which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit certain persons from purchasing agricultural land in the United States, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H5806BC77BF5946C8AA62AAA5A344BEE2"><section section-type="section-one" id="H223ACBE248CC4CAD85847FD2CD6E9DB9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prohibition of Agricultural Land for Foreign Adversaries Act</short-title></quote>.</text></section><section id="id720F10EC4A5440B9A51E3231BC1CB698"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="idb303e40f2bbe444486b8a49c468438c0"><enum>(1)</enum><header>Agricultural land</header><text>The term <quote>agricultural land</quote> has the meaning given the term in section 9 of the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3508">7 U.S.C. 3508</external-xref>).</text></paragraph><paragraph id="id0171F545FBD54A97BE4C3D7A2C66D1F9"><enum>(2)</enum><header>Covered person</header><text>The term <term>covered person</term> means an individual or entity associated with the government of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc14a47e6f8904e2286d374fdec3ed38c"><enum>(A)</enum><text>the Democratic People’s Republic of Korea;</text></subparagraph><subparagraph id="id64bb0e54519f446aabfd21cfdb547fe9"><enum>(B)</enum><text>the Islamic Republic of Iran;</text></subparagraph><subparagraph id="ideedf0c883686467297de1afd4d43f2e9"><enum>(C)</enum><text>the People's Republic of China; or</text></subparagraph><subparagraph id="idc218d3c7462846f0877fc64ea25d7a9b"><enum>(D)</enum><text>the Russian Federation.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6CF41496D7604821A71C4A920B3B30B3"><enum>(3)</enum><header>United States</header><text>The term <term>United States</term> includes any State, territory, or possession of the United States.</text></paragraph></section><section section-type="subsequent-section" id="id889E45734CB74927B70A7FA3636FD10B"><enum>3.</enum><header>Prohibition on purchase of agricultural land in the United States by persons associated with certain foreign governments</header><subsection id="idA9D89DA288D24604A4B676055A7060A8"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, the President shall take such actions as may be necessary to prohibit the purchase by covered persons of public or private agricultural land (including ranching land) located in the United States.</text></subsection><subsection id="idcbbfb2eb38b74fe8b323f85f3d900d67"><enum>(b)</enum><header>Implementation</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to carry out subsection (a).</text></subsection><subsection id="idc54bf8d77b544dc7bc08f150d38b1245"><enum>(c)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of subsection (a) or any regulation, license, or order issued to carry out that subsection shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></subsection></section><section id="idcae87edab1984a24822984689f917b4d"><enum>4.</enum><header>Prohibition on participation in Department of Agriculture programs by persons associated with certain foreign governments</header><subsection id="idBC6081EBA9A4456A9CD41C587C3D47BA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), notwithstanding any other provision of the law, the President shall take such actions as may be necessary to prohibit participation in Department of Agriculture programs by covered persons.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idEB33A1F0063C48D2A66036668D73BB49"><enum>(b)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Subsection (a) shall not apply to participation in any Department of Agriculture program relating to food inspection or any other food safety regulatory requirements.</text></subsection></section></legis-body></bill>
