            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>FBI Whistleblower Protection Enhancement Act of 2025</short-title></quote>.</text>
        </section>

            <enum>2.</enum>
            <header>Enhanced protections for FBI whistleblowers</header>
            <subsection id="id39865b3f2753467c8ec32bf39a88e8b8">
                <enum>(a)</enum>
                <header>Prohibited personnel actions</header>
 <text>Section 2303 of title 5, United States Code, is amended—</text> <paragraph id="id30782777fedd43449ba78211371147b7"> <enum>(1)</enum> <text>in subsection (a), by striking the flush text following paragraph (2)(B);</text>
                </paragraph>
                <paragraph id="id796872aaa7cb41f9838e7e6a6f24b9ca">
                    <enum>(2)</enum>
 <text>by redesignating subsections (b), (c), and (d) as subsections (c), (d), and (e), respectively;</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="idbc41d7b1a7c64e72abfe57f63e30e6ec">
                    <enum>(3)</enum>
 <text>by inserting after subsection (a)(2)(B) the following:</text> <quoted-block id="id2A008B328501498FBD0386AFF9483B9C" style="OLC" act-name=""> <subsection id="idD4E39098DB9D4717BE01B4F9CB3F3A2C"> <enum>(b)</enum> <text>Any employee of the Federal Bureau of Investigation who has authority to take, direct others to take, recommend, or approve any personnel action, shall not, with respect to such authority—</text>
                            <paragraph commented="no" display-inline="no-display-inline" id="id4c8efae5d5d8450684dddc85bcf71eed">
                                <enum>(1)</enum>
 <text display-inline="yes-display-inline">take or fail to take a personnel action with respect to an employee in, or applicant for, a position in the Bureau because of—</text>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id35c9eeb3fc854acb8ce6d9435697d326">
                                    <enum>(A)</enum>
 <text display-inline="yes-display-inline">the exercise of any appeal, complaint, or grievance right granted by any law, rule, or regulation—</text>
                                    <clause commented="no" display-inline="no-display-inline" id="ida645b5b520ad4faaa9f5165407b81a62">
                                        <enum>(i)</enum>
 <text display-inline="yes-display-inline">with regard to remedying a violation of subsection (a); or</text>
                                    </clause>
                                    <clause commented="no" display-inline="no-display-inline" id="iddeac2c650b364777a8b25970bc155ee3">
                                        <enum>(ii)</enum>
 <text display-inline="yes-display-inline">other than with regard to remedying a violation of subsection (a);</text>
                                    </clause>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id02dc0d77151c4aad9520a5acfa3c48b3">
                                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">testifying for or otherwise lawfully assisting any individual in the exercise of any right referred to in clause (i) or (ii) of subparagraph (A); or</text>
                                </subparagraph>
                                <subparagraph commented="no" display-inline="no-display-inline" id="id266a01086b6e4d908805206952aace9e">
                                    <enum>(C)</enum>
 <text display-inline="yes-display-inline">cooperating with or disclosing information to the Inspector General (or any other component responsible for internal investigation or review) of an agency, or the Special Counsel, in accordance with applicable provisions of law;</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="idab7c471579b645adaa6292425fb1a037">
                                <enum>(2)</enum>
 <text display-inline="yes-display-inline">implement or enforce any nondisclosure policy, form, or agreement that is described in subparagraph (A) or (B) of section 2302(b)(13); or</text>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="idf4dc0fa087fa44c9b3ff0f884a151f56">
                                <enum>(3)</enum>
 <text display-inline="yes-display-inline">coerce the political activity of any person (including the providing of any political contribution or service), or take any action against any employee or applicant for employment as a reprisal for the refusal of any person to engage in such political activity.</text>
                            </paragraph>
                        </subsection>
                        <after-quoted-block>;</after-quoted-block>
                    </quoted-block>
                </paragraph>
                <paragraph id="id9b7e61a1061449e6aa5bf6c91dbb7600">
                    <enum>(4)</enum>
 <text>in subsection (c), as so redesignated—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ida9030d34999b48d28c6c3d46e3560af8"> <enum>(A)</enum> <text display-inline="yes-display-inline">by inserting <quote>(1)</quote> after <quote>(c)</quote>; and</text>
                    </subparagraph>
                    <subparagraph commented="no" display-inline="no-display-inline" id="idfe0642e36ee9462cac09384b3f397a58">
                        <enum>(B)</enum>
 <text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id96757bbedf064dbbb21ddcc2342a85e4"> <paragraph indent="up1" commented="no" display-inline="no-display-inline" id="id66d5577eff7f43208b8f1a886beed4e2"> <enum>(2)</enum> <text display-inline="yes-display-inline">With respect to the Federal Bureau of Investigation, the Attorney General shall be responsible for—</text>
                                <subparagraph id="ida12b4cabe2de4a39806ba3a98c13f362">
                                    <enum>(A)</enum>
 <text>preventing prohibited personnel practices;</text> </subparagraph> <subparagraph id="ida860a190e4b6442492a14e2ebe1c0c82"> <enum>(B)</enum> <text>complying with and enforcing applicable civil service laws, rules, and regulations and other aspects of personnel management;</text>
                                </subparagraph>
                                <subparagraph id="id038748fe26e744669488b0cfbf013eae">
                                    <enum>(C)</enum>
 <text>ensuring, in consultation with the Special Counsel and the Inspector General of the Department of Justice, that employees of the Bureau are informed of the rights and remedies available to the employees under this chapter, chapter 12 of this title, and section 3001 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3341">50 U.S.C. 3341</external-xref>), including—</text>
                                    <clause id="idfb615c200e47438dbaba1338b9256774">
                                        <enum>(i)</enum>
 <text>information with respect to whistleblower protections available to new employees during a probationary period;</text>
                                    </clause>
                                    <clause id="id0f08fd8108e34f37b8c220dd9cc8d075">
                                        <enum>(ii)</enum>
 <text>the role of the Office of Special Counsel and the Merit Systems Protection Board with respect to whistleblower protections; and</text>
                                    </clause>
                                    <clause id="idda639985bff7401e9868d6172752232c" commented="no">
                                        <enum>(iii)</enum>
 <text> the means by which, with respect to information that is otherwise required by law or Executive order to be kept classified in the interest of national defense or the conduct of foreign affairs, an employee may make a lawful disclosure of the information to—</text>
                                        <subclause commented="no" display-inline="no-display-inline" id="id916c7f0a9c0e486dadb7fe242118bd75">
                                            <enum>(I)</enum>
 <text display-inline="yes-display-inline">the Special Counsel;</text>
                                        </subclause>
                                        <subclause id="id8b9dfa0243374f839dc2b1ef49550d67" commented="no">
                                            <enum>(II)</enum>
 <text>the Inspector General of the Department of Justice;</text>
                                        </subclause>
                                        <subclause commented="no" display-inline="no-display-inline" id="id2a12135ec0ba4c678f5395f16362e751">
                                            <enum>(III)</enum>
 <text display-inline="yes-display-inline">Congress (including any committee of Congress with respect to information that is not classified or, if classified, has been classified by the head of an agency that is not an element of the intelligence community and does not reveal intelligence sources and methods); or</text>
                                        </subclause>
                                        <subclause commented="no" display-inline="no-display-inline" id="idc29e505c988a4ed89260830d209a8a69">
                                            <enum>(IV)</enum>
 <text>another employee of the Bureau who is designated to receive such a disclosure; and</text>
                                        </subclause>
                                    </clause>
                                </subparagraph>
                                <subparagraph id="id1dac7b8af6b34a37adccf2864175dabd">
                                    <enum>(D)</enum>
 <text>ensuring that the information described in this paragraph is provided to each new employee of the Bureau not later than 180 days after the date on which the new employee is appointed; and</text>
                                </subparagraph>
                                <subparagraph id="idf18133286133497daccd16124eb9793c">
                                    <enum>(E)</enum>
 <text>making available information regarding whistleblower protections applicable to employees of the Bureau on the public website of the Bureau and on any online portal that is made available only to employees of the Bureau, if such portal exits.</text>
                                </subparagraph>
                            </paragraph>
                            <paragraph indent="up1" commented="no" display-inline="no-display-inline" id="id9f9a4e8b1b28415b9d40abb63354bf15">
                                <enum>(3)</enum>
 <text>Any employee of the Department of Justice to whom the Attorney General delegates authority for any aspect of personnel management shall, within the limits of the scope of the delegation, be responsible for the activities described in paragraph (2).</text>
                            </paragraph>
                            <after-quoted-block>; and</after-quoted-block>
                        </quoted-block>
                    </subparagraph>
                </paragraph>
                <paragraph id="idb77e029e0d5c4310b5b300814b0f39d2">
                    <enum>(5)</enum>
 <text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id9e4b9152141c48e8a25efd315cdbe73f"> <subsection id="idc3dbf4355fd54b3b887f287a62f9304d"> <enum>(f)</enum> <text>A disclosure shall not be excluded from this section because—</text>
                            <paragraph id="id9d2440fd26c2491292e2de4ee4b7d289">
                                <enum>(1)</enum>
 <text>the disclosure was made to a person, including a supervisor, who participated in an activity that the employee or applicant reasonably believed to be covered by this section;</text>
                            </paragraph>
                            <paragraph id="iddad67bd79419498399cc4318d64717af">
                                <enum>(2)</enum>
 <text>the disclosure revealed information that had been previously disclosed;</text>
                            </paragraph>
                            <paragraph id="id201bdfbef0404a34854b578b39a64c8d">
                                <enum>(3)</enum>
 <text>the disclosure was not made in writing;</text> </paragraph> <paragraph id="id4f5c131a9f8c411ba9ffe79b352a65f8"> <enum>(4)</enum> <text>the disclosure was made while the employee was off duty;</text>
                            </paragraph>
                            <paragraph id="id8daaed65f1234a4c83357656013726de">
                                <enum>(5)</enum>
 <text>of the amount of time which has passed since the occurrence of the events described in the disclosure; or</text>
                            </paragraph>
                            <paragraph id="id5457468c5b234456b709fe4f7802c092">
                                <enum>(6)</enum>
 <text>the disclosure was made during the normal course of duties of an employee.</text>
                            </paragraph>
                        </subsection>
                        <subsection commented="no" display-inline="no-display-inline" id="id0d75f7743b2947faab35e800eb8f44a1">
                            <enum>(g)</enum>
 <text>In this section, the term <term>personnel action</term> means any action described in clauses (i) through (xi) of section 2302(a)(2)(A) of this title with respect to an employee in, or applicant for, a position in the Federal Bureau of Investigation (other than a position of a confidential, policy-determining, policymaking, or policy-advocating character).</text>
                        </subsection>

                    </quoted-block>
                </paragraph>
            </subsection>
            <subsection id="id15955e97b0fb4ffe955877b3764ae189">
                <enum>(b)</enum>
                <header>Clarification of FBI whistleblower retaliation appeals process</header>
 <text display-inline="yes-display-inline">Section 2303 of title 5, United States Code, as amended by subsection (a) of this section, is amended—</text>
                <paragraph id="id2bfe349aae044aa691c9c4d82ab11cb4">
                    <enum>(1)</enum>
 <text>in subsection (d), as so redesignated, by inserting <quote>the requirements under subsection (e) of this section and</quote> before <quote>applicable</quote>; and</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id063a7b20d7e14ad08e4a87b11493a61d">
                    <enum>(2)</enum>
 <text>in subsection (e), as so redesignated—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id226d265647ba442fa3c9a556f2a2e554"> <enum>(A)</enum> <text display-inline="yes-display-inline">in paragraph (1), by striking <quote>a final determination or corrective action order by the Bureau</quote> and inserting <quote>any adjudicative dismissal, determination, or associated corrective action order made</quote>;</text>
                    </subparagraph>
                    <subparagraph id="id39ffa3a151bd481ebe4783186f061e1c">
                        <enum>(B)</enum>
 <text>in paragraph (2)—</text> <clause commented="no" display-inline="no-display-inline" id="idc373efbc02584f8197bd98be4f130b43"> <enum>(i)</enum> <text display-inline="yes-display-inline">by striking <quote>If no final determination or corrective action order has been made or issued for an allegation described in</quote> and inserting <quote>If no appealable decision has been made under</quote>; and</text>
                        </clause>
                        <clause commented="no" display-inline="no-display-inline" id="id1dbe64219f874422a8e7f2677e19eff1">
                            <enum>(ii)</enum>
 <text display-inline="yes-display-inline">by striking <quote>Federal Bureau of Investigation</quote> and inserting <quote>investigating office</quote>; and</text>
                        </clause>
                    </subparagraph>
                    <subparagraph id="idb0950654ddba4eeeb34503c0c357f7d3">
                        <enum>(C)</enum>
 <text>by adding at the end the following:</text> <quoted-block id="id30E4BACDCFB24F3FBA6BD8DA8BE386C8" style="OLC" act-name=""> <paragraph id="id315855978A47449C907EE3156EB11E31" indent="up1"> <enum>(3)</enum> <text>An appeal brought under paragraph (1), or corrective action sought under paragraph (2), shall be governed by the applicable legal burdens of proof described in section 1221(e).</text>
                            </paragraph>

                    </subparagraph>
                </paragraph>
            </subsection>
        </section>
        <section id="id21bbea019d944c6197ae5b353f018c74">
            <enum>3.</enum>
            <header>Preventing conflicts of interest in investigative or adjudicative
                processes</header>
 <text display-inline="no-display-inline">Section 3001 of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/50/3341">50 U.S.C. 3341</external-xref>) is amended—</text>
            <paragraph id="idd7b612a7b2774a5fa484735625f4481a">
                <enum>(1)</enum>
 <text>in subsection (b)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id2cda93943d9444eca6104407fac5503a"> <enum>(A)</enum> <text>in paragraph 6, by striking <quote>; and</quote> and inserting a semicolon;</text>
                </subparagraph>
                <subparagraph commented="no" display-inline="no-display-inline" id="id1f3c63348e174e899e20b5fb2d9dceb2">
                    <enum>(B)</enum>
 <text display-inline="yes-display-inline">in paragraph (7)(B), by striking <quote>, except that</quote> and all that follows through the period and inserting <quote>; and</quote>; and</text>
                </subparagraph>
                <subparagraph id="id3a63b7b7d0744b1393f69263bdd7c7db">
                    <enum>(C)</enum>
 <text>by inserting after paragraph (7) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id0790ffdf91e64c3698dbf035bed45c38"> <paragraph id="id58a06ef7d8044bfb819b157934d16a4b"> <enum>(8)</enum> <text>not later than 180 days after the date of the enactment of the <short-title>FBI Whistleblower Protection Enhancement Act of 2025</short-title>, and consistent with subsection (j), developing and implementing uniform and consistent policies and procedures that ensure, to the extent practicable, that the investigative or adjudicative process of an authorized investigative agency or authorized adjudicative agency of an employee that believes he or she has been subjected to reprisal under subsection (j) is free from conflict of interest.</text>
                        </paragraph>

            </paragraph>

                <enum>(2)</enum>
 <text>in subsection (j)(4)(A), by striking <quote>subsection (b)(7), except that</quote> and all that follows through the period at the end and inserting <quote>paragraphs (7) and (8) of subsection (b).</quote>.</text>
