which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Housing and Urban Development to establish an emerging developer fund program to provide competitive grants to nonprofit housing organizations and community development financial institutions, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD1AA2EF05EFA4D71A728DFC6B80AE47D"><section section-type="section-one" id="HC4CA9752B57F45A892A818B049490477"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sparking Production of Urban and Rural Housing Act</short-title></quote> or the <quote><short-title>SPUR Housing Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id8e249925580147c38e751feac395b165"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" id="HC35B0E01378F42E4A7AABA51BA52CCBF"><enum>(1)</enum><header>Community development financial institution</header><text>The term <term>community development financial institution</term> means an institution that has been certified as a community development financial institution (as defined in section 103 of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4702">12 U.S.C. 4702</external-xref>)) by the Secretary of the Treasury.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb9dbed5920e04e81b61f0c4f367963e9"><enum>(2)</enum><header display-inline="yes-display-inline">Distressed community</header><text display-inline="yes-display-inline">The term <term>distressed community</term> has the meaning given the term <term>qualified census tract</term> in <external-xref legal-doc="usc" parsable-cite="usc/26/42">section 42(d)(5)(B)(ii)</external-xref> of the Internal Revenue Code of 1986.</text></paragraph><paragraph id="HB95D993C992E42B98EB457DF8A3D1BB4"><enum>(3)</enum><header>High opportunity area</header><text display-inline="yes-display-inline">The term <term>high opportunity area</term> has the meaning given the term in section 1282.1 of title 12, Code of Federal Regulations, or any successor regulation.</text></paragraph><paragraph id="H503E7767262344C794FBEDFA9A87F7BD"><enum>(4)</enum><header>Emerging developer</header><text>The term <term>emerging developer</term> means a developer that has—</text><subparagraph commented="no" display-inline="no-display-inline" id="id29f374883a0f41a2b73a23fc64b65ca4"><enum>(A)</enum><text display-inline="yes-display-inline">limited real estate development experience and limited liquidity or net worth;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id761ebeff7602461985a1b78e31367e91"><enum>(B)</enum><text display-inline="yes-display-inline">any other qualifications as determined appropriate by the Secretary.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8be3a7f08a1f4ebd9b7dcfda535932d2"><enum>(5)</enum><header>Institution of higher education; part B institution</header><text>The terms <term>institution of higher education</term> and <term>part B institution</term> have the meanings given those terms in section 101 and 322, respectively, of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>, 1061).</text></paragraph><paragraph id="HD5236D1F1E4C4286B6A352B2EB079264" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph></section><section id="H413B58BB50A245CF8311F3CAE5305DEA"><enum>3.</enum><header>Emerging developer fund program</header><subsection id="H12EFD3E07DCA4AB3BA69C18C2CE62550"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall establish an emerging developer fund program to provide competitive grants to nonprofit housing organizations and community development financial institutions.</text></subsection><subsection id="H3CCF1950E4684940803754D6C05DB4F5"><enum>(b)</enum><header>Use of amounts</header><text display-inline="yes-display-inline">Nonprofit housing organizations and community development financial institutions that receive amounts under this section shall use such amounts—</text><paragraph id="HF0A7743266F0484884DF2BD1069AE1DB"><enum>(1)</enum><text display-inline="yes-display-inline">to offer financing to emerging developers undertaking affordable housing and community development projects, including—</text><subparagraph id="H831DCD56B73247B6A2F3BEB7D281FD0A"><enum>(A)</enum><text display-inline="yes-display-inline">predevelopment loans;</text></subparagraph><subparagraph id="HC7DA72D7E9B9446D99ADAE0223433079"><enum>(B)</enum><text>loan loss reserves;</text></subparagraph><subparagraph id="H00D86DE9A2BB4A58B6EE0AAB49BB2DE3"><enum>(C)</enum><text>grants;</text></subparagraph><subparagraph id="HED76B98BB0FC460EB6B9B0E0385A8C1E"><enum>(D)</enum><text>risk sharing; and</text></subparagraph><subparagraph id="HEA2349DDE7EC451EA8FDACC0630E080D"><enum>(E)</enum><text>credit enhancements, including interest rate buy downs;</text></subparagraph></paragraph><paragraph id="HC22E8AB550324BFD93442901C076D00F" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">to capitalize a fund to support affordable housing and community development projects of emerging developers;</text></paragraph><paragraph id="H03E37083A8F04438B8B4ECB778320CC4"><enum>(3)</enum><text display-inline="yes-display-inline">to offer capacity-building training, and technical assistance programs to emerging developers; and</text></paragraph><paragraph id="H3B09986D2E8D4B7E87B480E47883B4AB"><enum>(4)</enum><text display-inline="yes-display-inline">for other uses approved by the Secretary.</text></paragraph></subsection><subsection id="HA201DACB1E4F41F9B32726D53940E7B0"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">Each nonprofit housing organization and community development financial institution that applies for a grant under this section shall submit an application to the Secretary at such time and in such manner as the Secretary may reasonably require and shall—</text><paragraph id="HE1131D09EAF846EA99071C0C793FFB2E"><enum>(1)</enum><text>demonstrate plans for providing comprehensive training, technical assistance, and financing to emerging developers; and</text></paragraph><paragraph id="HDC7E2656851E43E2817D1526C7607F1D"><enum>(2)</enum><text>include information about past work completed by the organization or institution.</text></paragraph></subsection><subsection id="H6B688B67D99344C398DCB3D37B5CD5A6"><enum>(d)</enum><header>Awarding of grants</header><text>The Secretary shall award grants under this section based on the ability of an applicant to—</text><paragraph id="HA5123A3BCCE143E7A200559F3D019F3E"><enum>(1)</enum><text display-inline="yes-display-inline">identify and quantify the need for development capacity building in the community of focus, including emerging developers with an intent to pursue affordable housing and community development projects, including in distressed communities;</text></paragraph><paragraph id="H441388E2E59C4BAC99BA06F7D9B0B1EE"><enum>(2)</enum><text>provide comprehensive real estate development capacity building and ongoing technical assistance, including by helping emerging developers to—</text><subparagraph id="H85EBA5A8345C4BE4A0F877145B3A64B8"><enum>(A)</enum><text>develop and manage a construction budget;</text></subparagraph><subparagraph id="H7DBF34A75CF64B2D996DA45E4026342B"><enum>(B)</enum><text>determine financing needs;</text></subparagraph><subparagraph commented="no" id="HF0D24C73B9E04009B521083D6865ECA4"><enum>(C)</enum><text>identify and secure sources of private and public capital, including preparing applications for tax credits under <external-xref legal-doc="usc" parsable-cite="usc/26/42">section 42</external-xref> of the Internal Revenue Code of 1986;</text></subparagraph><subparagraph commented="no" id="H4E29C7648A04499E98F436BC9142E9E7"><enum>(D)</enum><text>structure capital stacks;</text></subparagraph><subparagraph commented="no" id="H91513DA6772544A481BAC635298ABFBA"><enum>(E)</enum><text>understand loan terms;</text></subparagraph><subparagraph commented="no" id="H0C4A5FE412D546BFA284AADE5AA27D1D"><enum>(F)</enum><text>conduct business planning;</text></subparagraph><subparagraph commented="no" id="H68357C6DBB6D44F0BB9904CAC5F09704"><enum>(G)</enum><text>conduct strategic planning;</text></subparagraph><subparagraph commented="no" id="H2B76323C59C1407BB2A1E6F3C65D60F5"><enum>(H)</enum><text>prepare bids;</text></subparagraph><subparagraph commented="no" id="HE5C45DF16FCE47E8AFF50F3A5709A5EF"><enum>(I)</enum><text>structure financial statements; and</text></subparagraph><subparagraph commented="no" id="H9F47249B08154062856299912977E6D5"><enum>(J)</enum><text>implement bonding strategies;</text></subparagraph></paragraph><paragraph id="HAC4586F4C0484AEAA37047BE6422CC72"><enum>(3)</enum><text>provide affordable lending products for affordable housing and community development projects, such as predevelopment loans and other relevant products;</text></paragraph><paragraph id="H9ED6DDD1D44547AE9C127EBF66E76AD7"><enum>(4)</enum><text>offer mentoring and networking opportunities for emerging developers;</text></paragraph><paragraph id="H183C32D3E6CE4B269E41B01F0B19D0C2"><enum>(5)</enum><text>build partnerships with institutions of higher education, including community colleges and part B institutions, to provide real estate development course work and other resources to current and aspiring real estate developers;</text></paragraph><paragraph id="HAE4D3A6173D04E368FAEC9650B7F8DA9"><enum>(6)</enum><text>provide ongoing technical assistance after completion of any curriculum offered at the institutions described in paragraph (5); and</text></paragraph><paragraph id="H4DD9D1A6F38F47B6AA741388FDD2E8E7"><enum>(7)</enum><text>track program outcomes, including the total number and volume of loans originated, total development costs, geographic areas served, and income streams created for the borrower.</text></paragraph></subsection><subsection commented="no" id="HC190202CE69C40CEA46A755AA65F904A"><enum>(e)</enum><header>Priority</header><text display-inline="yes-display-inline">When awarding grants under this section, the Secretary shall prioritize organizations that—</text><paragraph id="H55886E4D60F54954A104561714570D79"><enum>(1)</enum><text>are providing lending or technical assistance to emerging developers—</text><subparagraph id="H36719A423FB742BDA7F4D613833BF9BC"><enum>(A)</enum><text>with limited experience;</text></subparagraph><subparagraph id="H5106E99F65914063AE9B4F4110EC264A"><enum>(B)</enum><text>who are undercapitalized; or</text></subparagraph><subparagraph id="HCC464039662841E4A335E7DE24E27047"><enum>(C)</enum><text>who intend to focus on the development of affordable housing and community development projects in distressed communities and high opportunity areas; and</text></subparagraph></paragraph><paragraph commented="no" id="H1F948B5A36FB4A25BA32ADF2641D87D2"><enum>(2)</enum><text display-inline="yes-display-inline">have a history of providing support to emerging developers.</text></paragraph></subsection><subsection id="HAD56197BFB6944668292ABB6486A4531"><enum>(f)</enum><header>Limitation</header><text>No organization or institution may receive an award amount under this section that is greater than 15 percent of the amount appropriated pursuant to subsection (h).</text></subsection><subsection id="H60F181688E1A4B5E9EBAF90D174C553A"><enum>(g)</enum><header>Coordination with other Federal agencies</header><text>The Secretary shall coordinate with the Secretary of the Treasury with respect to the alignment of program under this section and reporting requirements under this section with similar requirements of the Community Development Financial Institutions Fund under the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4701">12 U.S.C. 4701 et seq.</external-xref>).</text></subsection><subsection id="H0409A85F50934F56AB099DB10B0AF387"><enum>(h)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $50,000,000 for each of fiscal years 2026 through 2030.</text></subsection></section></legis-body></bill>
