<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 2371</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250722">July 22, 2025</action-date><action-desc><sponsor name-id="S374">Mr. Cotton</sponsor> (for himself, <cosponsor name-id="S416">Mrs. Britt</cosponsor>, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, and <cosponsor name-id="S399">Mr. Hawley</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Health and Human Services to conduct a study on the impacts of arsenic, cadmium, mercury, and lead in infant formula on infant health and establish standards for regulating the content of such substances in infant formula.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Baby Formula Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id7610c6456c0044f0aef5ba300fea2e2c"><enum>2.</enum><header>Study on infant formula</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services shall complete a study on the impacts of arsenic, cadmium, mercury, and lead in infant formula on infant health.</text></section><section commented="no" display-inline="no-display-inline" id="idedc0b48de1984723aa9477652688b94f"><enum>3.</enum><header>Prohibition of toxic metals in infant formula</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary of Health and Human Services shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id4143bf0b59bd4e6993daac84866b4264"><enum>(1)</enum><text display-inline="yes-display-inline">establish enforcement action levels with respect to arsenic, cadmium, mercury, and lead in infant formula; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf6c0cb8d7f1545b4947f0cd797c8acd1"><enum>(2)</enum><text display-inline="yes-display-inline">establish, through rulemaking, maximum contamination levels for arsenic, cadmium, mercury, and lead in infant formula.</text></paragraph></section><section commented="no" display-inline="no-display-inline" id="id296aa43d35584e049d44c3a10a759cb5"><enum>4.</enum><header>Definition</header><text display-inline="no-display-inline">In this Act, the term <term>infant formula</term> has the meaning given such term in section 201(z) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321(z)</external-xref>).</text></section></legis-body></bill>
