which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To release a Federal reversionary interest and convey mineral interests in Chester County, Tennessee, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="id1D79D410A7A14FD785E522A6422E3948"><enum>1.</enum><header display-inline="yes-display-inline">Chester County reversionary and mineral interests release</header><subsection id="id295EECE82198409298D5DA0B18BD0DF4"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="idad9d3ca9c9064650ab468dd4b61829f3"><enum>(1)</enum><text>within the parcel of State forest land located in Henderson, Chester County, Tennessee, a recent survey by the State determined that Bethel Baptist Church is encroaching on State-owned land in Chickasaw State Forest by approximately 19 inches; </text></paragraph><paragraph id="id8DB77DED248644F89F1FF611A26B417F"><enum>(2)</enum><text>the parcel described in paragraph (1) was conveyed to the State by the Department of Agriculture, which retained a reversionary interest in the land; and</text></paragraph><paragraph id="idD34C52C863904A148C836349752A926D"><enum>(3)</enum><text>it is necessary to release the interests of the United States in and to that land to resolve the encroachment issue described in paragraph (1). </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idFAB0494A3AC44E089A80E0D31565EF6F"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id0F0FB58492B849E8BF0219D85E70BBE6"><enum>(1)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id62F83BF5494C4C10AE65627CF71FAA77"><enum>(2)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means the State of Tennessee.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD48C7F23D15B4945BFF63FF86BA2E6C0"><enum>(3)</enum><header display-inline="yes-display-inline">State forest land</header><text display-inline="yes-display-inline">The term <term>State forest land</term> means the approximately 0.62-acre parcel of land in Chickasaw State Forest that is identified as <quote>State Forest Land</quote> on the map prepared by the Forest Service entitled <quote>State Forest Land Detail Map</quote> and dated December 13, 2019.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id692D4C74C53A49769664F7B29090220A"><enum>(c)</enum><header display-inline="yes-display-inline">Release of reversionary interest</header><paragraph commented="no" display-inline="no-display-inline" id="ide63dfad86be74398aee9c8b84a14433b"><enum>(1)</enum><header display-inline="yes-display-inline">Release</header><subparagraph commented="no" display-inline="no-display-inline" id="id0514BD38F528445DA19E7B5ED6ED4A01"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall release, without consideration, the reversionary interest described in paragraph (2). </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBE15C6A3F0254912A54DC3297083EC0B"><enum>(B)</enum><header>Requirements</header><text display-inline="yes-display-inline">Notwithstanding any requirement for a grant of land under section 32(c) of The Bankhead-Jones Farm Tenant Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1011">7 U.S.C. 1011(c)</external-xref>) or any other provision of law, the release under subparagraph (A) shall occur without any appraisal, other report, or environmental or similar review being undertaken.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id72b48d8d968d4c2597f09dddc3917d54"><enum>(2)</enum><header display-inline="yes-display-inline">Description of reversionary interest</header><text display-inline="yes-display-inline">The reversionary interest referred to in paragraph (1)(A) is the reversionary interest of the United States in and to the State forest land that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc63bf3ff2ac64b739c8b350d3b849f43"><enum>(A)</enum><text display-inline="yes-display-inline">takes effect if the State forest land ceases to be used for public purposes; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96a896c1d58e45ea95aa7cfe68fffaa4"><enum>(B)</enum><text display-inline="yes-display-inline">was created by the deed—</text><clause commented="no" display-inline="no-display-inline" id="id656ee0eedca24371ae2c64020c261efb"><enum>(i)</enum><text display-inline="yes-display-inline">granting from the United States to the State the State forest land;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9B74DAFCF9234896A5C734B0C4FC2E60"><enum>(ii)</enum><text display-inline="yes-display-inline">dated August 12, 1955; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id16683f3182ce4a148be8957ca79b93d3"><enum>(iii)</enum><text display-inline="yes-display-inline">registered on pages 588 through 591 of book 48 of the record of deeds for Chester County, Tennessee.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1E4AF3480F234B5780AB150F62B3602A"><enum>(3)</enum><header>Payment of costs</header><text>As a condition of the release under paragraph (1), the State shall pay to the United States any administrative costs incurred by the United States in carrying out the release.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida17ab719eca14be2bba672f15c244f32"><enum>(d)</enum><header display-inline="yes-display-inline">Conveyance of mineral rights</header><paragraph commented="no" display-inline="no-display-inline" id="id0C341593507444A7BC465C06A5594BF6"><enum>(1)</enum><header>In general</header><text>Notwithstanding any requirement for the conveyance of Federal mineral interests under section 209 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1719">43 U.S.C. 1719</external-xref>), part 2720 of title 43, Code of Federal Regulations (or successor regulations), or any other provision of law, the Secretary shall convey to the State, by quitclaim deed, without warranty, and without consideration, the mineral interest in the State forest land owned by the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id912267FA5B2248F6B3A6FA703FC8FE12"><enum>(2)</enum><header>Requirements</header><text>Notwithstanding any other provision of law, the conveyance under paragraph (1) shall occur—</text><subparagraph commented="no" display-inline="no-display-inline" id="idAB2F7C1231D145ACB30608AC6447F33D"><enum>(A)</enum><text>without any exploratory program as to the character of the mineral deposits in the land;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFA63AF33070040818BA927FA72D4C8AF"><enum>(B)</enum><text>without any findings as to known mineral values and mineral development of the land; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB3777D0E24244CAFAE99CD2B37BA34D7"><enum>(C)</enum><text>without any appraisal, other report, or environmental or similar review being undertaken by the Secretary.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB2E8B3BA4E31476084C3619DDE9A72FD"><enum>(3)</enum><header>Payment of costs</header><text>As a condition of the conveyance under paragraph (1), the State shall pay to the United States any administrative costs incurred by the United States in carrying out the conveyance.</text></paragraph></subsection></section></legis-body></bill>
