        <official-title>To require research with respect to fentanyl and xylazine test strips, to
            authorize the use of grant funds for such test strips, and for other purposes.</official-title>

        <section section-type="section-one" id="S1">
            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advancing Lifesaving Efforts with Rapid Test strips for Communities Act</short-title></quote> or the <quote><short-title>ALERT Communities Act</short-title></quote>.</text>
        </section>
        <section id="id49263695217546b19ce0de2e5576a925">
            <enum>2.</enum>
            <header>Grant program from State and Tribal response to opioid use disorders</header>
 <text display-inline="no-display-inline">The activities carried out pursuant to section 1003(b)(4)(A) of the 21st Century Cures Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-3">42 U.S.C. 290ee–3</external-xref> note) may include facilitating access to products used to prevent overdose deaths by detecting the presence of one or more substances, such as fentanyl and xylazine test strips, to the extent the purchase and possession of such products is consistent with Federal and State law.</text>

            <enum>3.</enum>
            <header>First responder training</header>
 <text display-inline="no-display-inline">Section 546(c) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-1">42 U.S.C. 290ee–1(c)</external-xref>) is amended—</text>
            <paragraph commented="no" display-inline="no-display-inline" id="id947110c5cce54b5798f507cdf70887d3">
                <enum>(1)</enum>
 <text>in paragraph (3), by striking <quote>; and</quote> and inserting a semicolon;</text>
            </paragraph>
            <paragraph commented="no" display-inline="no-display-inline" id="idef93701935d44ce4849887d42fdb4785">
                <enum>(2)</enum>
 <text>in paragraph (4), by striking the period and inserting <quote>; and</quote>; and</text>
            </paragraph>
            <paragraph commented="no" display-inline="no-display-inline" id="id962c073dec614b458f4a598a3678f804">
                <enum>(3)</enum>
 <text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id8BA0713049C5479FA8D6A943FC1C67C9"> <paragraph id="id9ec5ed2a704c4bd99e82652f75633959"> <enum>(5)</enum> <text>train and provide resources for first responders and members of other relevant community sectors on carrying and facilitating access to fentanyl or xylazine test strips.</text>

        </section>
        <section id="id6997b2b3882a47d3b0b60ea415f674ba">
            <enum>4.</enum>
            <header>Research and marketing frameworks for test strip technology</header>
 <text display-inline="no-display-inline">The Secretary of Health and Human Services, in consultation with the Director of the National Institutes of Health, the Director of the Office of National Drug Control Policy, the Commissioner of Food and Drugs, and the Administrator of the Drug Enforcement Administration, shall develop and make publicly available research and marketing frameworks for developing, improving, and evaluating test strip technology for detecting fentanyl and other dangerous substances. Such frameworks shall—</text>

                <enum>(1)</enum>
 <text display-inline="yes-display-inline">include standards and guidance for manufacturers seeking to develop and test new test strip technology;</text>
            </paragraph>
            <paragraph commented="no" display-inline="no-display-inline" id="id2609555c951e4b7a8d5c9f5007ebfdb2">
                <enum>(2)</enum>
 <text display-inline="yes-display-inline">emphasize bringing new test strip technology intended for testing human specimens in clinical settings to support on-site clinical decision-making; and</text>
            </paragraph>
            <paragraph commented="no" display-inline="no-display-inline" id="id83318fc260c34ec79daee72a3ffc24dd">
                <enum>(3)</enum>
 <text display-inline="yes-display-inline">include guidance on available authorization pathways for test strips described in paragraphs (1) and (2).</text>
            </paragraph>
        </section>
        <section commented="no" display-inline="no-display-inline" id="idffdaa158ba484bbeb5f75adfe0007399">
            <enum>5.</enum>
            <header>Study on fentanyl test strip interventions</header>
 <text display-inline="no-display-inline">The Secretary of Health and Human Services shall—</text>
            <paragraph commented="no" display-inline="no-display-inline" id="idccfde431501e46de8bb9c5ebea46b05f">
                <enum>(1)</enum>
 <text display-inline="yes-display-inline">conduct a study on the impact of the availability, accessibility, and usage of drug checking supplies, including test strips, on frequency of overdose, overdose deaths, and engagement in substance use disorder treatment; and</text>
            </paragraph>
            <paragraph commented="no" display-inline="no-display-inline" id="id7dc46e51365b4fdfb19548353317eac3">
                <enum>(2)</enum>
 <text>not later than 2 years after the date of enactment of this Act, submit to Congress a report on the study conducted under paragraph (1).</text>
            </paragraph>
