<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 279</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250128">January 28, 2025</action-date><action-desc><sponsor name-id="S330">Mr. Bennet</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reform and enhance the pay and benefits of Federal wildland firefighters, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H8A8FB9F388164D88A62A7EE2A993F82A"><section section-type="section-one" id="H72F8CCB467AC4F17B7E4EFD7BC2D4414"><enum>1.</enum><header>Short title; definitions; table of contents</header><subsection id="HAF99B7C686DA4BF5AEB14023FCCA40C3"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Tim Hart Wildland Firefighter Classification and Pay Parity Act</short-title></quote> or <quote><short-title>Tim’s Act</short-title></quote>.</text></subsection><subsection id="H77DE784720B94254A13EB0CD892DF980"><enum>(b)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="H4667E46E9FD34E4481DC10E84D0504B3"><enum>(1)</enum><header>Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of the Office of Personnel Management.</text></paragraph><paragraph id="H07943279217F402AA54DA0C5EC97D6FC"><enum>(2)</enum><header>Federal wildland firefighter</header><text display-inline="yes-display-inline">The term <term>Federal wildland firefighter</term> means any temporary, seasonal, or permanent position at the Department of Agriculture or the Department of the Interior, or any Tribal Firefighter, that maintains group, emergency incident management, or fire qualifications, as established annually by the Standards for Wildland Fire Position Qualifications published by the National Wildfire Coordinating Group, and primarily engages in or supports wildland fire management activities, including forestry and rangeland technicians and positions concerning aviation, engineering heavy equipment operations, dispatch, or fire and fuels management.</text></paragraph><paragraph commented="no" id="H88724CCCA34B49DCB86D6E2E482A76EF"><enum>(3)</enum><header>Secretaries</header><text>The term <term>Secretaries</term> means the Secretary of Agriculture and the Secretary of the Interior.</text></paragraph></subsection><subsection id="HBB604DA7662F42D9A3C6FFA8DD4ABF54"><enum>(c)</enum><header>Table of contents</header><text>The table of contents for this Act is as follows:</text><toc><toc-entry level="section" idref="H72F8CCB467AC4F17B7E4EFD7BC2D4414">Sec. 1. id="HB96195CB24D04D45BE478C396359B9E9" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/5/5332">section 5332</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H926BB731B3364C38835B2CBD0F55E469" changed="not-changed"><section commented="no" display-inline="no-display-inline" id="HD246FA779E904FB4A04BF3FA1D7E7718" changed="not-changed"><enum>5332a.</enum><header>Special base rates of pay for wildland firefighters</header><subsection commented="no" display-inline="no-display-inline" id="H8BD6BD86C1C642E89B8A43B60FC3F208" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="HAEAE86F2CDE9484DA11F9794DE68A2C8" changed="not-changed"><enum>(1)</enum><text>the term <term>firefighter</term> means an employee who—</text><subparagraph commented="no" display-inline="no-display-inline" id="H91E847655C9F4081A289261AF43CFB43" changed="not-changed"><enum>(A)</enum><text>is a firefighter within the meaning of section 8331(21) or section 8401(14);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H45AE674C0DFF485483A987F8508BE908" changed="not-changed"><enum>(B)</enum><text>in the case of an employee who holds a supervisory or administrative position and is subject to subchapter III of chapter 83, but who does not qualify to be considered a firefighter within the meaning of section 8331(21), would otherwise qualify if the employee had transferred directly to that position after serving as a firefighter within the meaning of that section;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBCBF3E6862334C1A9A4418AFC24982B0" changed="not-changed"><enum>(C)</enum><text>in the case of an employee who holds a supervisory or administrative position and is subject to chapter 84, but who does not qualify to be considered a firefighter within the meaning of section 8401(14), would otherwise qualify if the employee had transferred directly to that position after performing duties described in section 8401(14)(A) for at least 3 years; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB04F5BA6FE57467788C3B34D21EDCCB0" changed="not-changed"><enum>(D)</enum><text>in the case of an employee who is not subject to subchapter III of chapter 83 or chapter 84, holds a position that the Office of Personnel Management determines would satisfy subparagraph (A), (B), or (C) if the employee were subject to subchapter III of chapter 83 or chapter 84; </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCB827C29339F438BAC43A25C497EFD81" changed="not-changed"><enum>(2)</enum><text>the term <term>General Schedule base rate</term> means an annual rate of basic pay established under section 5332 before any additions, such as a locality-based comparability payment under section 5304 or 5304a or a special rate supplement under section 5305;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF82E8413D3274A2BA3CB90E2E42D8701" changed="not-changed"><enum>(3)</enum><text>the term <term>special base rate</term> means an annual rate of basic pay payable to a wildland firefighter, before any additions or reductions, that replaces the General Schedule base rate otherwise applicable to the wildland firefighter and that is administered in the same manner as a General Schedule base rate; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0E00993A0E8A41DF8FFF335898F681A0" changed="not-changed"><enum>(4)</enum><text>the term <term>wildland firefighter</term> has the meaning given the term <term>Federal wildland firefighter</term> in section 1(b) of the <short-title>Tim Hart Wildland Firefighter Classification and Pay Parity Act</short-title>. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H81DF5217331A42AF8FC40FD2C310DDAC" changed="not-changed"><enum>(b)</enum><header>Special base rates of pay</header><paragraph commented="no" display-inline="no-display-inline" id="H056E13350DC144C4A3158173BDEC9A2B" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">Entitlement to special rate</header><text>Notwithstanding section 5332, a wildland firefighter is entitled to a special base rate at grades 1 through 15, which shall— </text><subparagraph commented="no" display-inline="no-display-inline" id="H96FE07D5C3E74B818C329B962AD04140" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">replace the otherwise applicable General Schedule base rate for the wildland firefighter; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBEE90EA044D348D9AACCA5D9923CD038" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">be basic pay for all purposes, including the purpose of computing a locality-based comparability payment under section 5304 or 5304a; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H18CB82250AF14B44BEC765DB0028453B" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">be computed as described in paragraph (2) and adjusted at the time of adjustments in the General Schedule. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDD0CCD21A3044FF5A3EC794F32E2ABB5" changed="not-changed"><enum>(2)</enum><header>Computation</header><subparagraph commented="no" display-inline="no-display-inline" id="H3D59C09EB4F147BCA8FC25318538A849" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The special base rate for a wildland firefighter shall be derived by increasing the otherwise applicable General Schedule base rate for the wildland firefighter by the following applicable percentage for the grade of the wildland firefighter and rounding the result to the nearest whole dollar:</text><clause commented="no" display-inline="no-display-inline" id="H5DD27849C0FF43E6B849A1C31F259D86" changed="not-changed"><enum>(i)</enum><text>For GS–1, 42 percent. </text></clause><clause commented="no" display-inline="no-display-inline" id="H2D570FE448B242B5A034B0558103C7E4" changed="not-changed"><enum>(ii)</enum><text>For GS–2, 39 percent. </text></clause><clause commented="no" display-inline="no-display-inline" id="HED217E03A137445098F7921ED28CC46F" changed="not-changed"><enum>(iii)</enum><text>For GS–3, 36 percent. </text></clause><clause commented="no" display-inline="no-display-inline" id="HA43B3915FF4C419DBE755AA6D25AA9E2" changed="not-changed"><enum>(iv)</enum><text>For GS–4, 33 percent.</text></clause><clause commented="no" display-inline="no-display-inline" id="H84D6F914E9984BBCA4B9F2ABF99E0A07" changed="not-changed"><enum>(v)</enum><text>For GS–5, 30 percent.</text></clause><clause commented="no" display-inline="no-display-inline" id="H7FBD8C93953546509BFF83B8AECB2418" changed="not-changed"><enum>(xiv)</enum><text>For GS–14, 3 percent.</text></clause><clause commented="no" display-inline="no-display-inline" id="HCF28EAE625584064BB5F759BB50ABA64" changed="not-changed"><enum>(xv)</enum><text>For GS–15, 1.5 percent.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDD28897D437445C88813855738B5C290" changed="not-changed"><enum>(B)</enum><header>Hourly, daily, weekly, or biweekly rates</header><text>When the special base rate with respect to a wildland firefighter is expressed as an hourly, daily, weekly, or biweekly rate, the special base rate shall be computed from the appropriate annual rate of basic pay derived under subparagraph (A) in accordance with the rules under section 5504(b).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H7FED7674ABDD463296F85C668DBF3DE5" changed="not-changed"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/5/5332">section 5332</external-xref> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF3EDD79D4D0043D39C49A099EEEB3CA4" changed="not-changed"><toc changed="not-changed"><toc-entry bold="off" level="section" changed="not-changed">5332a. Special base rates of pay for wildland firefighters.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H15B0C267FE9945B0B38460673619A77B" changed="not-changed"><enum>(c)</enum><header>Prevailing rate employees</header><text>Section 5343 of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBD1AAC265C724EE0989C88B223C54FDC" changed="not-changed"><subsection commented="no" display-inline="no-display-inline" id="HB13DC4737522438B9A0357255D7B8F33" changed="not-changed"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H57B79427AE7F44B28DBCE714049694ED" changed="not-changed"><enum>(1)</enum><text>For a prevailing rate employee described in section 5342(a)(2)(A) who is a wildland firefighter, as defined in section 5332a(a), the Secretary of Agriculture or the Secretary of the Interior (as applicable) shall increase the wage rates of that employee by an amount (determined at the sole and exclusive discretion of the applicable Secretary after consultation with the other Secretary) that is generally consistent with the percentage increases given to wildland firefighters in the General Schedule under section 5332a. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" indent="up1" id="H36E7482DF9F84BE5A4E68F13496ABA4E" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">An increased wage rate under paragraph (1) shall be basic pay for the same purposes as the wage rate otherwise established under this section. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" indent="up1" id="H447FA0E073CE44218AAEDBEEC6330422" changed="not-changed"><enum>(3)</enum><text display-inline="yes-display-inline">An increase under this subsection may not cause the wage rate of an employee to increase to a rate that would produce an annualized rate in excess of the annual rate for level IV of the Executive Schedule.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H6C5ABDBC7C7A4F679FDA3B5017FB1BBF" changed="not-changed"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the first day of the first applicable pay period beginning after the last day of the last pay period for which Federal wildland firefighter temporary salary increases were in effect, as originally authorized under section 40803(d)(4)(B) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6592">16 U.S.C. 6592(d)(4)(B)</external-xref>) and as extended under the Consolidated Appropriations Act, 2024 (<external-xref legal-doc="public-law" parsable-cite="pl/118/42">Public Law 118–42</external-xref>; 138 Stat. 25), the Continuing Appropriations Act, 2025 (division A of <external-xref legal-doc="public-law" parsable-cite="pl/118/83">Public Law 118–83</external-xref>; 138 Stat. 1524), and the Further Continuing Appropriations Act, 2025 (division A of <external-xref legal-doc="public-law" parsable-cite="pl/118/158">Public Law 118–158</external-xref>).</text></subsection></section><section commented="no" display-inline="no-display-inline" id="HD6E20228958F4FBCABAF17ED12E2E190" changed="not-changed"><enum>3.</enum><header>Wildland fire incident response premium pay</header><subsection commented="no" display-inline="no-display-inline" id="H00A020DC607445518E1ECD63209B0AAD" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/5/5545b">section 5545b</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HD2D3218A85D84C5AB59BC8E46A691C2B" changed="not-changed"><section commented="no" display-inline="no-display-inline" id="H657FF98DF71347DAA8EA85DE80223267" changed="not-changed"><enum>5545c.</enum><header>Incident response premium pay for employees engaged in wildland firefighting</header><subsection commented="no" display-inline="no-display-inline" id="H83BDB3DCC60E4666BE60C4D20EE166E5" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph commented="no" display-inline="no-display-inline" id="H990366ADAF604B1785E0C7ABDF3A8D76" changed="not-changed"><enum>(1)</enum><text>the term <term>appropriate committees of Congress</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="HB4CD318D7ABC474BBAD93E7D81FD0A88" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and Governmental Affairs of the Senate;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF5ABA19462EB489BB987757B81417666" changed="not-changed"><enum>(B)</enum><text>the Committee on Energy and Natural Resources of the Senate;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD8D9433FAD6449D7905002718679213B" changed="not-changed"><enum>(C)</enum><text>the Committee on Agriculture, Nutrition, and Forestry of the Senate;</text></subparagraph><subparagraph id="HD394413DA838488E9BA7E26522BC1E59" changed="not-changed"><enum>(D)</enum><text>the Committee on Appropriations of the Senate;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4974E0CE3362482081D798FF0A6F1608" changed="not-changed"><enum>(E)</enum><text>the Committee on Oversight and Accountability of the House of Representatives;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF0C7FAC5665448A5ADCFE57307D62BC4" changed="not-changed"><enum>(F)</enum><text>the Committee on Agriculture of the House of Representatives;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDC1CF34875104CE687D8B4F62A1745D7" changed="not-changed"><enum>(G)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0B843A14A0F141BBB3046E0EA9B7DAC7" changed="not-changed"><enum>(H)</enum><text>the Committee on Appropriations of the House of Representatives;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA18C9BC26DCA4CA1A470F760B0A71EB6" changed="not-changed"><enum>(2)</enum><text>the term <term>covered employee</term> means an employee of the Forest Service or the Department of the Interior who is—</text><subparagraph commented="no" display-inline="no-display-inline" id="HF5A096ED553A4890A16814D00AD2CEC5" changed="not-changed"><enum>(A)</enum><text>a wildland firefighter, as defined in section 5332a(a); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2AAF708D14EA4503820BD50CE5B4EE7F" changed="not-changed"><enum>(B)</enum><text>certified by the applicable agency to perform wildland fire incident-related duties during the period that employee is deployed to respond to a qualifying incident;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCBB29A0FA4C6478FAFB0BF5C71ABC930" changed="not-changed"><enum>(3)</enum><text>the term <term>incident response premium pay</term> means pay to which a covered employee is entitled under subsection (c);</text></paragraph><paragraph id="H2C4A128E94774FD8A4FC8A91530777C9" changed="not-changed"><enum>(4)</enum><text>the term <term>prescribed fire incident</term> means a wildland fire originating from a planned ignition in accordance with applicable laws, policies, and regulations to meet specific objectives;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE7B50FFF2C8A45588D31A06A92599ED7" changed="not-changed"><enum>(5)</enum><text>the term <term>qualifying incident</term>— </text><subparagraph commented="no" display-inline="no-display-inline" id="HD014C53CAA85423F8110872CB6381F1C" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">means— </text><clause commented="no" display-inline="no-display-inline" id="HD4905AD3DF6F477B9866FE992DA24101" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">a wildfire incident, a prescribed fire incident, or a severity incident; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H6B2D030FD4B94F9B8CDEB1700F94FCA0" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">an incident that the Secretary of Agriculture or the Secretary of the Interior determines is similar in nature to an incident described in clause (i); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCC78EA78293A48569A4DBBE6F5A42058" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">does not include an initial response (including an initial attack fire) in which a wildfire is contained within 36 hours; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H39EC776C7A70442DB4809EF69353B571" changed="not-changed"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>severity incident</term> means an incident in which a covered employee is pre-positioned in an area in which conditions indicate there is a high risk of wildfires.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2147F17386AA412FB346DA67FD666D05" changed="not-changed"><enum>(b)</enum><header>Eligibility</header><text display-inline="yes-display-inline">A covered employee is eligible for incident response premium pay under this section if— </text><paragraph commented="no" display-inline="no-display-inline" id="HAFCF23B75A5946DC93568309D66DD288" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">the covered employee is deployed to respond to a qualifying incident; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6B87F03904B64109AF4A0E0915C0C40A" changed="not-changed"><enum>(2)</enum><text>the deployment described in paragraph (1) is—</text><subparagraph commented="no" display-inline="no-display-inline" id="HE67C9E70C9FD46F892AB7ADA9E53C828" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">outside of the official duty station of the covered employee; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB035F9A00DB94CBA8E37D5080FF68AA3" changed="not-changed"><enum>(B)</enum><text>within the official duty station of the covered employee and the covered employee is assigned to an incident-adjacent fire camp or other designated field location.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFE743C5A5FD848B0BC51631E7392AC79" changed="not-changed"><enum>(c)</enum><header>Entitlement to incident response premium pay</header><paragraph commented="no" display-inline="no-display-inline" id="HB1BAA6A45B0D41BF9771CC935BC92FE2" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>A covered employee who satisfies the conditions under subsection (b) is entitled to premium pay for the period in which the covered employee is deployed to respond to the applicable qualifying incident. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC5FA4C0EA1534674A6069ACE11E85A8D" changed="not-changed"><enum>(2)</enum><header>Computation</header><subparagraph commented="no" display-inline="no-display-inline" id="H0B9903DEA022429D84C1222D74088D82" changed="not-changed"><enum>(A)</enum><header display-inline="yes-display-inline">Formula</header><text display-inline="yes-display-inline">Subject to subparagraphs (B) and (C), premium pay under paragraph (1) shall be paid to a covered employee at a daily rate of 450 percent of the hourly rate of basic pay of the covered employee for each day that the covered employee satisfies the requirements under subsection (b), rounded to the nearest whole cent. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H172F61D6B25246E88B3EA66DC283EE6B" changed="not-changed"><enum>(B)</enum><header>Limitation</header><text>Premium pay under this subsection—</text><clause commented="no" display-inline="no-display-inline" id="H29978B59BCF54186BAB0ACC438653145" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to a covered employee for whom the annual rate of basic pay is greater than that for step 10 of GS–10, shall be paid at the daily rate established under subparagraph (A) for the applicable rate for step 10 of GS–10 (where the applicable rate is the rate in effect in the same locality that is the basis for a locality-based comparability payment payable to the covered employee under section 5304); and</text></clause><clause commented="no" display-inline="no-display-inline" id="H0F73DCC6289E448683729728604110E5" changed="not-changed"><enum>(ii)</enum><text>may not be paid to a covered employee in a total amount that exceeds $9,000 in any calendar year.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H71E0F28DCCD249F38A8FD6F61559DC98" changed="not-changed"><enum>(C)</enum><header>Adjustments</header><clause commented="no" display-inline="no-display-inline" id="HF14B21FE258946499662750F4E61048E" changed="not-changed"><enum>(i)</enum><header>Assessment</header><text>The Secretary of Agriculture and the Secretary of the Interior shall assess the difference between the average total amount of compensation that was paid to covered employees, by grade, in fiscal years 2023 and 2024.</text></clause><clause commented="no" display-inline="no-display-inline" id="H80F94579842D410396C6E8A49C8711D5" changed="not-changed"><enum>(ii)</enum><header>Report</header><text>Not later than 180 days after the date that is 1 year after the effective date of this section, the Secretary of Agriculture and the Secretary of the Interior shall jointly publish a report on the results of the assessment conducted under clause (i).</text></clause><clause commented="no" display-inline="no-display-inline" id="HA6CF819ED1904F7191801F2917B600E8" changed="not-changed"><enum>(iii)</enum><header>Administrative actions</header><text>After publishing the report required under clause (ii), the Secretary of Agriculture and the Secretary of the Interior, in consultation with the Director of the Office of Personnel Management, may, in the sole and exclusive discretion of the Secretaries acting jointly, administratively adjust the amount of premium pay paid under this subsection (or take other administrative action) to ensure that the average annual amount of total compensation paid to covered employees, by grade, is more consistent with such amount that was paid to those employees in fiscal year 2023.</text></clause><clause commented="no" display-inline="no-display-inline" id="H821B1290CEEF4AB4AAE04BEA8ECC4589" changed="not-changed"><enum>(iv)</enum><header>Congressional notification</header><text>Not later than 3 days after an adjustment made, or other administrative action taken, under clause (iii) becomes final, the Secretary of Agriculture and the Secretary of the Interior shall jointly submit to the appropriate committees of Congress a notification regarding that adjustment or other administrative action, as applicable.</text></clause></subparagraph></paragraph></subsection><subsection id="H1BA9BA22FD994981907058BC0A6D2249" changed="not-changed"><enum>(d)</enum><header>Treatment of incident response premium pay</header><text>Incident response premium pay under this section—</text><paragraph id="H02DCED032B8940378FCC9747CD37A2D2" changed="not-changed"><enum>(1)</enum><text>is not considered part of the basic pay of a covered employee for any purpose;</text></paragraph><paragraph id="H340B748A30BB43DF8DA68CFBA8D4DC1B" changed="not-changed"><enum>(2)</enum><text>may not be considered in determining the lump-sum payment of a covered employee for accumulated and accrued annual leave under section 5551 or section 5552;</text></paragraph><paragraph id="HD8F776C183E545078939BBFEF9175B65" changed="not-changed"><enum>(3)</enum><text>may not be used in determining pay under section 8114;</text></paragraph><paragraph id="HFD9E467D80F443FDA3939DB5B9478387" changed="not-changed"><enum>(4)</enum><text>may not be considered in determining pay for hours of paid leave or other paid time off during which the premium pay is not payable; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H990E42AD6B26412293B3F35DF39655DA" changed="not-changed"><enum>(5)</enum><text display-inline="yes-display-inline">shall be disregarded in determining the minimum wage and overtime pay to which a covered employee is entitled under the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5742B5B7D0BD42AA8E8882C2D2315275" changed="not-changed"><enum>(b)</enum><header>Additional premium pay amendments</header><text>Subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United States Code, is amended—</text><paragraph id="H4D06D0AAE8B24D978A6C89C67A43559D" changed="not-changed"><enum>(1)</enum><text>in section 5544—</text><subparagraph id="H8B400211495F46938F7CDFEE0950902D" changed="not-changed"><enum>(A)</enum><text>by amending the section heading to read as follows: <quote><header-in-text level="section" style="OLC">Wage-board overtime, Sunday rates, and other premium pay</header-in-text></quote>; and </text></subparagraph><subparagraph id="H6794B4FD0DA14F6E8C3277022FCA39F8" changed="not-changed"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8B7BFDB1DE314E25955871F5447DD2C7" changed="not-changed"><subsection id="H902DFD82DBA74C7B8F397848A685EC8D" changed="not-changed"><enum>(d)</enum><text>A prevailing rate employee described in section 5342(a)(2)(A) shall receive incident response premium pay under the same terms and conditions that apply to a covered employee under section 5545c if that employee— </text><paragraph commented="no" display-inline="no-display-inline" id="H35AABED4F5CE4F01AB1E3693849F355B" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">is employed by the Forest Service or the Department of the Interior; and</text></paragraph><paragraph id="H825DD2B7335C42A79F5F420724C13650" changed="not-changed"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H50DD16EEE3EC4396866AD8237BB56B00" changed="not-changed"><enum>(A)</enum><text>is a wildland firefighter, as defined in section 5332a(a); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="H023B5352B091424D8F713D0D86EA83CC" changed="not-changed"><enum>(B)</enum><text>is certified by the applicable agency to perform wildland fire incident-related duties during the period the employee is deployed to respond to a qualifying incident (as defined in section 5545c(a)).</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H9B0234FA2F6E49E981B2745C886F03E5" changed="not-changed"><enum>(2)</enum><text>in section 5547(a), in the matter preceding paragraph (1), by inserting <quote>5545c,</quote> after <quote>5545a,</quote>.</text></paragraph></subsection><subsection id="H0E2DA6B873594F68BBF1F6431F7EC673" changed="not-changed"><enum>(c)</enum><header>Clerical amendments</header><text>The table of sections for subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United States Code, is amended—</text><paragraph id="HA119B61FC35E440DB35348B8EACD2905" changed="not-changed"><enum>(1)</enum><text>by amending the item relating to section 5544 to read as follows: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HD7787EFDD5544D7E9B58E68B704716E1" changed="not-changed"><toc changed="not-changed"><toc-entry bold="off" level="section" changed="not-changed">5544. Incident response premium pay for employees engaged in wildland firefighting.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HAE5D3E7EEFF2443A983D010DFA53D23B" changed="not-changed"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the first day of the first applicable pay period beginning after the last day of the last pay period for which Federal wildland firefighter temporary salary increases were in effect, as originally authorized under section 40803(d)(4)(B) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6592">16 U.S.C. 6592(d)(4)(B)</external-xref>) and as extended under the Consolidated Appropriations Act, 2024 (<external-xref legal-doc="public-law" parsable-cite="pl/118/42">Public Law 118–42</external-xref>; 138 Stat. 25), the Continuing Appropriations Act, 2025 (division A of <external-xref legal-doc="public-law" parsable-cite="pl/118/83">Public Law 118–83</external-xref>; 138 Stat. 1524), and the Further Continuing Appropriations Act, 2025 (division A of <external-xref legal-doc="public-law" parsable-cite="pl/118/158">Public Law 118–158</external-xref>).</text></subsection></section><section id="H70BC8043586C48F8ABAA476B71635CC5"><enum>4.</enum><header>Special limitations on pay for wildland firefighters</header><subsection id="H18EED32782D845BE917C2AEFD1A45FDA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United States Code, is amended—</text><paragraph id="H49CA89088B794BDFA71F1431FA7A8C14"><enum>(1)</enum><text>by inserting after section 5547 the following:</text><quoted-block style="USC" id="HA38CE53ADFFE485DA1F1EB5474DEDD99"><section id="HDD1BA2D8AA4C43DF9A332702DBA083F3"><enum>5547a.</enum><header>Special limitations on premium pay for employees engaged in wildland firefighting</header><subsection id="H1879E4914B5A4C9C9624CD8218CDEFBA"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text><paragraph id="HE2D0C2E5691248DC80B28357FF8B82AC"><enum>(1)</enum><text>the term <term>covered employee</term> means an employee of the Forest Service or the Department of the Interior who—</text><subparagraph id="H85ADB09776CB4176BA5A9ABFF8B1EBC6"><enum>(A)</enum><text>qualifies as a wildland firefighter based on the definitions of <term>firefighter</term> and <term>wildland firefighter</term> in section 5332a(a); or</text></subparagraph><subparagraph id="H3D24D1F1DAA4468780AB2F0388385476"><enum>(B)</enum><text>is certified by the applicable agency to perform wildland fire incident related duties during the period the employee is assigned to a qualifying incident;</text></subparagraph></paragraph><paragraph id="H808F0B20B1034F4EBF2990C909006B88"><enum>(2)</enum><text>the term <term>covered services</term> means services performed by an employee that are determined by the Secretary of the Interior or the Secretary of Agriculture, as applicable, to primarily involve emergency wildfire suppression activities, including any period of duty when the employee is sleeping or resting during an extended period of deployment to engage in those activities;</text></paragraph><paragraph id="H92D096927A084C5EB439913AE2B20326"><enum>(3)</enum><text>the term <term>emergency wildland fire suppression activities</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9c5d955e1efc45fa9d6ed20add449844"><enum>(A)</enum><text display-inline="yes-display-inline">means initial-response and extended-response activities that directly relate to suppression of a wildfire; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9f526e905dbf496c9330498119244e94"><enum>(B)</enum><text display-inline="yes-display-inline">includes activities associated with a severity incident, as defined in section 5545c(a); and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id42f532e60509407a89639cddce86af97"><enum>(C)</enum><text display-inline="yes-display-inline">does not include activities associated with a prescribed fire incident, as defined in section 5545c(a); and</text></subparagraph></paragraph><paragraph id="H807F151B57AE4BF0BE29E42DAD548246"><enum>(4)</enum><text>the term <term>premium pay</term> means the premium pay paid under the provisions of law cited in section 5547(a), except as otherwise provided in subsection (h).</text></paragraph></subsection><subsection id="H391D2E65FA524546824EC21ED4BE5BA8"><enum>(b)</enum><header>Relationship to limitation on premium pay</header><text>Any premium pay earned by a covered employee for covered services shall be disregarded in calculating the aggregate of the basic pay and premium pay of that covered employee for purposes of applying a limitation under section 5547.</text></subsection><subsection id="HF55C31DB6EC241DFAB1270814FBEFDFF"><enum>(c)</enum><header>Relationship to limitation on certain payments</header><text>Any premium pay of a covered employee that is disregarded under subsection (b) shall be disregarded in calculating the aggregate pay of that covered employee for purposes of applying the limitation under section 5307.</text></subsection><subsection id="H0AE0B1C4B49E4113816C9BC3B0FAAACB"><enum>(d)</enum><header>Limitation</header><paragraph commented="no" display-inline="no-display-inline" id="id0a6106280d1d4d959c625da96f9b2a9d"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Pay that is disregarded under subsection (b) may not be paid to the extent that the pay would cause the aggregate of the basic pay, premium pay, and hazard pay under section 5545(d) payable in the applicable calendar year to the applicable covered employee to exceed the rate of basic pay payable for a position at level II of the Executive Schedule under section 5313, as in effect at the end of that calendar year. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8df1a0ad99a64cf1b2e38e33579e418c"><enum>(2)</enum><header>Biweekly limitation</header><text display-inline="yes-display-inline">Any premium pay that is subject to a biweekly limitation under section 5547(c) shall be paid first before other premium pay in applying the limitation under paragraph (1).</text></paragraph></subsection><subsection id="H7E12CD324F3248DDBAD8CAEE4CAAE292"><enum>(e)</enum><header>Waiver</header><paragraph commented="no" display-inline="no-display-inline" id="idfbc256d9a2eb4e429ca808e31c7f212e"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Application of the limit in subsection (d) or subsection (h) to a covered employee may be waived at the sole and exclusive discretion of the Secretary of the Interior or the Secretary of Agriculture, as applicable. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6768b1c29622438b9b5dde6a9e832f24"><enum>(2)</enum><header>Prescription of criteria</header><text display-inline="yes-display-inline">Before authorizing a waiver under paragraph (1) for a covered employee, the Secretary of the Interior or the Secretary of Agriculture, as applicable, after consulting with the other Secretary, shall prescribe criteria that will be applied in making a determination to grant a waiver.</text></paragraph></subsection><subsection id="HCF639013A09B46569F752D8C672244D1"><enum>(f)</enum><header>Lump-Sum payments</header><text>Any additional pay resulting from application of this section may not be used in computing a lump-sum payment for accumulated and accrued annual leave under section 5551 or 5552.</text></subsection><subsection id="H7B559749A94E42759CA45FBF4CE7E6A8"><enum>(g)</enum><header>Maintenance of records</header><text>The Secretary of the Interior and the Secretary of Agriculture shall maintain records that document uses of the authority provided by this section.</text></subsection><subsection id="H03630D422CC14B3B8F66D2BE0BA2E960"><enum>(h)</enum><header>Certain rate employees</header><paragraph commented="no" display-inline="no-display-inline" id="id2d8f2b11bd1d44b19bd8171e336ab810"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>For a prevailing rate employee described in section 5342(a)(2)(A) who is a covered employee, premium pay may not be paid to the extent the premium pay would cause the aggregate of the basic pay and premium pay of the employee in the applicable calendar year to exceed the rate of basic pay payable for a position at level II of the Executive Schedule under section 5313, as in effect at the end of that calendar year.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idecbbeb0d97bb4ed79af456d8cc4febab"><enum>(2)</enum><header>Definitions</header><text>For the purposes of this subsection— </text><subparagraph commented="no" display-inline="no-display-inline" id="id5e692ae4528546229dfcce94cc4aeccb"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>basic pay</term> means wages, environmental differential pay, and night shift differential pay; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7a30f0a33d7549c4b3adec62bc0d8904"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>premium pay</term> means overtime pay, Sunday premium pay, and holiday premium pay.</text></subparagraph></paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H945BA950BD06494AA853C9DCB9158FEF"><enum>(2)</enum><text>in section 5541(2)(xi), by inserting <quote>, 5547a(h),</quote> after <quote>section 5544</quote>.</text></paragraph></subsection><subsection id="HFA1E50E65A6A4F0F9A8077FE939FF62B"><enum>(b)</enum><header>Calendar year 2025</header><text display-inline="yes-display-inline">For the purpose of applying section 5547 of title 5, United States Code, and section 1701 of division B of the Extending Government Funding and Delivering Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/5/5547">5 U.S.C. 5547</external-xref> note) in calendar year 2025, incident standby premium pay shall be included in premium pay that is subject to the limits established in those sections.</text></subsection><subsection id="H148562B16FAD41D5AA4245792660A829"><enum>(c)</enum><header>Effective dates</header><paragraph commented="no" display-inline="no-display-inline" id="id6248d1733d1c4523a43d6c272bdddcb2"><enum>(1)</enum><header display-inline="yes-display-inline">Amendments</header><text>The amendments made by subsection (a) shall take effect on the first day of the first pay period that has a payment date in January 2026. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id38852b0105ac4a77a8bd5377ae3cf6f1"><enum>(2)</enum><header>Calendar year 2025 application</header><text display-inline="yes-display-inline">Subsection (b) shall take effect on the first day of the first applicable pay period beginning on or after October 1, 2025.</text></paragraph></subsection><subsection id="H8BEF99FA89B9446BBD08B25ADF3B0DE2"><enum>(d)</enum><header>Clerical amendment</header><text>The table of sections for subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/55">chapter 55</external-xref> of title 5, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/5/5547">section 5547</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HDCA0970581754522926DAB2AB8A71FBB"><toc regeneration="no-regeneration"><toc-entry level="section">5547a. Special limitations on premium pay for employees engaged in wildland firefighting.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H55CF8367BB7A44D38BE972EE6855B266"><enum>5.</enum><header>Rest and recuperation leave for employees engaged in wildland firefighting</header><subsection id="H88FEC4B57D8043C3ADBD92A4FC300C73"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/5/6329d">section 6329d</external-xref> the following:</text><quoted-block style="USC" id="H4E10D142024748889C38995C27F2C9CC"><section id="H7AEEBEE7E37C446E8D9680BCD9336946"><enum>6329e.</enum><header>Rest and recuperation leave for employees engaged in wildland firefighting</header><subsection id="H7C27EA14ED7C4119958CF82FB8C3A0C1"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="HB2AD838CA2C34A13A3D2DAAB82AA9F81"><enum>(1)</enum><text>the term <term>applicable Secretary</term> means the Secretary of Agriculture or the Secretary of the Interior, as applicable to a covered employee;</text></paragraph><paragraph id="H5C8A6CE98FC347FEB27AA3EABA61E54F"><enum>(2)</enum><text>the term <term>covered employee</term> means an employee of the Forest Service or the Department of the Interior who—</text><subparagraph id="H9AF237FCFC054A6786256F0EB447A429"><enum>(A)</enum><text>qualifies as a wildland firefighter based on the definitions of the terms <quote>firefighter</quote> and <quote>wildland firefighter</quote> in section 5332a(a) (applying the definition of <quote>employee</quote> in section 6301(2) in lieu of the definition of <quote>employee</quote> in section 5331(a)); or</text></subparagraph><subparagraph id="HFAB465B57CD046F49AC8EDCDAFFF1FB0"><enum>(B)</enum><text>is certified by the applicable Secretary to perform wildland fire incident related duties during the period the employee is assigned to a qualifying incident; and</text></subparagraph></paragraph><paragraph id="H6EB18F96D22B4F21BEE888CA4888D328"><enum>(3)</enum><text>the term <term>qualifying incident</term> has the meaning given the term in section 5545c(a)(5).</text></paragraph></subsection><subsection id="HDCB0A6CBC1994AD38BDADD4513FE8284"><enum>(b)</enum><header>Rest and recuperation leave</header><text>A covered employee may receive paid rest and recuperation leave following the completion of service under a qualifying incident, subject to policies established at the sole and exclusive discretion of the applicable Secretary, after consulting with the other Secretary.</text></subsection><subsection id="H6FD745F86BAE4BD6AFE876058038CBF3"><enum>(c)</enum><header>Use of leave</header><paragraph commented="no" display-inline="no-display-inline" id="id56b5b50ad2a8435397fc03f2417be14b"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Rest and recuperation leave granted under this section— </text><subparagraph commented="no" display-inline="no-display-inline" id="idc2bdbb6ff18642d49403cebb64ac5fda"><enum>(A)</enum><text display-inline="yes-display-inline">shall be used during scheduled hours within the tour of duty of the applicable covered employee established for leave-charging purposes and shall be paid in the same manner as annual leave; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id38d847e9220f440289b1c633bdf5e1b9"><enum>(B)</enum><text display-inline="yes-display-inline">shall be used immediately after a qualifying incident; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id22cd5e519c6a461fa6e59877060286a4"><enum>(C)</enum><text display-inline="yes-display-inline">may not be set aside for later use. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida41eb7179eac420fb3b2a8a0b6d8677d"><enum>(2)</enum><header>No payment for unused leave</header><text display-inline="yes-display-inline">A covered employee may not receive any payment for unused rest and recuperation leave granted under this section.</text></paragraph></subsection><subsection id="H4C155736DF07446C87FD0C97BF4B0AAC"><enum>(d)</enum><header>Intermittent work schedule</header><text>A covered employee with an intermittent work schedule shall— </text><paragraph commented="no" display-inline="no-display-inline" id="id438e08226a0040aa9f97b8cee649e10d"><enum>(1)</enum><text display-inline="yes-display-inline">be excused from duty during the same period of time that other covered employees in the same circumstances are entitled to rest and recuperation leave; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide5dc3212f8fd4089a04c7da1b5504d1c"><enum>(2)</enum><text display-inline="yes-display-inline">receive a payment as if the covered employee were entitled to rest and recuperation leave under subsections (b) and (c).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H556F6F1D8FD94EB6BABB312813CCE3F1"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on the first day of the first applicable pay period beginning on or after October 1, 2025.</text></subsection><subsection id="H2FE54048C4C9479F9E1DACD9DC7B6341"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections for subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/63">chapter 63</external-xref> of title 5, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/5/6329d">section 6329d</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HCE428F9D999A44D6AE0C9AA9464228E6"><toc regeneration="no-regeneration"><toc-entry level="section">6329e. Rest and recuperation leave for employees engaged in wildland firefighting.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="ida61c29c2dee647c1b89b45f4160c4aad"><enum>6.</enum><header>Health provisions</header><subsection id="H3D6993F182A347B8A9A4A40147EDCEDB"><enum>(a)</enum><header>Database; recommendations</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretaries shall—</text><paragraph id="H1855A18E98754313BE0EB9E47504894B"><enum>(1)</enum><text>establish and maintain on a website a publicly accessible, searchable database, to be known as the <quote>Federal Wildland Firefighter Cancer and Cardiovascular Disease Database</quote>, to track chronic disease caused by on-the-job environmental exposure over the lifetimes of current and former Federal wildland firefighters;</text></paragraph><paragraph id="HD0933905DA86444FAAA57E16B934E075"><enum>(2)</enum><text>update the database under paragraph (1) not less frequently than annually; and</text></paragraph><paragraph id="HF33B70443A6E4413A65C05C311AB8C47"><enum>(3)</enum><text display-inline="yes-display-inline">develop and adhere to recommendations regarding mitigation strategies to minimize exposure to environmental hazards for Federal wildland firefighters. </text></paragraph></subsection><subsection id="H045B3221BEA14425A4A2C4A72D57F5DF"><enum>(b)</enum><header>Mental health</header><paragraph id="HCAC4B62C17A340E9821D9C66FE81D08E"><enum>(1)</enum><header>Establishment of program</header><subparagraph commented="no" display-inline="no-display-inline" id="id3cdd231902ca495e844b880b0a2242c0"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than January 1, 2026, the Secretaries shall establish and carry out a mental health awareness and support program for Federal wildland firefighters.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1ec88cb9913748b69307be7ceff5b304"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The program under this paragraph shall include the following:</text><clause id="H3A09C60E26854A21B32FFAD3BD41312F"><enum>(i)</enum><text display-inline="yes-display-inline">A mental health awareness campaign.</text></clause><clause id="H70CBA2ADEBB344C0A6E694BBA34D7149"><enum>(ii)</enum><text display-inline="yes-display-inline">A mental health education and training program that includes an onboarding curriculum.</text></clause><clause id="H8B44C107BC944D33BA881B83A88FE917"><enum>(iii)</enum><text display-inline="yes-display-inline">An extensive peer-to-peer mental health support network for Federal wildland firefighters and their immediate families. </text></clause><clause id="HC177F722A7BC43EB89130FD33A1A8735"><enum>(iv)</enum><text display-inline="yes-display-inline">Expansion of the Critical Incident Stress Management Program—</text><subclause commented="no" display-inline="no-display-inline" id="id31246696f224436b9cca396f81a53729"><enum>(I)</enum><text display-inline="yes-display-inline">to develop and retain a larger pool of qualified mental health professionals who are familiar with the experiences of the emergency response workforce; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id01e50f6cb4864a89a7447953d924a46e"><enum>(II)</enum><text display-inline="yes-display-inline">to monitor and track mental health in the Federal wildland firefighter profession to better—</text><item commented="no" display-inline="no-display-inline" id="id656fc49aead64b2089c6d5af3ab3b4fd"><enum>(aa)</enum><text display-inline="yes-display-inline">understand the scope of the issue of mental health; and</text></item><item commented="no" display-inline="no-display-inline" id="id297895bb2cc54ec7887f0b9360e42de1"><enum>(bb)</enum><text display-inline="yes-display-inline">provide ongoing assistance and professional long-term care to patients.</text></item></subclause></clause><clause id="HB39B67E545CE44CFA9F86101E0966FAA"><enum>(v)</enum><text display-inline="yes-display-inline">Establish and carry out a new and distinct mental health support service specific to Federal wildland firefighters and their immediate families—</text><subclause commented="no" display-inline="no-display-inline" id="id2011c472ce31444388ace2861ff440bf"><enum>(I)</enum><text display-inline="yes-display-inline">with culturally relevant and trauma-informed mental health professionals who are readily available; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idefe44925304a4a86a6426b468f288fa7"><enum>(II)</enum><text display-inline="yes-display-inline">not subject to any limit on the number of sessions or services provided.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="H35D5B5B9155B4029ADFAF9B80374D4C5"><enum>(2)</enum><header>Mental health leave</header><subparagraph commented="no" display-inline="no-display-inline" id="id6b06b423e62c4b06bd1277dc6684607d"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), each Federal wildland firefighter shall be entitled to 7 consecutive days of mental health leave, without loss or reduction in pay, during a calendar year.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id82984eb9a9cc4cb091cd78252e09763c"><enum>(B)</enum><header>Requirements</header><text display-inline="yes-display-inline">Mental health leave provided under subparagraph (A) shall not—</text><clause commented="no" id="HDA6DBB34C0BB418F9015F34E9CD34C17"><enum>(i)</enum><text>accumulate for use in any succeeding calendar year; or</text></clause><clause commented="no" id="H57F4DBEFC2604EE480709303A8186A36"><enum>(ii)</enum><text display-inline="yes-display-inline">be considered to be annual or vacation leave—</text><subclause commented="no" display-inline="no-display-inline" id="id5d312b67a5554beaa7b78282cf8be723"><enum>(I)</enum><text display-inline="yes-display-inline">for purposes of section 5551 or 5552 of title 5, United States Code; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id408ed73cc08d415e87009cf34159f20d"><enum>(II)</enum><text display-inline="yes-display-inline">for any other purpose.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H7CA9AAE15D204A36B93837B37AC0031F"><enum>(c)</enum><header>Coordination</header><text display-inline="yes-display-inline">In carrying out subsections (a) and (b), the Secretaries may enter into partnerships or cooperative agreements with other Federal agencies, institutions of higher education, or nonprofit organizations.</text></subsection><subsection id="H84B403C791424B368814E659F0C5CA62"><enum>(d)</enum><header>OWCP</header><text display-inline="yes-display-inline">The Office of Workers’ Compensation Programs within the Department of Labor shall—</text><paragraph id="H6C501F586B8547A3B8AC844CDD631602"><enum>(1)</enum><text>recognize post-traumatic stress disorder and psychological stress-related injuries and illnesses correlated to fire protection, suppression, and incident support activities;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2b98011a853d4cedbdcff5eadea96ccf"><enum>(2)</enum><text display-inline="yes-display-inline">ensure long-term coverage for the duration of the injuries and illnesses described in paragraph (1); and</text></paragraph><paragraph id="HEDDF5594EE994D738F2E980FC2387DEF" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>expand the Special Claims Unit to ensure unit staffing levels are sufficient to expedite the claims process and shorten response times to Federal wildland firefighters and incident support personnel injured or affected on the job in order to alleviate the psychological and financial burdens placed on patients and their families.</text></paragraph></subsection></section><section id="H9CAC2CEC66BF42FAA42FB44EF46E4AA3"><enum>7.</enum><header>Retirement for firefighters</header><subsection commented="no" id="H9FA74A49EC294D55A295DE92CC54FF14"><enum>(a)</enum><header>Deposit service</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any service performed by an individual as a Federal wildland firefighter on or after January 1, 1989, for which retirement deductions under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, have not been made shall be creditable under that chapter, if—</text><paragraph commented="no" id="H2D06E525ED684BA0A80FB178F8E5D51D"><enum>(1)</enum><text>that firefighter submits a written election to the Director; and</text></paragraph><paragraph commented="no" id="H19A14BD44BD94EAB9FCC9A48EFAEA64B"><enum>(2)</enum><text display-inline="yes-display-inline">the deposit requirements of section 8411(f) of that title have been met with respect to that service.</text></paragraph></subsection><subsection commented="no" id="H436C5F8294EF4E1BB3EF694EEB9D3D2D"><enum>(b)</enum><header>Disability annuity</header><text display-inline="yes-display-inline">Beginning on the date of enactment of this Act, any Federal wildland firefighter who suffers from a disease described in section 8143b(b)(2) of title 5, United States Code, due to environmental job-related exposure, including smoke inhalation, silicate inhalation, and firefighting toxic exposure, shall be considered to be disabled for purposes of section 8451 of that title, except that such section 8451 shall be applied to any such firefighter by substituting <quote>12 months</quote> for <quote>18 months</quote>.</text></subsection><subsection id="HFFD5070550F6472BAE06B4A6F6B05132"><enum>(c)</enum><header>Including overtime as basic pay</header><text display-inline="yes-display-inline">Section 8331(3) of title 5, United States Code, is amended—</text><paragraph id="HE96E434D1C034F85A6DF6DAE35575BB0"><enum>(1)</enum><text>in subparagraph (H), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H329EC26BF6A14F00936DCB72FB2C7E5B"><enum>(2)</enum><text>in subparagraph (I), by inserting <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="HE3D5C8303E324BE787B47BE0D61C552D"><enum>(3)</enum><text>by inserting after subparagraph (I) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H76A9318F3BFD45D1BF7F5AD83E037214"><subparagraph commented="no" id="HB9788ECAD06D46B78CAE8CF34C4C66B6"><enum>(J)</enum><text display-inline="yes-display-inline">with respect to a Federal wildland firefighter (as that term is defined in section 1(b) of the <short-title>Tim Hart Wildland Firefighter Classification and Pay Parity Act</short-title>), overtime pay received on or after the date of enactment of this subparagraph;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HACEE5F1C90AA439DA0AFFD62B74B1DBF"><enum>(4)</enum><text>in the undesignated matter following subparagraph (J) (as added by paragraph (3)), by striking <quote>subparagraphs (B) through (I) of this paragraph</quote> and inserting <quote>subparagraphs (B) through (J) of this paragraph,</quote>.</text></paragraph></subsection><subsection id="H073B8876DA0F40D3BC26B8CEDDDFCA37"><enum>(d)</enum><header>Separate normal-Cost percentage</header><text>Section 8423(a)(1)(B)(i) of title 5, United States Code, is amended by inserting after <quote>firefighters,</quote> the following: <quote>Federal wildland firefighters (as that term is defined in section 1(b) of the <short-title>Tim Hart Wildland Firefighter Classification and Pay Parity Act</short-title>),</quote>. </text></subsection></section><section id="H2EAA475ECD3B4FC18EBAC9937A59CFE4"><enum>8.</enum><header>Pay parity for Federal structural firefighters</header><subsection id="HB80CC6705B634588AA5DDBAA1D469C1F"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>Federal structural firefighter</term>—</text><paragraph id="HF6DCC6AB09494E35A5BAC7738F6E8862"><enum>(1)</enum><text>has the meaning given the term <quote>firefighter</quote> in section 8401 of title 5, United States Code; and</text></paragraph><paragraph id="HAE6ED1F14AC9496384C24D548B41713B" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>does not include a Federal wildland firefighter.</text></paragraph></subsection><subsection id="H15909C1A70974F39918A782DF5C7D5C8"><enum>(b)</enum><header>Requirements</header><paragraph commented="no" display-inline="no-display-inline" id="id81065062b1f24e6ba0bb86541034ff09"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Beginning on the date that is 1 year after the date of enactment of this Act, any pay, benefits, and bonuses provided to any Federal structural firefighter shall be comparable with the pay, benefits, and bonuses provided to Federal wildland firefighters under this Act and the amendments made by this Act. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf9d3acc691d24dc7ba6197fdc4544221"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which special base rates of pay are established under section 5332a of title 5, United States Code, as added by section 2 of this Act, the Director shall submit to Congress a report on whether pay for such Federal structural firefighters is competitive with that for Federal wildland firefighters.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H89202A2555CB46B8A450A553273E3EDD"><enum>9.</enum><header>Pay adjustments and other matters</header><subsection commented="no" id="HC4C1A546B07341BDB93781E4BD04D369"><enum>(a)</enum><header>Annual adjustments</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, beginning in the first pay period beginning on or after the date on which special base rates of pay are established under section 5332a of title 5, United States Code, as added by section 2 of this Act, and annually thereafter, the basic rate of pay for each Federal wildland firefighter to which those special base rates of pay apply shall be increased by not less than the percentage equal to the percent change in the Consumer Price Index (all items—United States city average), published monthly by the Bureau of Labor Statistics, for December of the preceding year over such Consumer Price Index for the December of the year prior to the preceding year, adjusted to the nearest <fraction>1/10</fraction> of 1 percent.</text></subsection><subsection commented="no" id="H894CC1A8708749D9B8B14890F1848192"><enum>(b)</enum><header>Compensation comparable to non-Federal firefighters</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which special base rates of pay are established under section 5332a of title 5, United States Code, as added by section 2 of this Act, the Secretaries shall submit to Congress a report on whether pay, benefits, and bonuses provided to Federal wildland firefighters are comparable to the pay, benefits, and bonuses provided for non-Federal firefighters in the State or locality where Federal wildland firefighters are based. </text></subsection><subsection commented="no" id="H14EA6B687BD5454CB1D5801B46CC8245"><enum>(c)</enum><header>Hazardous duty pay</header><paragraph commented="no" display-inline="no-display-inline" id="id326750ac6a7245f087b7b15c0e5603ef"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each Federal wildland firefighter carrying out work completed during prescribed fire, parachuting, tree climbing over 20 feet, hazard tree removal, and other hazardous work, as identified by the Secretaries, shall be entitled to be paid the appropriate differential under section 5545(d) of title 5, United States Code, as if that Federal wildland firefighter was covered by such section 5545(d). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc6c4ef1f55b04d448c1dcb048c1453aa"><enum>(2)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Director may prescribe regulations to carry out this subsection.</text></paragraph></subsection><subsection commented="no" id="H912D097892C24819A4610BE9F03DAC83"><enum>(d)</enum><header>Other matters</header><paragraph commented="no" id="H535C938024D845F3B2B496461D86ACF3"><enum>(1)</enum><header>Recruitment and retention bonus</header><subparagraph commented="no" display-inline="no-display-inline" id="iddc3499f8cabd446f9d113aa2cc866ff8"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>In order to promote the recruitment and retention of Federal wildland firefighters, the Director, in coordination with the Secretaries, shall establish a program under which a recruitment or retention bonus of not less than $1,000 may be paid to a Federal wildland firefighter in an amount determined appropriate by the Director and the Secretaries. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id452d8a3c3d104d1483ed2fadd417e322"><enum>(B)</enum><header>Minimum amount</header><text display-inline="yes-display-inline">The minimum amount of a bonus described in subparagraph (A) shall be increased each year by the Consumer Price Index in the manner prescribed under subsection (a).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id97ddcaafdccb4dc496865b4a7dffdce4"><enum>(C)</enum><header>Timing of payments</header><text display-inline="yes-display-inline">Any bonus under this subsection—</text><clause commented="no" id="HECDBAAB94E32481D85390D7AF029D3F3"><enum>(i)</enum><text>shall be paid to any primary or secondary Federal wildland firefighter upon the date that such firefighter successfully completes a work capacity test; and</text></clause><clause commented="no" id="H7BC4CBBA23734702AF71C4EBD1E6BA00"><enum>(ii)</enum><text>may not be paid to an individual described in clause (i) more than once per calendar year.</text></clause></subparagraph></paragraph><paragraph commented="no" id="HA8FC360A430E4792A07741426C8388DD"><enum>(2)</enum><header>Housing allowance</header><subparagraph commented="no" display-inline="no-display-inline" id="id59a27de60ff345feb00459fca22947eb"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretaries shall provide a housing allowance to any Federal wildland firefighter deployed to a location more than 50 miles from the primary residence of that Federal wildland firefighter. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idee1890a3536846d1b5d597f0f290b3c2"><enum>(B)</enum><header>Amount</header><text display-inline="yes-display-inline">An allowance paid under subparagraph (A) shall be in an amount determined appropriate by the Secretaries and adjusted based on the cost of housing in the area of deployment. </text></subparagraph></paragraph><paragraph commented="no" id="HB401B800EBCF4F3D9FA44A9DA225E28E"><enum>(3)</enum><header>Career transition</header><subparagraph commented="no" id="HE180D77DF7CB460FA4BA7C688A75608C"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretaries shall establish, and thereafter shall maintain, coordinate, and operate, a voluntary tuition assistance program for Federal wildland firefighters occupying permanent positions, which shall encompass a broad range of educational experiences (either in-person or through distance-learning), including academic skills development, vocational programs, career and technical programs, and programs leading to the award of undergraduate and graduate degrees.</text></subparagraph><subparagraph commented="no" id="H0E9C0276D9F6405C818716DEFC4A27B6"><enum>(B)</enum><header>Amount</header><text display-inline="yes-display-inline">The program under subparagraph (A) shall provide, not more than once during each calendar year, a payment of not less than $4,000 to each Federal wildland firefighter who elects to participate in the program. </text></subparagraph><subparagraph commented="no" id="H83F54F696EF946FF83682CB29C523BA6"><enum>(C)</enum><header>Review</header><text display-inline="yes-display-inline">The Secretaries shall conduct an annual review of whether the amount provided under subparagraph (B) is adequate, in consideration of inflation and other effects.</text></subparagraph></paragraph></subsection></section><section id="H902B9311CBFA4F47AD75EF40DFDBAC8C"><enum>10.</enum><header>Wildland Fire Management Casualty Assistance Program</header><subsection id="HA89128DE758845D5BB4DF7616C6BF9E5"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id0c0eabeb651943e1bc18b0e8d14756d5"><enum>(1)</enum><header>Affected firefighter</header><text>The term <term>affected firefighter</term> means any Federal wildland firefighter or Federal wildland fire support personnel who—</text><subparagraph id="H37070DB34B484970834AF9935D223E98"><enum>(A)</enum><text>requires hospitalization or treatment at a medical facility due to a line-of-duty injury or illness; or</text></subparagraph><subparagraph id="HF3E7B56209DA4AD5937C41ED8106807F"><enum>(B)</enum><text>is killed in the line of duty.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddccdd277fdf145bd8fc76d8f4a349571"><enum>(2)</enum><header display-inline="yes-display-inline">Affected next-of-kin</header><text>The term <term>affected next-of-kin</term>, with respect to an affected firefighter, means an individual related to the affected firefighter, as determined in accordance with the following descending order of priority:</text><subparagraph commented="no" id="H37DDD1B18C6948D7AB59E26E8B6AA91E"><enum>(A)</enum><text>A surviving legal spouse.</text></subparagraph><subparagraph commented="no" id="H6BA14501A5CD40CCA36C85BBE456C6C8"><enum>(B)</enum><text>A child (whether by current or prior relationship) aged 18 years or older, in descending precedence by age.</text></subparagraph><subparagraph commented="no" id="H035549D4E5DE4A64B7ACB86800279D6E"><enum>(C)</enum><text>A parent, unless custody has been vested in another individual by court order, in which case an adoptive parent shall take precedence over the natural parent from whom custody has been so removed.</text></subparagraph><subparagraph commented="no" id="H196EF3B99FFD48A99EFEC0D9D3BF757A"><enum>(D)</enum><text>A sibling (whether whole or half) aged 18 years or older, in descending precedence by age.</text></subparagraph><subparagraph commented="no" id="H8756048AEFF1486FAF41AE81331D2163"><enum>(E)</enum><text>A grandparent.</text></subparagraph><subparagraph id="H77CA1C95C5684AF78A31FA324F631E15" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text>Any other relative, with precedence to be determined in accordance with the applicable civil law of descent of the State of domicile of the affected firefighter at the time of the applicable illness or injury or death.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id467cc5c82ba544339353c7ecba4ffaab"><enum>(3)</enum><header>Casualty assistance officer</header><text>The term <term>casualty assistance officer</term> means an individual employed by the Department of the Interior to assist affected firefighters and affected next-of-kin with respect to the injury, illness, or death of an affected firefighter, including by providing advice relating to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9bfb1dcdd8804afe994555bbe6556d63"><enum>(A)</enum><text display-inline="yes-display-inline">services and benefits available under the Program to affected firefighters and affected next-of-kin; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb3bf1edb81f4445ba5a583425d87f6fb"><enum>(B)</enum><text>funeral arrangements, if applicable.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd7a58fc03cbe4af78d5bd61c0dec3e69"><enum>(4)</enum><header display-inline="yes-display-inline">Program</header><text>The term <term>Program</term> means the Wildland Fire Management Casualty Assistance Program established under subsection (b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6cd8553381454610a546787c299cccf7"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5e4a60590da8421eaf765b64b9683e46"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a program, to be known as the <quote>Wildland Fire Management Casualty Assistance Program</quote>, under which the Secretary shall provide assistance in accordance with this section to affected firefighters and affected next-of-kin.</text></subsection><subsection id="H6E1E680368D044368F7AF7DD98B48594"><enum>(c)</enum><header>Inclusions</header><text>The Program shall include the following:</text><paragraph id="HEBFDB196A75A4AA3B3F7CD3E62F7746F"><enum>(1)</enum><text>The provision to affected next-of-kin of the initial, and any subsequent, notification regarding the injury, illness, or death of an affected firefighter.</text></paragraph><paragraph id="HB9DD8F5C0EB84FC2B3991A581E09C177"><enum>(2)</enum><text>The reimbursement of affected next-of-kin for expenses associated with travel to visit an affected firefighter.</text></paragraph><paragraph id="H648CE2D306484B8BB6D7D14F92F066AB"><enum>(3)</enum><text>The qualifications, assignment, training, duties, supervision, and accountability for the performance of casualty assistance officers.</text></paragraph><paragraph id="HF0613D5BCEC148C688725B860623FF6D"><enum>(4)</enum><text display-inline="yes-display-inline">The relief or transfer of casualty assistance officers, including, in any case in which a casualty assistance officer is reassigned to another duty, the provision of notice of that reassignment to the applicable affected firefighters and affected next-of-kin.</text></paragraph><paragraph id="H6F6B51F79598484DA135B66C41A2145A"><enum>(5)</enum><text>Centralized short-term and long-term case management procedures for casualty assistance officers, including ensuring rapid access to expert case managers and counselors by—</text><subparagraph commented="no" display-inline="no-display-inline" id="id83bcfa2b6e534c8cb844e55da6b65f60"><enum>(A)</enum><text display-inline="yes-display-inline">casualty assistance officers; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7f6b11abcf854717aafd9a2ca0feb166"><enum>(B)</enum><text display-inline="yes-display-inline">affected firefighters and affected next-of-kin.</text></subparagraph></paragraph><paragraph id="HFCDA9AB552554BC9AAFCB855DE1DE319"><enum>(6)</enum><text>The provision, through a computer-accessible website and other means and at no cost to affected firefighters and affected next-of-kin, of personalized, integrated information relating to the benefits and financial assistance available from the Federal Government to affected firefighters and affected next-of-kin.</text></paragraph><paragraph id="HF25A9769B0564FEAA37517F525727512"><enum>(7)</enum><text>The provision to affected firefighters and affected next-of-kin of information relating to mechanisms for registering complaints regarding, or requests for, additional casualty assistance.</text></paragraph><paragraph id="HAF8E67976A20460685113118B6CB2C96"><enum>(8)</enum><text display-inline="yes-display-inline">Coordination among the Department of the Interior, the Department of Justice, and the Social Security Administration to ensure prompt and accurate resolution of issues relating to benefits administered by those agencies for affected firefighters and affected next-of-kin.</text></paragraph><paragraph id="HBDEE41E00230480297DDE24739429280"><enum>(9)</enum><text>Data collection, in consultation with the United States Fire Administration and the National Institute for Occupational Safety and Health, regarding the incidence and quality of casualty assistance provided to affected firefighters and affected next-of-kin.</text></paragraph></subsection><subsection id="H4D21E041E9A1416990274710CA1102CC"><enum>(d)</enum><header>No effect on certain benefits</header><text display-inline="yes-display-inline">The Program shall not affect any existing authority relating to line-of-duty death benefits for affected firefighters. </text></subsection></section><section id="H27F5A037F2A0487C880FDD7A1D4C1CDE"><enum>11.</enum><header>Continuing accrual of service for firefighters</header><subsection id="H52213EA58D184A809A707E91FF2D83FA"><enum>(a)</enum><header>Federal employees’ retirement system</header><text>Section 8401(14) of title 5, United States Code, is amended to read as follows:</text><quoted-block style="OLC" id="H2D7690BBC3844533AF59A7B436636CB1"><paragraph id="HF4EC1F19FEC94398A5B9E4EF911ABC68"><enum>(14)</enum><text>the term <term>firefighter</term> means—</text><subparagraph id="HAA745AFF60C0406A932935EFFF745F5F"><enum>(A)</enum><text>an employee, the duties of whose position—</text><clause id="H9439E931033B420D985D6C5BB549A92D"><enum>(i)</enum><text>are primarily to perform work directly connected with the control and extinguishment of non-wildland fires; and</text></clause><clause id="H7F24B022CE5C4DC6BEEC68AA36A69249"><enum>(ii)</enum><text>are sufficiently rigorous that employment opportunities should be limited to young and physically vigorous individuals, as determined by the Director considering the recommendations of the employing agency;</text></clause></subparagraph><subparagraph id="H541D96AF60D94FE68235DD9DE0D5E0CF"><enum>(B)</enum><text>an employee, the duties of whose position—</text><clause id="H65088B164D9F44498BDC2388758F4367"><enum>(i)</enum><text>are primarily to perform work directly connected with the control and extinguishment of wildland fires; and</text></clause><clause id="H6F38BB7D986D4ABDA9992DA40F566B86"><enum>(ii)</enum><text>are sufficiently rigorous that employment opportunities should be limited to young and physically vigorous individuals, as determined by the Director considering the recommendations of the employing agency;</text></clause></subparagraph><subparagraph id="H9489875294D6482CA355BFDE37BA712C"><enum>(C)</enum><text>an employee who—</text><clause id="HFF6975D8F40D4546A378CE22AA6D251B"><enum>(i)</enum><text>is transferred directly to a supervisory or administrative position after performing duties described in subparagraph (A) for at least 3 years; and</text></clause><clause id="H082F2DD3BA744DDC9D4A62119D1CCBC0"><enum>(ii)</enum><text>while serving in the supervisory or administrative position described in clause (i), has no break in service; or</text></clause></subparagraph><subparagraph id="H48E3D043F7E84DF6BF146F7DE27FA452"><enum>(D)</enum><text>an employee who—</text><clause id="HE367506EEDB24D4698CB92B9ABEC6894"><enum>(i)</enum><text>occupies a supervisory or administrative position after performing duties described in subparagraph (B) for at least 3 years; and</text></clause><clause id="HF28CC80105294E34AB7D14FC37A5A297"><enum>(ii)</enum><text>has not more than 24 months in total time of breaks in service;</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H45569242587348BF9E716EFE42F5E317"><enum>(b)</enum><header>Service before date of enactment</header><paragraph id="H4BE2A4D7F9DE4463A64CB31CB81D7819"><enum>(1)</enum><header>In general</header><text>Subject to the requirements under paragraph (2), service performed before the date of enactment of this Act by an individual who, on the date of enactment of this Act, is an employee (as defined in section 8401(11) of title 5, United States Code) shall, for the purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, be treated as service performed by a firefighter if—</text><subparagraph id="HC7759646FD144B06830BA12B51E71D8F"><enum>(A)</enum><text>that service was performed during the period beginning on October 1, 2003, and ending on the day before the date of enactment of this Act;</text></subparagraph><subparagraph id="HEA8A4F41E6594E03A626BA91C5A970C6"><enum>(B)</enum><text>at the time of performing such service—</text><clause id="HBFFB6FE98E064143B4378002CC4CE576"><enum>(i)</enum><text>the individual did not meet the requirements to be a firefighter under section 8401(14) of title 5, United States Code, because of a break in service; and</text></clause><clause id="H00A6602ABC314F2BAAB76745E101458B"><enum>(ii)</enum><text>would have met the requirements to be a firefighter under section 8401(14)(D) of title 5, United States Code, as amended by this Act; and</text></clause></subparagraph><subparagraph id="HC016ECD79819413EB6C7AF629BDDC9AA"><enum>(C)</enum><text>appropriate deductions and withholdings under sections 8422 and 8423 of title 5, United States Code, were made during such service.</text></subparagraph></paragraph><paragraph id="H7A7A94A3C3A54FC0BB1B5B35A9283CF1"><enum>(2)</enum><header>Credit for service</header><text>To receive credit for eligible service under paragraph (1), the applicable individual shall—</text><subparagraph id="H7E5835281A3941439D5E5605FA0184AA"><enum>(A)</enum><text>before the date on which the individual separates from service in the agency in which the individual holds a position on the date of enactment of this Act, submit a written election to the agency employing the individual;</text></subparagraph><subparagraph id="HD1E8DD29D01040A098145ED6CA9E258C"><enum>(B)</enum><text>if the individual is not employed by the agency that employed the individual when the service described in paragraph (1) was performed, submit a written election to such agency; and</text></subparagraph><subparagraph id="H4587B60BBD2D4840A58F047A3515613C"><enum>(C)</enum><text>remit to the agency that employed the individual when such service was performed the additional amount that would have been deducted during the period of prior service under section 8422 of title 5, United States Code, from the pay of the individual if the amendments made by subsection (a) had been in effect during the prior service, plus any applicable interest computed under section 8334(e) of title 5, United States Code.</text></subparagraph></paragraph><paragraph id="HB4D2BDBBB44B46BEB1317663109E3FC5"><enum>(3)</enum><header>Government contributions</header><text>If an individual remits payment under paragraph (2)(C) with respect to service described in paragraph (1), the agency that employed the individual when such service was performed shall remit to the Office of Personnel Management (for deposit in the Treasury of the United States to the credit of the Civil Service Retirement and Disability Fund) the total additional amount of Federal contributions that would have been paid under section 8423 of title 5, United States Code, if the amendments made by subsection (a) had been in effect during the prior service, plus any applicable interest computed in accordance with section 8334(e) of title 5, United States Code.</text></paragraph><paragraph id="H5E42066B7B114401B7619ED81E032132"><enum>(4)</enum><header>Notification and assistance requirements</header><text>The Director shall—</text><subparagraph id="HF0D5E939004343DD995A4BDC27C39052"><enum>(A)</enum><text>take such action as may be necessary and appropriate to inform individuals entitled to have any service credited under this subsection, or to have any annuity computed under this subsection, of the entitlement to the credit or computation; and</text></subparagraph><subparagraph id="H25DE813F12114AE0B7B7D99F722838DC"><enum>(B)</enum><text>upon request, assist any individual described in subparagraph (A) in obtaining such information in the possession of the Secretary of Agriculture or the Secretary of the Interior, as applicable, as may be necessary to verify the entitlement of the individual to have any service credited, or to have any annuity computed, pursuant to this subsection.</text></subparagraph></paragraph><paragraph id="H63E18DC8C66B42699870A42F86F2FDCD"><enum>(5)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to permit or require the making of any contribution to the Thrift Savings Fund that would not otherwise have been permitted or required but for the enactment of this section.</text></paragraph></subsection></section></legis-body></bill>
