                <paragraph commented="no" display-inline="no-display-inline" id="id56038BBD63B74D5898FEE1EED6685557">
                    <enum>(1)</enum>
 <text>by redesignating paragraphs (13) through (19) as paragraphs (14) through (20), respectively;</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="id22BE35D2C19242588420BA01129E1FF2">
                    <enum>(2)</enum>
 <text>by inserting after paragraph (12) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idEB1A7ED694834E3FAFC4B7748E90EC32"> <paragraph commented="no" display-inline="no-display-inline" id="idEF54E08DB4D944D58854EB8B6FC20E47"> <enum>(13)</enum> <header>Spontaneous loss of an unborn child</header> <text>The term <term>spontaneous loss of an unborn child</term> means the loss of a child in the womb that does not result from a purposeful act and is unplanned.</text>

 </subsection><subsection commented="no" display-inline="no-display-inline" id="IDC0538330BC324124835883DFC808856F"><enum>(b)</enum><header>Entitlement to Leave</header><text display-inline="yes-display-inline">Section 102(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6E33D03153AC476DBAE490AEDC01F4EB"><subparagraph commented="no" display-inline="no-display-inline" id="id5296E3E968FA46B4B7CA7C90EE980ABE"><enum>(G)</enum><text>Because of the spontaneous loss of an unborn child of the employee or spouse of the employee.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1BA90635E5D742F88C2B198E517B4FB0"><enum>(c)</enum><header>Schedule</header><text display-inline="yes-display-inline">Section 102(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(b)(1)</external-xref>) is amended by inserting after the third sentence the following: <quote>Subject to subsection (e)(4) and section 103(g), leave under subsection (a)(1)(G) may be taken intermittently or on a reduced leave schedule when medically necessary.</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD3A4CF8A77714A65BEFC371E4EEF7747"><enum>(d)</enum><header>Substitution of paid Leave</header><text display-inline="yes-display-inline">Section 102(d)(2)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(d)(2)(B)</external-xref>) is amended in the first sentence by striking <quote>(C) or (D)</quote> and inserting <quote>(C), (D), or (G)</quote>.</text></subsection><subsection id="id934284ebbb244d4a8ee2445067afcad6"><enum>(e)</enum><header>Notice</header><text display-inline="yes-display-inline">Section 102(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(c)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id67f4fecf0bcc48be91d3de28a9093f16"><paragraph id="id984df0f573d445f197b1c36237014984"><enum>(4)</enum><header>Notice for leave due to spontaneous loss of an unborn child</header><text>For leave under subsection (a)(1)(G), the employee shall provide such notice to the employer as is reasonable and practicable.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="IDE258F51D139948E386D38CD32C06D96F"><enum>(f)</enum><header>Certification</header><text display-inline="yes-display-inline">Section 103 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2613">29 U.S.C. 2613</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id88188a3fa77a401ab0ee03930ed4fab1"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfb7e6008107d431b8d54137c6da7fb5e"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>or subsection (g)(1) for leave under section 102(a)(1)(G)</quote> after <quote>section 102(a)(1)</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD9A4881921394C2EB9FC237747C2879A"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ID3421779A70D044FBB3B100C6EEDA5C70"><subsection commented="no" display-inline="no-display-inline" id="IDE7531FCD774D40548275CA95DB8ECC95"><enum>(g)</enum><header>Certification for leave due to spontaneous loss of an unborn child</header><paragraph commented="no" display-inline="no-display-inline" id="id032A6FB188934AF4AF0CC5161F849B07"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An employer may require that a request for leave under section 102(a)(1)(G) be supported by a certification issued by the health care provider of the eligible employee or of the spouse of the eligible employee, as appropriate. The employee shall provide, in a timely manner, a copy of such certification to the employer.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA14BDE4C9D614BA39E0F34D7BE4A43BF"><enum>(2)</enum><header>Sufficient certification</header><text display-inline="yes-display-inline">Certification provided under paragraph (1) shall be sufficient if it includes the information described in paragraphs (1), (2), (3), and (5) of subsection (b), with respect to spontaneous loss of an unborn child or bodily side effects of that loss, as appropriate.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id916E2B465AB94D0EBA5ACAEDA12B52B6"><enum>3.</enum><header>Leave for spontaneous loss of an unborn child, for civil service employees</header><subsection commented="no" display-inline="no-display-inline" id="id577E37A8215C468AAAF536FD1DF62D58"><enum>(a)</enum><header>Definitions</header><text>Section 6381 of title 5, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id44746DA5EB62489085C87FBF700CB1A7"><enum>(1)</enum><text>by redesignating paragraphs (7) through (12) as paragraphs (8) through (13), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id56A10E3C814D4C45AF0867F57CBEEEBB"><enum>(2)</enum><text>by inserting after paragraph (6) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id041DBB3F291D4D3BA952FBD2B4BC8946"><paragraph commented="no" display-inline="no-display-inline" id="id92224CAFD8E0444481E6C95EDD54AD55"><enum>(7)</enum><text>the term <term>spontaneous loss of an unborn child</term> means the loss of a child in the womb that does not result from a purposeful act and is unplanned;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id68FC896E3F854DE2BAEEC94A7672363A"><enum>(3)</enum><text>in paragraph (12)(B), as redesignated, by striking <quote>paragraph (8)(B)</quote> and inserting <quote>paragraph (9)(B)</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7AE9269A41B140B18E35DD2A7EF1B4EA"><enum>(b)</enum><header>Entitlement to Leave</header><text display-inline="yes-display-inline">Section 6382(a)(1) of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDC7481B1073B42BAB19EDC5FB823AD82"><subparagraph commented="no" display-inline="no-display-inline" id="id6D57934202434CF28810D56A08A771C8" indent="up1"><enum>(F)</enum><text>Because of the spontaneous loss of an unborn child of the employee or spouse of the employee.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idB29ADF2A5A404142838B2F974A82C697"><enum>(c)</enum><header>Schedule</header><text display-inline="yes-display-inline">Section 6382(b)(1) of title 5, United States Code, is amended by inserting after the third sentence the following: <quote>Subject to subsection (e)(4), and section 103(g), leave under subsection (a)(1)(G) may be taken intermittently or on a reduced leave schedule when medically necessary.</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idBC35D931BC7D4670BBA6AF98740D1509"><enum>(d)</enum><header>Substitution of paid Leave</header><text display-inline="yes-display-inline">Section 6382(d)(1) of title 5, United States Code, is amended in the first sentence by striking <quote>or (E)</quote> and inserting <quote>(E), or (F)</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idA0D24FE0B25B461E9BD17F2B34A908CE"><enum>(e)</enum><header>Notice</header><text display-inline="yes-display-inline">Section 6382(e) of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id90820C125EA7431CA788EEA973BC5B92"><paragraph commented="no" display-inline="no-display-inline" id="id16643EC85F854F73A23598B9DC61EA98" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">For leave under subsection (a)(1)(F), the employee shall provide such notice to the employing agency as is reasonable and practicable.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id29CEA7A6A07E4023AF1BA4B5CEF4947C"><enum>(f)</enum><header>Certification</header><text display-inline="yes-display-inline">Section 6383 of title 5, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idC5500F4B78224BECB3AA7AA4B44EB734"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id02246776C7B649B5BDA408B16D2AF0F7"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>or subsection (g)(1) for leave under section 6382(a)(1)(F)</quote> after <quote>section 6382(a)(1)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDDD0F2E588BE4C81867778ECA97928CA"><enum>(B)</enum><text>by striking <quote>under subsection (b) for such leave</quote> and inserting <quote>under subsection (b) for leave under subparagraph (C) or (D) of section 6382(a)(1) or subsection (g)(2) for leave under section 6382(a)(1)(F), respectively</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3DCF3C3D088F4653803BF968979D84F1"><enum>(2)</enum><text>in subsection (d)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id64C506DBEE474197B9E9A275F3557FD4"><enum>(A)</enum><text>in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="id66AB0062DB8540BE968393B2FDE183F2"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>or subsection (g)(1)</quote> after <quote>under subsection (a)</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idF047795E51CB45C88BCD40AB8F5D76BB"><enum>(ii)</enum><text>by inserting <quote>or subsection (g)(2), respectively</quote> after <quote>under subsection (b)</quote>; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7CE1DAB35357493B954960E7A79F920C"><enum>(B)</enum><text>in paragraph (2), by inserting <quote>or subsection (g)(2)</quote> after <quote>under subsection (b)</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id58B959C01EC2425F82E234F64BF94950"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id96BFBA6EE02E41B1B7235644ACBD1F3F"><subsection commented="no" display-inline="no-display-inline" id="id7902FFDE94764AC9A18D6173E4370A58"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id16AB8489D0344D6480BB10ACFFEEFDDD"><enum>(1)</enum><text>An employing agency may require that a request for leave under section 6382(a)(1)(F) be supported by a certification issued by the health care provider of the employee or of the spouse of the employee, as appropriate. The employee shall provide, in a timely manner, a copy of such certification to the employing agency.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id236799C849CD47C29C34DE7634DC6AC7" indent="up1"><enum>(2)</enum><text>Certification provided under paragraph (1) shall be sufficient if it includes the information described in paragraphs (1), (2), (3), and (5) of subsection (b), with respect to spontaneous loss of an unborn child or bodily side effects of that loss, as appropriate.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idCD94644C193A440A94738D3BFD7194D4"><enum>4.</enum><header>Refundable personal credit for individuals who have suffered a stillbirth</header><subsection id="idf6e01d97e72047da96da0620bc61b61d"><enum>(a)</enum><header>In general</header><text>Subpart C of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after section 36B the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAC286417935C4F71BAF2F04368C9D42A"><section id="idbb2b1db43c2e43ccb5109cfcc33d5913"><enum>36C.</enum><header>Stillbirths</header><subsection id="idfc908be6f6544242ad51e5d7bc02f01b"><enum>(a)</enum><header>Allowance of credit</header><paragraph id="id6976153D0FD141DEBB074167F784DA04"><enum>(1)</enum><header>In general</header><text>In the case of an eligible individual, there shall be allowed as a credit against the tax imposed by this subtitle for the taxable year an amount equal to the applicable amount.</text></paragraph><paragraph id="id68A7094F1FEE444B8AF3C0C53914921F"><enum>(2)</enum><header>Applicable amount</header><text>For purposes of paragraph (1), the applicable amount shall be equal to the dollar amount in effect for such taxable year under subsection (a) of section 24.</text></paragraph></subsection><subsection id="idFF9CD8FD249445EFB1D1FC810CCC6D99"><enum>(b)</enum><header>Eligible individual</header><text>For purposes of this section, the term <term>eligible individual</term> means any individual—</text><paragraph id="id1FD9E9B45BA34231AFF1BC112AEBB172"><enum>(1)</enum><text>who suffered during the taxable year the stillbirth of a child who would have been a qualifying child of the taxpayer (within the meaning of section 152) for the taxable year if such child had been born live, and</text></paragraph><paragraph id="id6afaeedc07bd46faab4a711517e5cefd"><enum>(2)</enum><text>for whom a certificate of birth resulting in stillbirth has been issued under applicable State law.</text></paragraph></subsection><subsection id="idEF316E60515846CEAC04F2FB5478A823"><enum>(c)</enum><header>Stillbirth</header><text>For purposes of this section, the term <term>stillbirth</term> means the delivery of a child where there was a spontaneous death of the child, not induced by any purposeful act, before the complete delivery from the child's mother.</text></subsection><subsection id="id13b09b0c08454f5caf9232234e00a305"><enum>(d)</enum><header>Identification requirement</header><paragraph id="idF2E5A82336D748F9962DB1A5DDE817E5"><enum>(1)</enum><header>In general</header><text>No credit shall be allowed under this section to a taxpayer unless the taxpayer includes the social security number of such taxpayer on the return of tax for the taxable year. In the case of a joint return, the requirements of this subsection shall be treated as met as long as 1 spouse includes a social security number on the return of tax for the taxable year.</text></paragraph><paragraph id="id5E9A877B83574E54B3F378DE81FB901F"><enum>(2)</enum><header>Social security number</header><text>For purposes of this subsection, the term <quote>social security number</quote> means a social security number issued to an individual by the Social Security Administration, but only if the social security number is issued—</text><subparagraph id="id344ff09f29e94b5a9fa72cb803c7b851"><enum>(A)</enum><text>to a citizen of the United States or pursuant to subclause (I) (or that portion of subclause (III) that relates to subclause (I)) of section 205(c)(2)(B)(i) of the Social Security Act, and</text></subparagraph><subparagraph id="id2cf18e2627b941ac9f08631fad9ed8cb"><enum>(B)</enum><text>before the due date for such return.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id595ef14e9f71423fb481bb1e2e316f54"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for subpart C of part IV of subchapter A of chapter 1 of such Code is amended by inserting after the item relating to section 36B the following new item:</text><quoted-block style="OLC" id="id83ac8e9a-c0b4-4149-900e-7418ea4e4fe1"><toc><toc-entry level="section" idref="idbb2b1db43c2e43ccb5109cfcc33d5913">Sec. 36C. Stillbirths.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idb62a6f05f941411c94f9ba8e5558215e"><enum>(c)</enum><header>Conforming amendments</header><paragraph id="id49722a665f44409aaf8344e18a342f3e"><enum>(1)</enum><header>Internal Revenue Code of 1986</header><text>Section 6211(b)(4)(A) of such Code is amended by inserting <quote>36C,</quote> after <quote>36B,</quote>.</text></paragraph><paragraph id="id344712E3CD7A420EA718AA38EA654CD2"><enum>(2)</enum><header>Refunds</header><text>Paragraph (2) of section 1324(b) of title 31, United States Code, is amended by inserting <quote>, 36C</quote> after <quote>36B</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb0ea97ca2544452e91d034ed4bfbbbd1"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
