which was read twice and referred to the <committee-name committee-id="SSAF00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20251027">October 27, 2025</action-date><action-desc>Reported by <sponsor name-id="S343">Mr. Boozman</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Agriculture to convey certain National Forest System land located in Franklin County, Mississippi, and for other purposes.</official-title></form><legis-body><section id="PH71A7C6ECCFC0434E90DC4FBEA6D183C5" commented="no" display-inline="no-display-inline" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSAF00"><enum>1.</enum><header display-inline="yes-display-inline">Okhissa Lake rural economic development land conveyance</header><subsection id="PHAA8425A0D14349FA9C422F8F100F2AB8" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id120ce31a6a3a4b89b900365bc4e8e79c"><enum>(1)</enum><header>Alliance</header><text display-inline="yes-display-inline">The term <term>Alliance</term> means the Scenic Rivers Development Alliance.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3a908ac85c54474ca9116aba4cae36ff"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><subsection id="PHEC49C006B1D444DFA1292B1868BF3E1F" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Request</header><text>Subject to the requirements of this section, if the Alliance submits a written request for conveyance by not later than 180 days after the date of enactment of this Act and the Secretary determines that it is in the public interest to convey the National Forest System land described in subsection (c), the Secretary shall convey to the Alliance all right, title, and interest of the United States in and to the National Forest System land described in subsection (c) by quitclaim deed through a public or private sale, including a competitive sale by auction or bid.</text></subsection><subsection id="PH09D56523A8FC42F38464FE19833B90FB" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Description of National Forest System land</header><paragraph id="PHACDAD9826A8B4A88B5B53E62CEAC9CBD"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the National Forest System land referred to in subsection (b) is—</text><subparagraph commented="no" display-inline="no-display-inline" id="id551f548ffaff4a5d80d2a20d77ec243a"><enum>(A)</enum><text display-inline="yes-display-inline">the approximately 137.7 acres of real property located in secs. 5 and 6, T. 5 N., R. 4 E., and sec. 31, T. 6 N., R. 4 E., Franklin County, Mississippi, as depicted on the map prepared for the Alliance by Marling Surveying, LLC, entitled <quote>Map of Survey of a 137.70 Acre Tract, a Portion of U.S. Department of Agriculture Forest Service Homochitto National Forest Tracts H–41g &amp; H–307</quote>, and dated September 16, 2024; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id485899974b4b4996a21baee8aa2e317a"><enum>(B)</enum><text display-inline="yes-display-inline">the approximately 173 acres of real property located in secs. 5, 6, 7, and 8, T. 5 N., R. 4 E., Franklin County, Mississippi, as depicted on the map prepared for the Alliance by Marling Surveying, LLC, entitled <quote>Map of Survey of a +/− 173 Acre Tract, a Portion of U.S. Department of Agriculture Forest Service Homochitto National Forest Tracts H–1, H–3b, H–41g &amp; H–307</quote>, and dated September 16, 2024.</text></subparagraph></paragraph><paragraph id="PH6C5B9C70E76B42B790F39300477A4187"><enum>(2)</enum><header>Survey</header><text>The exact acreage and legal description of the National Forest System land to be conveyed under this section shall be determined by a survey satisfactory to the Secretary.</text></paragraph></subsection><subsection id="PH9A89C8DB858E4FA788D1B26B1D2CA1A6" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Consideration</header><paragraph id="PHEE57F463854A49139F891B49627637DC"><enum>(1)</enum><header>In general</header><text>The consideration for the conveyance of any National Forest System land under this section shall be—</text><subparagraph id="PHAEAD4D7F12CD45178989C758F7464F3F"><enum>(A)</enum><text>provided in the form of cash; and</text></subparagraph><subparagraph id="PH96550F272AFA4A749B304A94400BC289"><enum>(B)</enum><text>in an amount equal to the fair market value of the National Forest System land being conveyed, as determined under paragraph (2).</text></subparagraph></paragraph><paragraph id="PH8DE00513C29D445487F81AAE695E1BBD"><enum>(2)</enum><header>Fair market value determination</header><text>The fair market value of the National Forest System land conveyed under this section shall be determined—</text><subparagraph id="PH0F2223446F954B05926336496B360F78"><enum>(A)</enum><text>in the case of a method of conveyance described in subsection (b), by an appraisal that is—</text><clause id="PHA6F2768D382E444088A638256A8E48D0"><enum>(i)</enum><text>conducted in accordance with the Uniform Appraisal Standards for Federal Land Acquisitions; and</text></clause><clause id="PHAA958226A12B486293C3286ED4F4711E"><enum>(ii)</enum><text>approved by the Secretary; or</text></clause></subparagraph><subparagraph id="PH1E74AACD880D495EBE245F9DDDAF4AA6"><enum>(B)</enum><text>in the case of a conveyance by a method other than a method described in subsection (b), by competitive sale.</text></subparagraph></paragraph></subsection><subsection id="PHFEAA3B9301A74EBCA54B3667E695B74F" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header>Terms and conditions</header><text>The conveyance under this section shall be subject to—</text><paragraph id="PHCE2A246079E84890BDF3F98A7A7BA2CA"><enum>(1)</enum><text>valid existing rights; and</text></paragraph><paragraph id="PH1239FCE9576E44519CB032F5FE7238C1"><enum>(2)</enum><text>such other terms and conditions as the Secretary considers to be appropriate to protect the interests of the United States.</text></paragraph></subsection><subsection id="PHC112E77FA456423C930F46DC1E929775" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header>Proceeds from sale</header><text>The Secretary shall deposit the proceeds of the conveyance of any National Forest System land under this section in the fund established under <external-xref legal-doc="public-law" parsable-cite="pl/90/171">Public Law 90–171</external-xref> (commonly known as the <quote>Sisk Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/484a">16 U.S.C. 484a</external-xref>).</text></subsection><subsection id="PH0D1AC1A2152A42EABFEE5350B9F87336" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header>Costs</header><text>As a condition for the conveyance under this section, the Secretary shall require the Alliance to pay at closing—</text><paragraph id="PHB475AA5C258243AC9E84D365956CEA49"><enum>(1)</enum><text>any reasonable appraisal costs; and</text></paragraph><paragraph id="PHF2539EA3DB3F4E9FA12B8B3A62C964B4"><enum>(2)</enum><text>the costs of any administrative or environmental analysis required by applicable law (including regulations).</text></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id739d98ea-2dd2-4aca-b5f5-0e0ba6675121" commented="no" display-inline="no-display-inline" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSAF00"><enum>1.</enum><header display-inline="yes-display-inline">Okhissa Lake rural economic development land conveyance</header><subsection id="idd664aa87-210a-4a04-b90f-b48b3ee0b7f0" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id6326a3af-bdf7-4fda-8598-068e270c9956"><enum>(1)</enum><header>Alliance</header><text display-inline="yes-display-inline">The term <term>Alliance</term> means the Scenic Rivers Development Alliance, an instrumentality of the State of Mississippi.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61d4bfd4-33b0-469e-9371-68515ce7dd93"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><subsection id="id3e4534b8-22ee-4464-9e06-d208497d850e" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Conveyance</header><text>Subject to the requirements of this section, not later than 180 days after the completion of the appraisal under subsection (d)(2) and the written agreement under subsection (e)(2), the Secretary shall convey by quitclaim deed to the Alliance all right, title, and interest of the United States in and to the surface estate of the National Forest System land generally described in subsection (c).</text></subsection><subsection id="id4888d1a7-eb96-4c85-925d-3d133d5466ba" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Land to be conveyed</header><paragraph id="id614069ef-0274-4f7f-846b-4c1b8f6b2476"><enum>(1)</enum><header>In general</header><text>The National Forest System land referred to in subsection (b) is—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9d21e53c-2a1c-4fa2-ad55-e706e6ec3e5b"><enum>(A)</enum><text display-inline="yes-display-inline">the approximately 137.7 acres of real property located in secs. 5 and 6, T. 5 N., R. 4 E., and sec. 31, T. 6 N., R. 4 E., Franklin County, Mississippi, as depicted on the map prepared for the Alliance by Marling Surveying, LLC, entitled <quote>Map of Survey of a 137.70 Acre Tract, a Portion of U.S. Department of Agriculture Forest Service Homochitto National Forest Tracts H-41g &amp; H-307</quote>, and dated September 16, 2024; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf1894533-957b-46e9-b844-65024a5a1565"><enum>(B)</enum><text display-inline="yes-display-inline">the approximately 173 acres of real property located in secs. 5, 6, 7, and 8, T. 5 N., R. 4 E., Franklin County, Mississippi, as depicted on the map prepared for the Alliance by Marling Surveying, LLC, entitled <quote>Map of Survey of a +/- 173 Acre Tract, a Portion of U.S. Department of Agriculture Forest Service Homochitto National Forest Tracts H-1, H-3b, H-41g &amp; H-307</quote>, and dated September 16, 2024.</text></subparagraph></paragraph><paragraph id="id345a773d-ae52-479e-8a82-a11c2d96fc1b"><enum>(2)</enum><header>Survey</header><text>The exact acreage and legal description of the National Forest System land to be conveyed under this section shall be determined by a survey satisfactory to the Secretary.</text></paragraph></subsection><subsection id="ida78f0992-ca4a-4297-b10e-b3ca7339fb09" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Consideration</header><text>The consideration for the conveyance of any National Forest System land under this section shall be—</text><paragraph id="id7115d928-90c3-4783-8f96-df0224e02940"><enum>(1)</enum><text>provided in the form of cash; and</text></paragraph><paragraph id="id9285b4b0-3a30-422f-9c65-2a8ba9d277cf"><enum>(2)</enum><text>in an amount equal to the fair market value of the National Forest System land being conveyed, as determined by an appraisal conducted in accordance with the Uniform Appraisal Standards for Federal Land Acquisitions and approved by the Secretary.</text></paragraph></subsection><subsection id="idc06bc262-9310-49ae-8435-14df660904f4" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header>Terms and conditions</header><text>The conveyance under this section shall be subject to—</text><paragraph id="idda3b5591-f3f3-4580-ad9c-74da9975a346"><enum>(1)</enum><text>valid existing rights;</text></paragraph><paragraph id="id1c88801b585a48a4bee4900dfe9cc013"><enum>(2)</enum><text>a written agreement entered into between the Secretary and the Alliance, under which the Alliance—</text><subparagraph commented="no" display-inline="no-display-inline" id="idacefbb3a53ce4078bdb6af0b6d475e83"><enum>(A)</enum><text display-inline="yes-display-inline">agrees to cover the costs of upkeep and maintenance of the Okhissa Lake Dam, including the dam, spillway, and related water control facilities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id763299b0bae948f1a0849c6151f670b4"><enum>(B)</enum><text display-inline="yes-display-inline">assumes responsibility and liability for compliance with all Federal and State dam safety laws and regulations;</text></subparagraph></paragraph><paragraph id="id4044cf4be7344494ab5e32123b893017"><enum>(3)</enum><text>the reservations in the United States of easements for public roads and trails, including—</text><subparagraph id="id24826648b177404f98e958836e17ff21"><enum>(A)</enum><text>a perpetual, nonexclusive road right-of-way 30 feet in width for ingress and egress over all portions of Forest Service Road 149A within any of the conveyed land; and</text></subparagraph><subparagraph id="id18300c7c074840d189d72e06f5ed6397"><enum>(B)</enum><text>such road and trail rights-of-way as the Secretary may determine to be necessary or desirable to retain public and administrative access to Okhissa Lake and appurtenant National Forest System land;</text></subparagraph></paragraph><paragraph id="id2e6944da48ad415fbc7ec7376a0bec53"><enum>(4)</enum><text>the reservation in the United States of all mineral rights, oil and gas rights, and all other subsurface rights in the conveyed land;</text></paragraph><paragraph id="id2609bc5f18a44033a36842c3f6bd70c7"><enum>(5)</enum><text>a right of re-entry reserving to the Secretary the right to retake possession and title to the conveyed land in the event the land is subsequently conveyed to a nonpublic entity or used for purposes other than public recreation and fish and wildlife habitat, subject to the condition that, in the event the Secretary exercises such a right of re-entry, the Alliance shall remain liable for the abatement and clean-up of hazardous substances, oil, and any other contaminants;</text></paragraph><paragraph id="id1fa4330645d14d59aab5f55f6a2d1c93"><enum>(6)</enum><text>a restrictive covenant against the subdivision of the conveyed land into residential lots; and</text></paragraph><paragraph id="id4bd72b20-0888-4fa5-9eee-4ec2d0dbb841"><enum>(7)</enum><text>such other terms and conditions as the Secretary considers to be appropriate to protect the interests of the United States.</text></paragraph></subsection><subsection id="id88dc9cd6-0767-4e29-8a57-e52e3e30f186" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header>Proceeds from sale</header><paragraph commented="no" display-inline="no-display-inline" id="id411ede5f0a0e47bea5467ba5665c0d8c"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall deposit the proceeds of the conveyance of any National Forest System land under this section in the fund established under <external-xref legal-doc="public-law" parsable-cite="pl/90/171">Public Law 90–171</external-xref> (commonly known as the <quote>Sisk Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/484a">16 U.S.C. 484a</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id39c30165ce864050967972a06b7f6f6f"><enum>(2)</enum><header>Use of funds</header><text>Amounts deposited under paragraph (1) shall remain available until expended, without further appropriation, for the acquisition of land and interests in land for the National Forest System.</text></paragraph></subsection><subsection id="id690af66f-4fc5-4447-b061-b4f4d629581b" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header>Costs</header><text>As a condition for the conveyance under this section, the Secretary shall require the Alliance to pay at closing any reasonable appraisal, survey, and closing costs.</text></subsection><subsection id="idfb7d7b7f32094611a519eff4c199e222"><enum>(h)</enum><header>Environmental laws</header><text>The Secretary shall not be required to comply with National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) or any other applicable environmental law in carrying out the conveyance under this section.</text></subsection><subsection id="idd116681a947c4b0695b2033a3cfc9fd0"><enum>(i)</enum><header>Hazardous materials</header><text>For purposes of the conveyance under this section, the Secretary—</text><paragraph id="id380ba8dad4e7436cb47c6df8c9c481c2"><enum>(1)</enum><text>shall meet disclosure requirements for hazardous substances, pollutants, or contaminants under section 120(h) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9620">42 U.S.C. 9620(h)</external-xref>); and</text></paragraph><paragraph id="id5bee6a051bfd4be190f9ee18f8864127"><enum>(2)</enum><text>shall not otherwise be required to remediate or abate those hazardous substances, pollutants, or contaminants.</text></paragraph></subsection></section></legis-body><endorsement><action-date date="20251027">October 27, 2025</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
