which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20250520">May 20, 2025</action-date><action-desc>Reported by <sponsor name-id="S153">Mr. Grassley</sponsor>, without amendment</action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Omnibus Crime Control and Safe Streets Act of 1968 to provide public safety officer benefits for exposure-related cancers, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="not-changed"><section section-type="section-one" id="idEF8F3B596E024EE892A9487F496D4E94" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Honoring Our Fallen Heroes Act of 2025</short-title></quote>.</text></section><section id="id8937b328704b4434886ac6baa839fb5c" changed="not-changed"><enum>2.</enum><header>Honoring our fallen heroes</header><subsection commented="no" display-inline="no-display-inline" id="id1f170f0864834b678ef81cdd1c1b0f52" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Cancer-Related deaths and disabilities</header><paragraph commented="no" display-inline="no-display-inline" id="id3465862feb0245df93e73f21a8ce0753" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1201 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id15ff9f982f3145f8a564f58130e2ba2c" changed="not-changed"><subsection id="idb34a978038184e7fa7df81fbaabe9a5d" changed="not-changed"><enum>(p)</enum><header>Exposure-Related cancers</header><paragraph id="id876d1c09a3cf48049866a027dfa5a771" changed="not-changed"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id92d7d0d99bff44b581b9bc5e990b6ab4" changed="not-changed"><enum>(A)</enum><header>Carcinogen</header><text>The term <term>carcinogen</term> means an agent that is—</text><clause commented="no" display-inline="no-display-inline" id="id14e216f59125424585b079924e17caf0" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">classified by the International Agency for Research on Cancer under Group 1 or Group 2A; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8a920a692fad49b3abb84825b5a2cff2" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">reasonably linked to an exposure-related cancer.</text></clause></subparagraph><subparagraph id="id53b2fa62ff7445cab2fc89925afd7670" changed="not-changed"><enum>(B)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Bureau.</text></subparagraph><subparagraph id="id2e0ddd8950e340b7ace74866ac32d911" changed="not-changed"><enum>(C)</enum><header>Exposure-related cancer</header><text>As updated from time to time in accordance with paragraph (3), the term <term>exposure-related cancer</term> means—</text><clause id="id7b90ac1e6a7e4e47b6ca8f055b8b72e2" changed="not-changed"><enum>(i)</enum><text>bladder cancer;</text></clause><clause id="idb7d5bdedffe94bc5b38f9c38408cb9e5" changed="not-changed"><enum>(ii)</enum><text>brain cancer;</text></clause><clause id="id5a9adf5b82ee4b7fa3603bdcc7658c62" changed="not-changed"><enum>(iii)</enum><text>breast cancer;</text></clause><clause id="id067d5204eedb49da87d7ecca5075a858" changed="not-changed"><enum>(iv)</enum><text>cervical cancer;</text></clause><clause id="id6ae12037f19048c4875eac87b46fc829" changed="not-changed"><enum>(v)</enum><text>colon cancer;</text></clause><clause id="id3604e47fa2fe495394e5b201c8a58e65" changed="not-changed"><enum>(vi)</enum><text>colorectal cancer;</text></clause><clause id="id7d802b09650545e0b70f298271cbec69" changed="not-changed"><enum>(vii)</enum><text>esophageal cancer;</text></clause><clause id="id6ede527bee404e358cae434e87c62f02" changed="not-changed"><enum>(viii)</enum><text>kidney cancer;</text></clause><clause id="id2f47bfd8166f4a53baa440c59bd76534" changed="not-changed"><enum>(ix)</enum><text>leukemia;</text></clause><clause id="idfe09360c434143bca9ce30a949f3e91b" changed="not-changed"><enum>(x)</enum><text>lung cancer;</text></clause><clause id="idefbf3cce5f994dc1bf7fefaee4f59924" changed="not-changed"><enum>(xi)</enum><text>malignant melanoma;</text></clause><clause id="id821a16f6577043d9bf02ed0a00a79a72" changed="not-changed"><enum>(xii)</enum><text>mesothelioma;</text></clause><clause id="idc6687cc89c1d40619ff44f351eb9a6c8" changed="not-changed"><enum>(xiii)</enum><text>multiple myeloma;</text></clause><clause id="idffb7d014200044caae9b3554127735d3" changed="not-changed"><enum>(xiv)</enum><text>non-Hodgkins lymphoma;</text></clause><clause id="id247425bcab6b4d628694ceefe4cac4c8" changed="not-changed"><enum>(xv)</enum><text>ovarian cancer;</text></clause><clause id="idef9d3f6da7514513a5f64985cb20a71f" changed="not-changed"><enum>(xvi)</enum><text>prostate cancer;</text></clause><clause id="idfd05c9aa8cfe454886854ced4b4e1f33" changed="not-changed"><enum>(xvii)</enum><text>skin cancer;</text></clause><clause id="id81653b6aa9924876810001a9b3668fa8" changed="not-changed"><enum>(xviii)</enum><text>stomach cancer;</text></clause><clause id="id2fe51a26f495419e9fe8e5d05e466fcc" changed="not-changed"><enum>(xix)</enum><text>testicular cancer;</text></clause><clause id="id85af245268634839a2530c3b1f17578f" changed="not-changed"><enum>(xx)</enum><text>thyroid cancer;</text></clause><clause id="id9d363815b5c54f0da38957e7fe113efa" changed="not-changed"><enum>(xxi)</enum><text>any form of cancer that is considered a WTC-related health condition under section 3312(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-22">42 U.S.C. 300mm–22(a)</external-xref>); and</text></clause><clause id="id1b5a5745049b451887c5d6b80d787619" changed="not-changed"><enum>(xxii)</enum><text>any form of cancer added to this definition pursuant to an update in accordance with paragraph (3).</text></clause></subparagraph></paragraph><paragraph id="idED24FDBE95FB409B80EEEDEAC08E955F" changed="not-changed"><enum>(2)</enum><header>Personal injury sustained in the line of duty</header><subparagraph id="id625b06318ad345bea798818c223babc9" changed="not-changed"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), as determined by the Bureau, the exposure of a public safety officer to a carcinogen shall be presumed to constitute a personal injury within the meaning of subsection (a) or (b) sustained in the line of duty by the officer and directly and proximately resulting in death or permanent and total disability, if—</text><clause id="id3ad56189e28d43538fe2911e099ca5b5" changed="not-changed"><enum>(i)</enum><text>the exposure occurred while the public safety officer was engaged in line of duty action or activity;</text></clause><clause id="id49259a702bab479796a699586f293af3" changed="not-changed"><enum>(ii)</enum><text>the public safety officer began serving as a public safety officer not fewer than 5 years before the date of the diagnosis of the public safety officer with an exposure-related cancer;</text></clause><clause id="id5dc476b2238d4d01be989f2ff1262ced" changed="not-changed"><enum>(iii)</enum><text>the public safety officer was diagnosed with the exposure-related cancer not more than 15 years after the public safety officer’s last date of active service as a public safety officer; and</text></clause><clause id="id66f107d4eb3146a48a25395542a2e49c" changed="not-changed"><enum>(iv)</enum><text>the exposure-related cancer directly and proximately results in the death or permanent and total disability of the public safety officer.</text></clause></subparagraph><subparagraph id="id32ed0b89982e46e59fb7fc4911f4ae65" changed="not-changed"><enum>(B)</enum><header>Exception</header><text>The presumption under subparagraph (A) shall not apply if competent medical evidence establishes that the exposure of the public safety officer to the carcinogen was not a substantial contributing factor in the death or disability of the public safety officer.</text></subparagraph></paragraph><paragraph id="id310147615a1b488da668609c64876bc4" changed="not-changed"><enum>(3)</enum><header>Additional exposure-related cancers</header><subparagraph commented="no" display-inline="no-display-inline" id="id8c52bb7ca314424ca1f7b930d3c98a6a" changed="not-changed"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">From time to time but not less frequently than once every 3 years, the Director shall—</text><clause id="idb126e9cb0fe74a2da1c638f606609ee9" changed="not-changed"><enum>(i)</enum><text>review the definition of <term>exposure-related cancer</term> under paragraph (1); and</text></clause><clause commented="no" display-inline="no-display-inline" id="ide7832c0be9f34a459ea968c4581d5d4e" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">if appropriate, update the definition, in accordance with this paragraph—</text><subclause commented="no" display-inline="no-display-inline" id="id18770c51cfbb4858970983b9c88369b3" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">by rule; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4857355eb6524c36a7285b74fd50312d" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">by publication in the Federal Register or on the public website of the Bureau.</text></subclause></clause></subparagraph><subparagraph id="id98dba19aae6c49d69ba0f467a28b14da" changed="not-changed"><enum>(B)</enum><header>Basis for updates</header><clause commented="no" display-inline="no-display-inline" id="idf18d3da46e8f4bb58c7cfde300d18e90" changed="not-changed"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Director shall make an update under subparagraph (A)(ii) in any case in which the Director finds such an update to be appropriate based on competent medical evidence of significant risk to public safety officers of developing the form of exposure-related cancer that is the subject of the update from engagement in their public safety activities.</text></clause><clause commented="no" display-inline="no-display-inline" id="idf4e7e87dcbe84ea984b31c14dad49521" changed="not-changed"><enum>(ii)</enum><header>Evidence</header><text display-inline="yes-display-inline">The competent medical evidence described in clause (i) may include recommendations, risk assessments, and scientific studies by— </text><subclause commented="no" display-inline="no-display-inline" id="iddf314d6f8b314ffd9e8589c910979b72" changed="not-changed"><enum>(I)</enum><text display-inline="yes-display-inline">the National Institute for Occupational Safety and Health;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd404d7dcae8e41da91e6891e656a8e34" changed="not-changed"><enum>(II)</enum><text display-inline="yes-display-inline">the National Toxicology Program;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida4302297f4ef421ba412cc01315f5797" changed="not-changed"><enum>(III)</enum><text display-inline="yes-display-inline">the National Academies of Sciences, Engineering, and Medicine; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf6b332ff9cf94b3ab61a9b9a7fb729f7" changed="not-changed"><enum>(IV)</enum><text display-inline="yes-display-inline">the International Agency for Research on Cancer.</text></subclause></clause></subparagraph><subparagraph commented="no" id="id454910d4-1f9c-4328-8ba4-a692443bc4e6" changed="not-changed"><enum>(C)</enum><header>Petitions to add to the list of exposure-related cancers</header><clause id="ided354faf4ac746ac8d257a3cc5894a2a" changed="not-changed"><enum>(i)</enum><header>In general</header><text>Any person may petition the Director to add a form of cancer to the definition of <quote>exposure-related cancer</quote> under paragraph (1).</text></clause><clause id="id3fce96d2b2e74b169b262b49ea0f6660" changed="not-changed"><enum>(ii)</enum><header>Content of petition</header><text>A petition under clause (i) shall provide information to show that there is sufficient competent medical evidence of significant risk to public safety officers of developing the cancer from engagement in their public safety activities.</text></clause><clause id="id6d0bc03593b74615a88c7fe410c0c1b9" changed="not-changed"><enum>(iii)</enum><header>Timely and substantive decisions</header><subclause commented="no" display-inline="no-display-inline" id="id1f1729cc6cea43df927a1a1bca846b9b" changed="not-changed"><enum>(I)</enum><header>Referral</header><text display-inline="yes-display-inline">Not later than 180 days after receipt of a petition satisfying clause (ii), the Director shall refer the petition to appropriate medical experts for review, analysis (including risk assessment and scientific study), and recommendation.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id86b148d64a8a46308713e5965e021790" changed="not-changed"><enum>(II)</enum><header>Consideration</header><text display-inline="yes-display-inline">The Director shall consider each recommendation under subclause (I) and promptly take appropriate action in connection with the recommendation pursuant to subparagraph (B).</text></subclause></clause><clause id="idf6c9532fec154c9b828901274c772640" changed="not-changed"><enum>(iv)</enum><header>Notification to congress</header><text>Not later than 30 days after taking any substantive action in connection with a recommendation under clause (iii)(II), the Director shall notify the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives of the substantive action.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id95a04ed2fef94c218797784007d92e78" changed="not-changed"><enum>(2)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply to any claim under—</text><subparagraph id="ida17dabd66fae4caca12c98b0734a758d" changed="not-changed"><enum>(A)</enum><text>section 1201(a) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281(a)</external-xref>) that is predicated upon the death of a public safety officer on or after January 1, 2020, that is the direct and proximate result of an exposure-related cancer; or</text></subparagraph><subparagraph id="id490d0fb3dfb74ab3b6f65ab3ecb58df1" changed="not-changed"><enum>(B)</enum><text>section 1201(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281(b)</external-xref>) that is filed on or after January 1, 2020, and predicated upon a disability that is the direct and proximate result of an exposure-related cancer.</text></subparagraph></paragraph><paragraph id="id2550D08ACBDB45CC9058CAF83F718CE2" changed="not-changed"><enum>(3)</enum><header>Time for filing claim</header><text>Notwithstanding any other provision of law, an individual who desires to file a claim that is predicated upon the amendment made by paragraph (1) shall not be precluded from filing such a claim within 3 years of the date of enactment of this Act. </text></paragraph></subsection><subsection id="id711fa1bcd6af4df28e0bd3f38c2802bb" changed="not-changed"><enum>(b)</enum><header>Confidentiality of information</header><paragraph commented="no" display-inline="no-display-inline" id="idda06ea5fbc7a438e8a44fb2f89fba983" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Section 812(a) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10231">34 U.S.C. 10231(a)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id525647f9c32541e38bf9cedb7f0fe1c1" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">in the first sentence, by striking <quote>furnished under this title by any person and identifiable to any specific private person</quote> and inserting <quote>furnished under any law to any component of the Office of Justice Programs, or furnished otherwise under this title, by any entity or person, including any information identifiable to any specific private person,</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0113bea08f98480c8265bc2b53517641" changed="not-changed"><enum>(B)</enum><text>in the second sentence, by striking <quote>person furnishing such information</quote> and inserting <quote>entity or person furnishing such information or to whom such information pertains</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7bf4b8e8d268402c8237b68b9d31a657" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Effective date; applicability</header><text display-inline="yes-display-inline">The amendments made by paragraph (1) shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id25823da1e2d0448799267e84000115a5" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">shall take effect for all purposes as if enacted on December 27, 1979; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1634d2585d5f4ceea10b609734d987da" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">apply to any matter pending, before the Department of Justice or otherwise, as of the date of enactment of this Act. </text></subparagraph></paragraph></subsection><subsection id="id357ed4628fd240fb98715965a4d4fbb7" changed="not-changed"><enum>(c)</enum><header>Technical amendments</header><paragraph commented="no" display-inline="no-display-inline" id="id877dd9e5eee64f42a5e72f1b23dd14e7" changed="not-changed"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1201(o)(2) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281(o)(2)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id19caa7a33c654e048b57c57b531a01e8" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting <quote>or (b)</quote> after <quote>subsection (a)</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id27ee010f84ce40c6b79e3ce9f4a7e474" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting <quote>or (b)</quote> after <quote>subsection (a)</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc00e549d98a045ffac4718a7398f58e9" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (C), by inserting <quote>or (b)</quote> after <quote>subsection (a)</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id662dcc2ec74f447ab416e5f26bf0d6a4" changed="not-changed"><enum>(2)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by paragraph (1) shall apply to any matter pending before the Department of Justice as of the date of enactment of this Act.</text></paragraph></subsection></section><section id="id2bc33cfc6f3a492c9b7a8c5ab6b5065e" changed="not-changed"><enum>3.</enum><header>Technical amendments</header><subsection id="id5c7efca2756c4d488197c5da79e3543d" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Section 3 of the Safeguarding America’s First Responders Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281</external-xref> note) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEEB2DE66BBA14F21931BF95F6EE7C454" changed="not-changed"><subsection id="id7523882356494EE19BFFD4016E82A59D" changed="not-changed"><enum>(d)</enum><header>Definition</header><text>In this section, the term <term>line of duty action</term> includes any action—</text><paragraph commented="no" display-inline="no-display-inline" id="id18b6c98918af4724a03d51a1c86226fb" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">in which a public safety officer engaged at the direction of the agency served by the public safety officer; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id375d7fa5dfe04efeb91ffd86239569ea" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">the public safety officer is authorized or obligated to perform.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ideb7681e23c1f40d6a98c65544cab5138" changed="not-changed"><enum>(b)</enum><header>Applicability</header><paragraph id="id63c02431e0c84b6bbdf0610876fada25" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The amendment made by subsection (a) shall apply to any claim under section 3 of the Safeguarding America’s First Responders Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281</external-xref> note)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb0e4d869325e463b98838847160b636d" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">that is predicated upon the death of a public safety officer on or after January 1, 2020; or</text></subparagraph><subparagraph id="idac6105a793b94c0187d6af18ec996856" changed="not-changed"><enum>(B)</enum><text>that is—</text><clause commented="no" display-inline="no-display-inline" id="id40b9fc02bd02404e941cbbdedf58e1df" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">predicated upon the disability of a public safety officer; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id38d4fa9f66294400a1f13f43febf3687" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">filed on or after January 1, 2020.</text></clause></subparagraph></paragraph><paragraph id="ide5671f97954846f0ac7de40ccd20262a" changed="not-changed"><enum>(2)</enum><header>Time for filing claim</header><text>Notwithstanding any other provision of law, an individual who desires to file a claim that is predicated upon the amendment made by subsection (a) shall not be precluded from filing such a claim within 3 years of the date of enactment of this Act.</text></paragraph></subsection></section></legis-body><endorsement><action-date>May 20, 2025</action-date><action-desc>Reported without amendment</action-desc></endorsement></bill>
