which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To transfer administrative jurisdiction over certain parcels of Federal land in Harpers Ferry, West Virginia, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id90990c95ad3d4e358cd2886b6b460bba"><enum>1.</enum><header>Transfers of administrative jurisdiction over certain parcels of Federal land in Harpers Ferry, West Virginia</header><subsection id="id41e8ea625ec34ffe9aa29d4d48b53c7d"><enum>(a)</enum><header>Transfers</header><paragraph commented="no" display-inline="no-display-inline" id="idca6341ba0be442aca6de83a110ff118f"><enum>(1)</enum><header>Transfer to the Commissioner of U.S. Customs and Border Protection</header><subparagraph commented="no" display-inline="no-display-inline" id="idc7ee95f2e8864bf6ad2e620256541856"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Administrative jurisdiction over approximately 25 acres of Federal land in Harpers Ferry, West Virginia, as generally depicted on the map entitled <quote>Harpers Ferry National Historical Park Proposed Land Transfers</quote>, numbered 385/176,677, and dated May 2021 (referred to in this section as the <quote>Map</quote>) is transferred from the Secretary of the Interior (referred to in this section as the <quote>Secretary</quote>) to the Commissioner of U.S. Customs and Border Protection, to be administered as part of the U.S. Customs and Border Protection's Advanced Training Center in accordance with applicable law.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1618536de89e4335996fb7738fa7c4be"><enum>(B)</enum><header>Exclusion from boundary</header><text display-inline="yes-display-inline">The Federal land transferred by subparagraph (A) is excluded from the boundary of Harpers Ferry National Historical Park.</text></subparagraph></paragraph><paragraph id="idc42268ba71b946af89206d6f51f95010"><enum>(2)</enum><header>Transfer to the Secretary</header><text>Administrative jurisdiction over 3 parcels of Federal land totaling approximately 71.51 acres in Harpers Ferry, West Virginia, as generally depicted on the Map, is transferred from the Commissioner of U.S. Customs and Border Protection to the Secretary, to be administered by the Secretary—</text><subparagraph commented="no" display-inline="no-display-inline" id="id22c6e80ed3874e3aa26e472bc68bcf8b"><enum>(A)</enum><text display-inline="yes-display-inline">as part of Harpers Ferry National Historical Park; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3f87006fb90849938d076062cf8dce68"><enum>(B)</enum><text display-inline="yes-display-inline">in accordance with applicable law.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbbef1037242245e190d160309084f9b0"><enum>(3)</enum><header>No reimbursement or consideration</header><text>A transfer of administrative jurisdiction over Federal land under paragraph (1)(A) or (2) shall be without monetary reimbursement or additional consideration. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7becf57cec5047258543d56224da2580"><enum>(b)</enum><header>Land surveys</header><paragraph commented="no" display-inline="no-display-inline" id="ida9fe1333d5b34172b0b4b0212aad4d1a"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commissioner of U.S. Customs and Border Protection—</text><subparagraph commented="no" display-inline="no-display-inline" id="id77badd5f110d470ca662db14c36efe87"><enum>(A)</enum><text display-inline="yes-display-inline">shall obtain a survey to finalize the exact acreage and legal description of the parcel of Federal land described in subsection (a)(1)(A); and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id14224da8befa4a249748852a40f31d9e"><enum>(B)</enum><text display-inline="yes-display-inline">may, in consultation with the Secretary, modify any clerical and typographical errors in the Map.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id26f2111243c44de5808f2825b5bca15e"><enum>(2)</enum><header>Cost of survey</header><text>The cost of the survey under paragraph (1)(A) shall be charged to an appropriation of the U.S. Customs and Border Protection.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id05146674892145338d07e9e5b0f16c23"><enum>(3)</enum><header>Information sharing</header><text>On completion of the survey under paragraph (1)(A), the Commissioner of U.S. Customs and Border Protection shall provide to the Secretary a copy of the survey.</text></paragraph><paragraph id="idd307937a9b414a8d9109bbb9ec8d2422"><enum>(4)</enum><header>Reversion and restoration</header><subparagraph commented="no" display-inline="no-display-inline" id="idb020b892783d48c3a2a61226fdb6647d"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If the Commissioner of U.S. Customs and Border Protection determines that the Federal land transferred by subparagraph (A) of subsection (a)(1) is no longer required for the U.S. Customs and Border Protection's Advanced Training Center, the Commissioner of U.S. Customs and Border Protection shall transfer administrative jurisdiction over the Federal land described in that subparagraph to the Secretary in a manner and condition acceptable to the Secretary, to be included within the boundary of, and to be administered as part of, Harpers Ferry National Historical Park. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idca4eb4443af14665a36108d4296b4d63"><enum>(B)</enum><header>Acreage limitation</header><text display-inline="yes-display-inline">The acreage limitation under section 1(d) of the Act of June 30, 1944 (58 Stat. 645, chapter 328; <external-xref legal-doc="usc" parsable-cite="usc/16/450bb">16 U.S.C. 450bb(d)</external-xref>) shall not apply to the inclusion within the boundary of Harpers Ferry National Historical Park of the Federal land under subparagraph (A). </text></subparagraph></paragraph></subsection></section></legis-body></bill>
