id="S1"><enum>(a)</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="yes-display-inline">This title may be cited as the <quote><short-title>Radiation Exposure Compensation Expansion Act</short-title></quote>.</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id30c5c815a0eb48d4a4f9ab94b7b53351"><enum>102.</enum><header display-inline="yes-display-inline">Claims relating to Manhattan Project waste</header><text display-inline="no-display-inline">The Radiation Exposure Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/101/426">Public Law 101–426</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) is amended by inserting after section 5 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfddb91b8745e4439a7774906776bb2f5"><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id72bf9562f1b242939d94192f842437d9"><enum>5A.</enum><header display-inline="yes-display-inline">Claims relating to Manhattan Project waste</header><subsection commented="no" display-inline="no-display-inline" id="id1bed1ff2131e41e882e6099e49005287"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A claimant shall receive compensation for a claim made under this Act, as described in subsection (b) or (c), if—</text><paragraph commented="no" display-inline="no-display-inline" id="id10f591f3d46044cf9b8736c7e75f4536"><enum>(1)</enum><text display-inline="yes-display-inline">a claim for compensation is filed with the Attorney General—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1b8fa0920aac428582c75d185d5d818a"><enum>(A)</enum><text display-inline="yes-display-inline">by an individual described in paragraph (2); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id55f6a65213184403bea08b8bcfa207ce"><enum>(B)</enum><text display-inline="yes-display-inline">on behalf of that individual by an authorized agent of that individual, if the individual is deceased or incapacitated, such as—</text><clause commented="no" display-inline="no-display-inline" id="idca160012e236415bb5926492e9ce06d3"><enum>(i)</enum><text display-inline="yes-display-inline">an executor of estate of that individual; or</text></clause><clause commented="no" display-inline="no-display-inline" id="iddb04646e3b434763b933e5b61590846f"><enum>(ii)</enum><text display-inline="yes-display-inline">a legal guardian or conservator of that individual;</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcca97204225948cab0ff8afecd0c4750"><enum>(2)</enum><text display-inline="yes-display-inline">that individual, or if applicable, an authorized agent of that individual, demonstrates that the individual—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8b8b08f644374483976b1746c5d4985a"><enum>(A)</enum><text display-inline="yes-display-inline">was physically present in an affected area for a period of at least 2 years after January 1, 1949; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide2f21afa55954b03acc2273a5fd8ab5d"><enum>(B)</enum><text display-inline="yes-display-inline">contracted a specified disease after such period of physical presence;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id596b44872dd445edb426365256b5150a"><enum>(3)</enum><text display-inline="yes-display-inline">the Attorney General certifies that the identity of that individual, and if applicable, the authorized agent of that individual, is not fraudulent or otherwise misrepresented; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1ac4dfc5fa304b4b8a545b3f10619287"><enum>(4)</enum><text display-inline="yes-display-inline">the Attorney General determines that the claimant has satisfied the applicable requirements of this Act.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9bea8152fea943eab364382c509137ed"><enum>(b)</enum><header display-inline="yes-display-inline">Losses available to living affected individuals</header><paragraph commented="no" display-inline="no-display-inline" id="id6045e4b3ba8e4f708568435074521343"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In the event of a claim qualifying for compensation under subsection (a) that is submitted to the Attorney General to be eligible for compensation under this section at a time when the individual described in subsection (a)(2) is living, the amount of compensation under this section shall be in an amount that is the greater of $50,000 or the total amount of compensation for which the individual is eligible under paragraph (2).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7e0258cca9aa4a7ba6f5046009214be7"><enum>(2)</enum><header display-inline="yes-display-inline">Losses due to medical expenses</header><text display-inline="yes-display-inline">A claimant described in paragraph (1) shall be eligible to receive, upon submission of contemporaneous written medical records, reports, or billing statements created by or at the direction of a licensed medical professional who provided contemporaneous medical care to the claimant, additional compensation in the amount of all documented out-of-pocket medical expenses incurred as a result of the specified disease suffered by that claimant, such as any medical expenses not covered, paid for, or reimbursed through—</text><subparagraph commented="no" display-inline="no-display-inline" id="id48b2c13aa85c48a59ef0ab3729c55905"><enum>(A)</enum><text display-inline="yes-display-inline">any public or private health insurance;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2e0c86661e044fc897ab1b452e129f0c"><enum>(B)</enum><text display-inline="yes-display-inline">any employee health insurance;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb63f95c2508b47c4a6289686c159cc20"><enum>(C)</enum><text display-inline="yes-display-inline">any workers’ compensation program; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4d3fff06a6bb422bbaa01793ec700e06"><enum>(D)</enum><text display-inline="yes-display-inline">any other public, private, or employee health program or benefit.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id11a9a02d0d424ec0add1c47751b9fc40"><enum>(c)</enum><header display-inline="yes-display-inline">Payments to beneficiaries of deceased individuals</header><text display-inline="yes-display-inline">In the event that an individual described in subsection (a)(2) who qualifies for compensation under subsection (a) is deceased at the time of submission of the claim—</text><paragraph commented="no" display-inline="no-display-inline" id="idcf3afcea97b947b6ad6b34e99faaf930"><enum>(1)</enum><text display-inline="yes-display-inline">a surviving spouse may, upon submission of a claim and records sufficient to satisfy the requirements of subsection (a) with respect to the deceased individual, receive compensation in the amount of $25,000; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfd7520a8b47f472f9008c4b4cdab96dd"><enum>(2)</enum><text display-inline="yes-display-inline">in the event that there is no surviving spouse, the surviving children, minor or otherwise, of the deceased individual may, upon submission of a claim and records sufficient to satisfy the requirements of subsection (a) with respect to the deceased individual, receive compensation in the total amount of $25,000, paid in equal shares to each surviving child.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb6129a8bd644461ca3594f0801f488b7"><enum>(d)</enum><header display-inline="yes-display-inline">Affected area</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>affected area</term> means—</text><paragraph commented="no" display-inline="no-display-inline" id="id9bfbd56e6acb4c08b7c9640070d17010"><enum>(1)</enum><text display-inline="yes-display-inline">in the State of Missouri, the ZIP Codes of 63031, 63033, 63034, 63042, 63045, 63074, 63114, 63135, 63138, 63044, 63121, 63140, 63145, 63147, 63102, 63304, 63134, 63043, 63341, 63368, and 63367;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb0f8c2dd42534d6db0484aa9d4f1e2ba"><enum>(2)</enum><text display-inline="yes-display-inline">in the State of Tennessee, the ZIP Codes of 37716, 37840, 37719, 37748, 37763, 37828, 37769, 37710, 37845, 37887, 37829, 37854, 37830, and 37831;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id77363e33e6f3443f85b0f77fa5631820"><enum>(3)</enum><text display-inline="yes-display-inline">in the State of Alaska, the ZIP Codes of 99546 and 99547; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc07163b69f9c4433bdddc0be6b5b7dd3"><enum>(4)</enum><text display-inline="yes-display-inline">in the State of Kentucky, the ZIP Codes of 42001, 42003, and 42086. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfa2518e3862e421c9fb9411ba7f7c55b"><enum>(e)</enum><header display-inline="yes-display-inline">Specified disease</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>specified disease</term> means any of the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id88c4630f7ef14158911934972834946f"><enum>(1)</enum><text display-inline="yes-display-inline">Any leukemia, other than chronic lymphocytic leukemia, provided that the initial exposure occurred after the age of 20 and the onset of the disease was at least 2 years after first exposure.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcec8e3d55706418d9cfd53cc9302b5ad"><enum>(2)</enum><text display-inline="yes-display-inline">Any of the following diseases, provided that the onset was at least 2 years after the initial exposure:</text><subparagraph commented="no" display-inline="no-display-inline" id="id7f96d3a9dfdb49ac96771a887bc902b4"><enum>(A)</enum><text display-inline="yes-display-inline">Multiple myeloma.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd8f20e25b41d4876aabe179cc2e8c948"><enum>(B)</enum><text display-inline="yes-display-inline">Lymphoma, other than Hodgkin’s disease.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0475ec00a9bf49d193a8678e364576f7"><enum>(C)</enum><text display-inline="yes-display-inline">Primary cancer of the—</text><clause commented="no" display-inline="no-display-inline" id="ida988a0c84b60401ea05e867b31a0fd36"><enum>(i)</enum><text display-inline="yes-display-inline">thyroid;</text></clause><clause commented="no" display-inline="no-display-inline" id="idc64ea2052d014eac9320a5b267c2f006"><enum>(ii)</enum><text display-inline="yes-display-inline">male or female breast;</text></clause><clause commented="no" display-inline="no-display-inline" id="id0f18b123c5664f8fbcfe1de1ce41ea37"><enum>(iii)</enum><text display-inline="yes-display-inline">esophagus;</text></clause><clause commented="no" display-inline="no-display-inline" id="ide04b0bc1008443cebebb8680818ac5ed"><enum>(iv)</enum><text display-inline="yes-display-inline">stomach;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9d3967c5976d45d8bbf763f85a56174a"><enum>(v)</enum><text display-inline="yes-display-inline">pharynx;</text></clause><clause commented="no" display-inline="no-display-inline" id="idc3faebc242494f8ab85e32a837dddf3c"><enum>(vi)</enum><text display-inline="yes-display-inline">small intestine;</text></clause><clause commented="no" display-inline="no-display-inline" id="ide7f1f77dd326418984274219c8e2d76c"><enum>(vii)</enum><text display-inline="yes-display-inline">pancreas;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7edcca2020194eefbcf129097795fa25"><enum>(viii)</enum><text display-inline="yes-display-inline">bile ducts;</text></clause><clause commented="no" display-inline="no-display-inline" id="idcc4eea58a94f4ed790edc8c9162f6bf6"><enum>(ix)</enum><text display-inline="yes-display-inline">gall bladder;</text></clause><clause commented="no" display-inline="no-display-inline" id="id16846f7b591644699735597ff578d1e8"><enum>(x)</enum><text display-inline="yes-display-inline">salivary gland;</text></clause><clause commented="no" display-inline="no-display-inline" id="ide7fd6596afc449149572f0124c0c00bd"><enum>(xi)</enum><text display-inline="yes-display-inline">urinary bladder;</text></clause><clause commented="no" display-inline="no-display-inline" id="idf9a43452792441ad85e68c9909e2564e"><enum>(xii)</enum><text display-inline="yes-display-inline">brain;</text></clause><clause commented="no" display-inline="no-display-inline" id="id386fdeb3c1574146b30e9df4871854f5"><enum>(xiii)</enum><text display-inline="yes-display-inline">colon;</text></clause><clause commented="no" display-inline="no-display-inline" id="id716692a6da5142c888aeb996e348170f"><enum>(xiv)</enum><text display-inline="yes-display-inline">ovary;</text></clause><clause commented="no" display-inline="no-display-inline" id="idb4ae9f65334d4a0b8b86619a81e43afd"><enum>(xv)</enum><text display-inline="yes-display-inline">bone;</text></clause><clause commented="no" display-inline="no-display-inline" id="idc6a09025918246fdbf618223d7cf119a"><enum>(xvi)</enum><text display-inline="yes-display-inline">renal;</text></clause><clause commented="no" display-inline="no-display-inline" id="idb7f9e18cf45c41da914cadc2161887d6"><enum>(xvii)</enum><text display-inline="yes-display-inline">liver, except if cirrhosis or hepatitis B is indicated; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id26ecc2f19b0b429da2c83d721caf21dc"><enum>(xviii)</enum><text display-inline="yes-display-inline">lung.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide27817ba417f42ba890abc28417fbea2"><enum>(f)</enum><header display-inline="yes-display-inline">Physical presence</header><paragraph commented="no" display-inline="no-display-inline" id="id9aeee8849a47489cb61c5c32c348cad9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For purposes of this section, the Attorney General shall not determine that a claimant has satisfied the requirements of subsection (a) unless demonstrated by submission of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6cfbae931d0f45438cfe20384c2104ff"><enum>(A)</enum><text display-inline="yes-display-inline">contemporaneous written residential documentation and at least 1 additional employer-issued or government-issued document or record that the claimant, for at least 2 years after January 1, 1949, was physically present in an affected area; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc3f786bcbc754e09a64db68a94a60e24"><enum>(B)</enum><text display-inline="yes-display-inline">other documentation determined by the Attorney General to demonstrate that the claimant, for at least 2 years after January 1, 1949, was physically present in an affected area.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id305d7be87dcb45c3af0a061ba8add308"><enum>(2)</enum><header display-inline="yes-display-inline">Types of physical presence</header><text display-inline="yes-display-inline">For purposes of determining physical presence under this section, a claimant shall be considered to have been physically present in an affected area if—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddf5cf077816b4dcd8363d3f5394cacf8"><enum>(A)</enum><text display-inline="yes-display-inline">the claimant’s primary residence was in the affected area;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc4d97f04a7ec42febc8af99544a4630c"><enum>(B)</enum><text display-inline="yes-display-inline">the claimant’s place of employment was in the affected area; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida1a9461e49964c08a04196268de4619d"><enum>(C)</enum><text display-inline="yes-display-inline">the claimant attended school in the affected area.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfd86ac59fe2940a4bf681c9fff6243cb"><enum>(g)</enum><header display-inline="yes-display-inline">Disease contraction in affected areas</header><text display-inline="yes-display-inline">For purposes of this section, the Attorney General shall not determine that a claimant has satisfied the requirements of subsection (a) unless the claimant submits—</text><paragraph commented="no" display-inline="no-display-inline" id="id643cda405c6e4c959e39635b7abc5496"><enum>(1)</enum><text display-inline="yes-display-inline">written medical records or reports created by or at the direction of a licensed medical professional, created contemporaneously with the provision of medical care to the claimant, that the claimant, after a period of physical presence in an affected area, contracted a specified disease; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcaeee87978a34edfb83e7c49037b1556"><enum>(2)</enum><text display-inline="yes-display-inline">other documentation determined by the Attorney General to demonstrate that the claimant contracted a specified disease after a period of physical presence in an affected area.</text></paragraph></subsection></section><after-quoted-block display="yes">. </after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idbf90ee95b14e48ea89ea9f435dedebb3"><enum>103.</enum><header display-inline="yes-display-inline">Cooperative agreement</header><subsection commented="no" display-inline="no-display-inline" id="id7a16c8bc6c99411fadac7107378fcf86"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than September 30, 2025, the Secretary of Energy, acting through the Director of the Office of Legacy Management, shall award to an eligible association a cooperative agreement to support the safeguarding of human and ecological health at the Amchitka, Alaska, Site.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id57a61d87ccd34bc09d048da01c759b5b"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">A cooperative agreement awarded under subsection (a)—</text><paragraph commented="no" display-inline="no-display-inline" id="idc198600c6f1d4aa6b3e3c533b875b8ba"><enum>(1)</enum><text display-inline="yes-display-inline">may be used to that will improve and focus long-term surveillance and monitoring of the site;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id609819a542b344049fceeae0d0c0df3d"><enum>(B)</enum><text display-inline="yes-display-inline">workforce development at the site; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8aa26919c1d44756ae4dac2287683878"><enum>(C)</enum><text display-inline="yes-display-inline">such other activities as the Secretary considers appropriate; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb741c55c950b43b892f1239b3da59f85"><enum>(2)</enum><text display-inline="yes-display-inline">shall require that the eligible association—</text><subparagraph commented="no" display-inline="no-display-inline" id="id58817699d298408489c51f334ebfe7e0"><enum>(A)</enum><text display-inline="yes-display-inline">engage in stakeholder engagement; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf8d6d62ce8b743cf9649011b34114e52"><enum>(B)</enum><text display-inline="yes-display-inline">to the greatest extent practicable, incorporate Indigenous knowledge and the participation of local Indian Tribes in research and development and workforce development activities.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4458ec32a5d44fae8b19a973782c5f6d"><enum>(c)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id76e90759f473423cad9541ca1fa50c1c"><enum>(1)</enum><header display-inline="yes-display-inline">Eligible association</header><text display-inline="yes-display-inline">The term <term>eligible association</term> means an association of 2 or more of the following:</text><subparagraph commented="no" of the State of Alaska.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6d212540230b4ce48d3cb8503c3298d6"><enum>(C)</enum><text display-inline="yes-display-inline">A local Indian Tribe.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id508438f4e85843d09c886ef968266124"><enum>(D)</enum><text display-inline="yes-display-inline">An organization—</text><clause commented="no" display-inline="no-display-inline" display-inline="no-display-inline" id="H22442C9471DF491EBBC895A8624D821D"><enum>(iv)</enum><text display-inline="yes-display-inline">is made by a person other than the individual filing the claim.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEA2F31B9421040EABBF698F3844474C"><enum>(B)</enum><header display-inline="yes-display-inline">Physical Presence in Affected Area</header><text display-inline="yes-display-inline">For purposes of this Act, the Attorney General shall accept a written affidavit or declaration as evidence to substantiate an individual’s physical presence in an affected area (as defined in section 4(b)(1)) during a period described in section 4(a)(1)(A)(i) or section 4(a)(2) if the affidavit—</text><clause commented="no" display-inline="no-display-inline" id="H4310F4CA168040FD9420314BEA8700D9"><enum>(i)</enum><text display-inline="yes-display-inline">is provided in display-inline="no-display-inline" id="H98ACD2584EEF406F92F3C84D88ACD99"><enum>(ii)</enum><text display-inline="yes-display-inline">attests to the individual’s presence in an affected area during that period;</text></clause><clause commented="no" display-inline="no-display-inline" id="H7A18FEEBEFAD4727B1F2BEA54C65DEB"><enum>(iii)</enum><text display-inline="yes-display-inline">is made subject to penalty for perjury; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HE44B2B7E244A40ECA1469CF8D45B717C"><enum>(iv)</enum><text display-inline="yes-display-inline">is made by a person other than the individual filing the claim.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" Act, the Attorney General shall accept a written affidavit or declaration as evidence to substantiate an individual’s participation onsite in a test involving the atmospheric detonation of a nuclear device if the affidavit—</text><clause commented="no" display-inline="no-display-inline" id="HB30B55BC024C473F8D004086F9F76B00"><enum>(i)</enum><text display-inline="yes-display-inline">is provided in addition to other material that may be used to substantiate the individual’s participation onsite in a test involving the atmospheric detonation of a nuclear device;</text></clause><clause commented="no" display-inline="no-display-inline" id="HBE98804E012C460382413B31145CA0A9"><enum>(ii)</enum><text display-inline="yes-display-inline">attests to the individual’s participation onsite in a test involving the atmospheric detonation of a nuclear device;</text></clause><clause commented="no" display-inline="no-display-inline" id="H00E8529F239B4B00AEA0E8641037CD7F"><enum>(iii)</enum><text display-inline="yes-display-inline">is made subject to penalty for perjury; and</text></clause><clause commented="no" display-inline="no-display-inline" processing of claims under such Act take into account and make allowances for the law, tradition, and customs of Indian tribes, including by accepting as a record of proof of physical presence for a claimant a grazing permit, a homesite lease, a record of being a holder of a post office box, a letter from an elected leader of an Indian tribe, or a record of any recognized tribal association or organization. </text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HD25F3C859E634098AE2D13FB60F13F00"><enum>207.</enum><header display-inline="yes-display-inline">Limitation on claims</header><subsection commented="no" display-inline="no-display-inline" id="H2E1477C072D0460A83127C2C408698B8"><enum>(a)</enum><header display-inline="yes-display-inline">Extension of filing time</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/8">Section 8(a)</external-xref> is amended—</text><paragraph commented="no" display-inline="no-display-inline" Any resubmittal made before the date of the enactment of the <short-title>Radiation Exposure Compensation Act Amendments of 2025</short-title> shall not be applied to the limitation under the preceding sentence.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H27FF2B5CF95245948BD0EAE5095FDDA7"><enum>(2)</enum><header display-inline="yes-display-inline">Previously successful claims</header><subparagraph commented="no" display-inline="no-display-inline" id="H6761C104D75B487CBCD83E71996589EC"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">After the date of enactment of the <short-title>Radiation Exposure Compensation Act Amendments of 2025</short-title>, any claimant who received compensation under this Act may submit a request to the Attorney General for additional compensation and benefits. Such request shall contain—</text><clause commented="no" display-inline="no-display-inline" id="H7C08939A1E6C4416A05FB18800A200CB"><enum>(i)</enum><text display-inline="yes-display-inline">the claimant’s name, social security number, and date of birth;</text></clause><clause commented="no" display-inline="no-display-inline" id="H70EC938871454679BFBA962229520235"><enum>(ii)</enum><text display-inline="yes-display-inline">the amount of award received under this Act before the date of enactment of the <short-title>Radiation Exposure Compensation Act Amendments of 2025</short-title>;</text></clause><clause commented="no" display-inline="no-display-inline" id="H1507722215A843C7B875F9E5BB704B35"><enum>(iii)</enum><text display-inline="yes-display-inline">any additional benefits and compensation sought through such request; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H59100A1A6F364B6000C7067B04ADB598"><enum>(iv)</enum><text display-inline="yes-display-inline">any additional information required by the Attorney General.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8FF724F7E23141BC879297C083429971"><enum>(B)</enum><header display-inline="yes-display-inline">Additional Compensation</header><text display-inline="yes-display-inline">If the claimant received compensation under this Act before the date of enactment of the <short-title>Radiation Exposure Compensation Act Amendments of 2025</short-title> and submits a request under <internal-xref idref="H6761C104D75B487CBCD83E71996589EC" legis-path="(b)(2)(A)">subparagraph (A)</internal-xref>, the Attorney General shall—</text><clause commented="no" display-inline="no-display-inline" id="H4D2F4F305641496F8F1BE8088904D67D"><enum>(i)</enum><text display-inline="yes-display-inline">pay the claimant the amount that is equal to any excess of—</text><subclause commented="no" display-inline="no-display-inline" id="H6EE871781A7F453EB2477DCB461212D2"><enum>(I)</enum><text display-inline="yes-display-inline">the amount the claimant is eligible to receive under this Act (as amended by the <short-title>Radiation Exposure Compensation Act Amendments of 2025</short-title>); minus</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H5F02A8BB74D84FF4009D044C51C83C15"><enum>(II)</enum><text display-inline="yes-display-inline">the aggregate amount paid to the claimant under this Act before the date of enactment of the <short-title>Radiation Exposure Compensation Act Amendments of 2025</short-title>; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H413335DE815E4A92B73272C9F63D63E0"><enum>(ii)</enum><text display-inline="yes-display-inline">in any case in which the claimant was compensated under section 4, provide the claimant with medical benefits under section 4(a)(5).</text></clause></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id0EF091CAB7774C69AA5986CBC2EDE34B"><enum>208.</enum><header display-inline="yes-display-inline">Grant program on epidemiological impacts of uranium mining and milling</header><subsection commented="no" display-inline="no-display-inline" id="id3B113F64B07F4A1C89375BE750E3B41F"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text><paragraph commented="no" display-inline="no-display-inline" id="id4615179882B9406F8BECA19918672750"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>institution of higher education</term> has the meaning given under section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA95BF23FEFAC42439094BAE3EB2C0AE4"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>program</term> means the grant program established under subsection (b); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8DD5345064DC4543B9060E2AD7A82596"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEA781614BBCC4516869CA6D55941FD70"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a grant program relating to the epidemiological impacts of uranium mining and milling. Grants awarded under the program shall be used for the study of the epidemiological impacts of uranium mining and milling among non-occupationally exposed individuals, including family members of uranium miners and millers.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id56ABAF4037644732A7386068BC37B215"><enum>(c)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">The Secretary shall administer the program through the National Institute of Environmental Health Sciences.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idAACBA58742634E5391846827AAE40C5B"><enum>(d)</enum><header display-inline="yes-display-inline">Eligibility and application</header><text display-inline="yes-display-inline">Any institution of higher education or nonprofit private entity shall be eligible to apply for a grant. To apply for a grant an eligible institution or entity shall submit to the Secretary an application at such time, in such manner, and containing or accompanied by such information as the Secretary may reasonably require.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8F61DCA28AD140DFBD3B7672EC07DCC0"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section $3,000,000 for each of fiscal years 2025 through 2027.</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id5A5141F3481743E98769E7F3F7FE71C2"><enum>209.</enum><header display-inline="yes-display-inline">Energy Employees Occupational Illness Compensation Program</header><subsection commented="no" display-inline="no-display-inline" id="id90DB4DAC99F041E6B47374C3F70658ED"><enum>(a)</enum><header display-inline="yes-display-inline">Covered employees with cancer</header><text display-inline="yes-display-inline">Section 3621(9) of the Energy Employees Occupational Illness Compensation Program Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/7384l">42 U.S.C. 7384l(9)</external-xref>) is amended by striking subparagraph (A) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id53DC8489021B4D35929E07769F412E4B"><subparagraph commented="no" display-inline="no-display-inline" id="IDae0bf359912f46ffa0ed8af284c1b2a6"><enum>(A)</enum><text display-inline="yes-display-inline">An individual with a specified cancer who is a member of the Special Exposure Cohort, if and only if—</text><clause commented="no" display-inline="no-display-inline" id="idA57C25E872574E2EAA5981B9E353019A"><enum>(i)</enum><text display-inline="yes-display-inline">that individual contracted that specified cancer after beginning employment at a Department of Energy facility (in the case of a Department of Energy employee or Department of Energy contractor employee) or at an atomic weapons employer facility (in the case of an atomic weapons employee); or</text></clause><clause commented="no" display-inline="no-display-inline" id="idD58101D7D061489BACD05EB9D6157EF4"><enum>(ii)</enum><text display-inline="yes-display-inline">that individual—</text><subclause commented="no" display-inline="no-display-inline" id="id88E39951A8184BC6AABFD931574972AC"><enum>(I)</enum><text display-inline="yes-display-inline">contracted that specified cancer after beginning employment in a uranium mine or uranium mill described under section 5(a)(1)(A)(i) of the Radiation Exposure Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) (including any individual who was employed in core drilling or the transport of uranium ore or vanadium-uranium ore from such mine or mill) located in Colorado, New Mexico, Arizona, Wyoming, South Dakota, Washington, Utah, Idaho, North Dakota, Oregon, Texas, or any State the Attorney General makes a determination under section 5(a)(2) of that Act for inclusion of eligibility under section 5(a)(1) of that Act; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3A7821534A5E4C019C9B84BB67DF0E1C"><enum>(II)</enum><text display-inline="yes-display-inline">was employed in a uranium mine or uranium mill described under subclause (I) (including any individual who was employed in core drilling or the transport of uranium ore or vanadium-uranium ore from such mine or mill) at any time during the period beginning on January 1, 1942, and ending on December 31, 1990.</text></subclause></clause></subparagraph><after-quoted-block display="yes">.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idAAECEE5D56614139878A0102E61EC215"><enum>(b)</enum><header display-inline="yes-display-inline">Members of Special Exposure Cohort</header><text display-inline="yes-display-inline">Section 3626 of the Energy Employees Occupational Illness Compensation Program Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/7384q">42 U.S.C. 7384q</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idE8954D447D1843A4B779EC3A6777D08F"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDE8941546D0F47158C4996D8412C9C6B"><paragraph commented="no" display-inline="no-display-inline" id="id3132E2565A5D4300B634BA3FCD4E7B51"><enum>(1)</enum><text display-inline="yes-display-inline">The Advisory Board on Radiation and Worker Health under section 3624 shall advise the President whether there is a class of employees—</text><subparagraph commented="no" display-inline="no-display-inline" id="id994EC2ABAD164CA994A030C459DBAC8F"><enum>(A)</enum><text display-inline="yes-display-inline">at any Department of Energy facility who likely were exposed to radiation at that facility but for whom it is not feasible to estimate with sufficient accuracy the radiation dose they received; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD4E2393B35CF4AD0BE14FBDA5883634F"><enum>(B)</enum><text display-inline="yes-display-inline">employed in a uranium mine or uranium mill described under section 5(a)(1)(A)(i) of the Radiation Exposure Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) (including any individual who was employed in core drilling or the transport of uranium ore or vanadium-uranium ore from such mine or mill) located in Colorado, New Mexico, Arizona, Wyoming, South Dakota, Washington, Utah, Idaho, North Dakota, Oregon, Texas, and any State the Attorney General makes a determination under section 5(a)(2) of that Act for inclusion of eligibility under section 5(a)(1) of that Act, at any time during the period beginning on January 1, 1942, and ending on December 31, 1990, who likely were exposed to radiation at that mine or mill but for whom it is not feasible to estimate with sufficient accuracy the radiation dose they received.</text></subparagraph></paragraph><after-quoted-block display="yes">; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD24847F04B7D494CB760AA1C0C49D8EF"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9988305770544E16872105BDCFA28283"><subsection commented="no" display-inline="no-display-inline" id="ID30801204c3444f77a63e71d99131599a"><enum>(b)</enum><header display-inline="yes-display-inline">Designation of additional members</header><paragraph commented="no" display-inline="no-display-inline" id="IDaf0737d8c97b4390a77a7aaa89fef95f"><enum>(1)</enum><text display-inline="yes-display-inline">Subject to the provisions of section 3621(14)(C), the members of a class of employees at a Department of Energy facility, or at an atomic weapons employer facility, may be treated as members of the Special Exposure Cohort for purposes of the compensation program if the President, upon recommendation of the Advisory Board on Radiation and Worker Health, determines that—</text><subparagraph commented="no" display-inline="no-display-inline" id="IDf9aebdb627fa4c7590ad72b0a2dc3f2f"><enum>(A)</enum><text display-inline="yes-display-inline">it is not feasible to estimate with sufficient accuracy the radiation dose that the class received; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6a27f9b3342244c1b2673a53771a84ab"><enum>(B)</enum><text display-inline="yes-display-inline">there is a reasonable likelihood that such radiation dose may have endangered the health of members of the class.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7DE528C135234207B8396747D8CD83B0"><enum>(2)</enum><text display-inline="yes-display-inline">Subject to the provisions of section 3621(14)(C), the members of a class of employees employed in a uranium mine or uranium mill described under section 5(a)(1)(A)(i) of the Radiation Exposure Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) (including any individual who was employed in core drilling or the transport of uranium ore or vanadium-uranium ore from such mine or mill) located in Colorado, New Mexico, Arizona, Wyoming, South Dakota, Washington, Utah, Idaho, North Dakota, Oregon, Texas, and any State the Attorney General makes a determination under section 5(a)(2) of that Act for inclusion of eligibility under section 5(a)(1) of that Act, at any time during the period beginning on January 1, 1942, and ending on December 31, 1990, may be treated as members of the Special Exposure Cohort for purposes of the compensation program if the President, upon recommendation of the Advisory Board on Radiation and Worker Health, determines that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id178021D4561542A8ACC81C8935B89919"><enum>(A)</enum><text display-inline="yes-display-inline">it is not feasible to estimate with sufficient accuracy the radiation dose that the class received; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDB6D368EA45A4BBBB8A21569571ABEC1"><enum>(B)</enum><text display-inline="yes-display-inline">there is a reasonable likelihood that such radiation dose may have endangered the health of members of the class.</text></subparagraph></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idde489f4374ff4bd49fca686141c1c06b"><enum>210.</enum><header display-inline="yes-display-inline">GAO study and report</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall conduct, and submit to Congress a report describing the results of, a study on the importance of, and need for, unmet medical benefits coverage for individuals who were exposed to radiation in atmospheric nuclear tests conducted by the Federal Government, and recommendations to provide such unmet medical benefits coverage for such individuals.</text></section></title></legis-body></bill>
