        <official-title>To require the Comptroller General of the United States to conduct a study
            regarding insurance coverage for damages from wildfires, and for other
            purposes.</official-title>

            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wildfire Insurance Coverage Study Act of 2025</short-title></quote>.</text>
        </section>
        <section id="HC050312C9334411C91AF240738C182AE">
            <enum>2.</enum>
            <header>GAO study regarding insurance for wildfire damage</header>
            <subsection id="HF2398296CC064F31AEEBAFD3178D3B41">
                <enum>(a)</enum>
                <header>Study</header>
 <text display-inline="yes-display-inline">The Comptroller General of the United States, in consultation with the Director of the Federal Insurance Office and State insurance regulators, shall conduct a study to analyze and determine the following:</text>
                <paragraph id="H43E1D89360084A28BDF8992B4340B20A">
                    <enum>(1)</enum>
                    <header>Risk assessment</header>
 <text>The extent and nature of wildfire risk in the United States, including—</text>
                    <subparagraph id="HD485191F8F254383BCD7A9F07712A19B">
                        <enum>(A)</enum>
 <text>identifying trends in declarations for wildfires under the Fire Management Assistance grant program under section 420 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5187">42 U.S.C. 5187</external-xref>), with respect to geography, costs, probability, and frequency of wildfire disasters;</text>
                    </subparagraph>
                    <subparagraph id="HF901BDD32A254AE19C0A7F5637B1711C">
                        <enum>(B)</enum>
 <text>identifying mitigation practices that would assist in reducing costs and risks for insurance policies covering damages from wildfires;</text>
                    </subparagraph>
                    <subparagraph id="H8EB4054E6DA740D0A390DCBB9303F912">
                        <enum>(C)</enum>
 <text>identifying existing programs of the Federal Government and State governments that measure wildfire risk and assess the effectiveness of those programs in forecasting wildfire events and informing wildfire response; and</text>
                    </subparagraph>
                    <subparagraph id="H6730EEA684FF4FBFA20631F1458A37E4">
                        <enum>(D)</enum>
 <text>analyzing and assessing the need for a national map for measuring and quantifying wildfire risk.</text>
                    </subparagraph>
                </paragraph>
                <paragraph id="H66CB31D442D84C2692E3EA58FDF56D9F">
                    <enum>(2)</enum>
                    <header>Existing state of coverage</header>
 <text>With respect to the existing state of homeowners insurance coverage and commercial property insurance coverage for damage from wildfires in the United States—</text>
                    <subparagraph id="H2930B8CBF2784CA89D1A837B87F12681">
                        <enum>(A)</enum>
 <text>the extent to which private insurers have, during the 10-year period ending on the date of enactment of this Act, adjusted rates, policyholder cost-sharing provisions, or both for those coverages (after adjusting for inflation) and the geographic areas in which adjusted rates, policyholder cost-sharing, or both have increased;</text>
                    </subparagraph>
                    <subparagraph id="H40F3AC5EB0A346A09E9230F7F930FC64">
                        <enum>(B)</enum>
 <text>the extent to which private insurers have, during the 10-year period ending on the date of enactment of this Act, declined to renew policies for those coverages and the geographic areas to which those declinations applied;</text>
                    </subparagraph>
                    <subparagraph id="H2F773659850B45AF8A15D1644C83886D">
                        <enum>(C)</enum>
 <text>the events and economic factors that have contributed to any increased rates described in subparagraph (A) and declinations to renew policies described in subparagraph (B);</text>
                    </subparagraph>
                    <subparagraph id="H69DF4B1F0AEC493E8D1CB15E33C3E2CC">
                        <enum>(D)</enum>
 <text>in cases in which private insurers have curtailed the overall wildfire exposure of those insurers, the extent to which homeowners insurance coverage and commercial property coverage were terminated altogether and the extent to which those coverages are still offered but with coverage for damage from wildfires excluded; and</text>
                    </subparagraph>
                    <subparagraph id="H9D993C45ECCC42678D9EC23E5922F3AD">
                        <enum>(E)</enum>
 <text>the extent to which, and the circumstances under which, private insurers are continuing to provide coverage for damage from wildfires—</text>
                        <clause id="H04AF6136D04D4E85B5D714D37EEDC76D">
                            <enum>(i)</enum>
 <text>in general;</text> </clause> <clause id="HAE6FACFF0EE34B7A9F863F6C52BBA566"> <enum>(ii)</enum> <text>subject to a condition that mitigation activities are taken, such as hardening of properties and landscaping against wildfires, by property owners, State or local governments, park or forest authorities, or other land management authorities; and</text>
                        </clause>
                        <clause id="HABA3F34D8A624CB19BD1B71D161C5111">
                            <enum>(iii)</enum>
 <text>subject to any other conditions.</text> </clause> </subparagraph> </paragraph> <paragraph id="H5DDFA2B1A1994F4C91B96F7CEEC9977A"> <enum>(3)</enum> <header>Regulatory responses</header> <text>With respect to actions taken by State insurance regulators in response to increased premium rates, policyholder cost-sharing, or both for coverage for damage from wildfires, or the exclusion of that coverage from homeowners insurance policies—</text>
                    <subparagraph id="HA79CA8961EAD4C27AA7386D81E08EAAB">
                        <enum>(A)</enum>
 <text>the extent to which States have leveraged their respective authorities to regulate rate increases;</text>
                    </subparagraph>
                    <subparagraph id="H57CC697B8A8E48EFAA9A2F8DD21991AD">
                        <enum>(B)</enum>
 <text>the extent to which States have enacted any moratoria on those rate and policyholder cost-sharing increases or exclusions and on non-renewals;</text>
                    </subparagraph>
                    <subparagraph id="HBC144B71C25F4B66B29C9B795DE96CC8">
                        <enum>(C)</enum>
 <text>the extent to which States require homeowners insurance coverage to include coverage for damage from wildfires or make sales of homeowners insurance coverage contingent on the sale, underwriting, or financing of separate wildfire coverage in the applicable State;</text>
                    </subparagraph>
                    <subparagraph id="H209F68444DC3444BB340AB1747EBAEF2">
                        <enum>(D)</enum>
 <text>the extent to which States have established State residual market insurance entities, reinsurance programs, or similar mechanisms for coverage of damages from wildfires;</text>
                    </subparagraph>
                    <subparagraph id="H6E963C1BEB4A42B69C97CE339FB89A25">
                        <enum>(E)</enum>
 <text>any other actions States or localities have taken in response to increased premium rates, policyholder cost-sharing, or both for coverage for damage from wildfires, or the exclusion of that coverage from homeowners policies, including forestry and wildfire management policies and subsidies for premiums and cost-sharing for wildfire coverage;</text>
                    </subparagraph>
                    <subparagraph id="H2FF4ADDF9C674FD3AA641EE627D8F5C3">
                        <enum>(F)</enum>
 <text>the effects of actions taken by States on the availability, coverage level, and affordability of homeowners insurance coverage; and</text>
                    </subparagraph>
                    <subparagraph id="H304E1B5C599B469D9199B2B5C5B99EDB">
                        <enum>(G)</enum>
 <text>the effectiveness and sustainability of actions described in subparagraphs (A) through (F) taken by States.</text>
                    </subparagraph>
                </paragraph>
                <paragraph id="HC3C38F01922E4124B1E3C474E2A9F5D8">
                    <enum>(4)</enum>
                    <header>Challenges in underwriting wildfire risk</header>
 <text>With respect to the challenges faced by private insurers underwriting wildfire risk, what is or are—</text>
                    <subparagraph id="H1EEF3AB27272425E8C2BF54FC73C5989">
                        <enum>(A)</enum>
 <text>the correlated risks and the extent of those risks;</text> </subparagraph> <subparagraph id="HE9CA578EF58C4D5BA4D860E73C86682D"> <enum>(B)</enum> <text>the factors affecting the extent of the ability of private insurers to estimate the magnitude of future likelihood of wildfires and of expected damages from wildfires;</text>
                    </subparagraph>
                    <subparagraph id="H425CDA7A9426473286382C7ECAEE7915">
                        <enum>(C)</enum>
 <text>the effects of the need to increase more affordable housing options, which may contribute to increased homebuilding in more remote, heavily-wooded areas with higher wildfire risk;</text>
                    </subparagraph>
                    <subparagraph id="HA1807471A29449B48BC832AB29ED69B3">
                        <enum>(D)</enum>
 <text>the potential for wildfire losses sufficiently large to jeopardize the solvency of insurers;</text>
                    </subparagraph>
                    <subparagraph id="H46A94C67523D4169900A51C73445EF45">
                        <enum>(E)</enum>
 <text>the extent to which, and the areas in which, risk-adjusted market premiums for wildfire risk limit the affordability or availability of coverage for consumers;</text>
                    </subparagraph>
                    <subparagraph id="H67571907FF3F47C6A3E7066CF092FCAD">
                        <enum>(F)</enum>
 <text>the effects of various existing and potential State and Federal Government responses to help address those challenges and mitigate wildfire risk, including actions such as—</text>
                        <clause id="HF0E036F4F5ED41A093EA19E0BB34A9FE">
                            <enum>(i)</enum>
 <text>improved forest management policies;</text> </clause> <clause id="H2F74B11C82A54BDEA74B126BE12324EC"> <enum>(ii)</enum> <text>obtaining improved data to estimate risk;</text>
                        </clause>
                        <clause id="H545304535DCB46FDA3303CF59AF01150">
                            <enum>(iii)</enum>
 <text>relocating homeowners from wildfire zones;</text> </clause> <clause id="HCF7DF2C9DDB64B2099B77025AB65806F"> <enum>(iv)</enum> <text>offsetting a portion of the charged risk-adjusted premiums of insurers with means-tested government affordability programs for lower income homeowners;</text>
                        </clause>
                        <clause id="HDEE2A83BB4D4413AB6BE726C4E2DF572">
                            <enum>(v)</enum>
 <text>encouraging the increased use of private reinsurance and other risk-sharing mechanisms by insurers to better diversify wildfire risk; and</text>
                        </clause>
                        <clause id="HB0E728EA838E492BA7CE46DF9E1BCF20">
                            <enum>(vi)</enum>
 <text>developing programs that offset the costs of wildfire risk for consumers and industry;</text>
                        </clause>
                    </subparagraph>
                    <subparagraph id="H26E1BF0D4B2843CFBAF7028F13887EA8">
                        <enum>(G)</enum>
 <text>the available policy responses if private insurers exit the wildfire coverage market and the potential advantages and disadvantages of each such response;</text>
                    </subparagraph>
                    <subparagraph id="HEA0EB015C25E49DCBB3D1EF0E20D059B">
                        <enum>(H)</enum>
 <text>the effects of the availability and affordability of wildfire coverage, policyholder cost-sharing, or both, on—</text>
                        <clause id="H85876414512C4BD5A9AD7ACD4DA206F7">
                            <enum>(i)</enum>
 <text>local communities that are disproportionately vulnerable to wildfires, including on low- or moderate-income property owners and small businesses;</text>
                        </clause>
                        <clause id="H07024B36BF6A428992B404F5228BEBF3">
                            <enum>(ii)</enum>
 <text>rebuilding in communities previously damaged by wildfires;</text> </clause> <clause id="HF2282FA026EB4E0EB586177501BF6CE5"> <enum>(iii)</enum> <text>the availability and affordability of housing supply; and</text>
                        </clause>
                        <clause id="HF01884321FDE4488B5B6805FD6CA8D99">
                            <enum>(iv)</enum>
 <text>the demand for wildfire insurance coverage by property owners;</text>
                        </clause>
                    </subparagraph>
                    <subparagraph id="H59E14FE62F034E069A7DD76D96CAA269">
                        <enum>(I)</enum>
 <text>the effects of potential State prohibitions on the termination of policies due to wildfire claims on insurer solvency; and</text>
                    </subparagraph>
                    <subparagraph id="H99A6D8FB2DAD4FF785C3E5B31045A765">
                        <enum>(J)</enum>
 <text>the manner in which private insurers are modeling or estimating future wildfire risk.</text>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection id="H0FB2208C777E4493B19D37AFBF25F517">
                <enum>(b)</enum>
                <header>Report</header>
 <text>Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report identifying the findings and conclusions of the study conducted under subsection (a).</text>
            </subsection>
