which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To restore the integrity of the Fifth Amendment to the Constitution of the United States, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="HB958B006AD9C4BC28BAF9F83470EA146"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fifth Amendment Integrity Restoration Act of 2025</short-title></quote> or the <quote><short-title>FAIR Act of 2025</short-title></quote>.</text></section><section id="H25F9CA8863FE41B993181D28221AF0E7"><enum>2.</enum><header>Civil forfeiture and nonjudicial forfeiture</header><text display-inline="no-display-inline">Section 983 of title 18, United States Code, is amended—</text><paragraph id="HA7F368AD83F74384A94E8AF4983BA1DB"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HDB1B5055F0E74500A7773C788E9D9DCE"><enum>(A)</enum><text>in the subsection heading, by striking <quote>Claim;</quote>;</text></subparagraph><subparagraph id="HAC74DBD2F7914753A680909464BC1BC5"><enum>(B)</enum><text>in paragraph (1)—</text><clause id="HE57C25BCFE05452DA8974B42D58FE45D"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="H5B4F44BDC8D64955844C5D61808E7C5D"><enum>(I)</enum><text>in clause (i)—</text><item id="H7624E602DE60401FA19411CEF90BE703"><enum>(aa)</enum><text>by striking <quote>clauses (ii) through (v), in any nonjudicial</quote> and inserting <quote>clause (ii), in any</quote>; and</text></item><item id="H029ACEDFD8AC4DFF829CA3FBCFC1BB34"><enum>(bb)</enum><text>by striking <quote>60</quote> and inserting <quote>7</quote>;</text></item></subclause><subclause id="HA7F43DE88D644733BFA5AB95DB4ABDD5"><enum>(II)</enum><text>by striking clauses (ii) through (v); and</text></subclause><subclause id="HAB3497EF78554FAC85C821E6EE97154C"><enum>(III)</enum><text>by inserting after clause (i) the following:</text><quoted-block style="OLC" id="HD142E933992C47CD8471A928897DB782"><clause id="HEE7C392B8EFB48538F6A05A8CAE3B771"><enum>(ii)</enum><text>If the identity or interest of a party is not determined until after the seizure or turnover but is determined before a declaration of forfeiture is entered, the Government shall determine the identity and address of the party or interest within 7 days after the seizure or turnover, and notice shall be sent to such interested party not later than 7 days after the determination by the Government of the identity and address of the party or the party’s interest.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subclause></clause><clause id="HB5BF95BDA2DB42F7B693652FDF80D241"><enum>(ii)</enum><text>by striking subparagraphs (B) and (C);</text></clause><clause id="H8345F92DF234401CA18627B341C84F1E"><enum>(iii)</enum><text>by redesignating subparagraphs (D) through (F) as subparagraphs (B) through (D), respectively; and</text></clause><clause id="H47600CEA35B64C578100EA9B1AD90698"><enum>(iv)</enum><text>in subparagraph (C), as so redesignated, by striking <quote>nonjudicial</quote>;</text></clause></subparagraph><subparagraph id="H09DED6436DD24CEBB5CC6CAA07F0188C"><enum>(C)</enum><text>by striking paragraph (2);</text></subparagraph><subparagraph id="H5C977FD2B15C46AAB23A85EF8405647D"><enum>(D)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (2) and (3), respectively; and</text></subparagraph><subparagraph id="H181372063A9046B79EAF97ED817C280E"><enum>(E)</enum><text>in paragraph (2)(A), as so redesignated—</text><clause id="HA85C3322B8A04A2298F9255096AE7323"><enum>(i)</enum><text>by striking <quote>90</quote> and inserting <quote>30</quote>; and</text></clause><clause id="HB364295337444B67B1930C71ED79A186"><enum>(ii)</enum><text>by striking <quote>after a claim has been filed</quote> and inserting <quote>after the date of the seizure</quote>;</text></clause></subparagraph></paragraph><paragraph id="HF66A1AEDDE8347C6A19E08CF46E0C4D5"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HC64F95520A044E93BCD1CC65448A382B"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H3A05BEEF809E47949C5DFF8B4C3126FF"><enum>(i)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" id="H3810500FF8E54E3AAEE4F9AF38B19A61"><subparagraph id="HCB7B8AFF01544AFEA66345F9339C5FC5"><enum>(A)</enum><text>If a person with standing to contest the forfeiture of property in a civil forfeiture proceeding under a civil forfeiture statute is—</text><clause id="HE5E26394E3704A4DAAB280AE32FA22ED"><enum>(i)</enum><text>financially unable to obtain representation by counsel; or</text></clause><clause id="HB677454C01E04E9890D93FF7EBFD1200"><enum>(ii)</enum><text>the cost of obtaining representation would exceed the value of the seized property,</text></clause><continuation-text continuation-text-level="subparagraph">the court may authorize or appoint counsel to represent that person with respect to the claim.</continuation-text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="HD9E0ABF735B84296A269BC6C093E8BA3"><enum>(ii)</enum><text>in subparagraph (B), by inserting <quote>or appoint</quote> after <quote>authorize</quote>; and</text></clause></subparagraph><subparagraph id="H922201B1A3214F9FBA709ED4AB649616"><enum>(B)</enum><text>in paragraph (2)(A)—</text><clause id="H8A275613250D4555B76FE7729C3B3FD7"><enum>(i)</enum><text>by striking <quote>in a judicial civil forfeiture proceeding</quote> and inserting <quote>in a civil forfeiture proceeding</quote>;</text></clause><clause id="H1CEC6DB31C7E4E6BADFD39E35BD97C3F"><enum>(ii)</enum><text>by inserting <quote>under paragraph (1)</quote> after <quote>counsel</quote>;</text></clause><clause id="HC5E29A44DE384CE1ABF3783F75A9A595"><enum>(iii)</enum><text>by striking <quote>, and the property subject to forfeiture is real property that is being used by the person as a primary residence,</quote>; and</text></clause><clause id="H3419B951D67D4623B093AE67B3B5BDC4"><enum>(iv)</enum><text>by striking <quote>, at the request of the person, shall insure</quote> and inserting <quote>shall ensure</quote>;</text></clause></subparagraph></paragraph><paragraph id="H7CF4FA2B4D1D4BFCA21500F99570BD93"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="H2A7784E058D74B97A39350F2198031DC"><enum>(A)</enum><text>in paragraph (1), by striking <quote>a preponderance of the evidence</quote> and inserting <quote>clear and convincing evidence</quote>;</text></subparagraph><subparagraph id="HC631F7B273704C0DA97706C0CA9AA837"><enum>(B)</enum><text>in paragraph (2), by striking <quote>a preponderance of the evidence</quote> and inserting <quote>clear and convincing evidence</quote>; and</text></subparagraph><subparagraph id="H37B7A2114317446D9C89B512480FAD9B"><enum>(C)</enum><text>by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" id="HDA5D6D1E1D3B487FA9753837B6FC7EBB"><paragraph id="H1D2004DCAC5D45B9B24F10B156D26043"><enum>(3)</enum><text>if the Government’s theory of forfeiture is that the property was used to commit or facilitate the commission of a criminal offense, or was involved in the commission of a criminal offense, the Government shall establish, by clear and convincing evidence, that—</text><subparagraph id="HC7331C143165494A9D404F00EE1788EB"><enum>(A)</enum><text>there was a substantial connection between the property and the offense; and</text></subparagraph><subparagraph id="HEB964D1BBC564A079CD3B5CA450102E0"><enum>(B)</enum><text>the owner of any interest in the seized property—</text><clause id="H827C9BD0EC7543268AEC9FE52C121743"><enum>(i)</enum><text>used the property with intent to facilitate the offense; or</text></clause><clause id="H1B63B7903CFF4A1F9BE8E482F8931BEE"><enum>(ii)</enum><text>knowingly consented or was willfully blind to the use of the property by another in connection with the offense.</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H11C3B31F1D5C481B95F943340599F693"><enum>(4)</enum><text>in subsection (d)—</text><subparagraph id="HEE7909B4054D4CCDA527FFE76C9D66FB"><enum>(A)</enum><text>in paragraph (1), by striking the second sentence and inserting the following: <quote>The Government shall have the burden of proving that the claimant is not an innocent owner by a preponderance of the evidence.</quote>; and</text></subparagraph><subparagraph id="HCA06446E8BE94C4FB5453D50FA66AE5F"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="HC1EE3D07F873404E86231CB780EC364D"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>an owner who</quote> and all that follows through <quote>upon learning</quote> and inserting <quote>an owner who, upon learning</quote>; and</text></clause><clause id="H7740F3F95F934E7ABC14A626E7C44477"><enum>(ii)</enum><text>in subparagraph (B)(i), by inserting before <quote>For the purposes of this paragraph</quote> the following: <quote>If the Government satisfies its burden under paragraph (1), the claimant may rebut the Government’s evidence related to his innocent ownership, including by showing that he did all that could reasonably be expected under the law.</quote>;</text></clause></subparagraph></paragraph><paragraph id="HCBC2B7BB9C41476A94CA0DEED0733AAE"><enum>(5)</enum><text>in subsection (e)—</text><subparagraph id="H9BB6C8EFD8AE44758F7444F7C9C14349"><enum>(A)</enum><text>in paragraph (1), in the matter preceding subparagraph (A)—</text><clause id="HE1B89C8513B448C6A08945FB1A202A50"><enum>(i)</enum><text>by striking <quote>nonjudicial</quote>; and</text></clause><clause id="HBDA51DA3EC584B1AADDFFD91F4D8A0DD"><enum>(ii)</enum><text>by striking <quote>a declaration</quote> and inserting <quote>an order</quote>;</text></clause></subparagraph><subparagraph id="HB19C1FFDD5C248D7B14D1AB3494C37FA"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="HF7ADCD3982394DD4A6E6D892A3848F22"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>declaration</quote> and inserting <quote>order</quote>; and</text></clause><clause id="H6FB6F493AEA24245905ADE0E07979EEF"><enum>(ii)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" id="HE7792A849801428FB7A75B9EA73CA5D1"><subparagraph id="H3A39784D251744D6B18665AF58E0D65C"><enum>(B)</enum><text>Any proceeding described in subparagraph (A) shall be commenced within 6 months of the entry of the order granting the motion.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H06F323F7C0A94FB8AD2E46471643553D"><enum>(C)</enum><text>by striking paragraph (5);</text></subparagraph></paragraph><paragraph id="HFC8B732E4A4C4D9AB07A6DD0D6BDD0A6"><enum>(6)</enum><text>in subsection (f)(1), in the matter preceding subparagraph (A), by striking <quote>(a)</quote> and inserting <quote>(a)(3)(A)</quote>;</text></paragraph><paragraph id="HA007B3E7D6BB483BAEC7637748816AD2"><enum>(7)</enum><text>in subsection (g)—</text><subparagraph id="H0D059A1E9A5947E5AAED9508F6E593BC"><enum>(A)</enum><text>in paragraph (1), by striking <quote>(a)(4)</quote> and inserting <quote>(a)(3)</quote>; and</text></subparagraph><subparagraph id="H0EFF734BD21A47E7A01B398E7ACBBE7D"><enum>(B)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" id="HAB6F0722F175447CBCB3EB6E75364F81"><paragraph id="HF8F068406B5D4F4DA9EB894D79502DAA"><enum>(2)</enum><text>In making this determination, the court shall consider such factors as—</text><subparagraph id="H847A8483221040CA88231D3916FCC4D8"><enum>(A)</enum><text>the seriousness of the offense;</text></subparagraph><subparagraph id="H9B4DA0BC2E5A4982A6E1C52366FF3DBE"><enum>(B)</enum><text>the extent of the nexus of the property to the offense;</text></subparagraph><subparagraph id="HBA6EF70149054CA19A0F69F94555421D"><enum>(C)</enum><text>the range of sentences available for the offense giving rise to forfeiture;</text></subparagraph><subparagraph id="HF0B6C8685B0A481FA14D6B25FC8455A9"><enum>(D)</enum><text>the fair market value of the property; and</text></subparagraph><subparagraph id="H561532AAFC8E495B816D2F3D520CEDFA"><enum>(E)</enum><text>the hardship to the property owner and dependents.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H72937208D845409289C3DC579AEBFAE6"><enum>(8)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H93BE697E976D451DBBB345E1B1306FED"><subsection id="HD4EC6897E7F348E7B2AE5CA29C2963C7"><enum>(k)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H140B0AD3FB444CB09C734B815CB0D5BE"><enum>(1)</enum><text>Notwithstanding any other provision of law—</text><subparagraph id="H4E85829F67F3426BBB21B07369D4C470"><enum>(A)</enum><text>no Federal seizing agency may conduct nonjudicial forfeitures;</text></subparagraph><subparagraph id="H078DEA57917E423AB39124B7E85F412D"><enum>(B)</enum><text>no property may be subject to forfeiture except through judicial process; and</text></subparagraph><subparagraph id="H472734F1F31843EFB8B03780A4454FAF"><enum>(C)</enum><text>no order of forfeiture may be entered except by a United States district court.</text></subparagraph></paragraph><paragraph id="HAC719BE292864030B048F96C5DA4ACF5"><enum>(2)</enum><text>In this subsection, the term <quote>nonjudicial forfeiture</quote> means an in rem action that permits the Federal seizing agency to start a forfeiture without judicial involvement.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HF34BA92FFB5A4A1CAA13197CDADCEDEF"><enum>3.</enum><header>Disposition of forfeited property</header><subsection id="HE5403746A7844BF1B997442C4716838A"><enum>(a)</enum><header>Revisions to controlled substances act</header><text>Section 511(e) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/881">21 U.S.C. 881(e)</external-xref>) is amended—</text><paragraph id="H2E166E05F40843C08D5F51CCC2664238"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="H13B12B6FED95426389695ACB8F3DF28F"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>civilly or</quote>;</text></subparagraph><subparagraph id="H82096377320A47F8B197EF515A7D6400"><enum>(B)</enum><text>by striking subparagraph (A); and</text></subparagraph><subparagraph id="HBFC6AD36EF8C4A4D98D6B33BF49ED784"><enum>(C)</enum><text>by redesignating subparagraphs (B) through (E) as subparagraphs (A) through (D), respectively;</text></subparagraph></paragraph><paragraph id="H0BCB565AE7AB4652B6F8317B541F32A7"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="H0CD152E2C2A64E6284D88F5F3C5CD038"><enum>(A)</enum><text>in subparagraph (A), in the matter preceding clause (i), by striking <quote>subparagraph (B) of paragraph (1)</quote> and inserting <quote>paragraph (1)(A)</quote>; and</text></subparagraph><subparagraph id="H643A95659CDE4B4395619F92D7BE121F"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>accordance with section 524(c) of title 28,</quote> and inserting <quote>the General Fund of the Treasury of the United States</quote>;</text></subparagraph></paragraph><paragraph id="H1E34286B1C4D49F5A2596768868C91A5"><enum>(3)</enum><text>by striking paragraph (3);</text></paragraph><paragraph id="H39790ED601254A6C9BDF66D1EAA911BE"><enum>(4)</enum><text>by redesignating paragraph (4) as paragraph (3); and</text></paragraph><paragraph id="H6E9B78C55E8F44138785F56A81C23A77"><enum>(5)</enum><text>in paragraph (3), as redesignated—</text><subparagraph id="H1C562EC33D3D45EC82DB9E35963DFBC6"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>paragraph (1)(B)</quote> and inserting <quote>paragraph (1)(A)</quote>; and</text></subparagraph><subparagraph id="HC8107995457F47D29B7D078CFB175495"><enum>(B)</enum><text>in subparagraph (B), in the matter preceding clause (i), by striking <quote>paragraph (1)(B) that is civilly or</quote> and inserting <quote>paragraph (1)(A) that is</quote>.</text></subparagraph></paragraph></subsection><subsection id="H83F17575E937407D9F67B3FDFC21E2CE"><enum>(b)</enum><header>Revisions to title 18</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/46">Chapter 46</external-xref> of title 18, United States Code, is amended—</text><paragraph id="HA6E32BD1B93A46879D8F8B4C1BAD11DD"><enum>(1)</enum><text>in section 981(e)—</text><subparagraph id="H1AD7EE0E35BF412C9EA387F93F9D9EDC"><enum>(A)</enum><text>by striking <quote>is authorized</quote> and all that follows through <quote>or forfeiture of the property;</quote> and inserting <quote>shall forward to the Treasurer of the United States any proceeds of property forfeited pursuant to this section for deposit in the General Fund of the Treasury or transfer such property on such terms and conditions as such officer may determine—</quote>;</text></subparagraph><subparagraph id="HEC1A449F9D86450D9BCB844F28EC0A87"><enum>(B)</enum><text>by redesignating paragraphs (3), (4), (5), (6), and (7) as paragraphs (1), (2), (3), (4), and (5), respectively; and</text></subparagraph><subparagraph id="H3567C311DD2B40489DFCE09FF11ED5AD"><enum>(C)</enum><text>in the matter following paragraph (5), as so redesignated—</text><clause id="H687316E9E0264BD1837BA06223CA2CFE"><enum>(i)</enum><text>by striking the first, second, third, sixth, and eighth sentences; and</text></clause><clause id="H31B1576631BF44F181D0C3E020CAB670"><enum>(ii)</enum><text>by striking <quote>paragraph (3), (4), or (5)</quote> and inserting <quote>paragraph (1), (2), or (3)</quote>; and</text></clause></subparagraph></paragraph><paragraph id="H8377D27A4235475B9112896EB5C31ADE"><enum>(2)</enum><text>in section 983(g)—</text><subparagraph id="H568C7F2552524048BD90D40D9A5963B4"><enum>(A)</enum><text>in paragraph (3), by striking <quote>grossly</quote>; and</text></subparagraph><subparagraph id="HE6EF85C7864242F1BBF8279F038E5440"><enum>(B)</enum><text>in paragraph (4), by striking <quote>grossly</quote>.</text></subparagraph></paragraph></subsection><subsection id="HF3F69E005D854A748C172D063CEFCE53"><enum>(c)</enum><header>Tariff act of 1930</header><text>The Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1304">19 U.S.C. 1304 et seq.</external-xref>) is amended—</text><paragraph id="HB7B2136CA4E447FAAADB979B3E743B23"><enum>(1)</enum><text>in section 613A(a) (<external-xref legal-doc="usc" parsable-cite="usc/19/1613b">19 U.S.C. 1613b(a)</external-xref>)—</text><subparagraph id="HD63FDE4B6DC044C7A8E3381FAC1EB211"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H741F3A8EA74B4569B5D984A192F545BE"><enum>(i)</enum><text>in subparagraph (D), by inserting <quote>and</quote> after the semicolon;</text></clause><clause id="H9A1E88ABC09F443582407FA9167F8508"><enum>(ii)</enum><text>in subparagraph (E), by striking <quote>; and</quote> and inserting a period; and</text></clause><clause id="H5F147553D7CC40D4B898011D8F0A23E8"><enum>(iii)</enum><text>by striking subparagraph (F); and</text></clause></subparagraph><subparagraph id="H204694219019400A9C1B8F919F339FA0"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="HAEB3ECD8DD574228A51D6729CBC91B19"><enum>(i)</enum><text>by striking <quote>(A) Any payment</quote> and inserting <quote>Any payment</quote>; and</text></paragraph><paragraph id="HC058AE8C05E14A149E21BC62B55FEAFA"><enum>(2)</enum><text>by redesignating subparagraphs (C) and (D) as subparagraphs (A) and (B), respectively.</text></paragraph></section><section id="H40EBEF6F8A1245C2B26BED36D7F601FD"><enum>5.</enum><header>Structuring transactions to evade reporting requirement prohibited</header><subsection id="H03225729FDD9441DA3F4B9169D30F6C8"><enum>(a)</enum><header>Amendments to title 31</header><text>Section 5324 of title 31, United States Code, is amended—</text><paragraph id="HF2A7A4D34209412A80175B5FF36002F3"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HE10CED7CEF454DF182221366839DDD0F"><enum>(A)</enum><text>in the matter preceding paragraph (1), by inserting <quote>knowingly</quote> after <quote>Public Law 91–508</quote>; and</text></subparagraph><subparagraph id="H94ED534A5A0A431D90CA5037AEC23BC1"><enum>(B)</enum><text>in paragraph (3), by inserting <quote>of funds not derived from a legitimate source</quote> after <quote>any transaction</quote>;</text></subparagraph></paragraph><paragraph id="H1B949E2DA707413B9FF182000119CD5B"><enum>(2)</enum><text>in subsection (b), in the matter preceding paragraph (1), by inserting <quote>knowingly</quote> after <quote>such section</quote>; and</text></paragraph><paragraph id="H9FB4DDE374BF47D4B0B7376A2B581ED1"><enum>(3)</enum><text>in subsection (c), in the matter preceding paragraph (1), by inserting <quote>knowingly</quote> after <quote>section 5316</quote>.</text></paragraph></subsection><subsection id="HFD30710A18AB41CA8EB87695D7D10856"><enum>(b)</enum><header>Probable cause hearing in connection with property seizures relating to certain monetary instruments transactions</header><paragraph id="H161B473BBFCF44E1BF7B539FE2F05C64"><enum>(1)</enum><header>Amendment</header><text>Section 5317 of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" id="H55E85FBB6FAD427A88012CCFC968257F"><subsection id="H1BC71734B51440F7B749E752A5B4775C"><enum>(d)</enum><header>Probable cause hearing in connection with property seizures relating to certain monetary instruments transactions</header><paragraph id="H5FCF8F64CA5C40F58A83F77545CFED09"><enum>(1)</enum><header>In general</header><text>Not later than 14 days after the date on which notice is provided under paragraph (2)—</text><subparagraph id="H3A1BA00C25ED453AAEABC570336D0A27"><enum>(A)</enum><text>a court of competent jurisdiction shall conduct a hearing on any property seized or restrained under subsection (c)(2) with respect to an alleged violation of section 5324; and</text></subparagraph><subparagraph id="HBC9B8A3B2B514AA5AF309D9BFB1D1655"><enum>(B)</enum><text>any property described in subparagraph (A) shall be returned unless the court finds that there is probable cause to believe that there is a violation of section 5324 involving the property.</text></subparagraph></paragraph><paragraph id="H2824AFB824964E659ECFAC7D045F1D40"><enum>(2)</enum><header>Notice</header><text>Each person from whom property is seized or restrained under subsection (c)(2) with respect to an alleged violation of section 5324 shall be notified of the right of the person to a hearing under paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H70817A6AFE6A462C846E1C41D26A5BFF"><enum>(2)</enum><header>Applicability</header><text>The amendment made by paragraph (1) shall apply to property seized or restrained after the date of enactment of this Act.</text></paragraph></subsection></section><section id="H475CB73494B940848EE68FB2407A9315"><enum>6.</enum><header>Reporting requirements</header><text display-inline="no-display-inline">Section 524(c)(6)(A)(i) of title 28, United States Code, is amended by inserting <quote>from each type of forfeiture, and specifically identifying which funds were obtained from including criminal forfeitures and which were obtained from civil forfeitures,</quote> after <quote>deposits</quote>.</text></section><section id="H08B29841A9A5491DA6EBC26D9E2148CB"><enum>7.</enum><header>Applicability</header><text display-inline="no-display-inline">The amendments made by this Act shall apply to—</text><paragraph id="H68BDB90220DF4FBB967603824E33FB5E"><enum>(1)</enum><text>any civil forfeiture proceeding pending on or filed on or after the date of enactment of this Act; and</text></paragraph><paragraph id="HE0C2B3633CC647209C3A152EBFD5DC8F"><enum>(2)</enum><text>any amounts received from the forfeiture of property on or after the date of enactment of this Act.</text></paragraph></section></legis-body></bill>
