which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Arms Export Control Act to address arms export controls for certain unmanned aircraft systems and items, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Leading Exports of Aerial Drones Act of 2025</short-title></quote> or the <quote><short-title>LEAD Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id530d8895eb4a4e21a88e8c214ce18b1e"><enum>2.</enum><header display-inline="yes-display-inline">Arms export controls for covered unmanned aircraft systems and items</header><subsection id="ide53a999c112a4e29b188260f7e5dcf28"><enum>(a)</enum><header>Arms Export Control Act</header><paragraph commented="no" display-inline="no-display-inline" id="id19c882a301454bf1a814593b213a039b"><enum>(1)</enum><header>Section 38</header><text display-inline="yes-display-inline">Section 38 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id51CEE444F6104656B9B579FF96D0E0BA"><subsection id="id13867eed729b46e1b1dbb793e9787195"><enum>(m)</enum><header>Covered unmanned aircraft systems and items</header><paragraph commented="no" display-inline="no-display-inline" id="id1890a6db46fd4c658437529a43d5ca65"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of transfers of defense articles and defense services under this Act, covered unmanned aircraft systems and items—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb80a57c33e444d58b5f593aac6fd0051"><enum>(A)</enum><text display-inline="yes-display-inline">shall be treated as manned aircraft systems items; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id69122b132ace4e80aba81bb1f7be9da4"><enum>(B)</enum><text>shall not be considered launch vehicles, missile technology, or missile equipment subject to controls or export restrictions for purposes of adherence by the United States to the Missile Technology Control Regime.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc1ce6744a93443448b9d3dc78eaee170"><enum>(2)</enum><header>Definition of covered unmanned aircraft systems and items</header><text display-inline="yes-display-inline">In this subsection, the term <term>covered unmanned aircraft systems and items</term> means unmanned aircraft systems and related items that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1a80d520e7c349aca714cd8689a8d3e7"><enum>(A)</enum><text display-inline="yes-display-inline">are controlled under the International Traffic in Arms Regulations and enumerated in the Missile Technology Control Regime Annex; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3f6cb374e93541c08b935741c73e064a"><enum>(B)</enum><text display-inline="yes-display-inline">are designed to be reusable.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id0DC58D98736A4420B12157494DE5252D"><enum>(2)</enum><header>Chapter 7</header><text>Chapter 7 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2797">22 U.S.C. 2797 et seq.</external-xref>) is amended by inserting after section 73B the following:</text><quoted-block id="id5171B3F88E2544F7BD288D7517A424A8" style="OLC" act-name=""><section id="id6EC6B6EE32684E73946FAB8CF541435D" section-type="subsequent-section"><enum>73C.</enum><header>Statement of policy on covered unmanned aircraft systems and items</header><text display-inline="no-display-inline">It is the policy of the United States to treat covered unmanned aircraft systems and items (as defined in section 38(m)(2)(B)) as manned aircraft systems and items for purposes of implementing the Missile Technology Control Regime.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id7393f310224f4c5b829b5542d2b9d73c"><enum>(b)</enum><header>International Traffic in Arms Regulations</header><paragraph commented="no" display-inline="no-display-inline" id="id06f19aff0c1b4635ab58b2d549918a5f"><enum>(1)</enum><header>United States Munitions List</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the President shall amend section 121.1 of title 22, Code of Federal Regulations, to provide that covered unmanned aircraft systems and items—</text><subparagraph id="idcf56bff79a0148a7873e8631e72d6558"><enum>(A)</enum><text>are subject to the same export control provisions as manned aircraft systems and items and that, for purposes of part 121 of such title, shall be reviewed under the same criteria and guidelines as manned aircraft systems and items; and</text></subparagraph><subparagraph id="idf001de5b16314dda81aa9f64c9d70b06"><enum>(B)</enum><text>are distinct from launch vehicles, missile technology, and missile equipment and are subject to separate export control provisions and that, for purposes of part 121 of such title, shall be reviewed under criteria specific to their technological and operational characteristics.</text></subparagraph></paragraph><paragraph id="id76de2063c21b4e97af8ef4bb383a5dbd"><enum>(2)</enum><header>Missile Technology Control Regime</header><text>Not later than 180 days after the date of the enactment of this Act, the President shall amend section 120.23 of title 22, Code of Federal Regulations, to provide that, for purposes of implementing the Missile Technology Control Regime, the United States shall treat covered unmanned aircraft systems and items—</text><subparagraph id="id0063377739414ce5b0c04bae823be20f"><enum>(A)</enum><text>separately from missile technology, including for purposes of co-production and co-development agreements with allies and partners; and</text></subparagraph><subparagraph id="id0644e6592f7a496097175aa2856a3d36"><enum>(B)</enum><text>as manned aircraft systems and items that shall not be subject to controls, missile technology reviews, or export restrictions for purposes of adherence by the United States to the Missile Technology Control Regime.</text></subparagraph></paragraph><paragraph id="id301059330d034881b4b2e8939666fd8e" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Definitions</header><text>In this section:</text><subparagraph commented="no" display-inline="no-display-inline" id="id3d19be16e8d446b29f7b4c4a66261359"><enum>(A)</enum><header>Covered unmanned aircraft systems and items</header><text>The term <term>covered unmanned aircraft systems and items</term> has the meaning given that term in subsection (m)(2) of section 38 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778</external-xref>), as added by subsection (a).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id624eb232d52a4a6e83084b94e61d2557"><enum>(B)</enum><header>Missile; Missile Technology Control Regime</header><text display-inline="yes-display-inline">The terms <term>missile</term> and <term>Missile Technology Control Regime</term> have the meanings given those terms in section 74(a) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2797c">22 U.S.C. 2797c(a)</external-xref>).</text></subparagraph></paragraph></subsection></section></legis-body></bill>
