which was read twice and referred to the <committee-name committee-id="SSCM00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To supplement existing lease authorities available to the Administrator of the National Aeronautics and Space Administration to support research, education, and training, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Space Exploration Research Act</short-title></quote>.</text></section><section id="id360b6e5456514afdb16ded37a82d2b4a"><enum>2.</enum><header>National Aeronautics and Space Administration supplemental lease authority</header><subsection id="id242b8a6cebeb48fa8137399d660d3ba5"><enum>(a)</enum><header>Supplemental lease authority</header><paragraph id="id0d60a704b199424ab4c441f26d44a3a2"><enum>(1)</enum><header>In general</header><text>The Administrator of the National Aeronautics and Space Administration (referred to in this Act as the <quote>Administrator</quote>) may, using existing lease authorities available to the Administrator and on such terms as the Administrator considers appropriate, lease, for a term not to exceed 99 years, real property under the jurisdiction of the Administrator to 1 or more entities described in subsection (c) for the purpose of the construction and operation on such real property of 1 or more facilities the purposes of which shall be—</text><subparagraph commented="no" display-inline="no-display-inline" id="id481e71b92abc48c595ea061dfb43fff9"><enum>(A)</enum><text display-inline="yes-display-inline">to conduct aeronautical and space research;</text></subparagraph><subparagraph id="id6228d890725a42a5b4be97440e77c585"><enum>(B)</enum><text>to educate and train individuals for careers in the space industry;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb229e696dfd548e8b8c44f545448e26d"><enum>(C)</enum><text display-inline="yes-display-inline">to carry out the transfer of aeronautical and space technology between the United States public and domestic private sectors;</text></subparagraph><subparagraph id="id13bca25c6645428f9b30d381fc7a79af"><enum>(D)</enum><text>to conduct scientific, engineering, medical, or academic activities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id03a281836110453bac9761729e3e6b48"><enum>(E)</enum><text>to conduct any other space-related activity.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id52f43843bd2d49a19aca14d59ed059c8"><enum>(2)</enum><header>Renewal</header><text>The Administrator may renew a lease under this subsection for 1 or more additional periods.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfd0fa7e4007b4e60931c76df56cf5586"><enum>(b)</enum><header>Administrative, maintenance, and instructional support</header><text>Subject to the availability of appropriations, the Administrator may—</text><paragraph id="idf4ba90959e84452eba6612477885738f"><enum>(1)</enum><text>enter into 1 or more agreements, on such terms as the Administrator considers appropriate, with 1 or more entities described in subsection (c) to lease back real property described in subsection (a), including such real property that has been—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7b7326a5ec984f56b5b481082c75b553"><enum>(A)</enum><text display-inline="yes-display-inline">leased to a private entity under other lease authority available to the Administrator; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcdbd023e2e564caba3dae85edcf9e9be"><enum>(B)</enum><text display-inline="yes-display-inline">subleased to an entity described in subsection (c);</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc2ae7c51a4a94ff28f43f2714ab0a482"><enum>(2)</enum><text>enter into 1 or more contracts, grant agreements, cooperative agreements, or other authorized transactions with an entity described in subsection (c) with respect to such property; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5fd950a6f07b4a8e8e01fa7b76e19f94"><enum>(3)</enum><text display-inline="yes-display-inline">provide administrative, maintenance, instructional, and other appropriate support, with or without reimbursement, to the 1 or more facilities described in subsection (a).</text></paragraph></subsection><subsection id="idc9bf921e5e494d60a2b6885e8a6e0869"><enum>(c)</enum><header>Entities described</header><text>An entity described in this subsection is—</text><paragraph id="id64058e4d48704f9f8172d888fa4b84d6"><enum>(1)</enum><text>the State in which the real property described in subsection (a) is located;</text></paragraph><paragraph id="id383ccd3bb88e447eb7df96c050c084f7"><enum>(2)</enum><text>a subdivision, agent, or agency of such a State;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbfe5be21c48e4e1db316e58945b6ef72"><enum>(3)</enum><text display-inline="yes-display-inline">a corporation or foundation organized exclusively for education or scientific purposes that is exempt from taxation under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/501">26 U.S.C. 501(c)(3)</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id23484ec927c44651a40e4c3db9530154"> <enum>(4)</enum> <text>an institution of higher education (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)).</text>
 </paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8cd3e2b1dda6467b9a4f1cb3c02b84a4"><enum>(d)</enum><header>Delegation</header><text>The Administrator may delegate the authorities under subsections (a) and (b) to subordinate officers and employees of the National Aeronautics and Space Administration, as the Administrator considers appropriate.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id470de77939ab4a3abe7ccb44d69ad6f0"><enum>(e)</enum><header>Effect of other law</header><text>The authority provided by this section shall apply—</text><paragraph commented="no" display-inline="no-display-inline" id="idbf7bc65a74254db9b878f4765ee7f00e"><enum>(1)</enum><text display-inline="yes-display-inline">regardless of the existing authority used by the Administrator to lease the real property described in subsection (a); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd38f81fb5ef14f339d51ca7815ab66d2"><enum>(2)</enum><text display-inline="yes-display-inline">notwithstanding any provision of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2b6a561711d140f3a3a74bbc97ac86ba"><enum>(A)</enum><text>section 1302 of title 40, United States Code;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida7bb4e6fc01f4548b0b0998158ee0852"><enum>(B)</enum><text display-inline="yes-display-inline">section 20145 of title 51, United States Code; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id27a9d4ca694d481fafae69a0fe35af3d"><enum>(C)</enum><text display-inline="yes-display-inline">section 306121 of title 54, United States Code.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
