which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish appropriate rules for prosecutors and Federal judges to carry a concealed firearm.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H0FF4C52A5101483D861C7A1A8BCDAEFA"><section section-type="section-one" id="H91D15DF4B645425C8A0D013B7FD61C31"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect Our Prosecutors and Judges Act of 2025</short-title></quote>.</text></section><section id="H26BDFF09746544C3B195766A96816E4C"><enum>2.</enum><header>Authority to carry a concealed firearm for prosecutors and Federal judges</header><subsection id="idB74590C3B45E4C4587266524457F30C0"><enum>(a)</enum><header>Current prosecutors and Federal judges</header><text>Section 926B of title 18, United States Code, is amended— </text><paragraph id="id0789C2309C46489397EE93229B3A5178"><enum>(1)</enum><text>in the section heading, by inserting <quote><header-in-text level="section" style="USC">, qualified prosecutors, and qualified Federal judges</header-in-text></quote> after <quote><header-in-text level="section" style="USC">qualified law enforcement officers</header-in-text></quote>; </text></paragraph><paragraph id="idDE81D87E7FB842F7994C59F693348C3D"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="idBE07F792048840118D4D669E7F6B3F8F"><enum>(A)</enum><text>by inserting <quote>, a qualified prosecutor, or a qualified Federal judge</quote> after <quote>qualified law enforcement officer</quote>; and</text></subparagraph><subparagraph id="id0BA61CBB833D4719A245046E8EED4F30"><enum>(B)</enum><text>by striking <quote>subsection (d)</quote> and inserting <quote>subsection (c)</quote>;</text></subparagraph></paragraph><paragraph id="id45EFAC4AF4C94797B668B525EDF09FDA"><enum>(3)</enum><text>by striking subsections (c), (d), and (e) and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id45E16A08A5314932AFA31A43B34A4B51"><subsection id="id8bbc32d8-6f68-11ea-9975-a701de0c24c0"><enum>(c)</enum><text>The identification required by this subsection is—</text><paragraph id="idF771DF78122245E0B4E305340EB335D3"><enum>(1)</enum><text>with respect to a qualified law enforcement officer, the photographic identification issued by the governmental agency for which the individual is employed that identifies the employee as a police officer or law enforcement officer of the agency; </text></paragraph><paragraph id="idD9F12EBBFCB44C2C8519F5F832F89E41"><enum>(2)</enum><text>with respect to a qualified prosecutor—</text><subparagraph id="id51B8562C34804965A7E6BDC67C9E77B2"><enum>(A)</enum><text>the photographic identification issued by the governmental agency by which the individual is employed that identifies the employee as a prosecutor of the agency; and</text></subparagraph><subparagraph id="id3B24B377FD6446A5BA91AD8E2FE3644E"><enum>(B)</enum><text>a certification— </text><clause id="idE8650EA3C4694C85BE568FA3DF3C2807"><enum>(i)</enum><text>if agency employing the qualified prosecutor has authorized the qualified prosecutor to carry a firearm, that indicates that the qualified prosecutor has been tested or otherwise found by the agency to meet the active duty standards for qualification in firearms training as established by the agency to carry a firearm of the same type as the concealed firearm; or</text></clause><clause id="idD41DBD36996F425F983FD212BA26279E"><enum>(ii)</enum><text>if the agency employing the qualified prosecutor has not authorized the qualified prosecutor to carry a firearm, issued by the State in which the qualified prosecutor resides or by a certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State that indicates that the qualified prosecutor has been tested or otherwise found by the State or certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State to have met—</text><subclause id="id9145FE6C49504A3083B436A870C13A6F"><enum>(I)</enum><text>the active duty standards for qualification in firearms training, as established by the State, to carry a firearm of the same type as the concealed firearm; or</text></subclause><subclause id="idDEFCF525121B4621BD90E68F23C25E04"><enum>(II)</enum><text>if the State has not established such standards, standards set by any law enforcement agency within that State to carry a firearm of the same type as the concealed firearm; and </text></subclause></clause></subparagraph></paragraph><paragraph id="idD07485BDA6824801A25C2E663F616F8F"><enum>(3)</enum><text>with respect to a qualified Federal judge—</text><subparagraph id="id23217C99A02841F38E6A9FC6B1DE36F9"><enum>(A)</enum><text>photographic identification issued by the Federal Government that identifies the individual as a Federal judge; and</text></subparagraph><subparagraph id="idD786E8B29C6E466E894F16D2339048D9"><enum>(B)</enum><text>a certification issued by the State in which the Federal judge resides or by a certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State that indicates that the individual has been tested or otherwise found by the State or certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State to have met—</text><clause id="id895A38BFA8DA4D66BF3FFC644C50404D"><enum>(i)</enum><text>the active duty standards for qualification in firearms training, as established by the State, to carry a firearm of the same type as the concealed firearm; or</text></clause><clause id="id4E3CFF9D6576453AAD9ABA96B03DD9AA"><enum>(ii)</enum><text>if the State has not established such standards, standards set by any law enforcement agency within that State to carry a firearm of the same type as the concealed firearm.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="idC5734C6227024BC78632170463C41EA5"><enum>(4)</enum><text>by redesignating subsection (f) as subsection (d); and</text></paragraph><paragraph id="id42481D56EC7E4A349119636823BCF6A3"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB9A0702EDE864E708C605C6D3A5E8B3D"><subsection id="id8bbc0bc1-6f68-11ea-9975-a701de0c24c0"><enum>(e)</enum><text>As used in this section— </text><paragraph commented="no" display-inline="no-display-inline" id="id8bbc32d9-6f68-11ea-9975-a701de0c24c0"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>firearm</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8bbc32da-6f68-11ea-9975-a701de0c24c0"><enum>(A)</enum><text>except as provided in this paragraph, has the same meaning as in section 921 of this title;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8bbc32db-6f68-11ea-9975-a701de0c24c0"><enum>(B)</enum><text>includes ammunition not expressly prohibited by Federal law or subject to the provisions of the National Firearms Act; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8bbc32dc-6f68-11ea-9975-a701de0c24c0"><enum>(C)</enum><text>does not include—</text><clause id="id8bbc32dd-6f68-11ea-9975-a701de0c24c0"><enum>(i)</enum><text>any machinegun (as defined in section 5845 of the National Firearms Act);</text></clause><clause id="id8bbc32de-6f68-11ea-9975-a701de0c24c0"><enum>(ii)</enum><text>any firearm silencer (as defined in section 921 of this title); and</text></clause><clause id="id8bbc32df-6f68-11ea-9975-a701de0c24c0"><enum>(iii)</enum><text>any destructive device (as defined in section 921 of this title); </text></clause></subparagraph></paragraph><paragraph id="id3C381029EEEA43E3837D2CC355ADF481"><enum>(2)</enum><text>the term <term>qualified Federal judge</term> means an individual who—</text><subparagraph id="idA8995A088A2247AD99F4E81922D5AA76"><enum>(A)</enum><text>is serving in a position as a judge that is established under article I, III, or IV of the Constitution of the United States; </text></subparagraph><subparagraph id="id957B3EACB1314434A53682B834F87861"><enum>(B)</enum><text>is not the subject of a pending impeachment inquiry or trial; </text></subparagraph><subparagraph id="ida43ef8b9a10845a6868e3a39fad348b4"><enum>(C)</enum><text>is not under the influence of alcohol or another intoxicating or hallucinatory drug or substance; and </text></subparagraph><subparagraph id="id66FDB4DEB99648AE978F85497844FB14"><enum>(D)</enum><text>is not prohibited by Federal law from receiving a firearm; </text></subparagraph></paragraph><paragraph id="idEAB5207780DB4E2E9269635DFF49D8E2"><enum>(3)</enum><text>the term <term>qualified law enforcement officer</term> means an employee of a governmental agency who—</text><subparagraph id="id8bbc0bc2-6f68-11ea-9975-a701de0c24c0"><enum>(A)</enum><text>is authorized by law to engage in or supervise the prevention, detection, investigation or prosecution of, or the incarceration of any person for, any violation of law, and has statutory powers of arrest or apprehension under section 807(b) of title 10, United States Code (article 7(b) of the Uniform Code of Military Justice);</text></subparagraph><subparagraph id="id8bbc0bc3-6f68-11ea-9975-a701de0c24c0"><enum>(B)</enum><text>is authorized by the agency to carry a firearm;</text></subparagraph><subparagraph id="id8bbc0bc4-6f68-11ea-9975-a701de0c24c0"><enum>(C)</enum><text>is not the subject of any disciplinary action by the agency which could result in suspension or loss of police powers;</text></subparagraph><subparagraph id="id8bbc0bc5-6f68-11ea-9975-a701de0c24c0"><enum>(D)</enum><text>meets standards, if any, established by the agency which require the employee to regularly qualify in the use of a firearm;</text></subparagraph><subparagraph id="id8bbc0bc6-6f68-11ea-9975-a701de0c24c0"><enum>(E)</enum><text>is not under the influence of alcohol or another intoxicating or hallucinatory drug or substance; and</text></subparagraph><subparagraph id="id8bbc0bc7-6f68-11ea-9975-a701de0c24c0"><enum>(F)</enum><text>is not prohibited by Federal law from receiving a firearm; and</text></subparagraph></paragraph><paragraph id="id21F068148F8B47F0BA6683A22D7B79FD"><enum>(4)</enum><text>the term <term>qualified prosecutor</term> means an individual who—</text><subparagraph id="idC89B70D72E314943BCED692CB6616912"><enum>(A)</enum><text>is a full-time employee of an agency of the Federal Government or a State or unit of local government who—</text><clause id="id51c9bdcd47fd43e6af5dad935cd03fd5"><enum>(i)</enum><text>is continually licensed to practice law; and</text></clause><clause id="id6f9b4e1115b84e649e0984ecda5501f1"><enum>(ii)</enum><text>prosecutes criminal or juvenile delinquency cases at the Federal, State, or local level (including supervision, education, or training of other persons prosecuting such cases); </text></clause></subparagraph><subparagraph id="idF421209B0F9148D0A687859C0151EF17"><enum>(B)</enum><text>is not the subject of any disciplinary action by the agency which could result in suspension;</text></subparagraph><subparagraph id="id382D77B199EA4EE3AD8FC478EDFA6411"><enum>(C)</enum><text>meets standards, if any, established by the agency which require the employee to regularly qualify in the use of a firearm;</text></subparagraph><subparagraph id="id0DA536F2BAE2472DA396190EDC361448"><enum>(D)</enum><text>is not under the influence of alcohol or another intoxicating or hallucinatory drug or substance; and</text></subparagraph><subparagraph id="id054EC1C601054EFCABB8D753F135C45F"><enum>(E)</enum><text>is not prohibited by Federal law from receiving a firearm.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id160615B1042B4212AF00A4600A0F4D7A"><enum>(b)</enum><header>Retired prosecutors and Federal judges</header><text>Section 926C of title 18, United States Code, is amended— </text><paragraph id="idCF29310FC857456BACA8E1902D0F907C"><enum>(1)</enum><text>in the section heading, by inserting <quote><header-in-text level="section" style="USC">, qualified retired prosecutors, and qualified retired Federal judges</header-in-text></quote> after <quote><header-in-text level="section" style="USC">qualified retired law enforcement officers</header-in-text></quote>; </text></paragraph><paragraph id="id84317D5E0E324199AB5EE6DC72D09F8C"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="idCE3D9162EAB540799B5C7908743DA3B3"><enum>(A)</enum><text>by inserting <quote>, a qualified retired prosecutor, or a qualified Federal judge</quote> after <quote>qualified law enforcement officer</quote>; and</text></subparagraph><subparagraph id="id87BAB41CC1FC49109D187BF828EA17DE"><enum>(B)</enum><text>by striking <quote>subsection (d)</quote> and inserting <quote>subsection (c)</quote>; and</text></subparagraph></paragraph><paragraph id="id7E3287EDD345415BA859B82D41D0C4E5"><enum>(3)</enum><text>by striking subsections (c), (d), and (e) and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idF1263C2285594C928361646319810719"><subsection id="idFE77B46AA3184777B409AB91CAE4ED9C"><enum>(c)</enum><text>The identification required by this subsection is—</text><paragraph id="idE298711235E64C1D8C3BAAB47A03E06E"><enum>(1)</enum><text>with respect to a qualified retired law enforcement officer—</text><subparagraph id="id8bbc8118-6f68-11ea-9975-a701de0c24c0"><enum>(A)</enum><text>a photographic identification issued by the agency from which the individual separated from service as a law enforcement officer that identifies the person as having been employed as a police officer or law enforcement officer and indicates that the individual has, not less recently than 1 year before the date the individual is carrying the concealed firearm, been tested or otherwise found by the agency to meet the active duty standards for qualification in firearms training as established by the agency to carry a firearm of the same type as the concealed firearm; or</text></subparagraph><subparagraph id="id8bbc8119-6f68-11ea-9975-a701de0c24c0"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id8bbc811a-6f68-11ea-9975-a701de0c24c0"><enum>(i)</enum><text>a photographic identification issued by the agency from which the individual separated from service as a law enforcement officer that identifies the person as having been employed as a police officer or law enforcement officer; and</text></clause><clause id="id8bbc811b-6f68-11ea-9975-a701de0c24c0" indent="up1"><enum>(ii)</enum><text>a certification issued by the State in which the individual resides or by a certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State that indicates that the individual has, not less than 1 year before the date the individual is carrying the concealed firearm, been tested or otherwise found by the State or certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State to have met—</text><subclause id="id8bbc811c-6f68-11ea-9975-a701de0c24c0"><enum>(I)</enum><text>the active duty standards for qualification in firearms training, as established by the State, to carry a firearm of the same type as the concealed firearm; or</text></subclause><subclause id="id8bbc811d-6f68-11ea-9975-a701de0c24c0"><enum>(II)</enum><text>if the State has not established such standards, standards set by any law enforcement agency within that State to carry a firearm of the same type as the concealed firearm; </text></subclause></clause></subparagraph></paragraph><paragraph id="idCFA9B32F8AF046FF9E6FF719F829B4A9"><enum>(2)</enum><text>with respect to a qualified retired prosecutor—</text><subparagraph id="idCE2DE2D260D8408FA39C382660583BEC"><enum>(A)</enum><text>the photographic identification issued by the governmental agency by which the individual was employed that identifies the individual as a former prosecutor of the agency; and</text></subparagraph><subparagraph id="id3844A08D7ECE4AE8860ECBA799F4F9B0"><enum>(B)</enum><text>a certification issued by the State in which the qualified retired prosecutor resides or by a certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State that indicates that the qualified retired prosecutor has, not less than 1 year before the date the qualified retired prosecutor is carrying the concealed firearm, been tested or otherwise found by the State or certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State to have met—</text><clause id="id15CB76B366704D4B9DAC0644F33B5452"><enum>(i)</enum><text>the active duty standards for qualification in firearms training, as established by the State, to carry a firearm of the same type as the concealed firearm; or</text></clause><clause id="id2C86BD0C2CF34B4189A625E5E8C5CB9A"><enum>(ii)</enum><text>if the State has not established such standards, standards set by any law enforcement agency within that State to carry a firearm of the same type as the concealed firearm; and </text></clause></subparagraph></paragraph><paragraph id="id518E7A911369406CA81169A18DA4E9CC"><enum>(3)</enum><text>with respect to a qualified retired Federal judge—</text><subparagraph id="idE3CA338B2C2D4E9AAB196B9B860B79F5"><enum>(A)</enum><text>photographic identification issued by the Federal Government that identifies the individual as a former Federal judge; and</text></subparagraph><subparagraph id="idEE522A9C7FC447F8BF2DE8CBC69C4CE6"><enum>(B)</enum><text>a certification issued by the State in which the Federal judge resides or by a certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State that indicates that the individual has, not less than 1 year before the date the individual is carrying the concealed firearm, been tested or otherwise found by the State or certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State to have met—</text><clause id="id333148A7244142799EE2CD0DB135F2BF"><enum>(i)</enum><text>the active duty standards for qualification in firearms training, as established by the State, to carry a firearm of the same type as the concealed firearm; or</text></clause><clause id="idAF8ABC7621A04318B4A8D01C8EBCB025"><enum>(ii)</enum><text>if the State has not established such standards, standards set by any law enforcement agency within that State to carry a firearm of the same type as the concealed firearm.</text></clause></subparagraph></paragraph></subsection><subsection id="idA933A71C60C24A8C975263CE1495A5EA"><enum>(d)</enum><text>As used in this section— </text><paragraph commented="no" display-inline="no-display-inline" id="id4E6958E4AEA34EBF8AD943AA01396E4F"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>firearm</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idE42703D83D74478CA07E78D9C2454359"><enum>(A)</enum><text>except as provided in this paragraph, has the same meaning as in section 921 of this title;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAD9D0E4E59DC436AAD764ABBC407F96E"><enum>(B)</enum><text>includes ammunition not expressly prohibited by Federal law or subject to the provisions of the National Firearms Act; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id890FAEF0BC1447E38924FF4EC101E60D"><enum>(C)</enum><text>does not include—</text><clause id="id45BDB49FEC6741CD997875ACC3F95E28"><enum>(i)</enum><text>any machinegun (as defined in section 5845 of the National Firearms Act);</text></clause><clause id="idFBD273D775BD47E0B86DB596D63B8B27"><enum>(ii)</enum><text>any firearm silencer (as defined in section 921 of this title); and</text></clause><clause id="id4CB558B83ECF4663ADE6AF97FABA8BA4"><enum>(iii)</enum><text>any destructive device (as defined in section 921 of this title); </text></clause></subparagraph></paragraph><paragraph id="id81E1EAF9026C46D6B0E4ECF60EFD2FA3"><enum>(2)</enum><text>the term <term>qualified retired Federal judge</term> means an individual who—</text><subparagraph id="id799292B926064455B89BFD0FCCB34A62"><enum>(A)</enum><text>separated from service in good standing from service in a position as a judge that was established under article I, III, or IV of the Constitution of the United States; </text></subparagraph><subparagraph id="idE6D41C07AA844A679E904105DE316D83"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id82C1B2D0C431421B93080083F712448B"><enum>(i)</enum><text>has not been officially found by a qualified medical professional employed by the Federal Government to be unqualified for reasons relating to mental health and as a result of this finding will not be issued the photographic identification as described in subsection (c)(3); and</text></clause><clause id="idB5E627720C1D459383EF97F2FB886B46" indent="up1"><enum>(ii)</enum><text>has not entered into an agreement with the Federal Government in which that individual acknowledges he or she is not qualified under this section for reasons relating to mental health and for those reasons will not receive or accept the photographic identification as described in subsection (c)(3); </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA8F36459F15D4295A73BB5D1F5C5D89F"><enum>(C)</enum><text>during the most recent 12-month period, has met, at the expense of the individual, the standards for qualification in firearms training for active law enforcement officers, as determined by the State in which the individual resides or, if the State has not established such standards, either a law enforcement agency within the State in which the individual resides or the standards used by a certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State; </text></subparagraph><subparagraph id="idADE2E15D5C084F7EAFFBFCA77C3879FD"><enum>(D)</enum><text>is not under the influence of alcohol or another intoxicating or hallucinatory drug or substance; and</text></subparagraph><subparagraph id="idCD6F77D4403C496C8B248F62C7195540"><enum>(E)</enum><text>is not prohibited by Federal law from receiving a firearm; </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8bbc59fb-6f68-11ea-9975-a701de0c24c0"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>qualified retired law enforcement officer</term> means an individual who—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8bbc59fc-6f68-11ea-9975-a701de0c24c0"><enum>(A)</enum><text>separated from service in good standing from service with a public agency as a law enforcement officer;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8bbc59fd-6f68-11ea-9975-a701de0c24c0"><enum>(B)</enum><text>before such separation, was authorized by law to engage in or supervise the prevention, detection, investigation, or prosecution of, or the incarceration of any person for, any violation of law, and had statutory powers of arrest or apprehension under section 807(b) of title 10, United States Code (article 7(b) of the Uniform Code of Military Justice);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8bbc59fe-6f68-11ea-9975-a701de0c24c0"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id8bbc59ff-6f68-11ea-9975-a701de0c24c0"><enum>(i)</enum><text>before such separation, served as a law enforcement officer for an aggregate of 10 years or more; or</text></clause><clause id="id8bbc8110-6f68-11ea-9975-a701de0c24c0" indent="up1"><enum>(ii)</enum><text>separated from service with such agency, after completing any applicable probationary period of such service, due to a service-connected disability, as determined by such agency;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8bbc8111-6f68-11ea-9975-a701de0c24c0"><enum>(D)</enum><text>during the most recent 12-month period, has met, at the expense of the individual, the standards for qualification in firearms training for active law enforcement officers, as determined by the former agency of the individual, the State in which the individual resides or, if the State has not established such standards, either a law enforcement agency within the State in which the individual resides or the standards used by a certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8bbc8112-6f68-11ea-9975-a701de0c24c0"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="id8bbc8113-6f68-11ea-9975-a701de0c24c0"><enum>(i)</enum><text>has not been officially found by a qualified medical professional employed by the agency to be unqualified for reasons relating to mental health and as a result of this finding will not be issued the photographic identification as described in subsection (c)(1); or</text></clause><clause id="id8bbc8114-6f68-11ea-9975-a701de0c24c0" indent="up1"><enum>(ii)</enum><text>has not entered into an agreement with the agency from which the individual is separating from service in which that individual acknowledges he or she is not qualified under this section for reasons relating to mental health and for those reasons will not receive or accept the photographic identification as described in subsection (c)(1);</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8bbc8115-6f68-11ea-9975-a701de0c24c0"><enum>(F)</enum><text>is not under the influence of alcohol or another intoxicating or hallucinatory drug or substance; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8bbc8116-6f68-11ea-9975-a701de0c24c0"><enum>(G)</enum><text>is not prohibited by Federal law from receiving a firearm; and</text></subparagraph></paragraph><paragraph id="id5718A14E262B40ADBEA583986D095018"><enum>(4)</enum><text>the term <term>qualified retired prosecutor</term> means an individual who—</text><subparagraph id="id6B9102E691FE4FB4ABC343E8B8E36DD8"><enum>(A)</enum><text>separated from service in good standing from service as a full-time employee of an agency of the Federal Government or a State or unit of local government who—</text><clause id="id28D88261F1CA42058C4C6BB28E9FD797"><enum>(i)</enum><text>during such service was continually licensed to practice law; and</text></clause><clause id="idA3562639F8CA4D85A6011BA630024594"><enum>(ii)</enum><text>prosecuted criminal or juvenile delinquency cases at the Federal, State, or local level (including supervision, education, or training of other persons prosecuting such cases); </text></clause></subparagraph><subparagraph id="id1C0A82D3B97D44C6A30A6DD9BDABC137"><enum>(B)</enum><text>before such separation, served as described in subparagraph (A) for an aggregate of 10 years or more; </text></subparagraph><subparagraph id="idE59373EE80054C068B1AC72C2A316B5E"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id39EE0D5E408944C69679351306AF548C"><enum>(i)</enum><text>has not been officially found by a qualified medical professional employed by the agency to be unqualified for reasons relating to mental health and as a result of this finding will not be issued the photographic identification as described in subsection (c)(2); and</text></clause><clause id="id4BA98494FAA04561A8D13FE4060CFA98" indent="up1"><enum>(ii)</enum><text>has not entered into an agreement with the agency in which that individual acknowledges he or she is not qualified under this section for reasons relating to mental health and for those reasons will not receive or accept the photographic identification as described in subsection (c)(2); </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1EABF656E26A408FB983685FBC4528FD"><enum>(D)</enum><text>during the most recent 12-month period, has met, at the expense of the individual, the standards for qualification in firearms training for active law enforcement officers, as determined by the former agency of the individual, the State in which the individual resides or, if the State has not established such standards, either a law enforcement agency within the State in which the individual resides or the standards used by a certified firearms instructor that is qualified to conduct a firearms qualification test for active duty officers within that State; </text></subparagraph><subparagraph id="idB672DC8190C5414BA432DBB90DFCD1F8"><enum>(E)</enum><text>is not under the influence of alcohol or another intoxicating or hallucinatory drug or substance; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC6DF7C319901424A9F51E7CA9C905271"><enum>(F)</enum><text>is not prohibited by Federal law from receiving a firearm.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id53CE5FDA546B4C20A4C81576806E4807"><enum>(c)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, is amended by striking the items relating to sections 926B and 926C and inserting the following: </text><quoted-block style="USC" id="idfc191a6c-5dd4-42bc-8567-8dc2cddf4fc1"><toc><toc-entry level="section">926B. Carrying of concealed firearms by qualified law enforcement officers, qualified prosecutors, and qualified Federal judges. </toc-entry><toc-entry level="section">926C. Carrying of concealed firearms by qualified retired law enforcement officers, qualified retired prosecutors, and qualified retired Federal judges.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id2F71866728FA47279F513E092BBCFE20"><enum>(d)</enum><header>Regulations</header><text>The Attorney General and the Director of the Administrative Office of United States Courts may promulgate such regulations as are necessary to carry out the amendments made by this section.</text></subsection></section></legis-body></bill>
