which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Omnibus Crime Control and Safe Streets Act of 1968 to direct certain prosecutor's offices to annually report to the Attorney General, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prosecutors Need to Prosecute Act of 2025</short-title></quote>.</text></section><section id="id977D31E1517545D0B013D96FF376C549"><enum>2.</enum><header>District attorney and prosecutor reports</header><text display-inline="no-display-inline">Section 501 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151</external-xref>) is amended— </text><paragraph id="id11584826BDB4433799977ABEB0757556"><enum>(1)</enum><text>by redesignating subsections (g) and (h) as subsections (h) and (i), respectively; and</text></paragraph><paragraph id="id2004D6E8B0B14516A41DC996CCBCFE6B"><enum>(2)</enum><text>by inserting after subsection (f) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC99DD7D4E59F4A239F93142CD9A60D61"><subsection id="idC99AAAE45661459C8B423B57A65DD081"><enum>(f)</enum><header>District attorney reporting requirements</header><paragraph id="id1E98F560893F4697BD0F9FF236374269"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="idD20A82F356D04FFEB24EFE882B5E4550"><enum>(A)</enum><header>Covered offense</header><text>The term <term>covered offense</term> means any of the following:</text><clause id="id63aee5c4efbd4ed4a218613673db8c0c"><enum>(i)</enum><text>Murder or non-negligent manslaughter.</text></clause><clause id="idfada895a115e42168b9c7e8c534ced04"><enum>(ii)</enum><text>Forcible rape.</text></clause><clause id="idc932c9dd25fd492684e044fec13093c2"><enum>(iii)</enum><text>Robbery.</text></clause><clause id="ida7027f8150744545b2255d20359413b5"><enum>(iv)</enum><text>Aggravated assault.</text></clause><clause id="id6b1157723cf44cc2baaaeb0a7213cfa0"><enum>(v)</enum><text>Burglary.</text></clause><clause id="idb8771a165f314234805b955647880c6b"><enum>(vi)</enum><text>Larceny.</text></clause><clause id="idca33d5ec753e49ff88723c573435e38a"><enum>(vii)</enum><text>Motor vehicle theft.</text></clause><clause id="id5e573acf79794366810bdb95789bd02d"><enum>(viii)</enum><text>Arson.</text></clause><clause id="idd8f825ad434c43b99a6ae82f2edda8ad"><enum>(ix)</enum><text>Any offense involving the illegal use of a firearm.</text></clause><clause id="idf75060ed52a1433b91934c6075250fdc"><enum>(x)</enum><text>Any offense involving the illegal possession of a firearm.</text></clause></subparagraph><subparagraph id="idB7C19DE17BC749E9A777CC777C7DC14E"><enum>(B)</enum><header>Covered prosecutor</header><text>The term <term>covered prosecutor</term> means the chief executive of a district attorney or prosecutor’s office that serves a local government—</text><clause id="id51F9406027B84BADAE353BA4AA50B9DB"><enum>(i)</enum><text>the population of the jurisdiction of which is not less than 360,000 individuals; and</text></clause><clause id="id1A5192E240E24796878A115D4525C278"><enum>(ii)</enum><text>that receives funds under this part.</text></clause></subparagraph></paragraph><paragraph id="id0E6FEBCFE5BE463983157E61BCD372AD"><enum>(2)</enum><header>Reporting requirement</header><text>Not later than 1 year after the date of enactment of the <short-title>Prosecutors Need to Prosecute Act of 2025</short-title>, and annually thereafter, a covered prosecutor shall submit to the Attorney General a report that contains, for the previous fiscal year, the following:</text><subparagraph id="id2712ead549b64f3ebb45a04369f49ed8"><enum>(A)</enum><text>The total number of cases referred to the covered prosecutor for prosecution of a covered offense.</text></subparagraph><subparagraph id="id087de8ced050406f900f55ae4eab292d"><enum>(B)</enum><text>The number of cases involving a covered offense—</text><clause id="idABCC83B7CCA846ADBA9A2FCD131321FB"><enum>(i)</enum><text>that the covered prosecutor declined to prosecute or refer for diversion; or</text></clause><clause id="idD52FF17671A7489B8558FDCE43AD79C1"><enum>(ii)</enum><text>for which the covered prosecutor declined to reach a plea agreement.</text></clause></subparagraph><subparagraph id="id22e33ffab634475abefe32b8bc43c0f1"><enum>(C)</enum><text>For cases involving a covered offense that result in a plea agreement or referral for diversion reached with the defendant, the number of cases for which the defendant—</text><clause id="id7b3e1d4668284f169370fde3b5a8cfb6"><enum>(i)</enum><text>was previously arrested for a covered offense arising out of a separate conviction;</text></clause><clause id="id338c759bf4374fe4bf6c848f3985c6c6"><enum>(ii)</enum><text>was previously convicted for a covered offense arising out of a separate conviction;</text></clause><clause id="id82deaf87bbf447408c177aca9940281d"><enum>(iii)</enum><text>is involved in an open case involving a covered offense arising out of separate conduct;</text></clause><clause id="id484c6140945542789362e90091c7dcef"><enum>(iv)</enum><text>is serving a term of probation for a conviction for a covered offense arising out of separate conduct; and</text></clause><clause id="id59a1e7d26625488d92b373a1079857ad"><enum>(v)</enum><text>was released on parole for a conviction for a covered offense arising out of separate conduct.</text></clause></subparagraph><subparagraph id="idc66c48ccbd5f48b4951fecb3a4f5ad6e"><enum>(D)</enum><text>The number of covered offenses that the covered prosecutor does not prosecute as a result of an internal policy against prosecuting specific criminal offenses, including—</text><clause id="idbf1db96fae4746d18318276636e6b82c"><enum>(i)</enum><text>each covered offense captured in the internal policy; and</text></clause><clause id="idedf963d2860249e698610aece2969c81"><enum>(ii)</enum><text>each criminal offense that is not captured in the internal policy.</text></clause></subparagraph></paragraph><paragraph id="id3EEB3A4C08A54655B4CDD606FDD2AEB0"><enum>(3)</enum><header>Compliance</header><text>With respect to a covered prosecutor that complies with the requirement under paragraph (2)—</text><subparagraph id="id630462A20FE14F8AB5F71C5F055F743E"><enum>(A)</enum><text>the Attorney General shall give priority in disbursing funds under this part to the local government served by the covered prosecutor; and</text></subparagraph><subparagraph id="id60EE7F413D5C4DB8AB01500CAB2704DD"><enum>(B)</enum><text>the local government described in subparagraph (A) shall ensure that the covered prosecutor receives a portion of the funds received under this part.</text></subparagraph></paragraph><paragraph id="id575f4afc0bbb4858a89023c56333709e"><enum>(4)</enum><header>Uniform standards</header><text>The Attorney General shall establish uniform standards for the reporting of the information required under this subsection, including the form such reports shall take and the process by which such reports shall be shared with the Attorney General.</text></paragraph><paragraph id="id7495931789344adea094b6e1a1393a79"><enum>(5)</enum><header>Submission to judiciary committees</header><text>The Attorney General shall—</text><subparagraph id="id25285A9729E045169D2AF8113E5323E0"><enum>(A)</enum><text>submit the information received under this subsection to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives; and</text></subparagraph><subparagraph id="id434E1DC915BA4306AE68837B888EB2B1"><enum>(B)</enum><text>publish such information on a publicly viewable website.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id22BC8D1E815D42779F4435F5B4FFE0CB"><enum>3.</enum><header>Byrne-JAG funds and elimination of cash bail</header><text display-inline="no-display-inline">The Attorney General shall not distribute amounts under subpart I of part E of title 1 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151 et seq.</external-xref>) to a State or local government that has in effect a policy that prohibits the use of cash bail for a defendant in a case involving the illegal use or illegal possession of a firearm.</text></section></legis-body></bill>
