which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To exempt the Department of Defense from certain environmental protection activities.</official-title></form><legis-body><section id="idf11644db10e14c82a44f5601885154b4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Necessary Environmental Exemptions for Defense Act</short-title></quote>.</text></section><section id="idf82ac6b7b6fe42bb806958bfdc4e3e77"><enum>2.</enum><header>Exemption of activities of Department of Defense from certain environmental protection laws</header><subsection id="id15c596769130460fb78c902722fbd209"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text><paragraph id="id09e620f780854695b1e32338675b9cea"><enum>(1)</enum><text>the Department of Defense (in this section referred to as the <quote>Department</quote>) must operate with maximum agility and efficiency to ensure it is prepared to deter and, if necessary, fight and win a conflict with the Chinese Communist Party;</text></paragraph><paragraph id="id87b5948c2bea4191bea1a1b5a58fc984"><enum>(2)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>), the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1361">16 U.S.C. 1361 et seq.</external-xref>), and the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) frequently and unnecessarily delay the readiness and operations of the Armed Forces without substantial benefit to the environment or protected species; and</text></paragraph><paragraph id="id69b5b35cd6964384b658a9d906aa4616"><enum>(3)</enum><text>national defense takes precedence over all administrative processes that might otherwise hinder the timely execution of defense-related activities.</text></paragraph></subsection><subsection id="idc13dd11e30a140bdb6a63e76b3d31bda"><enum>(b)</enum><header>Exemption</header><text>The Department and any component, contractor, or designee of the Department shall be exempt from any requirement under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>), the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1361">16 U.S.C. 1361 et seq.</external-xref>), and the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) for all activities, operations, permits, and projects conducted for the following purposes, if the President or the Secretary of Defense (in this section referred to as the <quote>Secretary</quote>) certifies the activity is directly related to countering the threat of the Chinese Communist Party to the United States:</text><paragraph id="ide324e1e2a213420089a5b3f30ca56b7a"><enum>(1)</enum><text>Readiness, training, or operations of the Armed Forces.</text></paragraph><paragraph id="idd3ff65cdf53c456584b2bba259367330"><enum>(2)</enum><text>Construction, maintenance, expansion, or repair of facilities or infrastructure of the Department.</text></paragraph><paragraph id="idc70459df15e247ae9118a9ef3b89ad4e"><enum>(3)</enum><text>Deployment, development, testing, or production of technologies, systems, or equipment of the Department.</text></paragraph><paragraph id="id92ac1b009ee44b848a7d0bfb48c2033b"><enum>(4)</enum><text>Deployment, development, testing, or production of commercial technologies, systems, or equipment related to an agreement, grant, or contract with the Department, the timely completion of which directly contributes to a critical national security interest of the United States.</text></paragraph></subsection><subsection id="id6361548e48c544c5839cea3d4bad18a0"><enum>(c)</enum><header>No alternative compliance obligations</header><text>Except for any environmental mitigations the Secretary may determine are appropriate—</text><paragraph id="id8e16ccdb32d8408bbe627c46562f227d"><enum>(1)</enum><text>no Federal, State, or local environmental review process may be required as a substitute or replacement for compliance with the provisions of law exempted under subsection (b); and</text></paragraph><paragraph id="id098bfeedf57f4cf287636eca6867ae61"><enum>(2)</enum><text>no Federal, State, or local authority may require environmental evaluations for activities, operations, permits, or projects for which similar evaluations are exempted under subsection (b).</text></paragraph></subsection><subsection id="idb9ee2666fd8a41c2aefc11af2ecdab82"><enum>(d)</enum><header>Review of environmental best practices</header><text>Not later than 5 years after the date of the enactment of this Act, and not less frequently than every 5 years thereafter, the Secretary shall review best practices for environmental mitigations and update the policy of the Department as necessary to reflect changes in priorities of the Department and advancements in environmental practices.</text></subsection><subsection id="idc38437c728264d00bddca9b7b21cb260"><enum>(e)</enum><header>Judicial preclusion</header><text>No court shall have jurisdiction to review, enjoin, or otherwise restrain any designation, activity, operation, permit, or project certification carried out or any determination made by the Department that is covered under subsection (b).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id4ee6b50679c94df08e15733c9ebdebab"><enum>(f)</enum><header>Retroactive application</header><text display-inline="yes-display-inline">This section shall apply to any activity, operation, or project described in subsection (b) that is ongoing as of the date of the enactment of this Act and shall nullify any legal action or administrative proceeding pending as of such date relating to compliance with the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>), the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>), the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1361">16 U.S.C. 1361 et seq.</external-xref>), or the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) in connection with such activity, operation, or project.</text></subsection></section></legis-body></bill>
