<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 2795</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250911">September 11, 2025</action-date><action-desc><sponsor name-id="S369">Mr. Markey</sponsor> (for himself and <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 49, United States Code, to ensure that revenues collected from passengers as aviation security fees are used to help finance the costs of aviation security screening by repealing a requirement that a portion of such fees be credited as offsetting receipts and deposited in the general fund of the Treasury.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H0E283748159D4BBCB18B87C657D99470"><section section-type="section-one" id="H4128BF14EBB04CE8A8B90F6645008A08"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Funding for Aviation Screeners and Threat Elimination Restoration Act</short-title></quote> or the <quote><short-title>FASTER Act</short-title></quote>.</text></section><section id="H8612769D71934C108D7DF48ADE1AA81A"><enum>2.</enum><header>Repeal of requirement regarding crediting and deposit of a portion of aviation security fees</header><subsection id="HD5D6A40ACF7A4AC5B492F84E4E09C636"><enum>(a)</enum><header>Repeal</header><text display-inline="yes-display-inline">Section 44940 of title 49, United States Code, is amended—</text><paragraph id="H6163E74F42FC42518DBC2BC1027237B9"><enum>(1)</enum><text>in subsection (c), by striking paragraph (3);</text></paragraph><paragraph id="HD0428BBED64C4CE18190AD7B11AF104E"><enum>(2)</enum><text>in subsection (f)—</text><subparagraph id="H2CD786FAA5B24ABD8DA4BF42B07D75FB"><enum>(A)</enum><text>by striking the heading and all that follows through <quote>title 31,</quote> and inserting <quote><header-in-text level="subsection" style="USC">Deposit and availability of fee.—</header-in-text>Notwithstanding sections 1341, 1512 through 1519, and 3302 of title 31,</quote>;</text></subparagraph><subparagraph id="H77782DFD225E495B934C6DF70F3702A2"><enum>(B)</enum><text>by striking paragraph (1);</text></subparagraph><subparagraph id="HE3072FC9A6294CBC9EEAEBABF4FAF1ED"><enum>(C)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (1) and (2), respectively; and</text></subparagraph><subparagraph id="H0CCE747BA9CD460BBD7B74821A105022"><enum>(D)</enum><text>by amending paragraph (1), as so redesignated, to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="H4A35C55B9F0F4F0FAD08AC2837B98828"><paragraph id="HFCAB667029A24957A0B8ADC17912291C"><enum>(1)</enum><text display-inline="yes-display-inline">shall be deposited into a separate account in the Treasury, which shall be available to the Administrator for expenditure notwithstanding any other law, including any provision of section 1341(a)(1) of title 31 (commonly referred to as the <quote>Anti-Deficiency Act</quote>), only to pay the costs of activities and services for which the fee is imposed; and </text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HCA31D9EC11814A4EA57AD7E8CC0BB59E"><enum>(3)</enum><text>by striking subsection (i).</text></paragraph></subsection><subsection id="HCA6DD3822D874D58A877BD48E145EC12"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Subsection (d)(4) of such section is amended by striking <quote>, other than subsection (i),</quote>.</text></subsection></section></legis-body></bill>
