which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Cooperative Forestry Assistance Act of 1978 to authorize States to approve certain organizations to acquire, hold, and manage conservation easements under the Forest Legacy Program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HFF0AF726F552475B848137A3CAE248E3"><section section-type="section-one" id="H8D91938B49E147F6BA19BC7786A47BF1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Forest Legacy Management Flexibility Act</short-title></quote>.</text></section><section id="H89DA9FC14F604C4BBCC60337BEBFBCDD"><enum>2.</enum><header>Authority of States to allow qualified organizations to acquire, hold, and manage conservation easements under the Forest Legacy Program</header><subsection id="H8DC1E59709E94B93AA739C4A93B70A31"><enum>(a)</enum><header>State authorization</header><text display-inline="yes-display-inline">Section 7 of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2103c">16 U.S.C. 2103c</external-xref>) is amended—</text><paragraph display-inline="no-display-inline" id="H7353DC1A4866463A8E8937D14E7CC85F"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (l)—</text><subparagraph id="HE3CF084EF5DF40708FD8A0820BF91B5D"><enum>(A)</enum><text>in paragraph (2)(A), by striking <quote>subsection (m)</quote> and inserting <quote>subsection (n)</quote>; and </text></subparagraph><subparagraph id="H5A48C218251649FDA953DA8C0E696354"><enum>(B)</enum><text>in paragraph (3)—</text><clause display-inline="no-display-inline" id="H02994EECB0BA4114AE24D9350B382AB7"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>the State of Vermont</quote> and inserting <quote>any State</quote>; and</text></clause><clause id="H212B686EFDCF4458BD7AC6BFDB1898C7"><enum>(ii)</enum><text>in subparagraph (B)(ii), in the matter preceding subclause (I), by striking <quote>State of Vermont</quote> and inserting <quote>applicable State</quote>;</text></clause></subparagraph></paragraph><paragraph id="H4A16C470D2C44E6D9C5E92BBBBD20D78"><enum>(2)</enum><text>by redesignating subsection (m) as subsection (n); and </text></paragraph><paragraph id="H025F2C45367D4D60BF04C20C332B0378"><enum>(3)</enum><text>by inserting after subsection (l) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8960F308B5ED4F0D87D8BDFD46C72876"><subsection id="H0691DC9C89294A07B90E25531339247C"><enum>(m)</enum><header>Third-Party conservation easements</header><paragraph id="HFF3BDCA2AED9442D8C67585F38BC0DC0"><enum>(1)</enum><header>Definition of qualified organization</header><text display-inline="yes-display-inline">In this subsection, the term <term>qualified organization</term> means an organization that—</text><subparagraph commented="no" id="HF15799E9802B487E941859477384B10C"><enum>(A)</enum><text display-inline="yes-display-inline">is a qualified organization (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/170">section 170(h)(3)</external-xref> of the Internal Revenue Code of 1986);</text></subparagraph><subparagraph display-inline="no-display-inline" id="H174271455BD84D5BB813E80DB23F99E0"><enum>(B)</enum><text display-inline="yes-display-inline">is organized for, and at all times since the formation of the organization has been operated principally for, one or more conservation purposes (as defined in section 170(h)(4)(A) of that Code);</text></subparagraph><subparagraph id="HEDD89FC3D58143D1962EC1BF9F6FFA26"><enum>(C)</enum><text display-inline="yes-display-inline">has not been the subject of any criminal or civil enforcement action taken by the Attorney General or the Commissioner of the Internal Revenue Service pertaining to the charitable donation of conservation easements under that Code; and</text></subparagraph><subparagraph id="HB8E85805D46B4F89801196C87E35ABFC"><enum>(D)</enum><text display-inline="yes-display-inline">has been awarded, and at all times thereafter has maintained, accredited status by the Land Trust Accreditation Commission, or if that Commission ceases to exist, a successor organization that offers substantially similar accreditation and is approved by the Secretary for purposes of this section.</text></subparagraph></paragraph><paragraph id="HBBEA84BCC0344460A2BFE3E4D07F2560"><enum>(2)</enum><header>Authorization</header><text display-inline="yes-display-inline">At the request of a State, the Secretary shall authorize the State to approve eligible qualified organizations to acquire, hold, and manage conservation easements to carry out activities under the Forest Legacy Program.</text></paragraph><paragraph id="H40F836F502AF4D23B8ECD45C9DF98E7D"><enum>(3)</enum><header>Eligibility</header><text>To be eligible to acquire, hold, and manage a conservation easement under this subsection, a qualified organization shall demonstrate to the Secretary the abilities necessary to acquire, monitor, and enforce interests in forestland—</text><subparagraph id="H94333DF809A148D7996A6E97646E6276"><enum>(A)</enum><text>consistent with the Forest Legacy Program; and</text></subparagraph><subparagraph id="H49E1FFBD96B14FCFA671396388BD1940"><enum>(B)</enum><text>in accordance with the applicable assessment of need submitted to the Secretary by the State in which the conservation easement is located.</text></subparagraph></paragraph><paragraph id="H99271CFC7BC04F8C845EBE43CE7EF524"><enum>(4)</enum><header>Reversion</header><text display-inline="yes-display-inline">If the Secretary or a State determines a condition described in paragraph (5) is met with respect to a conservation easement—</text><subparagraph id="HB756FDDACF134ACB924903374C79F28A"><enum>(A)</enum><text>all right, title, and interest of the qualified organization in and to the conservation easement shall terminate; and</text></subparagraph><subparagraph id="H3798793644224BBD9E151A4862DFE166"><enum>(B)</enum><text display-inline="yes-display-inline">all right, title, and interest in and to the conservation easement shall revert to the State or, if approved by the State, another qualified organization determined eligible by the Secretary under paragraph (3).</text></subparagraph></paragraph><paragraph id="HB761FFC768954D729064BFF41B1C2394"><enum>(5)</enum><header>Conditions for reversion</header><text display-inline="yes-display-inline">A condition referred to in paragraph (4) is, with respect to a conservation easement acquired, held, and managed by a qualified organization under this subsection, any of the following:</text><subparagraph id="HE97063F2487049C987E330788D3E2F12"><enum>(A)</enum><text>The qualified organization is unable to carry out the responsibilities of the qualified organization under the Forest Legacy Program with respect to the conservation easement.</text></subparagraph><subparagraph id="H4FBB6D78AB8945C89D1314B282E1C7D7"><enum>(B)</enum><text display-inline="yes-display-inline">The conservation easement has been modified in a way that is inconsistent with the purposes of the Forest Legacy Program or the applicable assessment of need described in paragraph (3)(B).</text></subparagraph><subparagraph id="HC4C3674C07954E35A9A985A556C3BA64"><enum>(C)</enum><text display-inline="yes-display-inline">The conservation easement has been conveyed to another person (other than a qualified organization determined eligible by the Secretary under paragraph (3) and approved by the State).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H625B9170149C468AB4C074360AF59E6B"><enum>(b)</enum><header>Technical corrections</header><text display-inline="yes-display-inline">Section 7 of the Cooperative Forestry Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2103c">16 U.S.C. 2103c</external-xref>) is amended—</text><paragraph id="HB557D1D4C896459E9035A21005E828D2"><enum>(1)</enum><text>in subsection (i), in the first sentence, by striking <quote>subsection (b)</quote> and inserting <quote>subsection (c)</quote>;</text></paragraph><paragraph id="HF171D136A0DC4BF0B1C879A04F605A1A"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (l)(3)(B)(i)(II), by adding <quote>and</quote> after the semicolon at the end; and</text></paragraph><paragraph id="H2574D98B796549AAB46C27369B6FD7E6"><enum>(3)</enum><text>in subsection (n) (as redesignated by subsection (a)(2)), in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Appropriation</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Authorization of appropriations</header-in-text></quote>.</text></paragraph></subsection></section></legis-body></bill>
