which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 31, United States Code, to subject certain art traders to provisions relating to records and reports on monetary instruments transactions.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="idea9f93645b24486c8467f4dd0c524ff0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Art Market Integrity Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="S1"><enum>2.</enum><header>Records and reports on monetary instruments transactions</header><subsection commented="no" display-inline="no-display-inline" id="id12bd2ce9e1ad4cabb559aeae252d5ee3"><enum>(a)</enum><header>Records and reports</header><paragraph commented="no" display-inline="no-display-inline" id="id515f8276acc241428c4dbff41b23dd06"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Section 5312 of title 31, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id38b666f6d393458295209d8cf09c96f3"><enum>(A)</enum><text>in subsection (a)(2)—</text><clause id="id639252fad04c4bf1a0ae13da966532a0"><enum>(i)</enum><text>by redesignating subparagraphs (Y) and (Z) as subparagraphs (Z) and (AA), respectively; and</text></clause><clause id="idd808b5670bf84d21b15ea22c7f90b8b4"><enum>(ii)</enum><text>by inserting after subparagraph (X) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id69E3765D4F3D4CE49C9B5362D3CE7F21"><subparagraph commented="no" display-inline="no-display-inline" id="idd989f4555e104c19934ac4d50070d584"><enum>(Y)</enum><text>a person engaged in the trade in works of art, including a dealer, advisor, consultant, custodian, gallery, auction house, museum, collector, or any other person who engages as a business as an intermediary in the sale of works of art, unless the person—</text><clause commented="no" display-inline="no-display-inline" id="idc78527e205d044a3837be8296553543f"><enum>(i)</enum><text>during the prior year, participated in no single transaction valued over $10,000 that involved a work of art;</text></clause><clause id="id1a991318d7d7477ba4a0bb1d3815c376"><enum>(ii)</enum><text>has not, during the prior year, participated in total transactions valued at $50,000 that involved a work of art; or</text></clause><clause id="id07e95984f79843d8a492797c37c7a9a2"><enum>(iii)</enum><text>is a person engaged in the art market for the sole purpose of selling works of art created by the person.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2be0ea3726ce43c2b1612e1a7c850eb3"><enum>(B)</enum><text>in subsection (c), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF753162D07C04DD6A4F9861A33AA37F4"><paragraph commented="no" display-inline="no-display-inline" id="idcd5a16d64aaf40db9ce27864680d34b9"><enum>(2)</enum><header>Work of art</header><text>The term <term>work of art</term> means any original painting, sculpture, watercolor, print, drawing, photograph, installation art, or video art, not including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id394152a04e8f42e69d1508be6efd2493"><enum>(A)</enum><text display-inline="yes-display-inline">applied art such as product design, fashion design, architectural design, or interior design; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf217db8c7bf943ac923f1f8f86d6d0d9"><enum>(B)</enum><text display-inline="yes-display-inline">mass-produced decorative art, including ceramics, textiles, or carpets.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd8eed6fa33d34fbeb06ec4d7d190db64"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall take effect on the earlier of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id83c833244ce340a0a63f0c56d65fd179"><enum>(A)</enum><text display-inline="yes-display-inline">the effective date of the rules issued under subsection (c); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7cc4c342b52d4fdc96ca3072c090e502"><enum>(B)</enum><text>the date that is 360 days after the date of enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="id3df332f2b278461db8affe64098a50ac"><enum>(b)</enum><header>Mandatory update to Treasury guidance on art transactions</header><paragraph id="idd4126f1088f749c68208596475a1b3d9"><enum>(1)</enum><header>In general</header><text>Not later than 360 days after the date of enactment of this Act, the Secretary of the Treasury shall issue updated guidance to the advisory issued by the Office of Foreign Asset Control on October 30, 2020, regarding the risks of high-value artwork transactions involving sanctioned persons or entities.</text></paragraph><paragraph id="id64fa8f02631242a1ab20b09a56551fef" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Interagency coordination</header><text>The Secretary of Treasury shall consult and coordinate with appropriate Federal agencies to update the guidance described in paragraph (1).</text></paragraph></subsection><subsection id="id55391c9876324443b9ae2c374de3fcf6"><enum>(c)</enum><header>Rulemaking</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of the Treasury (acting through the Director of the Financial Crimes Enforcement Network), in consultation and coordination with appropriate Federal agencies, shall issue proposed rules to carry out the amendments made by subsection (a), including—</text><paragraph id="idd707eb5d35994b99a64b38f5bc014e03"><enum>(1)</enum><text>determining which persons should be subject to the rulemaking based on domestic or international geographical location;</text></paragraph><paragraph id="ideedec217886f42e6a669f69dfb0a08d1"><enum>(2)</enum><text>the degree to which the regulations should apply based on status as an agent or intermediary acting on behalf of a purchaser; and</text></paragraph><paragraph id="ida073fe8e69bb4a75a158d8bcd4af281a"><enum>(3)</enum><text>whether certain exemptions should apply to the regulations.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2648eaee59be489b97c7fc8194d2fbf2"><enum>(d)</enum><header>Technical and conforming amendments</header><text>Section 6110(a) of the Anti-Money Laundering Act of 2020 (title LXI of division F of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>; 134 Stat. 4561)) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id5a8657b1acdf427093e6c8447bceb729"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id28f44a3bc5cb40ed82ed16622a7657c1"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text><clause commented="no" display-inline="no-display-inline" id="id9d847f64c7d749ee9c824f0b7adbe90c"><enum>(i)</enum><text>by striking <quote>subparagraphs (Z) and (AA)</quote> and inserting <quote>subparagraphs (AA) and (BB)</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id5efdfe7ea9c04982988b7731e5f92bef"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>subparagraphs (Y) and (Z)</quote> and inserting <quote>subparagraphs (Z) and (AA)</quote>; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4e1ea0dc7cd84d119fc6f0fdc86683be"><enum>(B)</enum><text>in subparagraph (B)—</text><clause commented="no" display-inline="no-display-inline" id="id653e2e53098c4e178bcf3f4449aaa4ea"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>subparagraph (X)</quote> and inserting <quote>subparagraph (Y)</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id86c488fff5524e4cb12db2428c232e3b"><enum>(ii)</enum><text>by striking <quote>‘(Y) a</quote> and inserting <quote>‘(X) a</quote>; and</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id838d402b12c24c60abebe5e2ce3487da"><enum>(2)</enum><text>in paragraph (2), by striking <quote>Section 5312(a)(2)(Y)</quote> and inserting <quote>Section 5312(a)(2)(X)</quote>.</text></paragraph></subsection></section></legis-body></bill>
