which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish grant programs to sustain populations of species of migratory waterfowl through the deployment of tools and practices that complement habitat conservation, and for other purposes.</official-title></form><legis-body><section id="H74A525B0423E4E678BEA4F0DFFF1FAE1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Habitat Enhancement Now Act</short-title></quote>.</text></section><section id="H4019BAE4C8FD4870B167FDEC86B18C0E"><enum>2.</enum><header>Grant programs to sustain populations of species of migratory waterfowl</header><subsection id="HFF323774C90647018E726C312B06CFE7"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text><paragraph id="HA201BA316C624698980D2321EFF41452"><enum>(1)</enum><text>the maintenance of healthy populations of migratory birds in North America is largely dependent on the protection, restoration, and management of wetland ecosystems and other habitats, as identified in the Implementation Plans of Joint Ventures authorized under the North American Waterfowl Management Plan;</text></paragraph><paragraph id="HE7B10D30EFD04B89BD478B2DF5F3A431"><enum>(2)</enum><text>duck populations in North America are being threatened by the loss in the quantity and quality of breeding habitat, which leads to declining nest success;</text></paragraph><paragraph id="H75C81CD810554AD99BD5E7AB0777DB7A"><enum>(3)</enum><text>low nest success has been widely documented to be the key annual driver in duck populations;</text></paragraph><paragraph id="H7BD009EADAF74EB38506FD870F26695E"><enum>(4)</enum><text>additional tools can be employed to increase nest success to complement the private, State, and Federal habitat conservation programs and efforts in order to sustain healthy waterfowl populations;</text></paragraph><paragraph id="H072380E006484F82AE608257BB74B08C"><enum>(5)</enum><text>relatively modest investments in management can make meaningful impacts towards supplementing waterfowl production in areas where waterfowl production outcomes have not been fully met;</text></paragraph><paragraph id="H428BF4BED5A748A48AB54FB22F2DBD13"><enum>(6)</enum><text>numerous studies have made it clear that nesting structures, in particular <quote>hen houses</quote>, are the most efficient and cost-effective tool for increasing nest success; and</text></paragraph><paragraph id="H82E892F549AB40D9BF62BBB1431A626B"><enum>(7)</enum><text>providing incentives to private landowners to establish nesting cover, create or restore brood ponds, and provide brood water is a priority to enhance production of mallards, gadwalls, and other breeding ducks in California.</text></paragraph></subsection><subsection id="H303AB0A098364C1D8728EC29DEA89D0E"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H65DBBD97B3DA44399310DD6D0E257894"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="HCD405C2C717649199173DE0B4F79333D"><enum>(A)</enum><text display-inline="yes-display-inline">a State, local, or Tribal government;</text></subparagraph><subparagraph id="H51BB3224E31A4ABB8371EEA6B6AE7AE8"><enum>(B)</enum><text>a nonprofit organization; and</text></subparagraph><subparagraph id="H5F462DDC336C4043A934F65248CB2D18"><enum>(C)</enum><text>an individual.</text></subparagraph></paragraph><paragraph id="H3481B31DDAE448FB8BE008CFECBA729B"><enum>(2)</enum><header>Hen house</header><text>The term <term>hen house</term> means a type of cylindrical nest structure installed on a post in a prairie pothole.</text></paragraph><paragraph id="H1F10FB4BBB674495B94648B593BA1937"><enum>(3)</enum><header>Prairie pothole</header><text>The term <term>prairie pothole</term> means a depressional wetland, including a freshwater marsh, that provides vital habitat to species of nesting waterfowl and other species.</text></paragraph><paragraph id="HCBC7A0B6DB9440C19CAAEDB8325FD0E8"><enum>(4)</enum><header>Prairie pothole region</header><text>The term <term>prairie pothole region</term> means the primary nesting grounds of the majority of North American ducks.</text></paragraph><paragraph id="HCE177AAA23C34A92ADBC3EACFCDE16BC" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></subsection><subsection id="H422E8D7D17B446268A0CEA4B243BEF14"><enum>(c)</enum><header>Grant programs</header><paragraph id="HBA0DB1F9334D4B82B3CAEABE417347CF"><enum>(1)</enum><header>Hen house grant program</header><subparagraph id="H1C83A3FDA2324DEAB824BD547635C40F"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a competitive grant program to award amounts to eligible entities to strategically place, build, and maintain hen houses in the prairie pothole region for the purpose of improving the nesting success rates of populations of species of migratory waterfowl.</text></subparagraph><subparagraph id="HC6D2B782E3774E60A99BEDFC3B1A4FB7"><enum>(B)</enum><header>Applications</header><text>To be eligible to receive a grant under this paragraph, an eligible entity shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines appropriate.</text></subparagraph></paragraph><paragraph id="H0B67CE8D4E2448EB93B0CF0A7FDDF11D" commented="no"><enum>(2)</enum><header>Breeding habitat grant program</header><subparagraph id="HF744DFD9A4F643C7BE168B0D390E7ACE" commented="no"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a competitive grant program to award amounts to eligible entities to develop breeding habitat for species of migratory waterfowl within California for the purpose of enhancing the breeding success rates of populations of species of migratory waterfowl, including by—</text><clause id="H7C3F770161244BD6ADFF10CF57C1FD7B" commented="no"><enum>(i)</enum><text>establishing nesting cover;</text></clause><clause id="H99B70F098C3D40D6A210E08DF6A06C7A" commented="no"><enum>(ii)</enum><text>creating brood ponds; and</text></clause><clause id="H996BE59A7FDB44809405954DC7F00B5B" commented="no"><enum>(iii)</enum><text>providing incentives to willing landowners to carry out the activities described in this subparagraph on land under the control of those landowners within California.</text></clause></subparagraph><subparagraph id="HDF61C0E521E04759B35F166588460798" commented="no"><enum>(B)</enum><header>Applications</header><text>To be eligible to receive a grant under this paragraph, an eligible entity shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines appropriate.</text></subparagraph></paragraph></subsection><subsection id="HC23861FF98A14DC9A3F8FDF44B58F118"><enum>(d)</enum><header>Funding</header><text display-inline="yes-display-inline">For each of fiscal years 2026 through 2030, of the amounts appropriated or otherwise made available to the <quote>Department of the Interior—Office of the Secretary—Departmental Operations</quote> account for each such fiscal year—</text><paragraph id="H452C0D36CC7C4F499FB94332281BFB34"><enum>(1)</enum><text>$3,500,000 shall be made available to carry out subsection (c)(1); and</text></paragraph><paragraph id="H6BD575D602534B14AD7D020CE903DB47" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">$3,500,000 shall be made available to carry out subsection (c)(2).</text></paragraph></subsection></section></legis-body></bill>
