the Administration has taken to implement the corrections described in subsection (a); 136 Stat. 2350), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id546566a0-2468-4d9e-b3da-4166f5f0893b" changed="added" reported-display-style="italic" committee-id="SSSB00"><paragraph commented="no" display-inline="no-display-inline" id="idc28a5869-c6f7-43e9-ba52-acbbba574c9d"><enum>(17)</enum><header>Requirements when funding is low</header><subparagraph commented="no" display-inline="no-display-inline" id="id4938af71-ec22-49af-a45d-3139d3b7e0a2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 24 hours after the unobligated balance of amounts available for the cost of direct loans authorized by this subsection is less than 10 percent of the 10-year average annual cost provided in the most recent Presidential budget request required under section 1105(a)(39)(A) of title 31, United States Code, or, if unavailable, the 10-year average annual cost for the immediately preceding 10-year period of SBA disaster loans (as defined in section 1105(j) of such title), the Administrator shall notify the <committee-name committee-id="SSAP00">Committee on Appropriations</committee-name> and the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship of the Senate</committee-name> and the <committee-name committee-id="">Committee on Appropriations</committee-name> and the <committee-name committee-id="">Committee on Small Business of the House of Representatives</committee-name>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3399673f-3691-4fd0-876f-9a054a20629c"><enum>(B)</enum><header>Limitation on obligating funds</header><text display-inline="yes-display-inline">During the period beginning on the first business day occurring on or after the date by which the Administrator is required to notify Congress under subparagraph (A) and ending on the date on which additional amounts are appropriated for such costs, the Administrator may limit the obligation of funds for a direct loan authorized under this subsection to the amount of such a loan for which collateral is required.</text></subparagraph><subparagraph id="id4e1c2828a4034258a12ee3e49de094ce"><enum>(C)</enum><header>Authority to limit obligation of funds</header><text>In carrying out the authority to enact a limitation under (B), the Administrator shall apply that limitation with respect to amounts obligated for all direct loans authorized under this subsection during the period described in subparagraph (B).</text></subparagraph><subparagraph id="ideffd4a48fc104bbeaa7ccd0a6b58ff5e"><enum>(D)</enum><header>Requirement to disburse within 14 days</header><text>If the Administrator exercises the authority under (B), the Administrator shall, not later than 14 days after the date on which additional amounts are appropriated under subparagraph (B), obligate and disburse on a regular schedule any remaining amount outstanding on a direct loan authorized under this subsection.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idd846abae1cbd4a1080c45362655fc10e"><enum>(b)</enum><header>Sunset</header><text>Effective on the date that is 4 years after the date of enactment of this Act, section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idba80372572644a9593e7c7d3b1203ec3"><enum> (1)</enum><text display-inline="yes-display-inline">by striking paragraph (17); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3ce88995e15e414f824ad97d797aad4b"><enum>(2)</enum><text>by redesignating paragraph (18) as paragraph (17).</text></paragraph></subsection><subsection id="id89d8c13bf8d64328956092da66eb51d9"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, in the event that the Administrator exercises the authority described in paragraph (17)(B) of section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>), as added by subsection (a), the Comptroller General of the United States shall submit to the appropriate committees of Congress a report assessing the actual and potential impact of the amendments made by subsection (a) during the period covered by the report.</text></subsection></section><section id="id583b85371eba4ffdbbb391e0cceaa4b0" changed="added" reported-display-style="italic" committee-id="SSSB00"><enum>7.</enum><header>GAO report on SBA disaster loan account</header><subsection id="id582a6dc944de45928dcded0170baeef8"><enum>(a)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Administrator and the appropriate committees of Congress a report on—</text><paragraph id="idd91bd1bd93334066a358fe050c4e1113"><enum>(1)</enum><text>the average weekly rate at which the Administration obligates the unobligated balance of amounts available for the cost of SBA disaster loans;</text></paragraph><paragraph id="id8e32ef50b44846139cb592c398e264f3"><enum>(2)</enum><text>the average amount, during the periods beginning on October 1, 2015 and ending on July 31, 2023 and beginning on July 31, 2023 and ending on the date of enactment of this Act, respectively, disbursed to a borrower each week, during the initial 12-week period in which a borrower receives amounts from an SBA disaster loan, beginning the day after the borrower accepts their loan, separated by home SBA disaster loan borrowers, business SBA disaster loan borrowers, and economic injury disaster loan borrowers; and</text></paragraph><paragraph id="id7d5f6752d7844460908023ddcc03ed59"><enum>(3)</enum><text>the average amount of fully disbursed SBA disaster loans, originated during the period beginning on July 31, 2023 and ending on the date of enactment of this Act, with separate averages for SBA disaster loans delineated by home, business, and economic injury disaster loans.</text></paragraph></subsection><subsection id="ida21b061034b34956b96b90ae994cb25c"><enum>(b)</enum><header>Response</header><text>Not later than 90 days after the date on which the Comptroller General of the United States submits the report under subsection (a), the Administrator shall submit to the appropriate committees of Congress a response to the report, including an implementation plan for any recommendations in the report.</text></subsection></section><section id="id0cdfbdfe-ac66-44f8-a045-6cd93212e64f" changed="added" reported-display-style="italic" committee-id="SSSB00"><enum>8.</enum><header>GAO report on disaster loan changes</header><subsection commented="no" display-inline="no-display-inline" id="iddbf1fd64-0f64-4bae-b76d-d44a235244c1"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this section, the term <term>covered final rule</term> means—</text><paragraph commented="no" display-inline="no-display-inline" id="id14c99713-dd0c-452e-89c4-12106bca1f26"><enum>(1)</enum><text display-inline="yes-display-inline">the final rule entitled <quote>Disaster Assistance Loan Program Changes to Maximum Loan Amounts and Miscellaneous Updates</quote> (88 Fed. Reg. 39335 (June 16, 2023); RIN 3245–AH91); or </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8693f5d5-25e7-4d58-afad-d0f801ce626b"><enum>(2)</enum><text display-inline="yes-display-inline">the final rule entitled <quote>Disaster Assistance Loan Program Changes to Unsecured Loan Amounts and Credit Elsewhere Criteria</quote> (89 Fed. Reg. 59826 (July 24, 2024); RIN 3245–AI08).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id949d58e4-bcbc-4f4a-9897-dd30525e68f7"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to the appropriate committees of Congress a report on—</text><paragraph commented="no" display-inline="no-display-inline" id="id563010b2-e4a5-4e0a-8550-b400036aada5"><enum>(1)</enum><text display-inline="yes-display-inline">the cost (as defined in section 502 of the Federal Credit Reform Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/2/661a">2 U.S.C. 661a</external-xref>)) of the increase in the home loan lending limits for, the extension of the deferment period for, the expansion of mitigation options for, the modifications to the criteria for determining whether applicants can obtain credit elsewhere with respect to, the changes to collateral requirements for, and other changes to the terms and conditions of loans under section 7(b)(1) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(1)</external-xref>) made by the covered final rules; and </text></paragraph><paragraph id="ide0c6b26e-76b3-4746-91ab-15ff6abb9266" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the effect on the subsidy for such loans of the changes contained in the covered final rules. </text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idc72c66b8-fb63-4fc9-9307-33d8f8e02ad9" changed="added" reported-display-style="italic" committee-id="SSSB00"><enum>9.</enum><header>SBA Inspector General review</header><subsection commented="no" display-inline="no-display-inline" id="idf96de528-afb3-407e-9007-65085138d8f3"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph commented="no" display-inline="no-display-inline" id="ida36af781-f151-4a05-87e6-5c6cb86ee1ea"><enum>(1)</enum><text>the term <term>covered amounts</term> means amounts made available for the cost of direct loans authorized by section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide6f4e667-270f-4f91-9d36-a6d6a43aba00"><enum>(2)</enum><text>the term <term>Inspector General</term> means the Inspector General of the Administration.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id75a9fa54-9641-4ff6-b57e-38e8d1b511e4"><enum>(b)</enum><header>Review</header><paragraph commented="no" display-inline="no-display-inline" id="id3ab6cab0-af5d-476d-8dc7-f78a7c372687"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Inspector General shall conduct a review of the circumstances surrounding the funding shortfall with respect to covered amounts, as described in—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida1716622-0327-42ae-8fe9-54fda4e6b2d7"><enum>(A)</enum><text display-inline="yes-display-inline">the letter from President Joseph R. Biden, Jr. entitled <quote>Letter to Congress on Disaster Needs</quote>, dated October 4, 2024; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3e04feb1-d7a1-4fe5-92ad-592953f27675"><enum>(B)</enum><text>the letter from the Administrator submitted to the Chair and Ranking Members of the Committees on Appropriations of the Senate and the House of Representatives, dated October 10, 2024.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id051c3e80-94bf-4c2d-9b2a-d1b4c434d2c9"><enum>(2)</enum><header>Contents</header><text>The review required under paragraph (1) shall include the following with respect to the funding shortfall described in that paragraph:</text><subparagraph commented="no" display-inline="no-display-inline" id="id42bdc8de-37a9-4d4e-9913-b0cfeeef4c5d"><enum>(A)</enum><text>The identification of any report or notification required by statute that the Administration failed to provide to Congress with respect to the funding shortfall.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id48a629c2-00f6-4b25-90f6-df37cdf7fef0"><enum>(B)</enum><text>The reason for any obligation or expenditure of covered amounts for a purpose that significantly diverged from the purpose for which the covered amounts were made available.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf1536993-e886-46a3-b158-9e003c54d692"><enum>(C)</enum><text>An analysis of the accuracy of projections and estimates relevant to the divergences described in subparagraph (B).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideabb1f13-bae2-4e23-8881-c18f9e405773"><enum>(D)</enum><text>The identification and description of any internal controls in place to manage covered amounts.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc67ddb68-1fe3-4bb5-aa69-66f2142d46e9"><enum>(E)</enum><text>An analysis of the impact that any reorganization of the Administration, including the transfer of administrative authority for the program carried out under section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) to the Office of Capital Access of the Administration, may have had with respect to the funding shortfall.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id10d47bba-9def-4b22-abc2-4555ae2e2ac5"><enum>(F)</enum><text>The identification of actions that the Administration can take to— </text><clause commented="no" display-inline="no-display-inline" id="ide4872b75-2120-4d32-8cf6-8e5959e8abf6"><enum>(i)</enum><text display-inline="yes-display-inline">improve the accuracy of information submitted by the President under section 1105(a) of title 31, United States Code, with respect to the Administration; </text></clause><clause commented="no" display-inline="no-display-inline" id="id1178f92d-11ec-4758-b5bf-ccc0f9eb088f"><enum>(ii)</enum><text>prevent any future funding shortfall with respect to any account of the Administration; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id43be0043-182d-4060-b5cc-f879b898c308"><enum>(iii)</enum><text>improve the reports submitted to the appropriate committees of Congress under section 12091(a) of the Small Business Disaster Response and Loan Improvements Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/15/636k">15 U.S.C. 636k(a)</external-xref>). </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5891aba5-d0ac-4ed2-86b7-b5c9690d7302"><enum>(G)</enum><text>Any other matter determined relevant by the Inspector General.</text></subparagraph></paragraph></subsection><subsection id="id43a7068e-7da3-460c-864f-61be306ca7e2" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this Act, the Inspector General shall submit to the appropriate committees of Congress a report that contains the findings of the review carried out under subsection (b). </text></subsection></section><section id="id000a7bff-536c-4000-adbc-73f123a42fc9" changed="added" reported-display-style="italic" committee-id="SSSB00"><enum>10.</enum><header>Budget and forecasting report regarding the cost of direct disaster loans</header><subsection commented="no" display-inline="no-display-inline" id="id0272a35d-cd44-4a1a-bd73-b74c873229a2"><enum>(a)</enum><header display-inline="yes-display-inline">Budget formulation and forecasting</header><text>Not later than 30 days after the date of enactment of this Act, the Administrator shall submit to the appropriate committees of Congress a report detailing corrections the Administration will make to improve forecasting, data quality, and budget assumptions relating to budget submissions relating to amounts made available for the cost of SBA disaster loans. </text></subsection><subsection id="id65dd4192-e947-467c-a5d8-ee70a9dc2298"><enum>(b)</enum><header>Updates</header><text>Not later than 90 days after the date of enactment of this Act, and every 90 days thereafter until the date that is 90 days after the date on which all the corrections described in subsection (a) have been implemented, the Administrator shall submit to the appropriate committees of Congress a report— </text><paragraph commented="no" display-inline="no-display-inline" id="idf1be178f-c7c6-4d2b-ba02-0f745e8aa788"><enum>(1)</enum><text display-inline="yes-display-inline">detailing the actions the Administration has taken to implement the corrections described in subsection (a); and</text></paragraph><paragraph id="id18beb585-18c5-4816-b898-83a03b1f023a" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">explaining how each action detailed under paragraph (1) is directly related to implementing 1 or more corrections described in subsection (a). </text></paragraph></subsection></section></legis-body><endorsement><action-date date="20250304">March 4, 2025</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
