Russell National School Lunch Act to allow schools that participate in the school lunch program to serve whole milk, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H52CC4FF092D5463B8035978055DA3057"><section section-type="section-one" id="HBDA7B45CABC54E11B02B7D4596C23553" changed="deleted" reported-display-style="strikethrough" committee-id="SSAF00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Whole Milk for Healthy Kids Act of 2025</short-title></quote>.</text></section><section id="HC55703BE35A44F12B61462B69CB14160" changed="deleted" reported-display-style="strikethrough" committee-id="SSAF00"><enum>2.</enum><header>Organic or non-organic whole milk permissible</header><text display-inline="no-display-inline">Section 9(a)(2) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(a)(2)</external-xref>) is amended—</text><paragraph id="HBFE301CDCC794AB69FBC3A56958AA50D"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id75133d5af30341cabfb9723ea6bfaea9"><enum>(A)</enum><text display-inline="yes-display-inline">by striking clauses (i) and (ii) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF95047F76BF2455CB5815D0B69BFB9C0" changed="deleted" reported-display-style="strikethrough" committee-id="SSAF00"><clause id="HCCE34631744D4AE083B821036C359DEA"><enum>(i)</enum><text display-inline="yes-display-inline">shall offer students a variety of fluid milk;</text></clause><clause id="H0D9A8BD8D11845ADBD538CA3ED0F925C"><enum>(ii)</enum><text display-inline="yes-display-inline">may offer students flavored and unflavored organic or nonorganic whole, reduced-fat, low-fat, and fat-free fluid milk and lactose-free fluid milk;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id22edb641549e4aebbef078b63847d588"><enum>(B)</enum><text>in clause (iii), by striking <quote>physician</quote> and inserting <quote>physician, parent, or legal guardian</quote>; and</text></subparagraph></paragraph><paragraph id="HCB87CDA17D03467698CA1BA3447C89EE"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB0E2F395253140B29363EB5D48BA5F99" changed="deleted" reported-display-style="strikethrough" committee-id="SSAF00"><subparagraph commented="no" id="H8F72BDDF81C94326A5C3387487C477A3"><enum>(D)</enum><header>Saturated fat</header><text display-inline="yes-display-inline">Milk fat included in any fluid milk provided under subparagraph (A) shall not be considered saturated fat for purposes of measuring compliance with the allowable average saturated fat content of a meal under section 210.10 of title 7, Code of Federal Regulations (or successor regulations).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section section-type="section-one" id="idf65615d4-4aa7-4cae-8f17-f18ffa33efd5" changed="added" reported-display-style="italic" committee-id="SSAF00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Whole Milk for Healthy Kids Act of 2025</short-title></quote>.</text></section><section id="ide0e82dfe-b513-4a72-91b9-38fd7994280b" changed="added" reported-display-style="italic" committee-id="SSAF00"><enum>2.</enum><header>Organic or non-organic whole milk permissible</header><subsection commented="no" display-inline="no-display-inline" id="id693a3af7424c4859ab014f28b4762e04"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 9(a)(2) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(a)(2)</external-xref>) is amended—</text><paragraph id="idc1b244fe-a496-4347-b845-c148ba0d9d38"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3184d0b0-d6b8-4b5c-ac87-6b067bfd34b9"><enum>(A)</enum><text display-inline="yes-display-inline">by striking clauses (i) and (ii) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide91992ed5ca9420d999df14ee8e87773" changed="added" reported-display-style="italic" committee-id="SSAF00"><clause id="ide0ccd23f73094474bc0a4e0f371f1258"><enum>(i)</enum><text>shall offer students a variety of fluid milk;</text></clause><clause id="idb6315d5084894247a71b39b45e0b17e2"><enum>(ii)</enum><text>may offer students options which may include flavored and unflavored organic or nonorganic whole, reduced-fat, low-fat, and fat-free fluid milk and lactose-free fluid milk, and nondairy beverages that are nutritionally equivalent to fluid milk and meet the nutritional standards established by the Secretary (which shall, among other requirements to be determined by the Secretary, include fortification of calcium, protein, vitamin A, and vitamin D to levels found in cow’s milk); and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id6675cbd957fc4d0c9eb9f4131d481409"><enum>(B)</enum><text>in clause (iii), by striking <quote>physician</quote> and inserting <quote>physician, parent, or legal guardian</quote>;</text></subparagraph></paragraph><paragraph id="id20a9902a63e545398ade979a1d0e7c7c"><enum>(2)</enum><text>in subparagraph (C), in the matter preceding clause (i), by striking <quote>fluid milk products</quote> and inserting <quote>products described in subparagraph (A)(ii)</quote>; and</text></paragraph><paragraph id="idb0a4cfc6-5f61-4443-8aeb-f59c952970bd"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbff809e8-942f-4201-a3f6-8739e9d4b26d" changed="added" reported-display-style="italic" committee-id="SSAF00"><subparagraph commented="no" id="id39ee1d70-423a-477b-a9cb-6decceb7ce8b"><enum>(D)</enum><header>Saturated fat</header><text display-inline="yes-display-inline">Milk fat included in any fluid milk provided under subparagraph (A) shall not be considered saturated fat for purposes of measuring compliance with the allowable average saturated fat content of a meal under section 210.10 of title 7, Code of Federal Regulations (or successor regulations).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2de1f41d0e8d4ac0b98eb16f03465101"><enum>(E)</enum><header>Application</header><text display-inline="yes-display-inline">Subparagraph (B)(ii) is not applicable to a school that offers nondairy beverages under subparagraph (A)(ii).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idff74d7096c3a42b9b6fd9bb4fef3f4a2" commented="no"><enum>(b)</enum><header>Conforming amendments</header><paragraph id="id2972dc6d8b5b4fc78b09fb26a923c412" commented="no"><enum>(1)</enum><text>Section 14(f) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1762a">42 U.S.C. 1762a(f)</external-xref>) is amended in the third sentence by inserting <quote>or a nondairy beverage that meets the nutritional standards described in section 9(a)(2)(B)</quote> after <quote>milk</quote>.</text></paragraph><paragraph id="idd21c8daa63cb46dbb3017ddd5776b500" commented="no"><enum>(2)</enum><text>Section 20(c) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769b">42 U.S.C. 1769b(c)</external-xref>) is amended by striking <quote>patterns and fluid milk requirements</quote> and inserting <quote>patterns, fluid milk requirements, and nutritional standards for nondairy beverages</quote>.</text></paragraph></subsection></section><section section-type="subsequent-section" id="idFB53F081CBF843609168E083FAA201B0" changed="added" reported-display-style="italic"><enum>3.</enum><header>Including food allergy information in existing training modules for local food service personnel</header><subsection commented="no" display-inline="no-display-inline" id="id859555105e624165980e4f435eaa87e2"><enum>(a)</enum><header display-inline="yes-display-inline">Food allergy training module</header><text display-inline="yes-display-inline">Section 7(g)(2)(B)(iii) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1776">42 U.S.C. 1776(g)(2)(B)(iii)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idc8946c06c87345c4a9bd719575068259"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subclauses (II) and (III) as subclauses (III) and (IV), respectively; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id43e1e7bd834547328adf0a0431960039"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subclause (I) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDE0323B5A1D846BEA6AB0A83DA7B40DB" changed="added" reported-display-style="italic"><subclause commented="no" display-inline="no-display-inline" id="id828c6f168eb046729a6ba4f3f6ca2e3a"><enum>(II)</enum><text>food allergies, including information on the best practices to prevent, recognize, and respond to food-related allergic reactions;</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idfc5ec9a97b50461f959f352439095619" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Certification</header><text>Section 7(g)(2)(B)(ii)(II) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1776">42 U.S.C. 1776(g)(2)(B)(ii)(II)</external-xref>) is amended by striking <quote>clause (i)</quote> and inserting <quote>clauses (i) and (iii)</quote>.</text></subsection></section></legis-body><endorsement><action-date date="20250710">July 10, 2025</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
