        <official-title>To amend the Federal Insecticide, Fungicide, and Rodenticide Act to
            establish a private right of action for injuries caused by pesticides, and for other

            <enum>1.</enum>
            <header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pesticide Injury Accountability Act of 2025</short-title></quote>.</text>
        </section>

            <enum>2.</enum>
            <header>Private right of action for injuries caused by pesticides</header>
 <text display-inline="no-display-inline">The Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136 et seq.</external-xref>) is amended—</text>
            <paragraph commented="no" display-inline="no-display-inline" id="id3dfb277e4fd04a3b8cd1fb49918da8d9">
                <enum>(1)</enum>
 <text>by redesignating sections 34 and 35 (<external-xref legal-doc="usc" parsable-cite="usc/7/136x">7 U.S.C. 136x</external-xref>, 136y) as sections 35 and 36, respectively; and</text>
            </paragraph>
            <paragraph commented="no" display-inline="no-display-inline" id="id37a6f573a9d349faba4349dd8d1070e6">
                <enum>(2)</enum>
 <text>by inserting after section 33 (<external-xref legal-doc="usc" parsable-cite="usc/7/136w-8">7 U.S.C. 136w–8</external-xref>) the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="ida71648f122f84be4aed265c1b2781dc5"> <section commented="no" display-inline="no-display-inline" id="id5d182d95ad5445b7a07a19ed401d8077"> <enum>34.</enum> <header>Private right of action for injuries caused by pesticides</header> <subsection commented="no" display-inline="no-display-inline" id="id0ea00c65074a47939d03bcfe9aed2b72"> <enum>(a)</enum> <header display-inline="yes-display-inline">In general</header> <text>Any person the property or person of which is injured by a pesticide may bring a civil action in Federal district court against a registrant of the pesticide for monetary damages for injury to the property or person caused by the pesticide.</text>
                        </subsection>
                        <subsection commented="no" display-inline="no-display-inline" id="id5c4d201489cf4d6e860dc5b34efbd857">
                            <enum>(b)</enum>
                            <header>Recoverable damages</header>
 <text display-inline="yes-display-inline">Monetary damages that may be recovered in a civil action under subsection (a)—</text>
                            <paragraph commented="no" display-inline="no-display-inline" id="id4637164a5f30422aa9199b62c3105143">
                                <enum>(1)</enum>
 <text display-inline="yes-display-inline">include compensatory and punitive damages, at the discretion of the court; and</text>
                            </paragraph>
                            <paragraph commented="no" display-inline="no-display-inline" id="id370d5c1fe85f4186bf8507b612bc8278">
                                <enum>(2)</enum>
 <text display-inline="yes-display-inline">do not include attorney's fees or court costs.</text>
                            </paragraph>
                        </subsection>
                        <subsection commented="no" display-inline="no-display-inline" id="id8dff8201434a43ab8aaff673b1bc5c4e">
                            <enum>(c)</enum>
                            <header>Effect</header>
 <text display-inline="yes-display-inline">Nothing in this section shall preempt any State law claim.</text>
                        </subsection>
