<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 2344</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250717">July 17, 2025</action-date><action-desc><sponsor name-id="S316">Mr. Whitehouse</sponsor> (for himself, <cosponsor name-id="S363">Mr. King</cosponsor>, <cosponsor name-id="S324">Mrs. Shaheen</cosponsor>, and <cosponsor name-id="S422">Mr. Welch</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to improve warnings about potential predatory practices regarding individuals acting as agents or attorneys in the preparation, presentation, or prosecution of veterans claims, and for other purposes.</official-title></form><legis-body><section id="id6ac81d379af146ab831b3945b290e149" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Veterans Affairs Claim Sharks Effective Warnings Act of 2025</short-title></quote>.</text></section><section id="ide6db877c84a14c9f93706ed49d867ef3" section-type="subsequent-section"><enum>2.</enum><header>Improve warnings about potential predatory practices regarding agents and attorneys for veterans claims</header><subsection commented="no" display-inline="no-display-inline" id="idddc82dcce4854455abc76e8e26c9426c"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5901(b) of title 38, United States Code, is amended—</text><paragraph id="idfdc728c720a842489cb68f2a8d5551ad"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8503d7f29c2046b6853ffc722dcc1cda"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter before subparagraph (A) by striking <quote>, each time a claimant under a law administered by the Secretary logs in to a website or online tool of the Department, such website or online tool issues to the claimant</quote> and inserting <quote>each public-facing website and online tool of the Department issues</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf0e7119ff6c84c1184805d6fa1dc75d0"><enum>(B)</enum><text>in subparagraph (A), by inserting <quote>, including individuals lacking recognition by the Secretary as described in subsection (a)</quote> after <quote>chapter</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id99d4aeb4885642a096576a9e351a1dbb"><enum>(C)</enum><text>in subparagraph (C), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id24696dd4203346338d610b413a995309"><enum>(D)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id68e246904fe74fc9addc999b069bcf30"><enum>(E)</enum><text display-inline="yes-display-inline">by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD368966D25DC4B28BA407C138376144C"><subparagraph id="idba952975573e42d3a91aa6d2dbb4ef73" indent="up1"><enum>(E)</enum><text>a message discouraging veterans from sharing their Department account log-in credentials or bank account log-in credentials, such as usernames or passwords, with anyone.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0468aa6049cf4ed1a67cd86b45d86efb"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8A36EF6B62B249F7BFF0545066597540"><paragraph commented="no" display-inline="no-display-inline" id="idd948d06617284ad58cf9d83bd5146684" indent="up1"><enum>(3)</enum><text>The Secretary shall carry out this subsection by acting through the Chief Veterans Experience Officer.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6e8a698d76a24043b83f37836cc38fdc"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the date that is 180 days after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
