<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 2653</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250801">August 1, 2025</action-date><action-desc><sponsor name-id="S322">Mr. Merkley</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 23, United States Code, to permit the use of certain electric vehicle charging stations at rest areas on the Interstate System, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Recharge your Electric Car on the Highway to Alleviate Range Gaps Effectively Act</short-title></quote> or the <quote><short-title>RECHARGE Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id841a3d500a494ae6a8736e81b3de5371"><enum>2.</enum><header>Use of and access to rest areas on the Interstate System for electric vehicle charging stations</header><subsection commented="no" display-inline="no-display-inline" id="id9a0a1c29266d45dca181c23a0063a6ce"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 111 of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd4b372a3b5bb42f99219c712a1956d8a"><subsection commented="no" display-inline="no-display-inline" id="id69693f8651314cb8ab9175ff888cc265"><enum>(f)</enum><header>Electric vehicle charging stations</header><paragraph commented="no" display-inline="no-display-inline" id="idd13a75a66bc34b8ab6d68554051c9c51"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding subsections (a) and (b), the Secretary shall permit, consistent with section 109(s), electric vehicle charging infrastructure for passenger automobiles (as defined in section 32901(a) of title 49) at rest areas on the Interstate System.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id20a7955a69d14ba2b0177b24a5f2efc3"><enum>(2)</enum><header>Savings clause</header><text display-inline="yes-display-inline">Nothing in this subsection permits commercial activities on rights-of-way on the Interstate System except as necessary for the charging of electric vehicles in accordance with this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id9993444f06d3440eb92ef87fe7b0bb5c"><enum>(b)</enum><header>Conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="id3b8322ec5bf04c74a1023daf31bf3487"><enum>(1)</enum><header>Congestion mitigation and air quality improvement program</header><text>Section 149(c)(2) of title 23, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id019fa74f8dab4e129f952c751e68c4a3"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>such stations</quote> and inserting <quote>such natural gas vehicle refueling stations</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id747deb8bde6b4164a5b9044ea0197a05"><enum>(B)</enum><text>by striking <quote>of title 23, United States Code</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2d9a3428a4554a45bae697048d005a88"><enum>(2)</enum><header>Jason's Law</header><text>Section 1401(d)(2) of the Moving Ahead for Progress in the 21st Century Act (<external-xref legal-doc="usc" parsable-cite="usc/23/137">23 U.S.C. 137</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/112/141">Public Law 112–141</external-xref>) is amended by striking <quote>Electric vehicle battery charging stations or natural</quote> and inserting <quote>Natural</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="iddb6d7f9366b0497988858373162b39ee"><enum>(c)</enum><header>Congressional intent</header><text>Nothing in this Act or an amendment made by this Act is intended as a statement of congressional intent with respect to the existing authority of the President or any other Federal agency under section 111 of title 23, United States Code.</text></subsection></section></legis-body></bill>
