        <official-title>To establish sentencing enhancements for offenses relating to bank,
            mortgage, credit, and tax fraud committed by elected public officials, and for other
            purposes.</official-title>

        <section id="S1" section-type="section-one">
            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Law Enforcement Tools to Interdict Troubling Investments in Abodes Act</short-title></quote> or the <quote><short-title>LETITIA Act</short-title></quote>.</text>
        </section>
        <section id="idee11ac58c21e4070800356bc1b57aa3e">
            <enum>2.</enum>
            <header>Findings</header>
 <text display-inline="no-display-inline">It is the sense of Congress that:</text> <paragraph id="id80e94210c43d49069c2e919d56716cd6"> <enum>(1)</enum> <text>In the United States, citizens elect civic and political leaders to represent their interests and act on their behalf.</text>
            </paragraph>
            <paragraph id="id73357081ab244e3a8a938feafc2b75fe">
                <enum>(2)</enum>
 <text>In return for being given this sacred trust, public officials are expected to fully adhere to the highest ethical and moral standards, and must discharge their duties faithfully, honestly, and impartially, free from any personal considerations or gain.</text>
            </paragraph>
            <paragraph id="idc48a01199fc140bfbb067a842fe2dd5a">
                <enum>(3)</enum>
 <text>Public service is a public trust, and the Government only functions when there is trust between the electorate and public officials.</text>
            </paragraph>
            <paragraph id="idf79c5308981f47a58fba91c8871b9072">
                <enum>(4)</enum>
 <text>When public officials abuse the faith that citizens place in them by committing crimes of dishonesty or moral turpitude, they betray both their office and the public, and deserve heightened punishment.</text>
            </paragraph>
            <paragraph id="ideb08545bb5cd4696bfc28fdfeb956047">
                <enum>(5)</enum>
 <text>Fraud is, at its core, a crime of dishonesty.</text> </paragraph> <paragraph id="idc259bc31427c4cd7b7a83b8e18e62a6d"> <enum>(6)</enum> <text>Mortgage, bank, credit, and tax frauds require deception and lies, and harm the victim financial institutions, investors, and the broader public.</text>
            </paragraph>
            <paragraph id="idd6185a11b7d049579fa8c9ce91b17b20">
                <enum>(7)</enum>
 <text>Therefore, public officials who commit these crimes deserve punishments above and beyond what a normal citizen should receive.</text>
            </paragraph>
            <paragraph id="idc185bc7f0a4e48bb86cc8b47e9891607">
                <enum>(8)</enum>
 <text>Such punishment must include mandatory minimum sentences of imprisonment for any public official to ensure that they cannot abuse their positions of influence to cut sweetheart or backroom deals that the average citizen would be unable to make.</text>
            </paragraph>
            <paragraph id="id5af733d475ee4612a7805f9c9ccc8fd7">
                <enum>(9)</enum>
 <text>If a public official commits multiple frauds, demonstrating a pattern and practice of dishonest, unethical, and illegal behavior, justice demands that the public official should face even harsher mandatory penalties.</text>
            </paragraph>
            <paragraph id="idee0ebf743bef4c4597d6596be102029b">
                <enum>(10)</enum>
 <text>No person is above the law, and public officials who commit fraud must be held to account. Integrity matters.</text>
            </paragraph>
        </section>
        <section id="id389c87831cbb4059b994d366375f6616">
            <enum>3.</enum>
            <header>Enhanced penalties for public officials who commit bank fraud</header>
 <text display-inline="no-display-inline">Section 1344 of title 18, United States Code, is amended—</text>
            <paragraph id="id409813064b574aed9cc98c5fef864d13">
                <enum>(1)</enum>
 <text>in the matter preceding paragraph (1), by striking <quote>Whoever knowingly executes, or attempts to execute,</quote> and inserting the following:</text>

                    <subsection id="idac44eaeb6f1c43348534eec2738f333e">
                        <enum>(a)</enum>
                        <header>Offense</header>
 <text>It shall be unlawful to knowingly execute, or attempt to execute,</text>
                    </subsection>
                    <after-quoted-block>;</after-quoted-block>
                </quoted-block>
            </paragraph>
            <paragraph commented="no" display-inline="no-display-inline" id="idbc7767ad8b0d417b8133500df2dbafe7">
                <enum>(2)</enum>
 <text>in subsection (a)(2), as so designated by paragraph (1), by striking the semicolon at the end and inserting a period;</text>
            </paragraph>
            <paragraph id="id5d47cfd3dc724f6ea1025be700b17522">
                <enum>(3)</enum>
 <text>by striking <quote>shall be fined not more than $1,000,000 or imprisoned not more than 30 years, or both.</quote>; and</text>
            </paragraph>
            <paragraph commented="no" display-inline="no-display-inline" id="id34721fac5bb4419891c2f3026e6f01c8">
                <enum>(4)</enum>
 <text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idc4a586a0bf7446f8be7ad59e810948d7"> <subsection id="idecd58ce4861c4ea5bd8768303033d27b"> <enum>(b)</enum> <header>Penalty</header> <paragraph id="id5e3026abae664eb8849f616a4c33d7fc"> <enum>(1)</enum> <header>In general</header> <text>Except as provided in paragraph (2), a person convicted of a violation of subsection (a) shall be fined not more than $1,000,000, imprisoned not more than 30 years, or both.</text>
                        </paragraph>

                            <enum>(2)</enum>
                            <header>Public official</header>
                            <subparagraph id="idf02e60ad577342efb6b12777dd08992b">
                                <enum>(A)</enum>
                                <header>Definition</header>
 <text>In this paragraph, the term <term>public official</term> means an officer, employee, elected or appointed representative of, or an individual acting for or on behalf of, the United States, a State, or a subdivision of a State, or any department, agency, or branch of government, in any official function, under or by the authority of any such department, agency, or branch of government.</text>
                            </subparagraph>
                            <subparagraph id="id304a82a8440b42f499fb7848494d24c1">
                                <enum>(B)</enum>
                                <header>Enhanced penalties</header>
 <text display-inline="yes-display-inline">In the case of an individual who is a public official at the time of an offense described in subsection (a)—</text>
                                <clause commented="no" display-inline="no-display-inline" id="id0391ce63418540869ecb606bfa1c9638">
                                    <enum>(i)</enum>
 <text display-inline="yes-display-inline">if the offense is the first or second such offense, the individual shall be fined not more than $1,500,000 and imprisoned not less than 1 year and not more than 35 years; and</text>
                                </clause>
                                <clause commented="no" display-inline="no-display-inline" id="id534957fd891e48df8f88b6f4b8239a4e">
                                    <enum>(ii)</enum>
 <text display-inline="yes-display-inline">if the offense is the third or subsequent such offense, the individual shall be fined not more than $2,000,000 and imprisoned not less than 5 years and not more than 40 years.</text>

                            </subparagraph>
                        </paragraph>
                    </subsection>

            </paragraph>
        </section>

            <enum>4.</enum>
            <header>Enhanced penalties for public officials who falsify loan and credit
                applications</header>
 <text display-inline="no-display-inline">Section 1014 of title 18, United States Code, is amended—</text>
            <paragraph id="idac920110c5b54a668559939bdf4c7371">
                <enum>(1)</enum>
 <text>by striking <quote>Whoever knowingly</quote> and inserting:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id3ffcb743d3ab4b5eb4609a8128193911"> <subsection id="idb840a6f2517f449082ce1c798f042763"> <enum>(a)</enum> <header>Offense</header> <text>Whoever knowingly</text>
                    </subsection>
                    <after-quoted-block>;</after-quoted-block>
                </quoted-block>
            </paragraph>
            <paragraph id="idc08119ce919a416599fca37921829825">
                <enum>(2)</enum>
 <text>by striking <quote>shall</quote> and all that follows, and inserting <quote>shall be punished as provided in subsection (b).</quote>; and</text>
            </paragraph>

                <enum>(3)</enum>
 <text display-inline="yes-display-inline">by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id666c5cbf79d646729dcaf886d4cf3955"> <subsection id="id8f910a3c2a5e4981a93b024cf56cfd5c"> <enum>(b)</enum> <header>Penalty</header> <paragraph id="id0732359ac9e8462c9439e18c52f2b02d"> <enum>(1)</enum> <header>In general</header> <text>Except as provided in paragraph (2), a person convicted of a violation of subsection (a) shall be fined not more than $1,000,000, imprisoned not more than 30 years, or both.</text>
                        </paragraph>

                            <enum>(2)</enum>
                            <header>Public officials</header>
 <text display-inline="yes-display-inline">In the case of an individual who is a public official at the time of an offense described in subsection (a)—</text>
                            <subparagraph commented="no" display-inline="no-display-inline" id="id1740f74d1514446e846341b8b6824f7c">
                                <enum>(A)</enum>
 <text display-inline="yes-display-inline">if the offense is the first or second such offense, the individual shall be fined not more than $1,500,000 and imprisoned not less than 1 year and not more than 35 years; and</text>
                            </subparagraph>
                            <subparagraph commented="no" display-inline="no-display-inline" id="idec0f2cec9138497c9fbad5714e33adc9">
                                <enum>(B)</enum>
 <text display-inline="yes-display-inline">if the offense is the third or subsequent such offense, the individual shall be fined not more than $2,000,000 and imprisoned not less than 5 years and not more than 40 years.</text>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                    <subsection commented="no" display-inline="no-display-inline" id="id3b92da21e8204d33a634969b02a841ba">
                        <enum>(c)</enum>
                        <header>Definitions</header>
 <text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="id138086655e4b4300a7a4c68fab94cdd8"> <enum>(1)</enum> <header>Public official</header> <text display-inline="yes-display-inline">The term <term>public official</term> means an officer, employee, elected or appointed representative of, or an individual acting for or on behalf of, the United States, a State, or a subdivision of a State, or any department, agency, or branch of government, in any official function, under or by the authority of any such department, agency, or branch of government.</text>
                        </paragraph>
                        <paragraph commented="no" display-inline="no-display-inline" id="id4a961935805446329df639b2a2b6d356">
                            <enum>(2)</enum>
                            <header>State-chartered credit union</header>
 <text display-inline="yes-display-inline">The term <term>State-chartered credit union</term> includes a credit union chartered under the laws of a State of the United States, the District of Columbia, or any commonwealth, territory, or possession of the United States.</text>
                        </paragraph>
                    </subsection>

            </paragraph>
        </section>

            <enum>5.</enum>
            <header>Enhanced penalties for public officials who falsify tax filings</header>
 <text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/7206">Section 7206</external-xref> of the Internal Revenue Code of 1986 is amended—</text>
            <paragraph commented="no" display-inline="no-display-inline" id="id1e1687f8dfdf4e27af4a0927380116be">
                <enum>(1)</enum>
 <text>by striking <quote>Any person</quote> and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="ida6a71e21957947f6ba8db4127f4f400e"> <subsection commented="no" display-inline="no-display-inline" id="idd8ed8cea145f4094b0b65be7fc83638a"> <enum>(a)</enum> <header>In general</header> <text>Any person</text>
                    </subsection>
                    <after-quoted-block>, and</after-quoted-block>
                </quoted-block>
            </paragraph>
            <paragraph commented="no" display-inline="no-display-inline" id="idd2eabcefe2ac4f199e3e5b03b2a29414">
                <enum>(2)</enum>
 <text>by adding at the end the following new subsection:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id2b0b0167ec4746349fde131810d6d678"> <subsection commented="no" display-inline="no-display-inline" id="id299cae78d16349f4b56eb4ab01c40fa2"> <enum>(b)</enum> <header>Enhanced penalty for public officials</header> <paragraph commented="no" display-inline="no-display-inline" id="id1882ba76fbf1476cba78b8fed64ec0e3"> <enum>(1)</enum> <header>In general</header> <text>In the case of an individual who is a public official at the time of an offense described in subsection (a)—</text>
                            <subparagraph commented="no" display-inline="no-display-inline" id="ide9b9aca2f5614c3dbde9eb67727ee877">
                                <enum>(A)</enum>
 <text display-inline="yes-display-inline">if the offense is the first or second such offense, subsection (a) shall be applied—</text>
                                <clause commented="no" display-inline="no-display-inline" id="idcad01b5e622b480f940319309687131c">
                                    <enum>(i)</enum>
 <text display-inline="yes-display-inline">by substituting <quote>$150,000</quote> for <quote>$100,000</quote>, and</text>
                                </clause>
                                <clause commented="no" display-inline="no-display-inline" id="id95a91ca5bd184a9d9996a134ef77fc16">
                                    <enum>(ii)</enum>
 <text>by substituting <quote>not less than 6 months and not more than 5 years</quote> for <quote>not more than 3 years</quote>, and</text>
                                </clause>
                            </subparagraph>
                            <subparagraph commented="no" display-inline="no-display-inline" id="idf459216da0924cfcae34d6a9f9c3e441">
                                <enum>(B)</enum>
 <text>if the offense is the third or subsequent such offence, subsection (a) shall be applied—</text>
                                <clause commented="no" display-inline="no-display-inline" id="idaaf030122da849b2b4dd2436e95f7497">
                                    <enum>(i)</enum>
 <text display-inline="yes-display-inline">by substituting <quote>$200,000</quote> for <quote>$100,000</quote>, and</text>
                                </clause>
                                <clause commented="no" display-inline="no-display-inline" id="id23516ecf754e4f98be55ce988f3dcbea">
                                    <enum>(ii)</enum>
 <text>by substituting <quote>not less than 2 years and not more than 10 years</quote> for <quote>not more than 3 years</quote>.</text>
                                </clause>
                            </subparagraph>
                        </paragraph>
                        <paragraph id="idbe105b1be7604fb484acc87382394839">
                            <enum>(2)</enum>
                            <header>Public official</header>
 <text>For purposes of this subsection, the term <term>public official</term> means an officer, employee, elected or appointed representative of, or an individual acting for or on behalf of, the United States, a State, or a subdivision of a State, or any department, agency, or branch of government, in any official function, under or by the authority of any such department, agency, or branch of government.</text>
                        </paragraph>
                    </subsection>

        </section>

            <enum>6.</enum>
            <header>Public integrity enforcement guidance for the department of justice and the
                department of the treasury</header>
            <subsection id="id6cafea07062b4eb6b08798b9db26581a">
                <enum>(a)</enum>
                <header>Directive to Department of Justice Law Enforcement Officials and Task
                    Forces</header>
                <paragraph id="id921b9a673908449db8261d5b71b0ceea">
                    <enum>(1)</enum>
                    <header>In general</header>
 <text>Not later than 90 days after the date of enactment of this Act, the Attorney General shall issue a directive to—</text>
                    <subparagraph id="id73d8f385421a4acca842e564ce2543f3">
                        <enum>(A)</enum>
 <text>all Federal law enforcement officers and relevant personnel employed by the Department of Justice who may be involved in the investigation of bank fraud and falsification of loan and credit applications; and</text>
                    </subparagraph>
                    <subparagraph id="id022724b867d04700ac32e8ba682bd04e">
                        <enum>(B)</enum>
 <text>members of all task forces led by the Department of Justice or a component thereof that participate in the investigation of bank fraud and falsification of loan and credit applications.</text>
                    </subparagraph>
                </paragraph>
                <paragraph id="idf6c50d3ed7334eca97f9e48e36790b8f">
                    <enum>(2)</enum>
                    <header>Required instructions</header>
 <text>The directive required to be issued under paragraph (1) shall include instructions on—</text>
                    <subparagraph id="id982505db667a4cfe84a21866c893ad9f">
                        <enum>(A)</enum>
 <text>the updates made by this Act to sections 1014 and 1344 of title 18, United States Code; and</text>
                    </subparagraph>
                    <subparagraph id="idb08f3cf084d340bda72a66cb2af8a8a4">
                        <enum>(B)</enum>
 <text>the investigation of public officials who commit bank fraud and falsification of loan and credit applications and how such individuals should be investigated for such acts.</text>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection id="ida946ddfba1ca45cab4818881b647bd53">
                <enum>(b)</enum>
                <header>Directive to Department of Treasury Officials</header>
                <paragraph id="id497d165eb9514e318b5f9e8ef11578e0">
                    <enum>(1)</enum>
                    <header>In general</header>
 <text>Not later than 90 days after the date of enactment of this Act, the Secretary of the Treasury, in consultation with the Attorney General, shall issue a directive to—</text>
                    <subparagraph id="idced476337a5a4a48bf3e4e137a4f320b">
                        <enum>(A)</enum>
 <text>all Federal law enforcement officers and relevant personnel employed by the Department of the Treasury who may be involved in the investigation of falsified tax filings; and</text>
                    </subparagraph>
                    <subparagraph id="idaf36d0d0828240eb9b937c9bc6072ef7">
                        <enum>(B)</enum>
 <text>members of all task forces led by the Department of the Treasury or a component thereof that participate in the investigation of falsified tax filings.</text>
                    </subparagraph>
                </paragraph>
                <paragraph id="idb1967c123eaa4ff9be659182081ebf81">
                    <enum>(2)</enum>
                    <header>Required instructions</header>
 <text>The directive required to be issued under paragraph (1) shall include instructions on—</text>

                        <enum>(A)</enum>
 <text>the updates made by this Act to <external-xref legal-doc="usc" parsable-cite="usc/26/7206">section 7206</external-xref> of the Internal Revenue Code of 1986;</text>
                    </subparagraph>
                    <subparagraph id="id5964fe18b00f4be4a2c3b3a781425d2a">
                        <enum>(B)</enum>
 <text>the investigation of public officials who falsify tax filings and how such individuals should be investigated for such acts; and</text>
                    </subparagraph>
                    <subparagraph id="idbd6bb7ad90fb4a22a24e3be9c1925ed2">
                        <enum>(C)</enum>
 <text>best practices for collaborating with the Department of Justice and components thereof in the investigation and prosecution of public officials who falsify tax filings.</text>
                    </subparagraph>
                </paragraph>
            </subsection>
        </section>
        <section id="id7f0f93302a234a91a484916f69137598" commented="no" display-inline="no-display-inline">
            <enum>7.</enum>
            <header>Effective date</header>
 <text display-inline="no-display-inline">The amendments made by this Act shall apply to convictions after the date of enactment of this Act.</text>
