which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Agriculture to convey to the City of Ouray, Colorado, certain land managed by the Forest Service, together with a reservoir.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Crystal Reservoir Conveyance Act</short-title></quote>.</text></section><section id="id043c558baacc468b85f8dca566a183ea"><enum>2.</enum><header>Conveyance of Federal land to Ouray, Colorado</header><subsection id="H362F9066E15B4125B28883521275F661"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H173140C562A246D8980E08C1F13BE284"><enum>(1)</enum><header>City</header><text>The term <term>City</term> means the City of Ouray, Colorado.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc049a0769f944ae5b502d778b03612a0"><enum>(2)</enum><header>Federal land</header><text>The term <term>Federal land</term> means—</text><subparagraph id="id4bfe47b938194f639a6075f6a3bea78d"><enum>(A)</enum><text>the site known as <quote>Crystal Reservoir</quote> in Ouray County, Colorado, including—</text><clause commented="no" display-inline="no-display-inline" id="idf153957370cf4244bce1da7999de8b14"><enum>(i)</enum><text>the lake associated with that reservoir;</text></clause><clause commented="no" display-inline="no-display-inline" id="id906375c8d09b4158af607e6f19561409"><enum>(ii)</enum><text display-inline="yes-display-inline">Full Moon Dam and associated facilities, including the spillway and outlet;</text></clause><clause commented="no" display-inline="no-display-inline" id="id03259b241efd42ea88759aa85fa36837"><enum>(iii)</enum><text display-inline="yes-display-inline">Full Moon Ditch and Reservoir Number 10; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id78cffefb6f774b17855d7ebc2a067eda"><enum>(iv)</enum><text>all infrastructure associated with the reservoir; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd38e84b69990454c9151b407c556c6c0"><enum>(B)</enum><text display-inline="yes-display-inline">the parcel comprising approximately 45 acres of land underlying and surrounding Crystal Reservoir, as depicted on the Map, managed by the Forest Service as necessary for access for repair, operation, and maintenance of Crystal Reservoir and the features described in clauses (i) through (iv) of subparagraph (A).</text></subparagraph></paragraph><paragraph id="HBA8E6976DEED44308CB31C59BB049552" commented="no"><enum>(3)</enum><header>Map</header><text>The term <term>Map</term> means the map prepared by the Forest Service entitled <quote>Crystal Reservoir Conveyance</quote> and dated June 23, 2025.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9355a6838caf4606a95b7daf7749f439"><enum>(4)</enum><header display-inline="yes-display-inline">Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph></subsection><subsection id="H1B56C7487E874F4CBC83C5B11E944FA0" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Conveyance</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Secretary shall convey to the City—</text><paragraph commented="no" display-inline="no-display-inline" id="id9fb928fc2f334b7da6eb13c745a83892"><enum>(1)</enum><text display-inline="yes-display-inline">all right, title, and interest of the United States in and to the Federal land; and</text></paragraph><paragraph id="id0b1443346fff4913835218e4ac5e1169" commented="no"><enum>(2)</enum><text>all water rights associated with the Federal land, including the Full Moon Ditch and Reservoir Number 10 water rights described in the decree of the State of Colorado in Civil Action No. 1959, dated May 11, 1942.</text></paragraph></subsection><subsection id="HAB08B9E7D3A144A083749CF7BB1EE148"><enum>(c)</enum><header>Requirements</header><text>The conveyance under subsection (b) shall be—</text><paragraph id="id9c076a43bfaf497c9197332d0c468f6e"><enum>(1)</enum><text>made by quitclaim deed;</text></paragraph><paragraph id="H60A3B92ECD7D4795BB43CB917239B09B"><enum>(2)</enum><text>subject to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id49af02e746f84409836b47f564260b88"><enum>(A)</enum><text display-inline="yes-display-inline">valid existing rights; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id91f0341b3d90450ab0abda34eada8f89"><enum>(B)</enum><text>the reversionary interest described in subsection (e)(3); and</text></subparagraph></paragraph><paragraph id="H13527B811E9D4739AEF65D680506BB8A" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>except as provided in subsection (d)(2), completed at no cost to the City.</text></paragraph></subsection><subsection id="H2E7E3139DD0747019601347A923976A8"><enum>(d)</enum><header>Costs</header><paragraph id="H9DC2A21ADCD0429596C44AD176D81288"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Secretary shall pay all costs associated with the conveyance under subsection (b).</text></paragraph><paragraph id="H99015ACB2BF54C919161DD3C532FAF97"><enum>(2)</enum><header>Survey</header><text>The City shall pay all costs associated with any surveys conducted for the purpose of accomplishing the conveyance under subsection (b).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0d02d128aa094666b5dea128fc2190e5"><enum>(e)</enum><header>Terms and conditions</header><paragraph commented="no" display-inline="no-display-inline" id="idc17eca5e5fe84752b0aee5cbda7eaf3c"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>As a condition of the conveyance of the Federal land under subsection (b), the City shall agree—</text><subparagraph id="id723e3976020c45eeb2f287a89eb8da64"><enum>(A)</enum><text>to grant to the Secretary an easement for each trail and road in existence on the date of the conveyance that, as determined by the Secretary, originates at, terminates at, or traverses the Federal land;</text></subparagraph><subparagraph id="id31c491c4a98d4f93ba082a8041376647"><enum>(B)</enum><text>effective beginning on the date of the conveyance, to assume responsibility for the costs of all repairs, operations, and maintenance of Full Moon Dam and related infrastructure, including Full Moon Ditch and Reservoir Number 10;</text></subparagraph><subparagraph id="id004ecd3001ec4389868b9507a109674c"><enum>(C)</enum><text>to maintain the Federal land in perpetuity as open space, to be held open—</text><clause commented="no" display-inline="no-display-inline" id="idf59c81f431d340bd90ef1a7ecb90f4de"><enum>(i)</enum><text display-inline="yes-display-inline">for full public access for recreational activities, including fishing; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id970fc81e568f4a9b9e2a231f4b0978fd"><enum>(ii)</enum><text display-inline="yes-display-inline">not subject to any fee for recreational access;</text></clause></subparagraph><subparagraph id="id0b8c9e1d853343de980438eb863a60f7" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>not to conduct on the Federal land any development, commercial operations, or construction, other than as needed for the operation and maintenance of Full Moon Dam, Crystal Reservoir, and related infrastructure, including Full Moon Ditch and Reservoir Number 10; and</text></subparagraph><subparagraph id="id76b994eacebf4a698282ca982330999d"><enum>(E)</enum><text>not to expand the historical footprint of Crystal Reservoir in a manner that would flood, impair, or harm any wetlands located upstream of the Federal land, subject to the condition that deepening Crystal Reservoir in a manner consistent with the water rights of the City shall be allowed.</text></subparagraph></paragraph><paragraph id="id5a5af8c6ed5246cd8dd90dfd41c012e0" commented="no"><enum>(2)</enum><header>Other terms and conditions</header><text>The conveyance under subsection (b) shall be subject to such other terms and conditions as the Secretary determines to be appropriate.</text></paragraph><paragraph id="id85d8c3762f2e46a3902e6381f473806f"><enum>(3)</enum><header>Reversionary interest</header><text>If the Federal land conveyed under subsection (b) ceases to be used in accordance with the terms and conditions under this subsection, the Federal land shall revert to the United States, at the discretion of the Secretary, if the Secretary determines that reversion is in the best interest of the United States.</text></paragraph></subsection><subsection id="idd96e4b3766524f59b1017d17a9d769f6"><enum>(f)</enum><header>Use of Red Mountain Ditch</header><text>After the conveyance under subsection (b), the Secretary shall allow the structure located near the Federal land commonly known as <quote>Red Mountain Ditch</quote>, located near Red Mountain Pass, to continue to be used by the City for all decreed purposes under Colorado water law, including the diversion and delivery of water for storage in Crystal Reservoir.</text></subsection><subsection id="id7836d8003b5d4ed1b3bbecced1b34add"><enum>(g)</enum><header>Water rights</header><paragraph commented="no" display-inline="no-display-inline" id="id9075d12c3c044393ba242dfa22d433d7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Subject to paragraph (2), the City may use Crystal Reservoir for—</text><subparagraph id="idf45c1cfde9514d6bafaaff677d2347f5"><enum>(A)</enum><text>storage of water and in-reservoir uses, consistent with any water rights; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6da94a6a5feb485b821780de98d5d23f"><enum>(B)</enum><text display-inline="yes-display-inline">releases of water for augmentation and other beneficial uses, consistent with any water rights.</text></subparagraph></paragraph><paragraph id="id692c14bd1c234fb9a1ce00c3e05e52e6"><enum>(2)</enum><header>State water law</header><text>The City shall manage all water rights associated with the Federal land in accordance with applicable water laws of the State of Colorado.</text></paragraph></subsection><subsection id="id4ed520d77da649228982bd1a312415bb"><enum>(h)</enum><header>Rule of construction</header><text>Nothing in this section prohibits the City from making any expenditure for repair of Full Moon Dam or any other feature of the Federal land before the date of the conveyance under subsection (b), subject to the approval of the Secretary.</text></subsection><subsection id="HA1A337CBBAA44D6D949983810845CD4D"><enum>(i)</enum><header>Map and legal description</header><paragraph id="HBB35E2678CAC4F44963C4E0ED625D546"><enum>(1)</enum><header>In general</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall finalize the Map and a legal description of the Federal land to be conveyed under subsection (b).</text></paragraph><paragraph id="HC76C6B6565BE4E12B7830ED215DD006C" commented="no"><enum>(2)</enum><header>Corrections</header><text>The Secretary and the City, by mutual agreement, may correct any minor errors in the Map or legal description under paragraph (1).</text></paragraph><paragraph id="HBC09C2BAAD134CAE86150D060A1F7769" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Map on file</header><text>The Map and legal description under paragraph (1) shall be on file and available for public inspection in each appropriate office of the Forest Service.</text></paragraph></subsection></section></legis-body></bill>
