<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 2569</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250731">July 31, 2025</action-date><action-desc><sponsor name-id="S427">Mr. Schiff</sponsor> (for himself and <cosponsor name-id="S330">Mr. Bennet</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide forbearance assistance during a major disaster or emergency, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H9E24EC84285C445F847BA0F1813C3825"><section section-type="section-one" id="H3831664FCDB24632ABE38DC76FE71BCC"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mortgage Relief for Disaster Survivors Act</short-title></quote>.</text></section><section id="H0C2530538F9648CAAA0D2FA023372E95"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H3518009788674A8DB14FACBDD54E13DF"><enum>(1)</enum><header>Covered mortgage loan</header><text>The <term>covered mortgage loan</term> means—</text><subparagraph id="H2754E5AFEFDA4BA199F4BCCEC60119CA"><enum>(A)</enum><text>a Federally backed mortgage loan; or</text></subparagraph><subparagraph id="HBD845D383DF840B5B92679E751209F94"><enum>(B)</enum><text>a Federally backed multifamily mortgage loan.</text></subparagraph></paragraph><paragraph id="H109D3BEE943C429881CA820C5CAF289F"><enum>(2)</enum><header>Covered period</header><text>The term <term>covered period</term> means the period beginning on the date of the declaration of a disaster and ending on the date on which the declaration ends.</text></paragraph><paragraph id="H3C6FD35AE23A454C80D9893F14E1AE1C"><enum>(3)</enum><header>Disaster</header><text>The term <term>disaster</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id11ab14cf6e894f07a36a6e72d65cdd5b"><enum>(A)</enum><text display-inline="yes-display-inline">any major disaster or emergency declared by the President under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0517b47601b34c659294d99e56ba9247"><enum>(B)</enum><text>any disaster or emergency declared by the Governor of a State or the Chief Executive of an Indian tribal government.</text></subparagraph></paragraph><paragraph id="H7536065B5E5F48D490DAA4A7B073EEE0"><enum>(4)</enum><header>Disaster area</header><text>The term <term>disaster area</term> means, with respect to a disaster, any area that is subject to the declaration of the disaster.</text></paragraph><paragraph id="HFA62916E738B4F8189417B11628089F1"><enum>(5)</enum><header>Federally backed mortgage loan</header><text>The term <term>Federally backed mortgage loan</term> includes any loan that is secured by a first or subordinate lien on residential real property (including individual units of condominiums and cooperatives) designed principally for the occupancy of from 1- to 4- families that is—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddca78196dea547e59c6b6440f1537206"><enum>(A)</enum><text display-inline="yes-display-inline">insured by the Federal Housing Administration under title II of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1707">12 U.S.C. 1707 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id789d736657ac4502883f7a7ad90b9a6a"><enum>(B)</enum><text display-inline="yes-display-inline">insured under section 255 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-20">12 U.S.C. 1715z–20</external-xref>);</text></subparagraph><subparagraph id="id61ac2bed90e14bbfbb3dd8d5e315739f"><enum>(C)</enum><text>guaranteed under section 184 or 184A of the Housing and Community Development Act of 1992 (12 U.S.C. 1715z–13a, 1715z–13b);</text></subparagraph><subparagraph id="idacee6380f7bd489c8f6f2971fb7a9cbd"><enum>(D)</enum><text>guaranteed or insured by the Department of Veterans Affairs;</text></subparagraph><subparagraph id="idc83616739954480b835b0164b79ca8bc"><enum>(E)</enum><text>guaranteed or insured by the Department of Agriculture;</text></subparagraph><subparagraph id="idd095a515fa274bcf89d4e8f76ff88202"><enum>(F)</enum><text>made by the Department of Agriculture; or</text></subparagraph><subparagraph id="ide2fafe0b797743779563465ad5659c98"><enum>(G)</enum><text>purchased or securitized by the Federal Home Loan Mortgage Corporation or the Federal National Mortgage Association.</text></subparagraph></paragraph><paragraph id="HE6E2F518DCAA407E98F7C227BF6A07F4"><enum>(6)</enum><header>Federally backed multifamily mortgage loan</header><text>The term <term>Federally backed multifamily mortgage loan</term> includes any loan (other than temporary financing, such as a construction loan) that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id25a4b44b58444ec8865da4be03f05fed"><enum>(A)</enum><text display-inline="yes-display-inline">is secured by a first or subordinate lien on residential multifamily real property designed principally for the occupancy of 5 or more families, including any such secured loan, the proceeds of which are used to prepay or pay off an existing loan secured by the same property; and</text></subparagraph><subparagraph id="H96E7768658304478B0D5469CFA2268EE" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>is—</text><clause commented="no" display-inline="no-display-inline" id="idf2eafff7616c4cd398d6b020078b1641"><enum>(i)</enum><text display-inline="yes-display-inline">insured under section 255 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1715z-20">12 U.S.C. 1715z–20</external-xref>);</text></clause><clause id="id5d8849320e0042cfa8fcbe6dda254ef3"><enum>(ii)</enum><text>guaranteed under section 184 or 184A of the Housing and Community Development Act of 1992 (12 U.S.C. 1715z–13a, 1715z–13b);</text></clause><clause id="id63a61e78b49042468338f6833d2ca61d"><enum>(iii)</enum><text>guaranteed or insured by the Department of Veterans Affairs;</text></clause><clause id="id60d5de80cb7b494ca1fc988c2a1fc43b"><enum>(iv)</enum><text>guaranteed or insured by the Department of Agriculture;</text></clause><clause id="id6e82b14448954cf792fe55d399ee72b1"><enum>(v)</enum><text>made by the Department of Agriculture; or</text></clause><clause id="id6fc129216a994a838f0b45eb83b97029" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><text>purchased or securitized by the Federal Home Loan Mortgage Corporation or the Federal National Mortgage Association.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id703c3a690bbb469596776fa89fb2a737"><enum>(7)</enum><header>Governor; Indian tribal government; State</header><text>The terms <term>Governor</term>, <term>Indian tribal government</term>, and <term>State</term> have the meanings given those terms in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>).</text></paragraph></section><section id="HD29BF1C3D6CC47EDA5F7BC7F2FD83FEF"><enum>3.</enum><header>Forbearance of loan payments for borrowers of properties with Federally backed loans in disaster areas</header><subsection id="H22D8A1AD58654BA8A04678DDE9FC8860"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to any disaster, a borrower with a covered mortgage loan that is secured by a property located within the disaster area may request a forbearance on the covered mortgage loan during the covered period. </text></subsection><subsection id="HEE200BFAB8AA4768B91A492EE4AE19BF"><enum>(b)</enum><header>Request for forbearance</header><text>A borrower described in subsection (a) may request a forbearance on a covered mortgage loan, regardless of the delinquency status of the covered mortgage loan, by—</text><paragraph id="id2b0cb797f24f423a89265690b1f1044a"><enum>(1)</enum><text>submitting a request to the borrower’s servicer in writing, over the phone, online, or through any other notification method determined to be eligible by the servicer; and</text></paragraph><paragraph id="id7dd360ad126542ca8586807cebe7f7d9"><enum>(2)</enum><text>affirming that the borrower is experiencing a financial hardship.</text></paragraph></subsection><subsection id="H91028CB1079E49A7B228FA2B8878DE2C"><enum>(c)</enum><header>Grant of forbearance</header><paragraph id="H091202F9D178457CAAAA74BB5E7475C7"><enum>(1)</enum><header>In general</header><text>Upon receiving a request for a forbearance from a borrower described in subsection (a), the borrower’s servicer shall promptly and without unreasonable delay grant a forbearance—</text><subparagraph id="H225246BEB09C45289C5A32A4B28605D5"><enum>(A)</enum><text>for a duration of 180 days; and</text></subparagraph><subparagraph id="HB42D5B8554B44AB4B74EC12DC32D1255"><enum>(B)</enum><text>regardless of the delinquency status of the covered mortgage loan.</text></subparagraph></paragraph><paragraph id="H3777E674F5CE4645990C13F2073DD2AC"><enum>(2)</enum><header>Extension of forbearance</header><text>At any time during the forbearance, a borrower may request an extension, of not more than 180 days, of the duration described in paragraph (1)(A).</text></paragraph></subsection><subsection id="H95514F6409C449F5BD3FA71BB1F66DA5"><enum>(d)</enum><header>Right To discontinue</header><text>A borrower described in subsection (a) may request to discontinue a forbearance granted under subsection (c) at any time.</text></subsection><subsection id="H343E4D3F5BF746EB9529E710EF311DDC"><enum>(e)</enum><header>Accrual</header><text display-inline="yes-display-inline">During any forbearance granted under subsection (c), no fees, penalties, or interest (beyond the amounts scheduled or calculated as if the borrower made all contractual payments on time and in full under the terms of the mortgage contract) shall accrue on the borrower’s account.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ide197907524a24a89bba9ed37c1b68f54"><enum>(f)</enum><header>Application</header><text>This section shall apply to with respect to any disaster declared on or after January 1, 2025.</text></subsection></section></legis-body></bill>
