            <header>Cyber workforce recruitment and retention</header>

                <enum>(a)</enum>
                <header>In general</header>
 <text>Section 1599f of title 10, United States Code, is amended to read as follows:</text> <quoted-block id="idE4169E0603664EB88D44A5E4DCF80430" style="USC" act-name=""> <section id="id62C41D5741A841B893CD9FE8DD7DF3C1"> <enum>1599f.<?LEXA-Enum 1599f.?></enum> <header>Cyber workforce recruitment and retention</header> <subsection commented="no" display-inline="no-display-inline" id="ida95aeb525e4f42738308c5c0aee4dedc"> <enum>(a)</enum> <header display-inline="yes-display-inline">General authority</header> <paragraph commented="no" display-inline="no-display-inline" id="idb950f032de4940d5a57f89536625324c"> <enum>(1)</enum> <header>In general</header> <text display-inline="yes-display-inline">The Secretary of Defense may—</text>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id3790408c98d14a8094869a2b624fdc44">
                                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">establish, as positions in the excepted service, such qualified positions in the Department of Defense as the Secretary considers necessary to carry out the cyber mission of the Department and are not in the Defense Civilian Intelligence Personnel System, including—</text>
                                    <clause commented="no" display-inline="no-display-inline" id="id857b0c351a4044e68c03cd00819e6adf">
                                        <enum>(i)</enum>
 <text display-inline="yes-display-inline">positions in the Defense Digital Executive Service established under subsection (c); and</text>
                                    </clause>
                                    <clause commented="no" display-inline="no-display-inline" id="ida40f670207a2496e9069cda6c894bcd2">
                                        <enum>(ii)</enum>
 <text>Defense Digital Senior Level positions designated under subsection (d);</text>
                                    </clause>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="ida4b48acde55d41a19862104bd55bff15">
                                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">carry out a program of personnel management authority provided in subsection (b) in order to facilitate recruitment of eminent experts in cyber for the Department; and</text>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="idbed315bd4c40462781399add8a5d671d">
                                    <enum>(C)</enum>
 <text display-inline="yes-display-inline">implement an interagency transfer agreement between qualified positions in the excepted service established under this section and positions in the competitive service in the Department, including the military departments.</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="iddfc0285360894051896191c0373f9c25">
                                <enum>(2)</enum>
                                <header>Applicability</header>
 <text display-inline="yes-display-inline">Unless explicitly provided otherwise by law, the authority of the Secretary under this section applies without regard to any other provision of law relating to the appointment, number, classification, or compensation of employees that the Secretary determines is incompatible with the approach to talent management under this section.</text>
                            </paragraph>
                        </subsection>
                        <subsection id="id71A8723FC8B3454984F16940DAE5AFB2">
                            <enum>(b)</enum>
                            <header>Personnel management authority</header>
                            <paragraph commented="no" display-inline="no-display-inline" id="id715c991beb6d420aa236193313010cd5">
                                <enum>(1)</enum>
                                <header display-inline="yes-display-inline">In general</header>
 <text>The Secretary may—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idfccbc839eaf14601a31cf64734d2224f"> <enum>(A)</enum> <text display-inline="yes-display-inline">without regard to any provision of title 5 governing the appointment of employees in the civil service, appoint individuals to qualified positions established under subsection (a)(1); and</text>
                                </subparagraph>
                                <subparagraph id="id6b2eab58377b4f948fe2dd7cdcaecb9e">
                                    <enum>(B)</enum>
 <text>subject to paragraphs (2) and (3), fix the compensation of employees appointed under subparagraph (A).</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="idbf2a294937b04835b4fae9f1facbb4e0">
                                <enum>(2)</enum>
                                <header>Rates of basic pay</header>
 <text>The Secretary—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id3060b9377de846a38f808da4cfff5a5d"> <enum>(A)</enum> <text display-inline="yes-display-inline">shall fix the rates of basic pay for employees appointed under paragraph (1)(A)—</text>
                                    <clause commented="no" display-inline="no-display-inline" id="id75cd9e4fbb16433fbe95d8bf08c39dfb">
                                        <enum>(i)</enum>
 <text display-inline="yes-display-inline">with the rates of pay provided for employees in comparable positions in the Federal Government; and</text>
                                    </clause>
                                    <clause commented="no" display-inline="no-display-inline" id="id524dade0c0d947759ec0dd6271a0e9a2">
                                        <enum>(ii)</enum>
 <text>subject to the same limitations on maximum rates of pay established for such employees by statute or regulation; and</text>
                                    </clause>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id0b26ecfb8824498ba7cbd370fffebbd6">
                                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">may prescribe the rates of basic pay for employees appointed under paragraph (1)(A) at rates not in excess of a rate equal to 150 percent of the maximum rate of basic pay authorized for positions at Level I of the Executive Schedule under section 5312 of title 5.</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="id97053d4b26de48deb9d4c8a2870d2c3d">
                                <enum>(3)</enum>
                                <header>Additional compensation</header>
                                <subparagraph commented="no" display-inline="no-display-inline" id="idddbd115f66ff45afbedaab4783d21ee2">
                                    <enum>(A)</enum>
                                    <header>In general</header>
 <text display-inline="yes-display-inline">Subject to subparagraph (C), the Secretary may, with respect to an employee appointed under paragraph (1)(A), other than such an employee receiving the maximum rate of basic pay prescribed under paragraph (2)(B), provide the employee compensation (in addition to basic pay), including payments, benefits, sabbaticals, incentives, awards, and allowances—</text>
                                    <clause commented="no" display-inline="no-display-inline" id="idce6a7074b0144cf487720e8fdc3b01e1">
                                        <enum>(i)</enum>
 <text display-inline="yes-display-inline">in accordance with relevant provisions of other laws, including provisions of title 5;</text>
                                    </clause>
                                    <clause commented="no" display-inline="no-display-inline" id="id8e2372aae14d453f81cb4c11bbb2a543">
                                        <enum>(ii)</enum>
 <text display-inline="yes-display-inline">consistent with, and not in excess of the level authorized for, comparable positions in the Federal Government; and</text>
                                    </clause>
                                    <clause commented="no" display-inline="no-display-inline" id="id6c81d1d9df534c1c92ef29f2250e2a41">
                                        <enum>(iii)</enum>
 <text display-inline="yes-display-inline">to the extent compatible with the approach to talent management under this section.</text>
                                    </clause>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id4f0f6b3e662144d797ac5a9596416bcc">
                                    <enum>(B)</enum>
                                    <header>Allowances</header>
 <text>An employee appointed under paragraph (1)(A) shall be eligible for an allowance under section 5941 of title 5, in addition to such basic pay, on the same basis and at least to the same extent as if the employee was an employee covered by such section, including eligibility conditions, allowance rates, and all other terms and conditions in statute or regulation.</text>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="idd8275bcf89324e19b578086e51f4a3aa">
                                    <enum>(C)</enum>
                                    <header>Maximum amount of additional compensation</header>
 <text display-inline="yes-display-inline">No additional compensation may be provided to an employee under this paragraph in any calendar year if, or to the extent that, the employee’s total annual compensation in such calendar year will exceed the maximum amount of total annual compensation payable at the salary set in accordance with section 104 of title 3.</text>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection commented="no" display-inline="no-display-inline" id="iddd074e7a5f39459a911a15964c76c129">
                            <enum>(c)</enum>
                            <header>Defense Digital Executive Service</header>
 <text>The Secretary may establish a Defense Digital Executive Service for positions established under subsection (a)(1)(A)(i) that are comparable to Senior Executive Service positions.</text>
                        </subsection>
                        <subsection commented="no" display-inline="no-display-inline" id="id0e8082a427c8416197d6717fd23b76e6">
                            <enum>(d)</enum>
                            <header>Defense Digital Senior Level positions</header>
 <text>The Secretary may designate as a Defense Digital Senior Level position any defense cyber position that, as determined by the Secretary—</text>
                            <paragraph commented="no" display-inline="no-display-inline" id="id32cde48377294aeca735775981275dc0">
                                <enum>(1)</enum>
 <text display-inline="yes-display-inline">is classified above the grade of GG–15 of the excepted service;</text>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="id90f3d198568244639fab71a7912e7445">
                                <enum>(2)</enum>
 <text display-inline="yes-display-inline">does not satisfy functional or program management criteria for being designated as a position in the Defense Digital Executive Service; and</text>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="id534b531eb1b044b59ad8c0848eb9aa39">
                                <enum>(3)</enum>
 <text display-inline="yes-display-inline">has no more than minimal supervisory responsibilities.</text>
                            </paragraph>
                        </subsection>
                        <subsection commented="no" display-inline="no-display-inline"
                            id="idfe4d953b4e3d42faaabb70d1d9ec49b0">
                            <enum>(e)</enum>
                            <header>Two-Year probationary period</header>
 <text display-inline="yes-display-inline">The probationary period for all employees hired under the authority provided by this section shall be two years.</text>
                        </subsection>
                        <subsection commented="no" display-inline="no-display-inline" id="id17e53a98c42d4d0fa403cc02f538306e">
                            <enum>(f)</enum>
                            <header>Incumbents of existing competitive service positions</header>
                            <paragraph commented="no" display-inline="no-display-inline" id="id4f9820990a9d473a8e9b8d1f8c704d41">
                                <enum>(1)</enum>
                                <header>In general</header>
 <text display-inline="yes-display-inline">An individual occupying a position on the date of the enactment of this section that is selected to be converted to a position in the excepted service under this section shall have the right to refuse such conversion.</text>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="id2d98126b21b7458994fdaeff90752bea">
                                <enum>(2)</enum>
                                <header>Position conversion</header>
 <text display-inline="yes-display-inline">After the date on which an individual who refuses a conversion under paragraph (1) stops serving in the position selected to be converted, the position shall be converted to a position in the excepted service.</text>
                            </paragraph>
                        </subsection>
                        <subsection commented="no" display-inline="no-display-inline" id="id8837FFC598294BC094B0F82F84D22989">
                            <enum>(g)</enum>
                            <header>Implementation plan; effective date of authority</header>
                            <paragraph commented="no" display-inline="no-display-inline" id="id548BEAF54E674026BA7F834D6B0903CD">
                                <enum>(1)</enum>
                                <header>In general</header>
 <text display-inline="yes-display-inline">The authority provided by this section shall become effective 30 days after the date on which the Secretary submits to the congressional defense committees a plan for the implementation of such authority.</text>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="idE593054494C744B9BBFA5E2131EB6B9F">
                                <enum>(2)</enum>
                                <header>Elements</header>
 <text display-inline="yes-display-inline">The plan described in paragraph (1) shall include the following:</text>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id4851222A03594888963525DA90BABAAE">
                                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">An assessment of the current scope of the positions covered by the authority provided by subsection (a).</text>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="idF6AEE83AAAB84E019938B1C856E3DB2F">
                                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">A plan for the use of the authority.</text>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id1C64F9B97C884C3DA79074A00C0DBB26">
                                    <enum>(C)</enum>
 <text display-inline="yes-display-inline">An assessment of the anticipated workforce needs for the cyber mission of the Department across the future-years defense program.</text>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id85957A0C4269448EB50BAB4FE6CB8D44">
                                    <enum>(D)</enum>
 <text display-inline="yes-display-inline">Other matters as appropriate.</text>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection commented="no" display-inline="no-display-inline" id="id3e61b4446e9b443d943f718c1f592264">
                            <enum>(h)</enum>
                            <header>Collective bargaining agreements</header>
 <text>Nothing in subsection (a) may be construed to impair the continued effectiveness of a collective bargaining agreement with respect to an office, component, subcomponent, or equivalent of the Department that is a successor to an office, component, subcomponent, or equivalent of the Department covered by the agreement before the succession.</text>
                        </subsection>
                        <subsection id="idd7dcc77fcedb429290172d330498b401">
                            <enum>(i)</enum>
                            <header>Regulations required</header>
 <text>The Secretary, in coordination with the Director of the Office of Personnel Management, shall prescribe regulations for the administration of this section.</text>
                        </subsection>
                        <subsection commented="no" display-inline="no-display-inline" id="id312b877b2ae747e9a62b8d5ebf9a32f7">
                            <enum>(j)</enum>
                            <header>Annual report</header>
                            <paragraph commented="no" display-inline="no-display-inline" id="id06440aee58e34d7ab24a5626292b180c">
                                <enum>(1)</enum>
                                <header display-inline="yes-display-inline">In general</header>
 <text>Not later than one year after the date of the enactment of this section and not less frequently than once each year thereafter until the date that is five years after the date of the enactment of this section, the Director of the Office of Personnel Management, in coordination with the Secretary, shall submit to the appropriate committees of Congress a detailed report on the administration of this section during the most recent one-year period.</text>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="idd9a6fdfa59824c80bd05035d48f2261c">
                                <enum>(2)</enum>
                                <header>Elements</header>
 <text>Each report required by paragraph (1) shall include, for the period covered by the report, the following:</text>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id6b7d516fca40483598de461b4c17bed5">
                                    <enum>(A)</enum>
 <text>A discussion of the process used in accepting applications, assessing candidates, ensuring adherence to veterans' preference, and selecting applicants for vacancies to be filled by an individual for a qualified position.</text>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="idbaa7a5d5e9cc428f8f29a8df014ce543">
                                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">A description of the following:</text>
                                    <clause commented="no" display-inline="no-display-inline" id="id287e98b2f2ba43e2809a9f5f34ec2835">
                                        <enum>(i)</enum>
 <text display-inline="yes-display-inline">How the Secretary plans to fulfill the critical need of the Department to recruit and retain employees in qualified positions.</text>
                                    </clause>
                                    <clause commented="no" display-inline="no-display-inline" id="id7d42aec341dc4abdbd96383768d55759">
                                        <enum>(ii)</enum>
 <text display-inline="yes-display-inline">The measures that will be used to measure progress.</text>
                                    </clause>
                                    <clause commented="no" display-inline="no-display-inline" id="id186ab6e51ce04c679398c8106c67e991">
                                        <enum>(iii)</enum>
 <text display-inline="yes-display-inline">Any actions taken during the reporting period to fulfill such critical need.</text>
                                    </clause>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="ida7ad253c7e16487294c26bf2a1c4a5c4">
                                    <enum>(C)</enum>
 <text>A discussion of how the planning and actions taken under subparagraph (B) are integrated into the strategic workforce planning of the Department.</text>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id42b89b8686fd4a11b909d10dcd961d23">
                                    <enum>(D)</enum>
 <text display-inline="yes-display-inline">The metrics on actions occurring during the reporting period, including the following:</text>
                                    <clause commented="no" display-inline="no-display-inline" id="idb41199f63045409f8e708eadd43b8d24">
                                        <enum>(i)</enum>
 <text display-inline="yes-display-inline">The number of employees in qualified positions hired, disaggregated by occupation and grade and level or pay band.</text>
                                    </clause>
                                    <clause commented="no" display-inline="no-display-inline" id="idf1a98551632e4cbfb03279501b90de45">
                                        <enum>(ii)</enum>
 <text display-inline="yes-display-inline">The placement of employees in qualified positions, disaggregated by military department, Defense Agency, or other component within the Department.</text>
                                    </clause>
                                    <clause commented="no" display-inline="no-display-inline" id="id2899959808a547558b1929fbb73e30a9">
                                        <enum>(iii)</enum>
 <text display-inline="yes-display-inline">The total number of veterans hired.</text>
                                    </clause>
                                    <clause commented="no" display-inline="no-display-inline" id="ida93c0ee817214d6db64be3407024773f">
                                        <enum>(iv)</enum>
 <text display-inline="yes-display-inline">The number of separations of employees in qualified positions, disaggregated by occupation and grade and level or pay band.</text>
                                    </clause>
                                    <clause commented="no" display-inline="no-display-inline" id="id1656aae5ed254891ac4164ce4e232167">
                                        <enum>(v)</enum>
 <text display-inline="yes-display-inline">The number of retirements of employees in qualified positions, disaggregated by occupation and grade and level or pay band.</text>
                                    </clause>
                                    <clause commented="no" display-inline="no-display-inline" id="id44696c4170c641f5a9b88b2b8359b0aa">
                                        <enum>(vi)</enum>
 <text display-inline="yes-display-inline">The number and amounts of recruitment, relocation, and retention incentives paid to employees in qualified positions, disaggregated by occupation and grade and level or pay band.</text>
                                    </clause>
                                    <clause commented="no" display-inline="no-display-inline" id="id9e56a13ae077491987cf6a5f222e2fd4">
                                        <enum>(vii)</enum>
 <text display-inline="yes-display-inline">The number of employees in qualified positions who held an appointment related to cybersecurity at a Federal agency outside of the Department during the three-year period prior to being appointed under this section.</text>
                                    </clause>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection id="id8f444d26a72247f38504264d504616ba">
                            <enum>(k)</enum>
                            <header>Comptroller General assessment</header>
                            <paragraph commented="no" display-inline="no-display-inline" id="id238ded2172834f83ab9601762a6fccf8">
                                <enum>(1)</enum>
                                <header>Availability of annual report</header>
 <text display-inline="yes-display-inline">The Director of the Office of Personnel Management shall make available to the Comptroller General of the United States each report required by subsection (j).</text>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="id0eac77849c91452ab79e9cf7091c0f7c">
                                <enum>(2)</enum>
                                <header>Assessment</header>
 <text display-inline="yes-display-inline">The Comptroller General shall—</text>
                                <subparagraph commented="no" display-inline="no-display-inline" id="ida0478bd0ed464514885b715f49c27d1f">
                                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">assess any differences in recruitment and retention for cyber positions experienced by Federal agencies based on unique hiring and pay authorities for cyber professionals, including with respect to Senior Executive Service positions and Senior Level positions; and</text>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id23cbeaada43741ee8ad076a65011ce29">
                                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">not later than five years after the date of the enactment of this section, submit to the appropriate committees of Congress the results of that assessment.</text>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection id="id238CF9FA3F344694BD285ABB52B4ABA4">
                            <enum>(l)</enum>
                            <header>Definitions</header>
 <text>In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="id26b39bc1add34963bb7edc53c98f5896"> <enum>(1)</enum> <header>Appropriate committees of Congress</header> <text>The term <term>appropriate committees of Congress</term> means—</text>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id44196ad183c749ca8c051bc870cc6b1e">
                                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">the Committee on Armed Services, the Committee on Homeland Security and Governmental Affairs, and the Committee on Appropriations of the Senate; and</text>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id800348d38a774fdd9b36f44e959a3658">
                                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">the Committee on Armed Services, the Committee on Oversight and Government Reform, and the Committee on Appropriations of the House of Representatives.</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="id4B5BEED4511B426CBCDE95696C6D1BBA">
                                <enum>(2)</enum>
                                <header>Competitive service</header>
 <text display-inline="yes-display-inline">The term <term>competitive service</term> has the meaning given that term in section 2102 of title 5.</text>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="id1ABCE7C3B1664CADA4ED2F6F3FBFA592">
                                <enum>(3)</enum>
                                <header>Excepted service</header>
 <text display-inline="yes-display-inline">The term <term>excepted service</term> has the meaning given that term in section 2103 of title 5.</text>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="idB384224BBDB040DE9C5DC816DB861175">
                                <enum>(4)</enum>
                                <header>Qualified position</header>
