which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve connections between the Department of Agriculture and national and homeland security agencies, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Agriculture and National Security Act</short-title></quote>.</text></section><section id="idee15d31d7f334224bb52d164c8ef67fe"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph commented="no" display-inline="no-display-inline" id="id5ca5c9aaf1c04a71a3b08a1799efe24b"><enum>(1)</enum><text display-inline="yes-display-inline">food and agriculture are critical to the national security of the United States; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id344da1a39af64450b75be6f5657ab32e"><enum>(2)</enum><text display-inline="yes-display-inline">additional efforts are needed to identify national security vulnerabilities related to food and agriculture, particularly with regard to emerging technologies.</text></paragraph></section><section id="id2b0c5aec347e4f7d9bb728ceea7ea803"><enum>3.</enum><header>Agriculture and national security</header><subsection id="ida58d18f2667a4870b53fd7212075539a"><enum>(a)</enum><header>Assistant Secretary of Agriculture for National Security</header><paragraph id="id5dcea8be8b6448b399194f9262a99fe0"><enum>(1)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Agriculture (referred to in this section as <quote>Secretary</quote>) shall—</text><subparagraph id="iddb5fb0b7a0a0462980dd2e7574e05dab"><enum>(A)</enum><text>establish within the Office of the Secretary the position of Assistant Secretary for National Security; and</text></subparagraph><subparagraph id="id4fa61ac7b4d64c14b93e4cdfe5bf4f0c"><enum>(B)</enum><text>appoint an individual to the position of Assistant Secretary for National Security.</text></subparagraph></paragraph><paragraph id="id03fa34ee08504257919ef0975f1faf25"><enum>(2)</enum><header>Authorization</header><text>Section 218(a) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6918">7 U.S.C. 6918(a)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5987d2a4ef4548efa6f46c4909479f1f"><enum>(A)</enum><text>in paragraph (2), by striking <quote>and</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1f70726400854fd6a3989123308f0801"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc250bd3b187a40b592ecc897b511b025"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8c561210e39648a5aaebf4c5f22f2ee0"><paragraph commented="no" display-inline="no-display-inline" id="idb865f26b5a274a2ca55ddbdc8aa56a59"><enum>(4)</enum><text display-inline="yes-display-inline">Assistant Secretary of Agriculture for National Security.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id572a7655c2614393986e3f3af11bc950"><enum>(3)</enum><header>Duties</header><text>Section 218 of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6918">7 U.S.C. 6918</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id442be582bb384996928472e1d3cf37d3"><subsection id="idd09f21d3451d4a20adca74e00815ef2a"><enum>(d)</enum><header>Duties of Assistant Secretary of Agriculture for National Security</header><text>The Secretary may delegate to the Assistant Secretary of Agriculture for National Security responsibility for—</text><paragraph id="idf4c0f69f19cb47cca101bc07b8aa52b3"><enum>(1)</enum><text>serving as the principal advisor to the Secretary on national security;</text></paragraph><paragraph id="ide972abd3290248c39c6b929961af8783"><enum>(2)</enum><text>acting as the primary liaison on behalf of the Department with the National Security Council and other Federal departments and agencies in activities relating to national security;</text></paragraph><paragraph id="idb1a7405fefb94113a2fdcef5b1697c96"><enum>(3)</enum><text>coordinating national security activities across the Department, including—</text><subparagraph id="idb36b138405ec4e19be97d3acbe6f7b57"><enum>(A)</enum><text>the activities of the Office of Homeland Security established under section 221;</text></subparagraph><subparagraph id="idf421e3d7da524bdcb4b55276354ac42d"><enum>(B)</enum><text>the activities of the Intelligence Community Counterintelligence Office established under section 7318 of the National Defense Authorization Act for Fiscal Year 2024 (<external-xref legal-doc="usc" parsable-cite="usc/50/3384">50 U.S.C. 3384</external-xref>);</text></subparagraph><subparagraph id="id0c03a5c084d64e5ba43207085126975b"><enum>(C)</enum><text>the implementation of the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3501">7 U.S.C. 3501 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id4c8fc7232533475b8e6e2677189b5b0b"><enum>(D)</enum><text>the implementation of section 721 of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565</external-xref>); and</text></subparagraph></paragraph><paragraph id="id90245f54cc16467f99507964db6d36e2"><enum>(4)</enum><text>coordinating with stakeholders to identify national security vulnerabilities and risk mitigation strategies relevant to food and agriculture, particularly with regard to emerging technologies and issues, including biotechnology, artificial intelligence, drones, cybersecurity, and supply chain vulnerabilities.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id8b8c1fdd52e74226b4101f4b86c0601c"><enum>(b)</enum><header>Interagency coordination</header><text>Section 221(e) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6922">7 U.S.C. 6922(e)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id25fc49f37211408b8314156f67b7aa07"><paragraph id="id6c79ef1962654597b390fc8dd926e3f7"><enum>(3)</enum><header>Detailees authorized</header><text>The Secretary may provide detailees to, and accept and employ personnel detailed from, defense, national and homeland security, law enforcement, and intelligence agencies, with or without reimbursement, to improve information sharing, vulnerability identification, and risk mitigation related to food and agriculture.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idb72a4905ee154a8d920b893526954fe3"><enum>(c)</enum><header>Biennial reports</header><text>Section 221 of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6922">7 U.S.C. 6922</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfe36058c023041089274b948c775d5c0"><subsection id="iddca89e020dd34e31825911a0ce7be61e"><enum>(f)</enum><header>Biennial reports</header><text>Not later than 180 days after the date of enactment of this subsection, and not less frequently than once every 2 years thereafter, the Secretary shall submit to Congress and the National Security Council a report that includes—</text><paragraph id="id87ea714e0c0d4a10863aa39272013662"><enum>(1)</enum><text>from the perspective of the Department, an assessment of any gaps or limitations in national security efforts related to food and agriculture in the United States, including—</text><subparagraph id="id5060078c0c4046c8b0605c36b4933f10"><enum>(A)</enum><text>influence of foreign state-owned enterprise;</text></subparagraph><subparagraph id="ida210362756bd444ba53884764d6fea10"><enum>(B)</enum><text>control of and access to agricultural data;</text></subparagraph><subparagraph id="idbbe59a33ec714638b5239358d605d564"><enum>(C)</enum><text>foreign acquisition of intellectual property, agricultural assets, and land;</text></subparagraph><subparagraph id="ideb511bed886c45148e429bdfc4b3738b"><enum>(D)</enum><text>agricultural input shortages and dependence on foreign-sourced inputs;</text></subparagraph><subparagraph id="idd198d3279b734d6ca3590cd9dc86088b"><enum>(E)</enum><text>supply chain and trade disruptions;</text></subparagraph><subparagraph id="idbe0367ba70e1471081a5d2dc9b2ca929"><enum>(F)</enum><text>science and technology cooperation;</text></subparagraph><subparagraph id="id7b37ab494da345c99aea449a712d6d57"><enum>(G)</enum><text>cybersecurity and artificial intelligence;</text></subparagraph><subparagraph id="id39bac54f118641eeb8b2e48095cbbc29"><enum>(H)</enum><text>unequal investments in research, development, and scale-up;</text></subparagraph><subparagraph id="id02f6ef5d284144a483d08ab22c92805d"><enum>(I)</enum><text>incongruent regulatory policies; and</text></subparagraph><subparagraph id="id8798092c58ac4c039aac5d14c1e008a8"><enum>(J)</enum><text>other vulnerabilities throughout the food and agriculture sector, particularly with regard to emerging technologies;</text></subparagraph></paragraph><paragraph id="id72f8230dbdc54c68bf63c3a92dc7d0e4"><enum>(2)</enum><text>the actions taken by the Secretary to address any gaps or limitations identified under paragraph (1), including through interagency coordination, threat information sharing, and stakeholder outreach;</text></paragraph><paragraph id="ide2ca6fb4ffb4495c92824afb1191c5a8"><enum>(3)</enum><text>policy recommendations, including recommendations for executive actions and legislative proposals—</text><subparagraph id="idae9af87276e84d9aa27c686d96249b9a"><enum>(A)</enum><text>to reduce any gaps or limitations identified under paragraph (1); and</text></subparagraph><subparagraph id="ida8fb39f3c2a348b4b46da4689939110f"><enum>(B)</enum><text>to address any identified vulnerabilities with respect to the gaps or limitations identified under paragraph (1); and</text></subparagraph></paragraph><paragraph id="id67ef393fe4b6412f814cc0758597ce40"><enum>(4)</enum><text>resources the Department requires to address current and future national security vulnerabilities related to food and agriculture, including gaps in personnel or access to cleared systems.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ida4aac6d527a64f8bb78ee5c83dfbdd00"><enum>(d)</enum><header>Conforming amendment</header><text>Section 296(b) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/7014">7 U.S.C. 7014(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7cd3eefba6784471a5dec951856faaba"><paragraph id="id085a758af13e42148cb26ab214501b4b"><enum>(11)</enum><text>The authority of the Secretary to carry out the amendments made to this title by the <short-title>Agriculture and National Security Act</short-title>.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
