which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to punish criminal offenses targeting first responders, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Graham Hoffman Act</short-title></quote>.</text></section><section id="id0d91965f030148fa8ee854d446cc6326"><enum>2.</enum><header>Crimes targeting first responders</header><subsection id="idf2a8d2dc5f434db08ee6c8f8f1f49094"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/7">Chapter 7</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id8c26a91c2f7c448bb164f09472a74233"><section id="id7ba1149e7a8f4f6180a748d072d21580"><enum>121.</enum><header>Crimes targeting first responders</header><subsection id="id9f54fe63c8ca4c2aa2e31ed2e9c227d9"><enum>(a)</enum><header>In general</header><text>Whoever, in any circumstance described in subsection (b), knowingly assaults a first responder engaged in official duties causing serious bodily injury, or attempts to do so—</text><paragraph id="id5a65255acb044ffaa6d41d3c73d688b9"><enum>(1)</enum><text>shall be imprisoned not more than 10 years, fined in accordance with this title, or both; and</text></paragraph><paragraph id="id2e78b252841440b8a82871a4d76de469"><enum>(2)</enum><text>shall be imprisoned for any term of years or for life, fined in accordance with this title, or both, if—</text><subparagraph id="id7c829c02ab0a4de399d8f81085e2f9f0"><enum>(A)</enum><text>death results from the offense; or</text></subparagraph><subparagraph id="id1edccca4833a499fb72f8baf6dc0b5d1"><enum>(B)</enum><text>the offense includes kidnapping or an attempt to kidnap, or an attempt to kill.</text></subparagraph></paragraph></subsection><subsection id="id9516ee66202a48f3b29014cd27fe4eb8"><enum>(b)</enum><header>Circumstances described</header><text>For purposes of subsection (a), the circumstances described in this subsection are that—</text><paragraph id="id8c718a47f8d74aa2b372f74fda993405"><enum>(1)</enum><text>the conduct described in subsection (a) occurs during the course of, or as the result of, the travel of the defendant or the victim—</text><subparagraph id="id1696976af8bb427ebf719b3503aa9bd1"><enum>(A)</enum><text>across a State line or national border; or</text></subparagraph><subparagraph id="id8b9cea69a2114d87bd5dcb75940a3af6"><enum>(B)</enum><text>using a channel, facility, or instrumentality of interstate or foreign commerce;</text></subparagraph></paragraph><paragraph id="ide0188316acfa4e32b3a1a6c66fdf7c24"><enum>(2)</enum><text>the defendant uses a channel, facility, or instrumentality of interstate or foreign commerce in connection with the conduct described in subsection (a);</text></paragraph><paragraph id="id1a906940f4c04323b9a381f1dbc54acb"><enum>(3)</enum><text>in connection with the conduct described in subsection (a), the defendant employs a firearm, dangerous weapon, explosive or incendiary device, or other weapon that has traveled in interstate or foreign commerce;</text></paragraph><paragraph id="idb548bb22c8d14bbe8b7ba6f85ac27bd0"><enum>(4)</enum><text>the conduct described in subsection (a)—</text><subparagraph id="id155a6b484c214d35b392e8f1ee7dc993"><enum>(A)</enum><text>interferes with commercial or other economic activity in which the victim is engaged at the time of the conduct; or</text></subparagraph><subparagraph id="id92ce40c189784c72bb173fd11a212f9a"><enum>(B)</enum><text>otherwise affects interstate or foreign commerce; or</text></subparagraph></paragraph><paragraph id="id9826ad3be18844dfa8aa5849015ef5af"><enum>(5)</enum><text>the victim is a Federal first responder.</text></paragraph></subsection><subsection id="ida42c589501d14d83b6615247b3b8ebf2"><enum>(c)</enum><header>Certification requirement</header><paragraph id="id176c0c1fae8f438eb48c1c3bcb95ad4d"><enum>(1)</enum><header>In general</header><text>No prosecution of any offense described in this section may be undertaken by the United States, except under the certification in writing of the Attorney General, or a designee, that—</text><subparagraph id="id54ef35fb1b3c486182cb7f31abf4689f"><enum>(A)</enum><text>the State does not have jurisdiction;</text></subparagraph><subparagraph id="id2c59bd1c59fb41ee99a3a83c75dc4afe"><enum>(B)</enum><text>the State has requested that the Federal Government assume jurisdiction;</text></subparagraph><subparagraph id="id768068a42a70416599797d3c3f32235c"><enum>(C)</enum><text>the verdict or sentence obtained pursuant to State charges left demonstratively unvindicated the Federal interest in protecting the public safety; or</text></subparagraph><subparagraph id="id1f35c1e8bb3c40f2b7ec638c7b3d3560"><enum>(D)</enum><text>a prosecution by the United States is in the public interest and necessary to secure substantial justice.</text></subparagraph></paragraph><paragraph id="idb7425dff94814547887bb053895cbe36"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to limit the authority of Federal officers, or a Federal grand jury, to investigate possible violations of this section.</text></paragraph></subsection><subsection id="id5a53d465e6c54b35818e111279e71858"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id9f6c8d36b3154a489b62d4049e3a1f6a"><enum>(1)</enum><header>First responder</header><text>The term <term>first responder</term> means—</text><subparagraph id="iddcf41e960aeb4f44a2e95023c03f465e"><enum>(A)</enum><text>a firefighter, a law enforcement officer, or a member of a rescue squad or ambulance crew, as those terms are defined in section 1204 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10284">34 U.S.C. 10284</external-xref>); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8040cfd4b88e481c8f17e55d61f9a4f5"><enum>(B)</enum><text>an officially recognized or designated employee or volunteer member of a paramedic ALS intercept service that meet the requirements under section 410.40(d) of title 42, Code of Federal Regulations (or any successor regulation). </text></subparagraph></paragraph><paragraph id="id2e066f5403b6462ab3abc2f0b53d44ec"><enum>(2)</enum><header>State</header><text>The term <term>State</term> means a State of the United States, the District of Columbia, or any commonwealth, territory, or possession of the United States.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id26e323585fef47b2976c435f2d91b23d"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/7">chapter 7</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="idb20ca858-b7ce-470f-a201-da12002c03f8"><toc><toc-entry level="section">121.
