which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require government-sponsored enterprises to consider digital assets in a mortgage loan risk assessment.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>21st Century Mortgage Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idd3440ff5038f4dbd92ae695bfb8c65f4" section-type="subsequent-section"><enum>2.</enum><header>Consideration of Digital Assets</header><subsection id="idd7e30e972b114223b10716b815c7778c"><enum>(a)</enum><header>Federal National Mortgage Association</header><text>Section 302(b) of the Federal National Mortgage Association Charter Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1717">12 U.S.C. 1717(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3d4f36d000c94f42917fe3fee43f225c"><paragraph commented="no" display-inline="no-display-inline" id="idb31ae330e43e4cdc948e9dd261bba9cf" indent="up1"><enum>(8)</enum><header>Digital Assets in Mortgage Risk Assessments</header><subparagraph commented="no" display-inline="no-display-inline" id="idfd54fe8fef3d4e2983d1fd19e3f5c93e"><enum>(A)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this paragraph:</text><clause commented="no" display-inline="no-display-inline" id="idb777d99cca434dc7b5340653e0ff9896"><enum>(i)</enum><header>Digital asset</header><text display-inline="yes-display-inline">The term <quote>digital asset</quote>—</text><subclause commented="no" display-inline="no-display-inline" id="ide333f7e1d58a4c1fb7f1a7808c20c72d"><enum>(I)</enum><text display-inline="yes-display-inline">means any digital representation of value that is recorded on a cryptographically-secured distributed ledger; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8b39737058cd43a7a7c3f225fc89aebc"><enum>(II)</enum><text display-inline="yes-display-inline">does not include any asset that—</text><item commented="no" display-inline="no-display-inline" id="id19807d6e9563428f9f8b94dea515bfe1"><enum>(aa)</enum><text display-inline="yes-display-inline">is not commercially fungible, including a digital collectible or other unique asset described in subclause (I); or</text></item><item commented="no" display-inline="no-display-inline" id="id26c67123f8fe4898bc211c56d056c91c"><enum>(bb)</enum><text>represents ownership of, or control over, an asset that is not itself an asset described in subclause (I).</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id74a642472e254cff90b941d67db32ba2"><enum>(ii)</enum><header>Qualified Custodial Arrangement</header><text>The term <quote>qualified custodial arrangement</quote> means—</text><subclause commented="no" display-inline="no-display-inline" id="id89fea690ff0d4b3da0b7c88e9d6e5c57"><enum>(I)</enum><text display-inline="yes-display-inline">custody of a digital asset by a third-party custodian who is chartered, licensed, or otherwise regulated under Federal or State law and is subject to the jurisdiction of the courts of the United States; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida3d53315b0d845d7883dca49682a69b8"><enum>(II)</enum><text display-inline="yes-display-inline">a multi-party custodial arrangement in which a controlling quorum of any private key, account, or other control component sufficient to authorize a transfer of the digital asset is held by custodians described in subclause (I), and the arrangement is subject to an enforceable governing agreement under the laws of the United States.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3ab0778e81e545e1a2a4f890bcf16cb6"><enum>(B)</enum><header>Digital Assets as Reserves</header><text>The corporation shall, in assessing the risk of a single-family mortgage loan, permit the holdings of a borrower in a digital asset, evidenced and maintained pursuant to a qualified custodial arrangement, to be included in the reserves of a borrower without conversion of the digital asset to United States dollars.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb41e82bc82974cc08c1d9a5a4b613afb"><enum>(C)</enum><header>Risk Mitigation</header><text>In carrying out subparagraph (B), the corporation shall—</text><clause commented="no" display-inline="no-display-inline" id="idfca174af2a8a4fcda146ca611aaa989d"><enum>(i)</enum><text display-inline="yes-display-inline">apply any appropriate adjustment for market volatility and liquidity of the digital asset;</text></clause><clause commented="no" display-inline="no-display-inline" id="id3b1af31a681a44789de70201799c3b79"><enum>(ii)</enum><text>apply any appropriate adjustment for concentration of digital assets as a portion of reserves; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idd9184cbc27ec4a6ab5319e97c0d306ad"><enum>(iii)</enum><text>periodically review and update any risk-based adjustment applied under clauses (i) and (ii).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8be178f9ee0a43588b2c65b969a25d63"><enum>(D)</enum><header>Notice and Approval</header><text>Prior to implementing or materially revising any methodology used to assess a digital asset under this paragraph, the corporation shall submit the proposed methodology to the board of directors of the corporation for approval and, upon approval, to the Director of the Federal Housing Finance Agency for review.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id0b456afa3d0c42cf925c0124ddeef5c2"><enum>(b)</enum><header>Federal Home Loan Mortgage Corporation</header><text>Section 305 of the Federal Home Loan Mortgage Corporation Charter Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1454">12 U.S.C. 1454</external-xref>) is amended by inserting at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id84b5f5018f1840b3bfe99224e0b2d2df"><subsection id="ide3867923bd1c4e45815a128a44369264"><enum>(e)</enum><header>Digital Assets in Mortgage Risk Assessments</header><paragraph commented="no" display-inline="no-display-inline" id="idb4ec8d3e3767479e9bb66de28f6482bd"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="id22edaa6432a141d9a24251c23d569cf1"><enum>(A)</enum><header>Digital Asset</header><text display-inline="yes-display-inline">The term <quote>digital asset</quote>—</text><clause commented="no" display-inline="no-display-inline" id="ide7b82e5de03a4653971107addfd7ca2b"><enum>(i)</enum><text display-inline="yes-display-inline">means any digital representation of value recorded on a cryptographically-secured distributed ledger; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id02dd3d1a5c094487841754c7f43b22e6"><enum>(ii)</enum><text>does not include any asset that—</text><subclause commented="no" display-inline="no-display-inline" id="id2b862daebbdb48adb2e2fd923f0ea96a"><enum>(I)</enum><text display-inline="yes-display-inline">is not commercially fungible, including a digital collectible or other unique asset described in clause (i); or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide59269034c51433da47b5544c42b3ba7"><enum>(II)</enum><text>represents ownership of, or control over, as asset that is not itself an asset described in clause (i).</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6f028c4842ec4ebeafed87bd993253b9"><enum>(B)</enum><header>Qualified Custodial Arrangement</header><text>The term <quote>qualified custodial arrangement</quote> means—</text><clause commented="no" display-inline="no-display-inline" id="idaa4cd5e9d9634138b5799ef183574d13"><enum>(i)</enum><text display-inline="yes-display-inline">custody of a digital asset by a third-party custodian who is chartered, licensed, or otherwise regulated under Federal or State law and is subject to the jurisdiction of the courts of the United States; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id1a72d6d9abe6456dbc1ed4e0ab60d82e"><enum>(ii)</enum><text display-inline="yes-display-inline">a multi-party custodial arrangement in which a controlling quorum of any private key, account, or other control component sufficient to authorize a transfer of the digital asset is held by custodians described in clause (i), and the arrangement is subject to an enforceable governing agreement under the laws of the United States.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7e50403b542a4e7ba7c50a62478f9553"><enum>(2)</enum><header>Digital Assets as Reserves</header><text>The Corporation shall, in assessing the risk of a single-family mortgage loan, permit the holdings of a borrower in a digital asset, evidenced and maintained pursuant to a qualified custodial arrangement, to be included in the reserves of a borrower without conversion of the digital asset to United States dollars.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf7cf0e5474024dcc8054502e89b96461"><enum>(3)</enum><header>Risk Mitigation</header><text display-inline="yes-display-inline">In carrying out paragraph (2), the Corporation shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id09fed5a8ef5f4c90a86f36f8d7c0c094"><enum>(A)</enum><text display-inline="yes-display-inline">apply any appropriate adjustment for market volatility and liquidity of the digital asset;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7175eac7e6da4ae98db1e3996492d7fa"><enum>(B)</enum><text display-inline="yes-display-inline">apply any appropriate adjustment for concentration of digital assets as a portion of reserves; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd9a6728717ad41e4ad86cde38ad87de8"><enum>(C)</enum><text display-inline="yes-display-inline">periodically review and update any risk-based adjustment applied under subparagraphs (A) and (B).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1add51191208478d873b9767c44030c6"><enum>(4)</enum><header>Notice and Approval</header><text display-inline="yes-display-inline">Prior to implementing or materially revising any methodology used to assess digital assets under this subsection, the Corporation shall submit the proposed methodology to the Board of Directors for approval and, upon approval, to the Director of the Federal Housing Finance Agency for review.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
