        <official-title>To direct the United States Trade Representative to prioritize North
            American alignment on foreign investment review during the next joint review conducted
            under the United States-Mexico-Canada Agreement.</official-title>

            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting the USMCA from Harmful Chinese Investment Act</short-title></quote>.</text>
        </section>

            <enum>2.</enum>
            <header>North American alignment on foreign investment review</header>
            <subsection id="id6a3d12efd255450cb1e5a904fc95f761">
                <enum>(a)</enum>
                <header>Sense of Congress</header>
 <text>It is the sense of Congress that—</text> <paragraph id="idce4d4e743a0b4a8d88483c570b2d8847"> <enum>(1)</enum> <text>Canada and Mexico are the two largest trading partners of the United States, with bilateral goods and services trade between the United States and each such country reaching approximately $1,000,000,000,000 in 2024;</text>
                </paragraph>
                <paragraph id="ided24c9b87bb04708baaaff765eed1bed">
                    <enum>(2)</enum>
 <text>the United States-Mexico-Canada Agreement (USMCA) underpins much of the trade referred to in paragraph (1) and promotes a strong North American supply chain that supports millions of good-paying jobs in the United States;</text>
                </paragraph>
                <paragraph id="id5760ccd7e5a04bea9217a36e64b56444">
                    <enum>(3)</enum>
 <text>given the close economic relationship between the United States, Mexico, and Canada under the USMCA, ensuring that each party has robust investment review mechanisms in place is important towards strengthening the collective national security interests of those countries against risks stemming from foreign investments by nonmarket economy countries, including the People’s Republic of China;</text>
                </paragraph>
                <paragraph id="id3bf690179307450eadb6903919d0966a">
                    <enum>(4)</enum>
 <text>the Committee on Foreign Investment in the United States plays a critical role in protecting the national security of the United States by reviewing foreign investments for national security risks; and</text>
                </paragraph>
                <paragraph id="idc3eb609fc4ca4039b3bc8823a79e35eb">
                    <enum>(5)</enum>
 <text>the establishment by Mexico and Canada of legislative and regulatory frameworks to review foreign investments for national security risks that are similar to the framework established under section 721 of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565</external-xref>) would—</text>
                    <subparagraph commented="no" display-inline="no-display-inline" id="idd5f80536d7d44b13b64e95732edc4308">
                        <enum>(A)</enum>
 <text display-inline="yes-display-inline">advance the national security interests of the United States; and</text>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="id9731bae36c634b06b123ca3ee5921f49">
                        <enum>(B)</enum>
 <text display-inline="yes-display-inline">allow for closer coordination between the USMCA countries with respect to shared threats from investments by nonmarket economy countries in strategically important economic sectors and critical infrastructure in North America.</text>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection id="id4d376969b83a40f095bd6634e4298b59">
                <enum>(b)</enum>
                <header>Joint review negotiation objective</header>
 <text>Subject to the requirements of section 611 of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4611">19 U.S.C. 4611</external-xref>), during the first joint review conducted after the date of the enactment of this Act, the Trade Representative shall advocate for—</text>
                <paragraph commented="no" display-inline="no-display-inline" id="id968aec0f0b1c44bb8375632dac7344bb">
                    <enum>(1)</enum>
 <text display-inline="yes-display-inline">each USMCA country to implement a legislative and regulatory framework for reviewing foreign investment for national security risks that is similar to the framework established under section 721 of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565</external-xref>); and</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id916567cac2cc41e29ff6a54d79ff11c9">
                    <enum>(2)</enum>
 <text>the establishment of a mechanism for USMCA countries to coordinate to address shared threats from investments by nonmarket economy countries.</text>
                </paragraph>
            </subsection>
            <subsection id="iddc8b78030e7d4c4ab9cd61a3693c6cb2">
                <enum>(c)</enum>
                <header>Technical assistance</header>
 <text>In carrying out subsection (b), the Trade Representative shall coordinate with the Secretary of the Treasury and the Secretary of State with respect to the provision of technical assistance to USMCA countries to support the establishment of frameworks for reviewing foreign investments for national security risks.</text>
            </subsection>
            <subsection id="id5291be8e2c20441da4daa06f08c3b032">
                <enum>(d)</enum>
                <header>Definitions</header>
 <text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="id98c101ef1a704a1694ce8511f2055c58"> <enum>(1)</enum> <header>Joint review</header> <text>The term <term>joint review</term> has the meaning given that term in section 611 of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4611">19 U.S.C. 4611</external-xref>).</text>
                </paragraph>

                    <enum>(2)</enum>
                    <header>Nonmarket economy country</header>
 <text>The term <term>nonmarket economy country</term> has the meaning given that term in section 771(18) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1677">19 U.S.C. 1677(18)</external-xref>).</text>
                </paragraph>
                <paragraph id="ID5092D2086B454C0AA63D8F13CAFA4518" commented="no" display-inline="no-display-inline">
                    <enum>(3)</enum>
                    <header display-inline="yes-display-inline">Technical assistance</header>
 <text display-inline="yes-display-inline">The term <term>technical assistance</term> includes—</text>
                    <subparagraph id="IDD3EAC47D834A40FA9688DFE32924756D" commented="no" display-inline="no-display-inline">
                        <enum>(A)</enum>
 <text>the use of short-term and long-term expert advisers to assist foreign governments with the establishment of frameworks for reviewing foreign investments for national security risks;</text>
                    </subparagraph>
                    <subparagraph id="IDA25CB35FAC7E438AB2CE314DAEC1F515" commented="no" display-inline="no-display-inline">
                        <enum>(B)</enum>
 <text>training in the recipient country, the United States, or elsewhere for the establishment of such frameworks;</text>
                    </subparagraph>
                    <subparagraph id="ID33E31161C9FD42689DCFD6276E7BC056" commented="no" display-inline="no-display-inline">
                        <enum>(C)</enum>
 <text>grants of goods, services, or funds to foreign governments;</text> </subparagraph> <subparagraph id="IDB465F423E0CA4E37A5F84407AF12CD7D" commented="no" display-inline="no-display-inline"> <enum>(D)</enum> <text>grants to United States nonprofit organizations to provide services or products that contribute to the provision of advice to foreign governments; and</text>
                    </subparagraph>
                    <subparagraph id="ID8D04F865B481417386BB7E893F7E7271" commented="no" display-inline="no-display-inline">
                        <enum>(E)</enum>
 <text>study tours for foreign officials in the United States or elsewhere for the purpose of providing technical information to such officials.</text>
                    </subparagraph>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id95adb06d782642e79af3c3cb27c54931">
                    <enum>(4)</enum>
                    <header>Trade Representative</header>
 <text>The term <term>Trade Representative</term> means the United States Trade Representative.</text>
                </paragraph>

                    <enum>(5)</enum>
                    <header>USMCA</header>
 <text>The term <term>USMCA</term> has the meaning given that term in section 3 of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4502">19 U.S.C. 4502</external-xref>).</text>
                </paragraph>

                    <enum>(6)</enum>
                    <header>USMCA country</header>
 <text>The term <term>USMCA country</term> has the meaning given that term in section 202(a) of the United States-Mexico-Canada Agreement Implementation Act (<external-xref legal-doc="usc" parsable-cite="usc/19/4531">19 U.S.C. 4531(a)</external-xref>).</text>
