which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Equal Credit Opportunity Act to modify the requirements associated with small business loan data collection, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Regulatory Overreach to Empower Communities to Thrive and Ensure Data Privacy Act</short-title></quote> or the <quote><short-title>PROTECTED Act</short-title></quote>.</text></section><section id="id03c19e31043147e5b39a939e660bcab5"><enum>2.</enum><header>Small business loan data collection</header><text display-inline="no-display-inline">Section 704B of the Equal Credit Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1691c-2">15 U.S.C. 1691c–2</external-xref>) is amended—</text><paragraph id="id54e965f2888d4faaaf8392510deb0812"><enum>(1)</enum><text>in subsection (c)—</text><subparagraph id="id93ed226573764202b3c40a52c139c495"><enum>(A)</enum><text>by striking <quote>Any applicant</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6758e4e9197e4c8d930dd29f0ea932d4"><paragraph id="idaf9b363cd0c7486492499af0c09549da"><enum>(1)</enum><header>In general</header><text>Any applicant</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idde8be84df1a7431baa0c0189fa158887"><enum>(B)</enum><text>by striking the period at the end and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id8918fa1f4695417283c4297951e65c9f"><quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">, and the financial institution may, when requesting such information, inform the applicant in writing that—</quoted-block-continuation-text><subparagraph id="id24a4bc960d2f46db83a1b8bacb923058"><enum>(A)</enum><text>the Bureau of Consumer Financial Protection requires the financial institution to ask, collect, and report such information to the Federal Government annually pursuant to this section;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcfa4334769724ab7aebe006cb6d697af"><enum>(B)</enum><text>the applicant's response will not affect the financial institution’s evaluation of the request for credit; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3aa16630d8d0428a970b32bf4487e472"><enum>(C)</enum><text>the applicant is not required to provide such information.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2c695f74497145939fc3a7ce0c2bac99"><enum>(2)</enum><text>in subsection (e)—</text><subparagraph id="id85967ec9698e44a3a349e5a8584858a6"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="id4bf878bb2c9a4f1aae594df53a42f3e0"><enum>(i)</enum><text>by striking subparagraphs (C), (G), and (H); and</text></clause><clause id="idd25b9a3794a24fbe885f0585a9839a01"><enum>(ii)</enum><text>by redesignating subparagraphs (D), (E), and (F) as subparagraphs (C), (D), and (E), respectively;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7096f16425d84174a40e5e4452112446"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (4)—</text><clause commented="no" display-inline="no-display-inline" id="id75ca5ade77f74ec1bbba8e05d75ffcd4"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>The</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6ee463835fac4838a0af9657e0130a9b"><subparagraph commented="no" display-inline="no-display-inline" id="idfde6c0f4e5e54275a20add4961cf47d2"><enum>(A)</enum><header>In general</header><text>The</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="idb0faba6fb02b4e918f21992becc10fe2"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd523ddd23b2549bf8ce8247764e0d3d8"><subparagraph commented="no" display-inline="no-display-inline" id="id1b441bc2e41b4372a516c24f8ecc2208"><enum>(B)</enum><header>Rulemaking</header><text>The Bureau shall, before deleting or modifying data under this paragraph, and after notice and an opportunity for comment, issue rules that include a description of what modifications and deletions the Bureau intends to make to the data and how such modifications and deletions will advance a privacy interest.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbe11984faec8461bb3d5c0787c86636d"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6ad811c3f95a442ab8ec4c03ee0ab276"><paragraph id="id7188bb7ffca546bfb1663d8940134eca"><enum>(5)</enum><header>Prohibition on information not reported by an applicant</header><text>A financial institution may not compile and maintain information described under subsection (b) that was determined by the financial institution using visual observation or any other manner other than being provided by an applicant.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9760d6936da84b86ab3c662474f1633f"><enum>(6)</enum><header>Treatment of response rate</header><text>The percentage of applicants providing a financial institution with the information described under subsection (b) may not be used as a factor in determining whether a financial institution is in compliance with the requirements under this subsection.</text></paragraph><paragraph id="id0E93F968BE2744E597B613EAEA5E65EB" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Safe harbor</header><text display-inline="yes-display-inline">The Bureau may not enforce compliance with the requirements of this subsection during the 2-year period beginning on the effective date described in paragraph (8).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide89f8629e2554dbaa9df32918546c506"><enum>(8)</enum><header>Effective date</header><text display-inline="yes-display-inline">This subsection shall take effect on the date that is 3 years after the date on which the Bureau completes the cost-benefit analysis under chapter 6 of part I of title 5, United States Code (commonly referred to as the <quote>Regulatory Flexibility Act</quote>) and subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly referred to as the <quote>Paperwork Reduction Act</quote>)).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1a3499576f024bf1b04076915d94cd47"><enum>(9)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph id="id41cebdb07a754b15b42ecfa9a8ae3330"><enum>(A)</enum><header>Financial institution</header><text>The term <term>financial institution</term>—</text><clause commented="no" display-inline="no-display-inline" id="id948ee42ecab9452286f84142a9c58277"><enum>(i)</enum><text display-inline="yes-display-inline">means—</text><subclause id="id81d9d5aaed274ae3942cf552952d7164"><enum>(I)</enum><text>any partnership, company, corporation, association (incorporated or unincorporated), trust, estate, cooperative organization, or other entity that—</text><item id="ide191d2cde3044a19ad27a83ee96bd3f1"><enum>(aa)</enum><text>engages in any financial activity; and</text></item><item id="id7378a6bc927f41a0b7e4be9e3f581f27"><enum>(bb)</enum><text>in each of the preceding 2 calendar years, originated not less than 2,500 credit transactions for small businesses; and</text></item></subclause></clause><clause id="id4f81d7daf29f45b6a3d825b2ca18d5b4"><enum>(ii)</enum><text>does not include—</text><subclause id="idd3f78750d2154252a436ab90903e6d9a"><enum>(I)</enum><text>any financial institution with less than $10,000,000,000 in assets;</text></subclause><subclause id="idf8ca93880621438bbbfaf2f945ed2e40"><enum>(II)</enum><text>a Farm Credit System institution chartered under and subject to the provisions of the Farm Credit Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/12/2001">12 U.S.C. 2001 et seq.</external-xref>);</text></subclause><subclause id="id23b3337ac0e24bfb81b0b38f112e3f54"><enum>(III)</enum><text>community development financial institutions, as defined in section 103 of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4702">12 U.S.C. 4702</external-xref>); or</text></subclause><subclause id="ida7eb35d687934445a33ffd115b7ff91e"><enum>(IV)</enum><text>lenders involved in equipment and vehicle financing.</text></subclause></clause></subparagraph><subparagraph id="id77ff5c6b0ee74b6c82980448b4f62cbf"><enum>(B)</enum><header>Small business</header><text>The term <term>small business</term> means an entity with gross annual revenues of not more than $1,000,000 in the preceding fiscal year.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
