which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Omnibus Public Land Management Act of 2009 to authorize certain extraordinary operation and maintenance work for urban canals of concern.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Urban Canal Modernization Act</short-title></quote>.</text></section><section id="idbebb61f594a04986820ae70e0bea09f6"><enum>2.</enum><header>Extraordinary operation and maintenance work performed by the Secretary of the Interior</header><subsection id="id5af4eb68879143b09694aa17e50dfae1"><enum>(a)</enum><header>Definitions</header><text>Section 9601 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/510">43 U.S.C. 510</external-xref>) is amended—</text><paragraph id="idc3e35c6150b948b3a1dd85c288e7ee09"><enum>(1)</enum><text>by redesignating paragraphs (1), (2), (3), (4), (5), (6), and (7) as paragraphs (2), (3), (4), (5), (6), (7), and (1), respectively, and moving the paragraphs so as to appear in numerical order;</text></paragraph><paragraph id="id6c2f985372f54d34ac34a8d362d2ea76"><enum>(2)</enum><text>in paragraph (3) (as so redesignated), by striking <quote>et seq.)</quote> and inserting <quote>et seq.))</quote>;</text></paragraph><paragraph id="id7fb6082ff6a14f65b82181c1a5d87804"><enum>(3)</enum><text>in paragraph (4) (as so redesignated), by striking <quote>mean</quote> and inserting <quote>means</quote>; and</text></paragraph><paragraph id="id99e5b1ad09d44beabb337baa389cc419"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida9d32214e798492b8b7fc0e141f267a0"><paragraph id="id7184fdee029e45f79a07406817b4f6da"><enum>(8)</enum><header>Urban canal of concern</header><text>The term <term>urban canal of concern</term> means a transferred works or segment of a transferred works that is a canal reach—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddd23e20393604a27b9935dc3e553c3ee"><enum>(A)</enum><text display-inline="yes-display-inline">the failure of which would result in an estimated at-risk population of more than 100 individuals, as determined by the Secretary, pursuant to the guidelines and criteria developed under section 9602(a); and</text></subparagraph><subparagraph id="ida273fb74e2a74470a9112ad67329f3b9"><enum>(B)</enum><text>that is determined by the Secretary to be classified as an urban canal reach.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id2478d1b026b349ad92733228ded7b3e2"><enum>(b)</enum><header>Extraordinary operation and maintenance work on urban canals of concern</header><text>Section 9603 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/43/510b">43 U.S.C. 510b</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id87cc034ebc434732b7251f639acb7a4e"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id8cee15fa1ab446b1a0e20c06a8263c75"><enum>(A)</enum><text>by striking <quote>(a)</quote> and all that follows through <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6BC925E5C23B436F9AFB360FB7D6ACB7"><subsection commented="no" display-inline="no-display-inline" id="idd450009cf14543b097e593c689d0c0e0"><enum>(a)</enum><header>Authorization</header><paragraph commented="no" display-inline="no-display-inline" id="idb4bfb5de2e6047b3a35a9c05ff361080"><enum>(1)</enum><header>Project facilities</header><text>The Secretary</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb0f97342f5794ae2aade25d39e5571f6"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA69B861B426542069A90F25D9FC34BC0"><paragraph id="id4b4c4e2aa618482297cb6e2b7941c60b"><enum>(2)</enum><header>Urban canals of concern</header><text>The Secretary or the transferred works operating entity may carry out, in accordance with subsection (b), any extraordinary operation and maintenance work on an urban canal of concern that the Secretary determines to be necessary pursuant to the guidelines and criteria set forth in section 9602(a).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7cf058316dfb4f8ea3c58baf76852688"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id858133f5fcf24b89a1fb5769723d94c4"><enum>(A)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1bc0b535cf05422dafac250c80232821"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id62715E878A2A408F8B57F3DBD4F303B0"><paragraph id="id39a6fd546c234542bb0dbf08fd39b1d1" commented="no"><enum>(3)</enum><header>Urban canals of concern</header><text display-inline="yes-display-inline">Except in the case of emergency extraordinary operation and maintenance work carried out under subsection (c), of the total costs of extraordinary operation and maintenance work on an urban canal of concern conducted under subsection (a)(2)—</text><subparagraph id="id879b3983d1254bc79c9e22dcf6cf50ab" commented="no"><enum>(A)</enum><text>35 percent shall be provided by the Secretary on a nonreimbursable basis; and</text></subparagraph><subparagraph id="id5954da1455c346419672de701ded34fa" commented="no"><enum>(B)</enum><text>the remaining amounts shall be advanced by the Secretary in accordance with paragraph (2), to be repaid by the transferred works operating entity in accordance with that paragraph.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="ide53dd9314f6c418a9bd28e86eee4ccb6"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf81b3f2477c94d038cf2f096fa539626"><subsection commented="no" display-inline="no-display-inline" id="idf48b9671376346519b1dd6f2d83193aa"><enum>(e)</enum><header>Reimbursable funds</header><text>Any reimbursable funds provided under this section shall be considered to be a non-Federal source of funds for purposes of any cost-sharing requirement for a Federal grant.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
