<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 2731</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250908">September 8, 2025</action-date><action-desc><sponsor name-id="S427">Mr. Schiff</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 and the Social Security Act to provide that an individual engaged in a labor dispute may receive unemployment benefits.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H5C059E2C05104B549425F3129856AC8D"><section section-type="section-one" id="HB08E66E1E64F4825A77C377F20D4B43C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Empowering Striking Workers Act of 2025</short-title></quote>.</text></section><section section-type="subsequent-section" id="H245F75F6E95848689EB49A29D08C9146"><enum>2.</enum><header>Unemployment insurance for striking workers</header><subsection id="HCEA7CAAE06314C9EA09A0CDCF8C387CC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/3304">Section 3304(a)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>and</quote> at the end of paragraph (18), by striking the period at the end of paragraph (19) and inserting <quote>; and</quote>, and by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5087772A3EBF4EE6B1E5E912CA75DD90"><paragraph display-inline="no-display-inline" id="H2E079A9D56184275B1BABC01C217387B"><enum>(20)</enum><text display-inline="yes-display-inline">in the case of an individual who is employed but unable to work due to a labor dispute (including any controversy concerning terms, tenure or conditions of employment, or concerning the association or representation of persons in negotiating, fixing, maintaining, changing, or seeking to arrange terms or conditions of employment, regardless of whether the disputants stand in the proximate relation of employer and employee), including an individual unable to work as an indirect result of such a labor dispute, compensation is payable to such individual as though such individual were unemployed beginning on the date that is the earlier of—</text><subparagraph id="H7535FC5146904B7F8507E09FFA7A1FC7"><enum>(A)</enum><text>the date that is 14 days after the date on which a strike began;</text></subparagraph><subparagraph id="HCC677573BDCB4B33B7277FA8E470E30F"><enum>(B)</enum><text display-inline="yes-display-inline">the date on which a lock-out began;</text></subparagraph><subparagraph id="H21F0ABC1B7304A018B50CCE2A3999F86"><enum>(C)</enum><text>the date on which the employer hired permanent replacement workers; or</text></subparagraph><subparagraph id="H9080D018F0334C68BBAC78D811B5C68A"><enum>(D)</enum><text>the date on which the strike or lock-out ended and the individual became unemployed.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4B9AEFAA333444E69FE7EA9337015C37"><enum>(b)</enum><header>Exemption from work availability requirement</header><text display-inline="yes-display-inline">Section 303(a)(12) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/503">42 U.S.C. 503(a)(12)</external-xref>) is amended by inserting <quote>(other than a claimant who is an individual unable to work due to a labor dispute as described in <external-xref legal-doc="usc" parsable-cite="usc/26/3304">section 3304(a)(20)</external-xref> of the Internal Revenue Code of 1986)</quote> after <quote>claimant</quote>.</text></subsection></section></legis-body></bill>
