        <official-title>To amend the Federal Water Pollution Control Act to provide exclusions from
            the term <quote>navigable waters</quote>, and for other purposes.</official-title>

            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clarifying Legal Exclusions Around Regulated Waters Act</short-title></quote> or the <quote><short-title>CLEAR Waters Act</short-title></quote>.</text>
        </section>
        <section id="S1" section-type="subsequent-section">
            <enum>2.</enum>
            <header>Definition of navigable waters</header>
 <text display-inline="no-display-inline">Section 502(7) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362(7)</external-xref>) is amended—</text>
            <paragraph commented="no" display-inline="no-display-inline" id="idd477d948dce3423391fdee30160cdd92">
                <enum>(1)</enum>
 <text>by striking <quote>(7) The term</quote> and inserting the following:</text> <quoted-block id="idEF3625F418AF4DDC8F7A9867C4771B77" style="OLC" act-name=""> <paragraph id="id22F47132C8CC4EB3A67E95F5C00B396B"> <enum>(7)</enum> <header>Navigable waters</header> <subparagraph commented="no" display-inline="no-display-inline" id="ide39e81da2add4ab9a722b4adac861374"> <enum>(A)</enum> <header>In general</header> <text display-inline="yes-display-inline">The term</text>
                        </subparagraph>
                    </paragraph>

 <text>by adding at the end the following:</text> <quoted-block id="id541BF5DAC0494EAF923A83B397004D40" style="OLC" act-name=""> <subparagraph id="id76C376988F8A4348B44582EC652B32D8"> <enum>(B)</enum> <header>Exclusions</header> <text>The term <term>navigable waters</term> does not include any of the following:</text>
                        <clause commented="no" display-inline="no-display-inline" id="id4d00e4435329439ab3cc22864e248119">
                            <enum>(i)</enum>
 <text display-inline="yes-display-inline">Any component of a waste treatment system, including any lagoon or treatment pond (such as a settling or cooling pond), designed to actively or passively—</text>
                            <subclause commented="no" display-inline="no-display-inline" id="id6a38b85454f64dee813b98410fca0f9e">
                                <enum>(I)</enum>
 <text display-inline="yes-display-inline">convey or retain wastewater; or</text>
                            </subclause>
                            <subclause commented="no" display-inline="no-display-inline" id="id0457ce23849e44e6a4eefe0087c37bc5">
                                <enum>(II)</enum>
 <text display-inline="yes-display-inline">concentrate, settle, reduce, or remove pollutants from wastewater.</text>
                            </subclause>
                        </clause>
                        <clause commented="no" display-inline="no-display-inline" id="id5ad2677d72124b1bb752ccb6f97ae0eb">
                            <enum>(ii)</enum>
 <text display-inline="yes-display-inline">Ephemeral features that flow only in direct response to precipitation.</text>
                        </clause>
                        <clause commented="no" display-inline="no-display-inline" id="id495692c71a624528818729a20e5e47a8">
                            <enum>(iii)</enum>
 <text display-inline="yes-display-inline">Groundwater.</text> </clause> <clause commented="no" display-inline="no-display-inline" id="idd51f60b973ec4e58bee6342694c0bde4"> <enum>(iv)</enum> <text display-inline="yes-display-inline">Any other features determined to be excluded by the Administrator and the Secretary of the Army, acting through the Chief of Engineers.</text>
